Just after wrapping up the first day of his deposition, Casey Anthony's defense team has filed a motion alleging the man who found Caylee Anthony's remains could be responsible for the toddler's death.

Defense attorney Jose Baez filed the motion "to introduce prior bad acts and other circumstantial evidence pertaining to Roy Kronk" around 5 p.m. Thursday. The motion lays out the defense's strategy for the first time and claims a third party is responsible for Caylee's death.

The motion claims that Roy Kronk, the Orange County meter reader that discovered Caylee's remains in December 2008, has a history of abusing and restraining women with duct tape as well as holding them against their will. Caylee's remains were discovered in a wooded area near the Anthony family home.

The motion also alleges that Kronk could have a history of inappropriate behavior with young girls.

The defense said it interviewed two of Kronk's ex-wives and his son.

One ex said Kronk kidnapped her and held her for two weeks against her will using duct tape to restrain her.

The defense also claimed Kronk knew the location of Caylee's remains and may have had possession of them in November 2008.

The defense said the prosecution only has circumstantial evidence against Anthony in the first-degree murder case against her, and according to Florida law, for circumstantial evidence to prevail, all other options must be ruled out.

The motion asks the court "to allow Anthony to introduce at trial circumstantial evidence tending to indicate that a third party, and not Miss Anthony, is equally likely to be responsible for the death of the child Caylee Marie Anthony."

These allegations come the same day Kronk was deposed for several hours and the defense team unveiled its newest member, Mort Smith, a private investigator and professor at DePaul University.

Kronk's attorney, David Evans, issued a news release Thursday evening stating his client is a witness, not a suspect.

"Shortly after adjourning the deposition, the Anthony defense team filed a Motion, Memorandum of Law, and accompanying materials suggesting that Roy Kronk, the individual who found Caylee Anthony's remains and repeatedly reported his find to law enforcement agencies, should be considered a suspect in the murder of Caylee Anthony," Evans said. "He voluntarily appeared today and truthfully responded to all questions asked by Anthony's attorney. He has cooperated fully with law enforcement from Day One. He has nothing to hide, and has hidden nothing."

Evans said Kronk has always understood he may become a target of the defense.

"In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior," Evans said. "The State will respond to these papers in due course in the criminal proceedings. As for Mr. Kronk, he vehemently denies the allegations against him and is confident that he will be vindicated. In the meantime, as he stated early on in this case, no good deed goes unpunished."

Kronk first reported finding something suspicious in the woods near the Anthonys' home on Aug. 11, 2008, but after three phone calls, a deputy came out and said he found nothing. That deputy, Richard Cain, was later fired from the Sheriff's Office for lying to his superiors about his encounter with Kronk.

Kronk is expected to be a key witness for the prosecution, but the defense apparently hired Smith to dig through Kronk's personal life.

Kronk's deposition will continue on Friday.

Anthony, 23, remains jailed on first-degree murder charges in the Caylee's death. Caylee's grandmother reported the toddler missing in July 2008, one month after she was last seen.

ORLANDO, Fla. -- Casey Anthony's attorney filed a new motion to treat Roy Kronk, the former meter reader who found Caylee Anthony's remains, as a suspect in her death.

The motion, filed late Thursday, came after Kronk spent the day giving a deposition behind closed doors to the defense. It asks the court to allow the defense to introduce "prior bad acts" by Kronk.

Claiming evidence that Kronk "is involved in an imaginary world of fantasy and violence," the motion concludes by stating that "Roy M. Kronk should have been a suspect in this case."

Kronk, after his deposition on Thursday, said, "I haven't done anything wrong, and I maintained that all along."

His attorney, David Evans, said in a news release: "In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior."

Kronk will come back for a second day of depositions in the case against Casey Anthony.

Casey Anthony's defense team is going after the former Orange County meter reader who discovered Caylee's remains, claiming there is circumstantial evidence that makes him "equally likely to be responsible for the death of the child."

Now, the attorneys are asking a judge to allow a jury to hear allegations of Roy Kronk's past wrong-doings, including inappropriate behavior with girls, use of duct tape to restrain women and holding women against their will.

Kronk's attorney, David Evans, said his client denies the allegations and understands this is Anthony's defense attorneys attempt to cast blame on someone other than their client.

"In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior," Evans said in an e-mail. "The State will respond to these papers in due course in the criminal proceedings."

So far, the information in the defense's motion, which included hundred of pages of interviews, could not be verified by the Orlando Sentinel.

Transcripts of interviews with Kronk's two ex-wives, son, and a longtime live-in girlfriend's daughter depict the former meter reader as an untrustworthy man willing to resort to violence. No police reports or other supporting documentation were provided.

Ex-wives Jill Kerley and Crystal Sparks said Kronk physically attacked them. Sparks said she called police, but could not remember if she filed a restraining order. Kerley said he used duct tape to hold her against her will.

Both ex-wives said Kronk tells tall tales.

"I don't think he would know the truth if it hit him upside the head," Kerley said, who was briefly married to Kronk in the early 1990s.

Kronk's son Brandon Sparks said the former meter reader told him before Thanksgiving 2008 that he found Caylee Anthony's body and would be on television. Brandon Sparks shared the news with his wife.

"We both didn't pay any mind, though. We both thought it was far-fetched," Sparks said.

Casey Anthony, 23, is charged with first-degree murder in the death of Caylee. The toddler was reported missing in July 2008. If convicted, Anthony could face the death penalty.

The legal request was filed late Thursday, moments after Kronk finished a day-long questioning by defense attorneys at the State Attorney's Office. Another day will be scheduled soon.

"I know I haven't done anything wrong and so I have no reason to be fearful," Kronk said afterwards.

Kronk called detectives after he found the toddler's remains less than a mile from her family home in east Orange County on Dec. 11. He told authorities that he had tried to alert them four months earlier but his tips were shrugged off by deputies.

Defense Says Kronk May Have Killed Caylee

ORLANDO -- For the first time, Casey Anthony’s lawyers are pointing the finger at someone else.

They're identifying Roy Kronk as a person who may have killed Caylee.

In a motion filed late Thursday afternoon, the defense said:

* they have evidence Kronk has a possible history of inappropriate behavior with young girls
* that he has used duct tape to restrain women
* that he has a history of abusing and restraining women

The defense wants to grant what's called third party status to Kronk.

Essentially, they’re saying the evidence against Anthony is circumstantial, and there's just as much circumstantial evidence against Kronk, so they want to introduce his background in court.

Shortly after the motion being filed by Anthony's defense team, Kronk's attorney, David Evans, released the following statement.

"Today, the Casey Anthony defense team commenced, but did not complete, the deposition of Roy Kronk in the State v. Casey Anthony case. OK, if this wasn't so sad and involved beautiful little Caylee being murdered, it would almost be comical. So, Baez, which is it, Kronk did it, a stranger did it, Amy, Ricardo, Jessie or Tony are code for Zani the nanny, or once KC explains what happened we will ALL understand what happened? I know that the only things the jury can consider is what is heard IN court. However, there is NO way, any human being who will be on that jury will be able to forget all we have heard from the defense ITSELF, as to what the possible scenario is. The defense and from KC, as they speak FOR HER, has said so many different things, no one will EVER believe Kronk, who never even knew who KC was could have done this crime. I actually think that not only will they dismiss this fairly quickly, it will anger a jury that she is trying to blame toe ONE person who brought Caylee out of that swamp! I know it would anger me!
I am trying to imagine the cartoon moment during or directly after the deposition with Roy Kronk, when the defense got this NEW bright idea to blame Kronk. That must have been priceless to see. Then him running to file this silly, ridiculous motion. Oh, yet AGAIN!

Since the defense team has been perusing the blogs they have seen Kronk being held suspect by commentors moreso than Jesse, his father, Amy, Ricardo and Tony (they have seen the ire of commentors concerning implicating these friends of Casey's). I think they are hoping that there will be one or two jurists who will think the same.

I can't see Judge Strickland granting this motion.

Kronk’s Ex-Wives Discuss Alleged Abuse In New Defense Interviews

ORLANDO -- Allegations that former meter reader Roy Kronk may have been involved in Caylee Anthony’s death are not only coming from Casey’s defense team, they’re also coming from Kronk’s own family.

The defense filed an enormous motion with the court late Thursday.

It includes video of interviews with Kronk's family members.

In the motion, lawyers stop just short of saying they believe Kronk killed Caylee, and they've uncovered some extremely incriminating aspects of Kronk's past.

Mort Smith, Defense Investigator: When you learned Roy had found Caylee's remains, what went through your mind?
Jill Kerley, Kronk’s Ex-Wife: That he had done it.
Smith: Meaning?
Kerley: He probably was the one who murdered Caylee Anthony or had something to do with it.

Kronk and Kerley divorced after four months.

“It was abusive -- mentally and physically,” Kerley said. “He beat me up in front of his dad and I had to go the hospital. He duct taped my hands one time.”

Defense attorneys are clearly trying to connect Kronk to duct tape found at the crime scene with Caylee's remains.

Kerley: He said it was 100 mph duct tape.
Smith: And how often did he duct tape you?
Kerley: On two occasions.

Crystal Sparks, another ex-wife of Kronk’s, was also interviewed.

“I think there's a lot of concern for Roy being around young girls,” Sparks said. “Roy is not heard from. Roy is not seen. Roy is just non-existent in our lives, which is great for us.”

During her interview, Sparks also spoke about alleged abuse with Kronk.

“He made threats. He made constant threats against me,” Sparks said. “It was not uncommon for him to say 'I should have killed you when I had the chance.' I heard that all the time.”

Kronk called 911 three times in August 2008, saying he saw something suspicious in the woods off Suburban Drive.

Two weeks before Thanksgiving and a month before he reported finding Caylee's remains, he called his son Brandon and told him he was going to be a hero and appear on TV.

“‘I know where Caylee is and I'm going to go get her,’” Sparks said, quoting her son Brandon.

Those two interviews are just two pieces of the puzzle Casey's lawyers are using to create reasonable doubt.

They indicate in their motions that Roy Kronk “knew of the location of Caylee Anthony's remains and indeed may have had possession or control of them in November 2008” and they wrote that “Roy Kronk, and not Miss Anthony, is equally likely to be responsible for the death of Caylee Anthony."

“The more I think about it, the more my gut tells me he had something to do with it,” Kerley said.

After hearing about the motion, Kronk's attorney David Evans issued a statement:

okay... i am NOT a law professor like bozo himself, BUT... i thought that a witness was protected from being on trial...

i thought the ONLY way prior bad acts were admissible on a witness and/or defendant was if they were being treated as HOSTILE on the STAND.. i was under the assumption that prior bad acts were only admissible to confront a hostile witness of LYING on the stand...

like i said.. no law degree here, but i have never heard of bringing in a WITNESSES past into a hearing..

Sherry~You are so smart girl, they have kept up with the blogs and have surely read all the vile things said about Kronk. How sad. I don't think he is anyone except someone with a good hunch, and unless it is proven otherwise, I will continue to believe that. The story he tells in it's entirety is completely believable if that is the way it happened and add that to the fact they proved the cop blew him off and I can see it happening the way it did. I bet he wishes he had been more persistant when he had that intuition.

i DONT think this motion can be granted... due to the fact that kronk was NEVER tried or convicted of these "claims" ... IF he had a conviction for these "alleged" prior bad acts, it MAY be possible.. BUT with nothing more than (as Dis stated) a few pissed off ex wives, i think not..

Doesn't surprise me that JB and AL would throw an innocent man like Kronk to the wolves since AL participated in letting a man she KNEW was innocent sit in prison convicted of a murder he did not commit. And she knew because HER client committed the murder!

A Serious look at the Defense’s Motion concerning Kronk

Okay, we took a rather irreverent look at the latest defense move in which they have stated Kronk is the possible third party involved in the disappearance and murder of Caylee Anthony. Now let’s look at it seriously, both in what they think they have, and what they don’t have.

Their claims center around statements made by ex-girlfriends and wives, daughters of ex-wives who are now deceased, and a statement by his son. Let’s look at these and how the defense plans to use them.

Mr. Kronk is alleged to have been abusive to his ex-girlfriend/wife Jill Kersley. The allegations include beatings and using duct tape to restrain her during the beatings. Ms. Kersley is prepared to testify to physical abuse, being restrained with duct tape and being kidnapped by Mr. Kronk for two weeks in Maryland. It should be noted that Mr. Kronk was, in fact, arrested on these charges. But when the evidence was presented to a Grand Jury, not only did that jury find there was no probable cause to pursue the charges, but the entire issue was expunged from Mr. Kronk’s record. I’m not sure how this legally will play out considering the state will be able to show that a grand jury found Ms. Kersley’s accusations to not be sufficient to press on in this matter.

Casey’s Defense Interviews Kronk’s Ex-Wives

ORANGE COUNTY, Fla. -- Not only is Casey Anthony's defense team trying to blame Roy Kronk for killing Caylee, new videos released Friday show lawyers are trying to dig up every speck of dirt they can on him.

Kronk is the meter reader who found Caylee's body in the woods near Casey Anthony's house last December. Eyewitness News reported Thursday night the defense team wants to label Kronk as a suspect and it wants the sheriff's office to investigate if Kronk really killed Caylee.

Kronk’s bitter ex-wives have accused him of almost everything but the Kennedy assassination and the 9-11 attacks, but they were not questioned under oath and the defense did not provide one iota of evidence to support any of the allegations, no police reports, nothing.

One-by-one, former meter reader Roy Kronk's ex-wives and their bitter children made wild accusations.

“Sometimes he'd walk in when I was putting my clothes on,” said April Applegate Hensley, the daughter of one of Kronk’s ex-girlfriends. “I told him I was tired of it and jokingly he said, ‘Turn to animals and I'll videotape it.’”

But she also said Kronk supported her terminally-ill mother and that he brought the only discipline into her troubled life, which she resented.

“I pulled back. He hit the door, broke his wrist,” ex-wife Crystal Sparks said during the questioning. “He threw me up against the back of the door … He was not a good dad.”

Sparks told the defense Kronk exposed their 6-year-old to porn. She couldn't remember whether she filed for a protective order and couldn't explain her email praising Kronk for finding Caylee Anthony's remains saying he did a good thing.

“He would up beating me up in front of my father,” ex-wife Jill Kerley said. “He duct-taped my hands one time.”

That appeared to be an obvious attempt to connect Kronk to the rare duct tape found layered over Caylee's mouth.

It's not uncommon for bitter exes to do this.

“You bet they see an opportunity for their 15 minutes of fame and to, in fact, pay back,” WFTV legal analyst Bill Sheaffer said.

Sheaffer points out that, if the defense team repeats unsubstantiated allegations like this outside of court, they could be sued. They didn't during their morning network blitz Friday, which tells him they have no evidence to back them up.

“Well, what happens to a cornered animal? They just lash out, lash out, lash out,” Sheaffer said.

Kronk's attorney said the defense never asked Kronk specific questions about these allegations Thursday when they had him under oath and could’ve pinned him down while they had the advantage of surprise.

Sheaffer says it's another indication that this is another media stunt without any evidentiary or legal substance.

Roy Kronk said he first found the plastic bag containing Caylee's body in the woods near the Anthony home in August, but a deputy didn't take him seriously and really didn't investigate. So he called deputies back into the woods again on December 11 and that's when they took a close look and found Caylee's body.

Kronk worked for Orange County until last month, when he was fired during a dispute over a shoulder injury.

Estee, I just watched the Bill Sheaffer video all th way through... and boy, did he hit the nail right on the head!!!!

I think he also answered the question why when JB and sidekicks went on national TV, they were careful of the words they chose so as not to open themselves up to a suit against them. They are not protected from insinuating an innocent person could be guilty apparently UNLESS they are within a court of law......

Piper, I can't honestly see how they will be able to.... unless they try to pass off the imaginanny as the person who gave Caylee to Kronk..... but then they have the problem of.... no nanny exists......

Piper, I don't know why I didn't say this before... because I've been thinking a lot about this. I don't think JB and AL ever thought there was a chance in Hades this motion will be granted. I think it is more about tainting the prospective jury pool.... and making someone else besides THE GUILTY ONE look bad guilty.

They KNOW there is nothing that ties Kronk to the death of Caylee, so they are doing everything they can to cause doubt in JUST ONE PERSON'S mind..... and if they can't do it in court... they will do it beforehand.

I'm not honestly sure what their defense will ultimately end up being, but I just can't see this going forward.... especially not with Judge Strickland at the helm.

These people telling tales out of class will be sorry they ever got involved with this bozo of an attorney. I listened to Michelle 's radio show with Dr. Koby and Mark Eiglarsh (sp) I love Mark!!!! He is a good attorney and made a lot of good points. Also, Hornesby called in too!!! What a treat! He shot everyone of Koby's rediculous statements down....it was great! I'm not sure where I got the link but it is her so-called show. I won't even say what I think of Michelle because she already takes great pride in the criticism she has recieved but I think she's full of CHIT!!!!! All the people in this case who have tried to derail justice for Caylee will regret it in the end....I have faith in that! I do not know how you guys feel, but if I was Roy Kronk, I'd be suing somebody's a$$ BIG TIME over this!!!!!! This headline implies... no, STATES... that Roy Kronk killed Caylee....... I'm not sure of the law of this, but I would sue anyone and everyone that I could regarding this.... and not for the money!!!!! This really makes me SOOOO angry!!

NEW YORK (CBS) Meter reader Roy Kronk, who was hailed as a hero for finding the body of murdered Florida 2-year-old Caylee Anthony, was really the girl's killer, according to new claims by defense attorneys representing the toddler's mother, Casey Anthony.

Casey Anthony is awaiting trial on first-degree murder charges for her daughter's death. She's pleaded not guilty and has previously said a babysitter kidnapped her child.

On Dec. 11, 2008, Kronk led police to Caylee Anthony's body. He was quickly ruled out as a possible suspect.

But Casey Anthony's defense team hit the network morning show circuit Friday, including CBS News’ "The Early Show" armed with videotaped interviews with Kronk's ex-wives. They portrayed Kronk as inappropriate with children, violent toward women, and capable of Caylee's murder.

"When you learned that Roy Kronk had found the remains of Caylee Anthony, what went through your mind?" an attorney asked one of Kronk's ex-wives, Jill Keerley, during a taped interview provided to CBS News.

"That he had done it," Keerley replies.

"Done it, meaning...?" the lawyer asks.

"He probably was the one who murdered Caylee Anthony, or had something to do with it," Keerley responds.

"You had mentioned that he had a certain saying about duct tape," the lawyer says.

"Yeah," answers Keerley, quoting Kronk, "'It's a hundred-mile-an-hour duct tape, nothing can get through it.'"

Investigators found duct tape on Caylee's skull.

Casey Anthony's attorneys also gave CBS News video of April Hensley, who was 11 when Kronk lived with her mother. The girl says of Kronk, "Sometimes he would, you know, walk in while I was putting my clothes on."

Casey's defense team admits it has no physical evidence to support its theory, CBS News Correspondent Kelly Cobiella points out. And Kronk's lawyers say this is just a ploy to deflect blame from the real suspect -- Casey Anthony.

But Andrea Lyon, one of Casey Anthony's defense attorneys, turned the evidence argument on its head Friday when she told NBC's TODAY Show, "There is as much circumstantial evidence implicating Roy Kronk as there is implicating our client … He's the only one who's been with the body. He's the only one who magically discovers it."

Prosecutors say they'll seek the death penalty if Casey Anthony is convicted of first-degree murder.
