Judge: Bullets can be used against suspect in disappearance

COLUMBIA — Bullets seized at the home of a man accused in the disappearance of a Columbia teen can be used against him on a separate federal charge, a judge ruled Wednesday.
An attorney for Freddie Grant had argued that authorities withheld information from a judge who authorized the Aug. 21 search of Grant’s Elgin home. During that search, deputies found bullets and other ammunition that, as a convicted felon, Grant isn’t allowed to have.
Grant could face life in prison on the federal charge if a judge determines that his prior convictions make him an armed career criminal, and that trial is set for next month. He also faces a state kidnapping charge.

Gabrielle Swainson's Father Doesn't Think Missing Cheerleader Daughter Is Alive

The father of a 15-year-old South Carolina cheerleader missing since August doubts that she's still alive.
Gabrielle Swainson's father, Alvin Thompson, spoke to reporters after the suspect in his daughter's kidnapping was convicted on weapons charges on Tuesday, according to WLTX.
"I don't think she's alive," Thompson said. "There's been too much time."
Only one person can explain the disappearance, Thompson said, and that's Freddie Grant, a man with previous convictions for intent to distribute cocaine, aggravated assault and kidnapping.

Grant took Deputies to an area near the fire department in Elgin where deputies searched for Gabbiee's remains. The area was searched when Gabbiee disappeared last August and the FBI set up a command post there.
The body was taken to the Richland County Coroner's Office.
"It kills us because we failed to find her," said Lott. "Even though we could not have saved her life, when she was buried. It hurts all of us to know that many, many people walked that area.
"Many, many people looked in the exact same place where we found her." said Lott. "But the way she was concealed, you wouldn't know. The type of hole that he dug, the things he put on top of it. The cadaver dog would not have been able to find it at the depth that it was. We just couldn't find it. There's just no way of finding it without someone taking us to that area and showing us."

We've been in negotiations for quite some time with Freddy's attorneys," said Lott, referring to Johnson. "We have stood strong on what our offer was. We made an offer to them and haven't changed from day one. We had to do a lot of soul searching. It was almost that you're making a deal with the devil and it was tough."

"That was, I guess, the breaking point as far as to getting Freddie to lead us to where Gabbiee was at. My heart is breaking for this family and community. But if the deal with the devil is what it took to find her and bring her home then at least the family can have a proper burial for Gabbiee. I hope the family knows that there are many out there praying for and thinking of them as they start the healing process.

Dominique Grant, the daughter of murder suspect Freddie Grant, is out of jail and paperwork has been filed to dispose of the accessory after the fact charge against her.
Dominique, 27, was arrested and charged by investigators on July 11. Officials say she tried to help Freddie dispose of 15-year-old Gabbiee Swainson's cell phone by leaving it behind a Piggly Wiggly grocery store in Myrtle Beach.
Sheriff's investigators were still looking for Swainson's body at that time. The teen's remains were found weeks later in a deep grave in Elgin.
During a Thursday evening news conference, Sheriff Leon Lott credited Dominique's arrest with helping break the case wide open.

When asked if he would like to be screened for a Public Defender, Grant replied he already had an attorney. A similar type of deal was made in the Jacque Waller case, Clay Waller, her husband was convicted of a crime unrelated to her disappearance, and was doing the prison term in a federal penitentiary. Teams searching area in Elgin Thursday

Grant took Deputies to an area near the fire department in Elgin where deputies searched for Gabbiee's remains. The area was searched when Gabbiee disappeared last August and the FBI set up a command post there.
The body was taken to the Richland County Coroner's Office.
"It kills us because we failed to find her," said Lott. "Even though we could not have saved her life, when she was buried. It hurts all of us to know that many, many people walked that area.
"Many, many people looked in the exact same place where we found her." said Lott. "But the way she was concealed, you wouldn't know. The type of hole that he dug, the things he put on top of it. The cadaver dog would not have been able to find it at the depth that it was. We just couldn't find it. There's just no way of finding it without someone taking us to that area and showing us."

We've been in negotiations for quite some time with Freddy's attorneys," said Lott, referring to Johnson. "We have stood strong on what our offer was. We made an offer to them and haven't changed from day one. We had to do a lot of soul searching. It was almost that you're making a deal with the devil and it was tough."

A point where this case took a very important turn was where Freddie's daughter, Dominque, was arrested," said Lott. "That was, I guess, the breaking point as far as to getting Freddie to lead us to where Gabbiee was at. So I don't want anybody to think he did this out of his conscience or he felt bad for Gabbiee or Elvia or this community. He didn't do that. He did it solely because his daughter was arrested and she was facing some very serious jail time. That's what we needed."

My heart is breaking for this family and community. But if the deal with the devil is what it took to find her and bring her home then at least the family can have a proper burial for Gabbiee. I hope the family knows that there are many out there praying for and thinking of them as they start the healing process.
At least this families know where their loved ones are now, they would have never been able to find their bodies because their killers took measures to make sure their bodies were never going to be found.
There are only a few cases where the State have prosecuted a murder case without a body that have resulted in a guilty verdict. Defense lawyers can successfully argue that the alleged victims left on their own volition and they might still be alive, there is the risk of double jeopardy if the perpetrators are acquitted of the murder charges.
At least this case had a resolution, it is not the outcome her family and friends were wishing for. There is never closure, the family of these victims have to live the rest of their lives experiencing the emotions that their killers lack; feeling sorry, regret and remorse. They are always going to wonder what they could have done to prevent their loved ones untimely deaths.

ELGIN — The same day Freddie Grant was sentenced to 30 years for the murder of Richland County teen Gabrielle Swainson, hundreds gathered in Elgin to light candles and remember the girl.
Elgin was where Grant lived and where he buried Gabrielle’s body.
“It’s just hard to believe something like this could happen so close,” said Monica Barber with tears in her eyes. Barber teaches at Jackson Elementary and has a 6-year-old daughter.
