You’d be forgiven for thinking the drama surrounding Oscar Pistorius was finally at an end when Judge Thokozile Masipa refused the state permission to appeal his sentence.
But experts say it’s far from over.
It’s now almost certain that the state will appeal for special permission to the Appeal Court in Bloemfontein to have the six-year sentence the judge handed down overturned, says Marius du Toit, criminal law attorney from Pretoria.
“I think everyone knew that Judge Masipa would give the state a hiding in court today, and Advocate Gerrie Nel and his team were prepared for it. Remember, when they appealed for the first time Masipa granted leave to appeal only the legal questions – not the sentence.
“I though the chance of her granting leave to appeal was zero,” Marius says, adding that you can turn to the Appeal Court the moment a judge refuses leave to appeal.

#OscarPistorius has been sentenced to 13 years in prison for the 2013 murder of his girlfriend, Reeva Steenkamp. The Supreme Court of Appeal (#SCA) is handing down its judgement in this matter, after the State had applied to have Pistorius' initial six-year prison sentence increased.
Pistorius had fired four shots through a bathroom door, claiming that he believed there was an intruder in the bathroom. North Gauteng High Court Judge Thokozile Masipa initially sentenced Pistorius to five years for culpable homicide in 2014.

#OscarPistorius has been sentenced to 13 years in prison for the 2013 murder of his girlfriend, Reeva Steenkamp. The Supreme Court of Appeal (#SCA) is handing down its judgement in this matter, after the State had applied to have Pistorius' initial six-year prison sentence increased.
Pistorius had fired four shots through a bathroom door, claiming that he believed there was an intruder in the bathroom. North Gauteng High Court Judge Thokozile Masipa initially sentenced Pistorius to five years for culpable homicide in 2014.
Pistorius served only 10 months of the five-year sentence in prison before being released and put under house arrest. The State appealed the culpable homicide conviction, and it was later replaced with murder by the Supreme Court of Appeal in 2016. ...."

"....Pistorius reportedly 'sustained a bruise' in the altercation on December 6, but the fight could see him lose privileges such as access to the jail tuck shop and the phone that started the fight, ....."

We want to know that proper security protocols were followed by prison staff.
'If Oscar Pistorius is found to be at fault, he could lose his privileges and be re-classified if he is no longer considered 'low risk'.'
Pistorius is being held at the 'relaxed' Atteridgeville Correctional Centre, near his wealthy family's sprawling compound in the capital Pretoria, but could face a return to the notorious maximum security facility Kgosi Mampuru II where he served his first year behind bars.
Atteridgeville only houses inmates who are serving a maximum of six years, and has upgraded facilities, including ensuite bathrooms for prisoners with special needs....."

He will do anything to avoid or prolong the transfer to the tougher prison.

Oscar Pistorius is to be secretly freed from prison on compassionate leave to attend a memorial service for his 101-year-old grandfather
"....The athlete has previously been given leave to attend the memorial service of Hendrik's wife Gerti who was his maternal grandmother who died aged 92 in August 2016.
And in August last year, Pistorius was again allowed 'compassionate leave' to attend the funeral of his other grandmother, English-born Joyce Bekker, who died aged 93.
Being allowed out of Atteridgeville Prison in Pretoria, South Africa, for a third time has led to questions that the former national hero may be getting preferential treatment.
Sources in the Pistorius family have confirmed to local media that they expect Oscar to be present but the prison authorities claim a final decision has not yet been made.

Interesting prison.
Seems he is always planning or taking a "holiday" from his sentence.
During Viet Nam war, my brother, a Marine, requested leave to attend the funeral of a cousin who was unexpectedly killed by a drunk driver. Les was my brother's closest friend as well as a cousin. Leave was denied....
