Judge: Bullets can be used against suspect in disappearance

COLUMBIA — Bullets seized at the home of a man accused in the disappearance of a Columbia teen can be used against him on a separate federal charge, a judge ruled Wednesday.

An attorney for Freddie Grant had argued that authorities withheld information from a judge who authorized the Aug. 21 search of Grant’s Elgin home. During that search, deputies found bullets and other ammunition that, as a convicted felon, Grant isn’t allowed to have.

Grant could face life in prison on the federal charge if a judge determines that his prior convictions make him an armed career criminal, and that trial is set for next month. He also faces a state kidnapping charge.

Gabrielle Swainson's Father Doesn't Think Missing Cheerleader Daughter Is Alive

The father of a 15-year-old South Carolina cheerleader missing since August doubts that she's still alive.

Gabrielle Swainson's father, Alvin Thompson, spoke to reporters after the suspect in his daughter's kidnapping was convicted on weapons charges on Tuesday, according to WLTX.

"I don't think she's alive," Thompson said. "There's been too much time."

Only one person can explain the disappearance, Thompson said, and that's Freddie Grant, a man with previous convictions for intent to distribute cocaine, aggravated assault and kidnapping.

The last 8 months have been agonizing according to family and friends of missing teen, Gabrielle Swainson.

The daily struggle to find Swainson has not only had an effect on her mother, but an entire community who is hoping and praying for the teens safe return.

Gabbie's mother, Elvia Swainson was invited to Tuesday night's Ridge View High School Baseball game for Senior night. Her daughter's fellow classmates requesting she throw out the first pitch during the game in honor of her daughter. Elvia says she didn't hesitate.

Columbia, SC (WLTX) - A man accused of kidnapping missing teenager Gabbiee Swainson will be sentenced Thursday on federal ammunition charges.

Freddie Grant, 53, was found guilty back in January of being a felon in possession of ammunition.

Deputies found a box of shotgun shells and a box of .38 caliber bullets at Grant's home back in August while searching for the missing teen.

COLUMBIA, S.C. (AP) - A man charged with kidnapping a Richland County teen is appealing his 17-year prison sentence on a federal ammunition charge.

Court documents filed Monday show that an attorney for 53-year-old Freddie Grant has asked the 4th U.S. Circuit Court of Appeals to consider his client's case.

Grant was sentenced last week for having shotgun shells and .38 caliber bullets in his home when it was searched by authorities looking for Gabbiee Swainson.

Daughter of accused kidnapper charged in Gabrielle Swainson disappearance

COLUMBIA, SC — The daughter of the man accused of taking Gabrielle Swainson from her bed last summer has been charged with being an accessory to the kidnapping, according to the Richland County sheriff.

Dominique Grant, 27, is charged with accessory after the fact to a felony, according to Alvin S. Glenn Detention Center records. The woman was arrested after investigators found Gabrielle’s cell phone in Myrtle Beach, where Grant now lives, according to Richland County Sheriff Leon Lott

Dominique Grant’s father, Freddie Grant, was accused of kidnapping the then 15-year-old girl after she disappeared from her mother’s Northeast Richland home in the early morning hours of Aug. 18. Police found duct tape covered in Gabrielle’s blood, but the girl hasn’t been seen since her disappearance.

RICHLAND COUNTY, SC Deputies think they have found a burial site for Gabrielle Swainson, the 15-year-old who went missing from her Northeast Richland County home one year ago.

“The search for Gabbiee is over. She’s coming home,” Sheriff Leon Lott said during a 7 p.m. press conference to announce a major development in the case.

The sheriff’s department brought suspect Freddie Grant down from a federal penitentiary in Kentucky to find Gabbiee’s body.

Deputies were searching late Thursday for her body off U.S. 1 near Elgin in an area that has been searched many times.

“It kills us because we failed to find her,” Lott said.

The body was taken to the Richland County Coroner's Office.

"It kills us because we failed to find her," said Lott. "Even though we could not have saved her life, when she was buried. It hurts all of us to know that many, many people walked that area.

"Many, many people looked in the exact same place where we found her." said Lott. "But the way she was concealed, you wouldn't know. The type of hole that he dug, the things he put on top of it. The cadaver dog would not have been able to find it at the depth that it was. We just couldn't find it. There's just no way of finding it without someone taking us to that area and showing us."

We've been in negotiations for quite some time with Freddy's attorneys," said Lott, referring to Johnson. "We have stood strong on what our offer was. We made an offer to them and haven't changed from day one. We had to do a lot of soul searching. It was almost that you're making a deal with the devil and it was tough."

"That was, I guess, the breaking point as far as to getting Freddie to lead us to where Gabbiee was at. regarding the bolded section.... makes me wonder how he knew this, if there is some sick twisted group who have discussed this ... and how many are buried the same way and if that is why so many are not found. 

My heart is breaking for this family and community. But if the deal with the devil is what it took to find her and bring her home then at least the family can have a proper burial for Gabbiee. I hope the family knows that there are many out there praying for and thinking of them as they start the healing process.

Dominique Grant released from jail, paperwork filed to dispose of charges

Dominique Grant, the daughter of murder suspect Freddie Grant, is out of jail and paperwork has been filed to dispose of the accessory after the fact charge against her.

Dominique, 27, was arrested and charged by investigators on July 11. Officials say she tried to help Freddie dispose of 15-year-old Gabbiee Swainson's cell phone by leaving it behind a Piggly Wiggly grocery store in Myrtle Beach.

Sheriff's investigators were still looking for Swainson's body at that time. The teen's remains were found weeks later in a deep grave in Elgin.

During a Thursday evening news conference, Sheriff Leon Lott credited Dominique's arrest with helping break the case wide open.

Freddie Grant Makes Court Appearance on Murder Charge

Columbia, SC (WLTX) - The man charged with killing a Columbia teenager made his first court appearance Friday morning in Richland County.

Freddie Grant, 53, went before a magistrate at the Richland County Detention Center. Grant is charged with murder in the death of 15-year-old Gabbiee Swainson.

Meanwhile, Richland County Sheriff Leon Lott and Coroner Gary Watts confirmed Friday morning that the body recovered in a field in Elgin Thursday is Swainson. An autopsy on the body is being performed Friday, and a cause of death could be given by the end of the day.

Grant said little at the hearing, answering questions about his name and where he was staying. (He had been held in a federal prison in Kentucky after being convicted on an ammunition charge related to this investigation) Grant did seem to indicate there was some confusion as to whether his lawyer was to have been at the hearing.

Accused Killer Makes First Court Appearance After Body Found

The bond hearing for Freddie Grant was held Friday morning at 9:30 at Alvin S. Glenn Detention Center. The judge did not actually set a bond, since that will happen in General Sessions Court. A date for that hearing has yet to be set.

When the judge asked Grant what his address was for paperwork purposes, Grant responded that his address was “the penitentiary”. When asked if he would like to be screened for a Public Defender, Grant replied he already had an attorney. He said he had been in contact with Fielding-Pringle but the Public Defender’s Office has yet to confirm this fact.

Grant was brough into Alvin S. Glenn Thursday night at 8:12 p.m. by the Richland County Sheriff's Department after he led authorities to the body of Gabbiee Swainson.

A similar type of deal was made in the Jacque Waller case, Clay Waller, her husband was convicted of a crime unrelated to her disappearance, and was doing the prison term in a federal penitentiary. He was originally charged with first degree murder in his wife's disappearance, but he made a plea deal in exchange for telling the authorities where he had buried her body.

At least  this families know where their loved ones are now, they would have never been able to find their bodies because their killers took measures to make sure their bodies were never going to be found.

There are only a few cases where the State have prosecuted a murder case without a body that have resulted in a guilty verdict. Defense lawyers can successfully argue that the alleged victims left on their own volition and they might still be alive, there is the risk of double jeopardy if the perpetrators are acquitted of the murder charges.

At least this case had a resolution, it is not the outcome her family and friends were wishing for. There is never closure, the family of these victims have to live the rest of their lives experiencing the emotions that their killers lack; feeling sorry, regret and remorse. They are always going to wonder what they could have done to prevent their loved ones untimely deaths.

A court hearing for Freddie Grant, the man charged with kidnapping and murder in the death of Richland County teen Gabrielle Swainson, will be 2:30 p.m. Wednesday before the Hon. Robert Hood at the Richland County Judicial Center.

Grant was charged in the girl’s kidnapping in late August 2012 and would not give any information on the girl’s whereabouts until last week, when he made a deal to have charges against his daughter, 27-year-old Dominique Grant, dismissed. Dominique Grant was arrested after being accused of helping her father cover up Gabrielle’s disappearance.

As part of that deal, Freddie Grant, currently serving a 17-year sentence on federal ammunition charges, was flown from a prison in Kentucky to the Midlands Thursday, where he showed investigators where Gabrielle was buried.

COLUMBIA, SC (WIS) - The man who kidnapped and killed Gabbiee Swainson will spend 30 years in state prison for his actions, after negotiating a deal with authorities. He will first serve 18 years at a federal facility before starting his state sentence.  

In front of a packed Richland County courtroom, Freddie Grant, 53, agreed to plead guilty and accept concurrent sentences of 30 years on charges of kidnapping and murder with no chance for parole in return for showing authorities where the 15-year-old's body was buried.

He faced up to life in prison.

"This case has deeply affected our community," said the judge. "I will go along with this negotiation because of the need for Gabbiee's family to have closure."

An indictment for murder signed by Fifth Circuit Solicitor Dan Johnson reads: "That Freddie Grant did in Richland County on or about August 18, 2012, willfully, feloniously, and intentionally kill the victim, Gabrielle Swainson, with malice aforethought, either express or implied, by means of asphyxiation, and the victim did die as a proximate result thereof.

Family and friends of Gabbiee have scheduled memorials in her memory. A candlelight vigil will be held in Elgin Wednesday at 8:15 p.m. It's at the Town Hall on Main Street.

Her funeral is scheduled for Sunday, Aug. 18. -- exactly one year after Gabbiee's disappearance. That will take place at Right Direction Church International on Broad River Road at 6 p.m.

Elgin was where Grant lived and where he buried Gabrielle’s body.

Visitation was Saturday to honor the life of Gabbiee Swainson.

The muggy morning air fit the mood at Greenlawn Funeral Home Saturday as heavy hearts honored a soul gone too soon.

"When they discovered her body I just couldn't even let it go," said Franciner Reiley. "I felt like I needed to do something and to come and show my support because it could have been anybody's child."

COLUMBIA, S.C. The man who kidnapped and killed a 15-year-old Columbia girl orchestrated almost every part of the crime, including a final attempt to frame someone else through the victim's cellphone that likely sealed his fate.

The Associated Press reviewed the investigative file in the Gabrielle Swainson case. It took months for prosecutors to produce hundreds of pages of documents requested through a Freedom of Information Act request. Part of the delay happened because Swainson's killer, Freddie Grant, is still being investigated in the disappearance of a second woman.

The documents show Grant planned almost every step of the attack and sexual assault and remained unhelpful and defiant until the end, when he agreed to plead guilty if prosecutors dropped an accessory charge against his daughter.

Grant is serving 30 years in prison.
