Elizabeth Johnson listens to opening statements in her trial on Thursday

PHOENIX (CBS5/AP) - The father of missing baby Gabriel Johnson will take the stand as the trial continues Monday for the Arizona woman charged with criminal wrongdoing in her child's disappearance more than two years ago.

Logan McQueary and several police officers and detectives are expected to take the stand as the trial resumes at 10:30 a.m.

Good to "see" you! Missed all of you too. Don't have much time to be on the computer these days.

I only have time to watch a little part of the trial today and it seems it is not starting on time at 10:30 MST.

I remember Tammi Smith's trial. I don't think it ever started on the scheduled time! Oh, well . . .

I noticed the ABC15 video screen is slightly larger.

I would suggest keeping KPHO and ABC15 both in open windows and mute one. In case one of these TV stations have problems with their stream, you can watch the other one and have it available immediately.

Need to go. I guess I'll leave KPHO & ABC15 in open windows and click on whenever I can.

Great to "see" you, too. I am only here for a brief while. lol

I won't be able to hear all of Logan's testimony. Things to do today. It seems most of what I've heard so far is similar to what he said in Tammi Smith's trial.

So far, this is a repeat from the Tammi trial. Elizabeth looks pretty 'cool as a cucumber' today.
I feel like Logan is just numb. He answers, but is pretty monotone.

Lunch Break. Prosecution finishes eliciting testimony from Logan. Defense will cross after lunch.

Logan broke my heart, and it makes me mad as a hornet at Tammi Smith all over again!

IMO, he was a willing and able father willing to parent his child, and both Elizabeth and the Smith's prevented that.

Cross examination will be interesting. I think they are going to focus in on Logan's past crimes/probation problems and pound away at that...jmo.

Breaking for lunch. The Judge asked everyone to be back by 1:25 p.m.

You may be right Weezie, but I thought the pros. did a good job of covering all that and he admitted it all and also the fact that he is still on probation. I just tuned into this trial today, what exactly are the charges for eliz.Johnson? I know its not for murder, although I don't know why since she said that she killed Gabriel and no one could ever locate him.

Agreed - the prosecutor laid it all out on the table FIRST which was a good strategy, but I still think the defense is going to hammer away... I believe her charges are for kidnapping and child interference (like TS) of custody. Not sure what the sentence guidelines are but whatever they are, it won't be enough because Baby Gabriel is still "missing".

Man who rented room from Elizabeth for about 3 weeks finished direct from Pros....no cross by defense. Witness excused.

Assistant Mgr at 99 cent store where Logan worked just testified to the incident when EJ came in yelling and screaming at him and police were called.

Defense has no questions. Witness excused.

2nd verse/same as the first....Just had the cashier testify as to EJ's coming into the store, yelling at Logan, police called. No defense questions. Witness excused.

I've been out of pocket all morning, but just tuned in to the live stream and currently Frank McQueary, Logan's father, is on the stand. Prosecution questioning him. Very steady, very believable witness. Defense has no questions. Jury has no questions. Witness dismissed. Lunch break until 1:30 MST.

Tammi's former friend now testifying.
Whoa....EJ just sobbed out loud and moaned. Crying lots. It was at the point that the witness said she called the FBI when she saw TS on the news saying "Gosh golly gee, I sure don't know how Craig Cherry's name got on that paternity affadavit".
This is the lady whose husband's name TS wanted to put on the paperwork before she put CC (her cousin).

The defense actually got up and asked a few questions. Mainly to get the witness to say the phone calls she had with TS about plans to get custody of Gabriel were with TS and she could not testify that EJ was part of the plan because her phone conversations were with TS and who knows if EJ was a participant or not.

Not sure who is questioning nor the witness:


State calls officer Smith but first Def requests approaching bench.

Short 5-10 minute break.

Edit: Judge states, now jury is out of room, break is for EJ to compose herself.

That was fascinating. Did the Judge just say he did not think she did it on purpose to disrupt the proceedings?

Yes.

(I don't much care for this judge. He is, IMO, WAY too lenient. I was disgusted with the sentencing of TS.)

Yes.

The crap sentence for TS told me he had more regard for the defendant (after all the shenanigans she pulled) than he did for the victims: baby Gabriel, Gabriel's father and Gabriel's grandparents.

I too was not impressed with his handling of Tammi. And I am not impressed with him during this trial either. Another baby killer is just going to go on with her life I am afraid.

I believe the jury has transcripts now to go along with the audio, but cannot have transcripts when they go to deliberate (just the audio).

At least the jury is hearing EJ "losing it" and getting a sense of her manipulative personality. Here's hoping!

Surely, the judge should have had both parties agree to a stipulation of a written transcript being read aloud in court and it being a true copy of the words. If I was on this jury I would think the State had lost it! (IMO, The judge has not heard this before because if he had, I don't think he would have allowed it in court.)

Dec 28, 2009, he attended briefing and became involved in missing child filed by Logan against EJ. He attended a court hearing. He was the only officer from his dept in the court re this case. He had met Logan that day in the lobby of the court. Logan did not advise any new info. End of hearing, Logan was given temporary custody. Included was a warrant to recover child if child found.

Looking at documents Det. rec from court that date.
Docs exhibit entered into court.

Det. met w/ county atty; custodial interference filed that day, national center for missing and exploited children contacted to locate mother, child, vehicle;

Dec 30, 2009; Bureau of health statistics notified in case a duplicate birth certificate was requested

Jan 10, 2010: San Antonino PD contacted; items reviewed to assist Det. Thompson so as to make presentation to SA PD; field identification cards were shared which contained names and contact info;

Det. reviewed Tempe Dec 9 field ID card;next date ??? Logan requested assist from Tempe PD to find his child;
Logan provided earlier tape recorder and detective copied the audio recording and made summary recordings; @ 10 recordings were obtained from Logan; between Logan and EJ; 2 from TS and Logan; Logan, TS and EJ. Recordings with EJ claiming she had killed this child; TS/Logan were the first contacts Logan had with TS; TS and husband/Logan with re TS wanting to adopt baby--- TS was trying to persuade Logan for adoption; TS/hubby Jack told Logan to let TS find EJ and baby, not to involve the PD; TS told Logan if he signed adoption papers EJ would return with the baby; Jack made comment he did not want Logan to mess anything up; Det assisted in conducting additional followup in January; Craig Cherry follow up re CC's name being listed in connection with the baby; Det obtained all original court docs to avoid the purging of the original docs; Det now presents the original docs.

Det present to doc search warrant served at TS/JS home; he took photos of interior/exterior, documented physical evidence seized. Confirming his documents.

Doc taken from TS home: Temporary guardianship by power of atty: EJ delegated all powers and control over baby to TS including full first aide treatment; Dated Dec 9, 2009. Notarized. Re as core information.

Dec 20, 2009; Logan informed EJ he was going to take child for visitation; EJ agreed for the visit and specifics; Doc found at TS' home.


Jan 15. 2010:
Det obtained copies of 2 custody proceedings; sealed; det confirms packs contents; one has recording of 22 minutes long.

Judge is ordering a 15 minute afternoon recess.

Judge: Confirming both audio and vid in packets.

Logan said he was not there when baby was born in May but lived there from mid June until "about a week ago"---
EJ said they lived together off and on, more on.

Judge asks where the baby is; EJ states baby is on the way to court; Judge states it is not a good idea. EJ states she has custody of the child. Judge asks Logan to define what custody is; ask EJ. Tells them they are wrong and is correcting them on what joint legal custody is; can not make specific choices without consulting the other parent. Mentions living arrangements have nothing to do with equality of time. Asking whether they want joint legal custody OR if one parent should have sole legal custody. Logan states joint; EJ states joint custody, too.

Parenting time: Judge asking re Logan's work schedule; clarifying time available for baby; EJ states she is not currently working; asks Logan who has baby lived with?
Logan said equal time; EJ states she has had baby mostly. Logan states he was on probation; possession of stolen property-- class 5 felony. He was on 6 yrs probation. Logan has been discharged from probation.

Judge says o hearing today. Just asking what they desire for custody schedule. Logan asks vaguely; judge instructs. Logan asks for M-F with EJ taking him on week-ends. Ej disagrees and wants reverse schedule.
Judge is asking re home living arrangement for Logan.
Asking Logan what experience he has with children; Logan said CPS will do report on both of them at his request; baby is with another family.

Judge asks EJ where baby is; she states baby is in her care and CPS has investigated.

Logan asks for M, Tu, and Saturday.
EJ----
Lot of switching.

Judge wants a parenting conference.
EJ will have baby from Wed AM through Sunday AM;
Logan to have baby from Sunday AM through Wed AM.
Judge asks for child support hearing.

EJ is on food stamps, WIC, and free health care for baby.

Defense cross examines.

Asks about telephone calls Logan shared. Was EJ in state or very likely had left state on Dec 18 for Texas? Det did monitor the call Logan had with the Smiths. Atty asks if Logan had been promised if Logan signed adoption papers EJ would bring the baby back? Yes.
Did det have any reason to believe EJ was a party to this adoption arrangement and you can see the baby? No.

Had EJ left AZ and gone to TX at that time? Yes, he was aware of the possibility.

Was EJ even aware of any conversations with TS? No, nothing to indicate it to the detective.

Who is Craig Cherry? A relative of Ts.
Who signed the paternity document? Not CC; TS did.
Anything to show EJ had knowledge of this? No.

Det ids a doc taken from TS' home; no information as to whether EJ had knowledge of the docs being shown.

State up again.

Craig Cherry's name is on document. Yes.
Lists him as potential father re DNA on CC and Logan.
