A Florida appeals court ruled Wednesday that a millionaire polo playboy from Houston cannot legally adopt his longtime girlfriend, only seven years his junior.

Precisely why John Goodman, the 49-year-old heir to an air-conditioning fortune, wanted to "adopt" Heather Hutchins was never entirely clear - money was at the center of it, though explanations differed - but that reason is now moot. A three-judge panel unanimously held that Goodman's failure to tell his ex-wife and his teenage children of the adoption until it was a done deal violated their right to due process

Goodman is a longtime Houston resident and polo enthusiast who in recent years has spent much of his time in Palm Beach, where he built a major venue for national and international polo matches. Facing a potential prison sentence if convicted in the 2010 two-car accident, he and Hutchins executed the adoption in October 2011 and did not tell anyone until the beginning of 2012 after the objection period ended. The appeals court called that "fraud."

In a separate addendum, Senior Judge Alan R. Schwartz went further: "Even if the motivation and the means for securing it were not so reprehensible, I believe ... the adoption of a paramour is so contrary to the beneficent purposes of such an action that no such judgment can ever be sustained."

In the continuing saga of billionaire John Goodman's prosecution on alleged intoxication manslaughter charges, his chances for a retrial are apparently improving.

The Sun Sentinel reports that Goodman's lawyers are claiming that a juror at his original trial did not disclose that his wife had been arrested on a charge of driving under the influence.

The newest revelation of possible juror misconduct in John Goodman's DUI manslaughter case will be examined at an April 29 court hearing, Palm Beach County Circuit Judge Jeffrey Colbath said Thursday.

The evidentiary hearing, to interview Goodman trial juror Dennis DeMartin of Delray Beach, was scheduled during a conference call with attorneys for the state and Goodman.

On Monday, the 4th District Court of Appeal in West Palm Beach sent the case back to the trial court for 45 days in response to a motion by Goodman's attorneys alleging DeMartin lied during jury selection last year.

The new argument revolves around a recently self-published book by DeMartin in which he wrote his ex-wife was once arrested for DUI, a fact the attorneys say DeMartin did not disclose when they were questioning him before being seated as a juror.

WEST PALM BEACH, Fla. —Wellington millionaire John Goodman will get a new trial, WPBF 25 News has learned.

The polo mogul was convicted of DUI manslaughter last year in the 2010 death of 23-year-old Scott Wilson.

A juror was accused of misconduct and this week was questioned by attorneys and the judge in the case.

Judge Jeffrey Colbath ruled just before 5 p.m. Friday that Goodman will get a new trial. Goodman has been serving his 16-year sentence on house arrest as the appeals process has played out.

A date for the new trial has not been set.

WEST PALM BEACH, Fla. -- Wealthy Wellington resident and polo tycoon John Goodman has won a new trial, and it could be held before the end of this year.

In an 11-page ruling, Circuit Judge Jeffrey Colbath says Goodman juror Dennis DeMartin was not truthful during jury selection and as a result, Goodman was denied a fair trial.

Had DeMartin brought up the fact that his ex-wife had a DUI arrest, he would not have been chosen as a juror.

Judge Jeffrey Colbath issued the ruling Wednesday as the International Polo Club Palm Beach founder awaits a new trial

During a hearing last week, Goodman's attorney asked that his client's bond be reinstated to the same release conditions he had before his DUI manslaughter conviction last year. However, the assistant state attorney argued that Goodman was a flight risk because of his wealth.

John Goodman's new attorneys may want the polo mogul's new trial moved out of Palm Beach County because of extraordinary publicity in the case, according to a request filed Wednesday.

Palm Beach County Circuit Judge Jeffrey Colbath twice last year denied Goodman's former attorneys their desire to move his trial to Miami due to an intense media focus on the DUI manslaughter prosecution.

But Colbath on May 3 granted Goodman, 49, a new trial because of juror misconduct, wiping out his conviction and 16-year prison sentence. Goodman attorneys Roy Black and Mark A.J. Shapiro then left the team, and attorneys Douglas Duncan and Scott Richardson took the reins.

In their new motion, the defense asked Colbath to cancel a planned Monday conference on trial scheduling, citing that they need "sufficient, reasonable time to investigate and prepare Mr. Goodman's case for trial." They said they would not request a November trial as originally planned.

The attorneys asked for a September court date to review the status of trial preparations and reveal at that time whether Goodman will again seek a change of venue.

The judge presiding over John Goodman's DUI manslaughter case said Wednesday he's receptive to moving the new trial out of Palm Beach County because of the potential difficulty of picking a jury here.

The stars are lining up for a mid-to-late January trial, which would be more than eight months after Colbath threw out Goodman's conviction and 16-year prison sentence because of juror misconduct allegations.

The wait is in part because Goodman's new attorneys, Douglas Duncan and Scott Richardson, can't get their hands on case files and evidence held by Goodman's former attorney Roy Black and his Miami firm.

Duncan told the court that Black has placed a "retaining lien" on those records — a legal term meaning Black has a right to keep them until he's fully paid for his services. The new defense team is working around this by paying for fresh copies from the State Attorney's Office.

After the hearing, Richardson and Duncan would not answer questions from reporters about how much money their client owes Black.

The judge agreed it could be possible to "shanghai" a jury from another county, keeping the trial in the courthouse about 17 miles east of the site of the Feb. 12, 2010, crash that killed Scott Patrick Wilson, 23. The victim's parents, William Wilson and Lili Wilson, attended Wednesday's hearing but declined to comment afterward.

The judge said if jurors are brought in he would consider holding long trial days and even court on Saturday "so we can get these people in and out" with as minimal disruption to their lives as possible.

Defense attorneys Robert Gershman and Joseph Walsh are representing the 70-year-old retired Delray Beach accountant for free as he fights charges he derailed the polo mogul’s DUI manslaughter conviction. He’s accused of withholding key information during jury selection and later conducting a drinking experiment. His attorneys had listed the Goodman prosecutor as a witness in the case.

Palm Beach County Chief Circuit Judge Jeffrey Colbath on Tuesday said he won't allow attorneys for former John Goodman juror Dennis DeMartin to question a prosecutor at an upcoming hearing.

Colbath denied a subpoena served on Assistant State Attorney Sherri Collins, meaning she won't have to testify at DeMartin's final hearing Monday on a misdemeanor charge of indirect criminal contempt.

DeMartin, 70, of Delray Beach, is accused of misconduct that prompted Colbath to throw out the Wellington polo mogul's March 2012 DUI manslaughter conviction and 16-year prison sentence for the February 2010 death of Scott Wilson, 23.

John Goodman's attorneys say they've just made a stunning discovery that they say casts some doubt on the Wellington polo mogul's DUI manslaughter retrial.

Goodman's Bentley convertible and victim Scott Wilson's Hyundai Sonata — major pieces of evidence — are missing for Goodman's retrial early next year, the defense attorneys revealed in court papers filed this week.

But the Palm Beach County State Attorney's Office said it released both damaged vehicles to insurance companies, complying with requests after Goodman was convicted by a jury and sentenced in May 2012 to 16 years in prison.

John Goodman case: Judge delays start of DUI manslaughter retrial

WEST PALM BEACH, Fla. -- Fifteenth Judicial Circuit Court Judge Jeffrey Colbath has agreed to delay the start of the DUI manslaughter retrial of International Polo Club founder John Goodman after defense attorneys said they needed more time to prepare their defense. The trial, which had been expected to start in January, could now start as early as late February or early March. The next hearing is scheduled for 8:15am on Tuesday, January 14. wrote:

The defense wanted the judge to suppress the blood evidence. Attorneys argued that Goodman's blood was taken without a warrant and therefore should not be used in this trial. The state said that investigators had every right to take blood because there was probable cause of a traffic homicide. Judge Colbath denied that motion. "As a result, the State has destroyed constitutionally material evidence of a known/established exculpatory value to the Defense, thereby preventing any chance for Mr. Goodman to present a complete defense and receive a fair trial," the defense wrote.

...In November, his attorneys filed a motion seeking to exclude Goodman's blood test results from evidence because the sample was taken without a warrant three hours after the crash. But Colbath, after hearing objections from prosecutors last week, formally denied the request in an order Friday.

...The retrial is set to run from March 3-21.

HOUSTON (KTRK) --  A vital piece of evidence from a high-profile DUI manslaughter case is in the hands of a car hobbyist outside of Houston, the Sun Sentinel reports.

So where is that wrecked Bentley now?

It's sitting in the garage of businessman Ryne Manahan's home in Sugar Land, according to the Sun Sentinel.  

The Goodman Bentley was originally purchased at auction by an unknown buyer for $27,737, the Sun Sentinel reports, and it turned up on the auction block again in July 2013. That's when Manahan says he bought it online for $11,000.

Manahan, 45, tells the Sun Sentinel that he intends to completely restore the car.

It's the luxury car from one of South Florida's biggest pending criminal cases, and it's not in evidence. Not even close.

Parked 1,142 miles away in the garage of a residence near Houston is Wellington polo magnate John Goodman's smashed 2007 black Bentley Continental GTC convertible.

Businessman Ryne Manahan now holds the keys. And he intends to completely restore the car despite its less-than-glorious past.

"Nobody will be able to tell it was ever wrecked," Manahan, 45, told the Sun Sentinel last week in an exclusive interview. "It'll look nice."

The point is that Roberts said Snelgrove and the impound lot were getting harassed by Chubb and that's why she released the car. The defense said phone records did not show numerous calls from Chubb at that time. State said there wouldn't be records cuz they went through a switchboard. Defense says Chubb's own records show lots of calls to Snelgrove early on, but do not show lots of calls during the time in question. In fact, Chubb records show Snelgrove calling them.
