Nicole Pietz--Found Deceased On Feb. 6, 2006
Nicole Pietz was found discarded under blackberry bushes on the afternoon of February 6, 2006. She was 32 years old. She had been 'missing' since January 28, 2006.
Her husband is currently on trial for her murder.

Martin "David" Pietz has been charged with second-degree murder. He is being held on $1 million bail.
The 33-year-old Lynnwood woman disappeared in Jan. 28, 2006 after leaving home. A week later, a hiker found her body in Burien, dumped in a field of overgrown blackberry bushes. Two weeks later, her car was discovered at a parking lot in Seattle's University District.
An autopsy revealed Nicole Pietz had been strangled, but her killer was never found.
David Pietz, who was the last person to see his wife alive, had said that when he woke up around 8:20 a.m. on Jan. 28, 2006, his wife had already left. But forensic evidence showed Nicole Pietz likely died around midnight the morning of Jan. 28 -- a time when David Pietz claimed his wife was asleep in their bed, investigators said.
David Pietz also failed a polygraph test, and when detectives asked him to retake the test, he refused and hired an attorney.

"My daughter was murdered and left in the woods to rot," said Gael Schneider, the mother of Nicole Pietz.
Nicole's body turned up in the woods of Burien in 2006. It took nearly 7 years, but prosecutors finally believe they have enough evidence to convict David Pietz for the murder.
Schneider waited many years to confront her son-in-law from the stand. She also described his behavior at Nicole's funeral.

Here are a couple of YouTube videos from the JVM show where Jane devoted a portion to Nicole. While I'm glad to see that she is covering the case, I'm disappointed in the discussion. They don't seem to understand that circumstantial evidence can and should be treated by the jury exactly as they would treat direct evidence.
I'll just add a little portion of the judge's instructions to the jury on another case I followed recently:
Quote: "With regard to the types of evidence, folks: There are two types of evidence from which you may find the truth as to the facts of the case—direct evidence and circumstantial evidence. Direct evidence is the testimony of one who exerts actual knowledge of a fact, such as an eye witness. Circumstantial evidence is proof of a chain or group of facts and circumstances, indicating the guilt or innocence of a defendant.
The law makes no distinction between the weight to be given to either direct or circumstantial evidence. Nor is a greater degree of certainty required of circumstantial evidence than of direct evidence. You should weigh all the evidence in the case. After weighing all the evidence, if you are not convinced of the guilt of the defendant, beyond a reasonable doubt, you must find the defendant not guilty."
Another thing, one of Jane's guests said there was nothing in the car--well, there was. Mr. Pietz DNA was the predominate DNA. Predominate! Now why would that be if Nicole was the last person driving that particular vehicle?
Anyway, here are the videos--disappointing though they may be. (Just one more thing--the state is only about half way through presenting their case. There is more to come.)

On Friday afternoon— January 27, 2006—Nicole Pietz took her vehicle into LesSchwab Tire Center. They recorded her mileage as 44,384. When law enforcement recovered the Jetta on February 22, 2007; the total mileage showing was 44,451.
Thus we know that the car was driven a total of 67 miles by someone after Nicole left LesSchwab Tire Center, located at 19401 Bothell Everett Hwy, Bothell, WA 98012.
The state had Detective John K. Pavlovich testify at trial to the following:
The distance from Les Schwab Tire Center to Taco Time to Nicole’s condo equals 5.6 miles. (A dated, time stamped receipt was found from the Taco Time in the Jetta, and Nicole’s stomach contents confirm that she had eaten there. They believe these 5.6 miles on the Jetta were put on it with Nicole driving.)
Next:
From the condo to the King of King’s Church is 35.3 miles.
From the King of King’s Church to where Nicole’s body was found is 8.9 miles.
From where Nicole’s body was found to where the Jetta was recovered is 18.2 miles.
The underlined mileage totals 67.7 miles.
The state tossed out the idea that he may have been driving around looking for a place to do what he had to do—which was dispose of Nicole’s body. I find this highly probable, and the 'theory'—by the way—was objected to by the defense and sustained by the judge.
If you look on Google maps at both locations—the King of King’s Church in Renton and the site where Nicole’s remains were found in Burien—you can see that they both have woods around/behind them.
The interesting thing about the King of King’s Church is that this is where Nicole was heading on Saturday morning for the AA celebration of her eighth year of sobriety.
Now, I have mapped it myself on Google maps, but I couldn’t get the various routes to match exactly with what Detective Pavlovich said. (See at around 9:20 in the video.) He dug this case out of the cold files and drove all the routes himself, under similar weather conditions, and during the times he felt the crime had occurred. I applaud Detective Pavlovich and apologize for my maps not matching his exactly.

While this map is not as accurate as the one above, I couldn't resist adding it as I think it gives the best indication of the distance her car traveled.
"A" is the condo where Nicole lived with the defendant, "B" is the site where Nicole's remains were found, and "C" is where Nicole's Jetta was discovered.
The red "X" with the circle around it is the approximate location of the King of King's Church where it is thought the defendant may have driven to first--possibly scouting it out as a dump site; then deciding against it and driving to the dead end street in Burien instead.

Personally, the highlight of the day for me was Gael's testimony. The defense attorney recalled for her the various antics she'd subjected David to over the years since Nicole's death. For those that aren't aware, she has confronted David at at least 2 of his employers asking how David could look himself in the mirror along with informing his coworkers that they work with a murderer. She and a friend left a wig with red lipstick on it on David's doorstep at the condo and has made several phone calls to him just after midnight - the time she strongly feels he murdered Nicole late Saturday, early Sunday of January 28th/29th 2006. There very well could be more instances that I'm not aware of, but I offer these as examples of what she admitted to on the stand today. No matter how the attorney came at her with these, she stood tall and proud and entirely unapologetic for her actions. I think he may have been trying to cast her in a poor light for the jurors, but for me, she came across as a protective mama bear willing to do anything for her precious cubs. Go Gael

- VELEZ-MITCHELL: Tonight breaking news. Stunning new police interrogation tapes played in the brutal murder trial of a beautiful suburban wife. Prosecutors saying this handsome hubby murdered his wife more than seven years ago so he could keep having a slew of mistresses on the side but no longer on the side because she`ll be dead.
Nicole Pietz vanished from her Washington home back in 2006. Days later she was found naked and strangled in the woods. Cops say she disappeared the very same day she found out her husband was cheating on her. Prosecutors have laid out evidence that David Pietz was a serial cheater. Four different women testified that he was having affairs with them, one even dating back to when he was newly engaged to his wife.
Husband David Pietz claims his wife who was eight years sober left home for an AA meeting to celebrate her sobriety birthday and never came back. Then he suggested she took a bottle of pain killers -- Percocet, right -- and OD`d. Listen to this part of his interrogation tape played in court from ABC News.

PIETZ: So many pills, I don`t know if I was just hoping she did or I was thinking she flushed them down the toilet.

VELEZ-MITCHELL: Straight out to the "Lion`s Den", Jon Leiberman, is he really suggesting that his wife took her clothes off, got naked herself, took a bunch of pills strangled herself and then tossed herself in the woods?
JON LEIBERMAN, HLN CONTRIBUTOR: Well, you said it. Look, the bottom line is this. Circumstantial cases can be won. They`re much more difficult. Yes this case is entirely circumstantial but there is a lot of evidence and at the heart of it is the credibility of this alleged killer.
I mean I went through the court documents and you look at it, for one, a major thing is this diamond tennis bracelet that he claims disappeared when she disappeared but then six years later it turns up in his possession. He fails a lie detector test about it. He lies about, you know, not having any affairs and then all these women take the stand. He says he`s not into drugs.
VELEZ-MITCHELL: Jon --
LEIBERMAN: Yes.
VELEZ-MITCHELL: There is a smoking gun here that I think is absolutely extraordinary, all right. We`re going to get to it now because it`s really unbelievable. It`s like something out of "Murder She Wrote".
Minutes after learning his wife`s body was dead -- found dead -- ok, David Pietz is interrogated by cops. Detectives say it looks on the surface like he might have broken down and sobbed during this investigation. Listen to this and watch carefully -- from ABC.

VELEZ-MITCHELL: Ok. Well, yes, basically the detective is saying that it looked like he was crying but when he looked very carefully there were no actual tears. But here is the smoking gun and I want to throw this to Ebony Williams. This is unbelievable.
When the body is found naked and strangled in the woods, Nicole is wearing a mouth guard that she never wore except when she was going to sleep. So first of all, who goes off to an AA meeting to celebrate their sobriety birthday and then decides I`m on my way to celebrate my sobriety birthday, I`m going to go get stoned. As a person who`s 18 years sober, I can tell you, that`s not the moment when you decide to go out.
And secondly, who goes wearing the mouth guard that they only wear when they`re sleeping. What does it tell you Ebony?
EBONY WILLIAMS, ATTORNEY: Well it tells us that he`s clearly lying about that part of it. He`s got to be a criminal defense attorney`s worst nightmare because he`s talking too much, you know, cardinal sin as a defendant talking way too much. It`s not this guy`s job to figure out the theory of the case. That`s the prosecutor`s job let them handle that.
But what he`s doing in his statement, he`s giving away too much evidence, you know, showing himself to be a liar to the gentleman`s point earlier, credibility completely undermined and now we don`t believe him. Even though it`s strictly circumstantial.
VELEZ-MITCHELL: It tells me that she was in bed when whatever bad thing happened to her happened. She did not go off to an AA meeting. She was wearing her mouth guard, she was asleep in bed and something interrupted her life. Stay right there. We`ll be back on the other side.

VELEZ-MITCHELL: But the jury`s already heard from four women who testified about his cheating ways while married to Nicole. And, again, one of his mistresses testified that this women slipped his wife Ecstasy to try to get her in bed to have a threesome.
Back out to the "Lion`s Den", Heather Hansen, criminal defense attorney, a terrible thing if true but it doesn`t -- a cheater doesn`t make a murderer necessarily.
HEATHER HANSEN, CRIMINAL DEFENSE ATTORNEY: That`s right, Jane. We have plenty of direct evidence that he was a jerk, plenty of direct evidence that he was a cheater. What we don`t have is direct evidence that he killed her. You talked about how she had her mouth guard in. There`s no evidence of a struggle in the house. There`s no DNA evidence whatsoever and in fact, there`s a fingerprint of a third person found in her car.
So the prosecution is going to have to overcome all of that in order to make this case stick.
VELEZ-MITCHELL: J. Wyndal, the mouth guard to me is the smoking gun.
J. WYNDAL GORDON, CRIMINAL DEFENSE ATTORNEY:I think so, too, Jane. I don`t think the case is that complicated. His defense attorneys would do him well to be trying to consider some type of plea bargain in this situation. How is she going to have a mouth guard, how is she going to be naked, how is she going to be strangled, all --
VELEZ-MITCHELL: Yes, but it doesn`t necessarily point to him. That`s the problem. Yes. It`s all very suspicious, but six years have passed --
GORDON: A mouth guard? Doesn`t she go to bed with a mouth guard to keep from snoring? Isn`t that what that`s for?
VELEZ-MITCHELL: I agree with you but would you convict on that basis?
GORDON: I think circumstantially, you can consider that evidence and I think it militates towards a conviction more so than whatever defense he has of not being the one responsible.
VELEZ-MITCHELL: All right. I don`t know.
GORDON: And I`m a defense attorney. That is the rule.
VELEZ-MITCHELL: Beyond reasonable doubt. It`s very suspicious.

PINSKY: Welcome back. Co-host, Jenny Hutt, stays with me. David Pietz (ph) is on trial for strangling his wife then dumping her naked body in a field. Prosecutors say Pietz had a bunch of affairs. One of his lovers claims he had drugged his wife to coax her in to having a threesome. Good times. Now, a piece of evidence surfaced that may help the prosecutors put him away. Take a look at this.

UNIDENTIFIED MALE: She was eventually found beaten and strangled on the side of the road. Cell phone tracking provided enough evidence to charge Pietz with murder.
UNIDENTIFIED MALE: Suspicious cell phone call after the disappearance made with Nicole`s phone which was never found. This was her husband, David, caught on surveillance tape three minutes before midnight on a seemingly odd shopping trip.

PINSKY: Back with us, Mark, Lynn, Danny, and Areva. Lynn, I think -- I believe you`ve been following this case along with us. You have a reaction to this guy?
LYNN BERRY, HLN ANCHOR: Well, I mean, I think the long list of women proves he`s a scumbag. I don`t know if it proves he`s a murderer, and I think that -- really hard with the evidence that we know. The Drano. A lot of scumbags out there. You know, they don`t necessarily mean they`re murderers.
The Drano trip, I mean, if he was buying seven bottles of bleach and a whole bunch of other things, maybe that would be to cover up a crime scene, it`s that cell phone ping. It was a tower near where he worked, a gym where he worked, and it was with her cell phone. That was never found. So, they`re trying to link the two, but the defense quickly jumped on that and said that was a cell tower that was under maintenance because they were having some troubles.
So, that can totally throw that evidence out. And then, there`s also a little piece of DNA evidence that they`ve found in her car, his DNA in her car. It`s her husband. I don`t know how strong that`s going to be. So, it doesn`t seem like they have the smoking gun here.

- PINSKY: And Mark, I heard your -- Mark had a peshaw at Lynn`s comment about the scumbag. Go ahead.

MARK EIGLARSH, SPEAKTOMARK.COM: No. Yes. She articulated exactly what I wanted to say, but it`s such a loving, wonderful way. Yes, if this was you`re guilty or not of being a scumbag, they`d have proof beyond all doubt. Where they fall short is how that Drano links back to any crime scene. It`s not there. It`s crazy behavior. Midnight buying Drano, but it could have been doing some cleaning.
And also, the ping as Lynn just said, you know, there was some problems with the cell phone tower. So, the question is, where`s the smoking gun? I read through all this material, I have yet to find one thing where I go, oh yes, no, they`ve got a proof beyond a reasonable doubt in court. I don`t see it.
PINSKY: And Danny, isn`t it true that this all happened years before they ever came after, the spouse?
DANNY CEVALLOS, ATTORNEY: Yes. And there`s a lot of talk about how the time distance -- the elapsed time is bad for the prosecution, but the reality is when the prosecution waits to indict a defendant, the prejudice is really against the defendant. And imagine if you were arrested for something that someone said you did seven years ago and trying to piece together, even with an investigator what the heck you were doing seven years ago at different hours of different days.
In all of these cases where the prosecution waits and sits on an indictment and indicts several years later, the prejudice may be to the prosecution, but ultimately, far more to the defendant.
PINSKY: And Areva, apparently Pietz failed a polygraph test. Do you have any thoughts on that?
AREVA MARTIN, ATTORNEY: He`s a liar. Those are my thoughts. He`s a liar. He said he had a low sexual libido and he wasn`t that into sex, but he had four women were paraded into court saying that they had sex with him. But my question, Dr. Drew is, when did murder become the way you deal with a problem relationship?
We see case after case where people don`t want to be married. And rather than getting a divorce, we hear these, you know, allegations of murder. So, these cases are just puzzling to me. And you, as a doctor, tell us why guys, mostly guys, not picking on men, but so often, men trying to kill their wives when they just want to have an affair?
JENNY HUTT, ATTORNEY: Right. It`s the weirdest thing. Dr. Drew --
EIGLARSH: Tell us, Drew. Why are men doing it, Drew?
(LAUGHTER)
(CROSSTALK)
HUTT: Dr. Drew, does this -- Wait. Does this mean that --
PINSKY: Mark, you swore me to secrecy on this one, Mark. I promise I wouldn`t tell the secret.
(LAUGHTER)
BERRY: Throw it back to Mark.

HUTT: But Dr. Drew, does this mean that now, as women, we`re going to have to say to our men before we get serious or when we get serious, look, I hope you don`t have an affair, but like if you decide to, just promise me you won`t then also kill me.
MARTIN: -- psychological exam, Jenny. Do they need to take a test? Do I need to go home and say, honey, I need you to run to the doctor immediately so I can see if you`re going to kill me if I don`t wash the dishes.
PINSKY: I will tell you what --
HUTT: Exactly. Don`t have an affair and also don`t kill me.
PINSKY: I have two sort of rejoinders to this. One is evaluate your own pickers. If you have a history of picking problematic men or if you had relations with problematic people in family of origin that sort of set your love map towards guys that are problematic, Areva, maybe your sort of precaution is very appropriate.
If you come from a healthy background and you have healthy relationship, you really don`t have to worry about this kind of thing so much. But let me propose before I go to break, why are we looking at the spouse here and there. A bunch of women that wanted to get rid of this lady, as well, right? They all wanted this guy for himself.
BERRY: Oh.
PINSKY: No?
MARTIN: But we don`t have any women being charged with murder of this woman, Dr. Drew. We have this husband being charged with the murder. So, I don`t think we can equate that to these women. Now, they`re bad actors, too. I don`t condone, you know, women having affairs with married men. So, these women aren`t the best, you know, women to be, you know, paraded in to court.
So, they`re making us look bad, us that have been in monogamous marriages for many, many years like myself. So, I`m not going to give them a parade.
PINSKY: All right. Fair enough. Next up, one of Nicole Pietz`s co- workers, this is wife`s co-worker, was at the funeral. She is here with some interesting things to say about the husband`s behavior. We`ll be right back.

PINSKY: Too late to back out of it. "Behavior Bureau" is here. Back with my co-host, Jenny Hutt. Samantha, Daneen, and Tiffanie are with me. And that, which is one of the four women who testified she had been intimate with David Pietz. He is on trial for the murder of his wife, Nicole.
Let me just say for the panel, particularly, I guess Tiffanie, you and I are the licensed mental health people here. When you do unhealthy -- when you engage in unhealthy behaviors, unhealthy things tend to happen, right, Tiffanie? Am I right making that point? There`s a reason we have - -
TIFFANIE DAVIS HENRY, PH.D., PSYCHOTHERAPIST: For sure.
PINSKY: -- things that are healthy spiritually and personally --
HENRY: You`re absolutely 100 percent correct.
PINSKY: Yes. You end up in a bad place when you start behaving in ways that`s unsavory, unthoughtful to the people you`re supposed to care about.
HENRY: For sure. You know what, Dr. Drew? I say all the time. You have what you`re committed to. You have what -- what you have in your hands, what you have in your marriage, what you have in your relationship is what you`re committed to, and if you`re committed to chaos, if you`re committed extramarital affairs, if you`re committed to giving your time outside of that relationship, guess what, your primary relationship is going to suck.
You`re not going to like it. It`s not going to be what you want it to be, and this guy was spending so much time outside of his marriage that, of course, his marriage wasn`t what he wanted it to be, but that in and of itself does not say you harm or kill your wife. It does not.
PINSKY: Preach, Tiffanie. Jenny.
HUTT: She`s correct. She`s right about that. however, leading up to when a woman or girl finds a right guy, she`s going to make a lot of many mistakes, Dr. Drew. Much of the time and maybe be with some not so savory people in the moment and then find her way to the right guy. I think that happens all the time, too. I think to say that every time you`re in a bad relationship that doesn`t work --
HENRY: That`s how we learn, for sure.
HUTT: That you`re going to end up being that`s forever, and I`m not sure that`s what you`re saying, but I just don`t think that`s true.
PINSKY: But I can`t resist. Danine has that grin again. Go ahead, Danine.
DANINE MANETTE, AUTHOR, "ULTIMATE BETRAYAL": The fact that there was a line of mistresses wrapped around the courthouse, you know, that were OK sleeping with a married man is just pathetic to me. But, with that being said, you know, it`s not just men out there that are running around. We have the Andrea Schneiderman trial, remember?
There are a lot of women out there that are stepping out on their husbands as well, and they are just as pathetic. So, this is not just a man thing. This is just a pathetic individual thing.
PINSKY: Now, joining us on the phone, I have Julie. She was a friend and former co-worker of Nicole Pietz. And Julie, you actually saw David at Nicole`s funeral. Can you tell us -- you observed something about his behavior.
VOICE OF JULIE, NICOLE PIETZ`S FRIEND: Yes. Absolutely. Actually, my mom`s the one that pointed it out to me recently because I didn`t quite remember until she said something. But we were sitting in the front row adjacent to Nicole and -- Nicole`s -- I`m sorry -- Nicole`s family and David and he was completely emotionless at the funeral. Not crying. Nothing. Just sitting there. So, I thought that was --
PINSKY: Yes. It`s kind of peculiar. Sam, I wonder if you have a question for Julie?
SAMANTHA SCHACHER, SOCIAL COMMENTATOR: I do. Julie, yes, he was calm, cool and collected. I found that very odd, too, but I also found, really weird, that he didn`t help participate in looking for her. Am I right about that or putting up flyers?
JULIE: Oh, yes. You`re right about that. I would say about 10 or 15 of us gathered at a mall that was downtown Seattle called West Lake Center because that was the last place that her cell phone was tracked. This is before her body was found, and we all gathered there and we passed out flyers one afternoon in the rain for -- I would say four or five hours.
And he was nowhere to be seen. And another group did it up on Capitol Hill, another area of Seattle. He was nowhere to be seen with that group either.
SCHACHER: That`s weird.
PINSKY: Julie, did she have suspicions or did she ever talk to you about his carrying on with other folks?
JULIE: No. Unfortunately, I don`t have any information as far as that goes. You know, we just had mostly work banter back and forth, friendly, you know, hey, how`s it going? I actually lived in the same apartment as her and him before they moved to the condo that they lived in this last time, but -- and then I worked out of the same gym as her and I worked with her. So, I would see her all the time.
PINSKY: And no evidence that she was worried about this marriage or - - you know, sort of upset by this guy`s behavior.
JULIE: No. No.
PINSKY: Thank you, Julie. We do appreciate it. I`ve got to go to break and we`re going to talk more about these mistresses after this.

PINSKY: Back with my co-host, Jenny Hutt, and Sam, Danine, and Tiffanie on the "Behavior Bureau." David Pietz on trial for the murder of his wife, Nicole. Friend says that just weeks after his wife`s body have been discovered, David asked if it was too soon to go on a date. Tiffanie?
HENRY: A hot mess, Dr. Drew. There`s no way that if you`re grieving that`s what you`re thinking about. I have seen many aggrieving person on my couch who the last thing that they thought about was sex, let alone, entering into a relationship with anyone else. And, if they did think that and feel that, they haven`t said it out loud.
To say that out loud to a random person, a co-worker, whomever, is just totally inappropriate and it really does bring into question, his judgment and also, you know, his character and whether or not he did this.
PINSKY: Danine, it really does throw up on a lot of questions, plus, all the women that are coming forward, don`t you agree?
MANETTE: Yes. And it`s just so pathetic. It`s so ridiculous that some women are so desperate to have a pair of pants in the house, that they`ll just take any philandering pig. And these are the same women that turn around and talk about all men are dogs and I can`t find a good man. Well, you can`t be part of the problem and then expect to be part of the solution. You know? So, it`s like I don`t even want to hear it.
(CROSSTALK)
HENRY: -- but if you`re feeding dog, it`s going to keep coming back at you.
HUTT: It is more his fault than it is theirs. He`s the one with the duty to his wife. They don`t have a duty to her.
MANETTE: Yes. But you can`t complain about -- the men are cheating with somebody. You can`t complain about men being dogs if you`re laying down for them.
PINSKY: There we go. So, Sam, that`s what I expect from you guys. Eventually, you blame the women in this. Somehow, you --

PINSKY: I think they could be the murderers. They could be. It`s possible.

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us.
Bombshell tonight. To the upscale Seattle suburbs. Family, neighbors, co- workers stunned when the body of 32-year-old Nicole is found naked, still wearing her dental retainer from the night before. She`s lying naked out in a field of blackberry bushes 30 miles from the condo she shared with her younger husband of four years, Martin.
Now, cops immediately search for random sex attackers, but then they get a tip. Did her husband, Martin, go get her diamond tennis bracelet appraised after he tells the cops she was wearing it when she went missing? Now, how is that possible? If she went missing and was killed wearing the tennis bracelet, then how does he pop up with that same tennis bracelet getting it appraised? Tip number one.
After our digging, we find out he had also tried to push her into having threesomes, three-way sex experiences, that he put ecstasy in her drinks, her non-alcoholic drinks at bars to, quote, "loosen her up."
And to Dave Mack, morning talk show host, WAAX. Is it true -- this is not a character assassination, I`m just trying to find out the nature of their relationship. Since he`s popping up with her tennis bracelet, is it true that computer forensics reveal he`s on AdultFriendFinder, Ashley Madison, which is when married people try to hook up for sex with other married people, and various -- Match.com and porn sites. What do you know, Dave Mack?
DAVE MACK, WAAX, CLEAR CHANNEL: He was doing exactly that, Nancy. And the sick reality is that he was touring all those sites, he`s trying to hook up -- he`s actually researching and Googling how to cheat on your spouse or girlfriend, you know, and how to find...

GRACE: Dave, I`m not hung up on his sex life, but it`s giving me a window into their relationship. I mean, if every man that went on AdultFriendFinder or Ashley Madison went to jail, well, OK, there would be no men to work on the outside, they`d all be in jail. Come on, Dave Mack, can you honestly say you`ve never looked at a little sexy site on line? I mean, come on! You`re a man. I want to get...

MACK: Nancy, I appreciate the accusation, but not all of us do that, just FYI.
GRACE: Good to know.
MACK: However -- and it doesn`t indicate that he`s a murderer, either. But what it does indicate...

MACK: Maybe your husband`s being truthful, Nancy.
GRACE: Maybe he is!
MACK: Here`s the deal, Nancy. You know what? The sick part about this is she was sober for eight years from a pill addiction, and he`s drugging her non-alcoholic drinks. She was going to pick up her eight-year chip (ph). And for somebody who`s been sober for 23 years, that`s a big deal, eight years. And he`s drugging her so that he can have his way sexually with her, and he`s trying to find ways to pull other people into the relationship. The guy`s a scumbag.
GRACE: You know, very often, we say, OK, the guy`s a scumbag, but -- is he the obvious scapegoat? I want to look at the evidence?
Dave Mack joining me from WAAX, morning talk show host. Also with me, Jean Casarez. Jean, take it from the top. What do we know? I know that she had worked that day, that a co-worker, a male co-worker, came in to where she was in the break room, and she was crying. And she had back ailments, but she had to stand up all day for her job at the wireless phone store.
And he goes, What`s wrong? She goes, I think my husband`s having an affair. OK, he was, like, awkward! And leaves. I know that happened.
I know she had a taco dinner, possibly drive-through, because they found it in her stomach. The medical examiner found it. What else do we know?
JEAN CASAREZ, HLN LEGAL CORRESPONDENT: That`s so significant, what you just said right there, because about 6:25 in the evening, she went to Taco Time, got a Mexican dinner, took it home. Her husband admits -- Martin admits that he was virtually the last one to see her because he got home from work, he says about midnight, and she was in bed asleep.
GRACE: OK, Jean, wait. They`re both working adults, right? He`s a little bit younger than her. She`s, like, 32. What are they doing out on a weeknight at midnight?
CASAREZ: Well, he was working until around 10:00, and then he goes to the supermarket to get Drano...
GRACE: OK.
CASAREZ: ... and Kentucky`s hard lemonade liquor. But here`s what`s significant. That dinner was still in her stomach, and that window shows that her death was very close in time to that midnight hour.
GRACE: OK, let me see Jean Casarez again, please. Jean, let me get this straight. She goes to work. She has this discussion with a co-worker that day in the break room. She goes, we think, for fast food, Taco Bell or something like that, gets home. I know that she got ready for bed and went to bed because she had her retainer on.
CASAREZ: Right.
GRACE: She didn`t have on any PJs because she was naked. But I know she had that retainer in her mouth that she wears at night when her body was found. It shows me that she was either in bed asleep or getting ready for bed when she was attacked.
CASAREZ: Exactly.
GRACE: And he`s out to midnight. Now, he works at a what, a 24-hour fitness health club?
CASAREZ: Yes, he did. He did. One other thing, Nancy, that`s significant, her wedding ring was in cleaning solution by the nightstand. And that`s what she did every night before she went to bed. And that`s what...
GRACE: So every night puts the wedding band -- you know, very, very quickly to Dr. Eris Huemer, psychotherapist, joining me. To me, that`s significant, that she still was in the relationship, because she would take -- you know, a lot of times in the tabloids, you see, Oh, the ring is off, with all these stars that are having marital problems. She thought so much of it, she put it in cleaning solution by the bed every night.
You know what`s by my bed? Pictures of my children and a water bottle. She had her wedding ring by her bed every night in cleaning solution. Now, that strikes me. I`m not a shrink like you. I don`t know what it means. What does it mean?
ERIS HUEMER, PSYCHOTHERAPIST: Well, I think that she definitely -- it sounds like she was in love with him, but that she just found out that he had a double life. He had a double life prior to them getting engaged. And his affairs, his alleged affairs, continued throughout the marriage. So it sounds like to me that this was a crime of passion, that possibly -- because she had said something to the people at her work that night, and possibly that she confronted him that night before he murdered her, that possibly, he talked about the affairs right then.
GRACE: You know, I want to go back to Jean Casarez. Jean, you were talking about the window, the timeline window, and you mentioned that he got off of work at 10:00 o`clock that night. When was her body found?
CASAREZ: It was found several days later, but it was found in a field. And the legal documents say it was carefully laid there, and the bottom of her feet, Nancy, were completely clean. So she did not walk onto that field at all.
GRACE: You said something extremely significant, Jean. You just said her body was laid there. In all my years of prosecuting, the person that stages a crime scene, that lays someone out artfully, knows the person.
Now, I don`t necessarily mean husband or wife, it could be the delivery boy, it could be the newspaper boy, it could be the guy at the checkout. It could be, you know, somebody that lives on the floor above you.
But there is a relationship because if it`s a random killer, they don`t care. They`ll just leave the body and get the "H" out of there.
CASAREZ: Yes.
GRACE: Staging is something altogether different.
Unleash the lawyers. Joining me tonight, veteran trial lawyer Anne Bremner. She practices in the Seattle area. Also with me tonight, defense attorney Peter Odom out of the Atlanta jurisdiction.
All right, Peter, let`s hear from you first.
PETER ODOM, DEFENSE ATTORNEY: OK. This is a crime in search of evidence. They have a completely circumstantial case against him. And evidently, what the prosecutors want to do, what they mean to do is smear his character and hope that the jury will hate him so much that they`ll convict him of a murder that he didn`t commit.
GRACE: Did you say it`s just circumstantial evidence? That`s a yes, no question.
ODOM: Yes, that is what I said.
GRACE: All right, Peter...
ODOM: Because that`s what it is.
GRACE: ... I know that you`ve tried many, many cases...
ODOM: Yes, that`s exactly what it is.
GRACE: ... as have we all. But isn`t it true that the judge will instruct a jury in every criminal case that circumstantial evidence is to be weighed with the exact weight as direct evidence? Under the law, circumstantial evidence is not inferior to direct evidence. Isn`t that true?
ODOM: Provided that it excludes all other rational inferences. That`s how the instruction goes.
GRACE: That`s right.
ODOM: There`s no way that the prosecutors can succeed in this case...
GRACE: So could you answer my question, Peter?
ODOM: I think I did. I think I did, Nancy.
GRACE: No! The answer is...
ODOM: It`s not the answer you wanted...
GRACE: No, the answer is truthful, yes, judges must instruct juries in criminal trials that circumstantial evidence is to be weighed equally with direct evidence...
ODOM: Correct.
GRACE: ... unless -- unless the evidence does not outweigh the hypothesis of innocence.
ODOM: Of innocence.
GRACE: That -- that -- is a direct quote from the law, Peter, is it not?
ODOM: And that`s exactly right. And that`s what`s going to save this man`s life...
GRACE: My point is...
ODOM: ... because there`s so many rational inferences that can be drawn that point to his innocence, not his guilt.
GRACE: And that would be what?
ODOM: And the law saves him here.
GRACE: So what would those points be pointing to his innocence?
ODOM: How about this, Nancy, that...
GRACE: What?
ODOM: ... it`s not illegal to have an affair.
GRACE: How does that point to his innocence?
ODOM: The prosecutors just want to drag these women up there...
GRACE: No, I`m asking you, how does him sleeping around, feeding his wife ecstasy in her non-alcoholic drinks, trying to force her into threesomes -- how does that point to innocence?
ODOM: Here`s another point, Nancy. This is a criminal trial. The state has to prove his guilt. He doesn`t have to prove his innocence.
GRACE: True. That`s very true.
ODOM: The state has the burden of proof.
GRACE: But my question to you was -- you said there`s so much pointing to his innocence. Just name one thing!
ODOM: Nancy, the fact that there`s no evidence shows that he`s innocent.
GRACE: OK, so you don`t have anything. All right...
ODOM: The fact that there`s no evidence of his guilt.
GRACE: ... fine. Give me an alibi. Give me an alibi. Give me anything.
ODOM: He doesn`t have to present an alibi. He doesn`t need to present anything.
GRACE: OK, so you have -- you got nothing?
ODOM: The state has nothing.
GRACE: All right. All right. Great. Great. All right, Anne, let`s hear from your side.
ANNE BREMNER, DEFENSE ATTORNEY: Well, I`d say objection, Nancy. I mean, none of this evidence that we`re hearing about right now should be admissible. Just because he`s a creep and has affairs doesn`t make him a killer.
I mean, the fact of the matter is, he had affairs before he gets married, he has affairs afterwards, and he`s on all the Web sites. So what? That shouldn`t even come into evidence. We don`t know if it`ll come in or not, but it shouldn`t. I say objection on that.
But everything else we`ve heard about, like, what about what he said about the diamond bracelet? You know, that`s another so what. So basically, he goes and has it appraised. There`s a dearth of evidence in this case.
GRACE: No! No! That`s not the point, Anne. I`ll give you guys the point about the diamond bracelet.
BREMNER: OK.
GRACE: The point is about the timing, the timeline. The point is that after he says to police, She`s got on this diamond bracelet I gave her when she goes missing, then a few days later, he`s got the bracelet and he`s getting it appraised. He lied!

GRACE: Welcome back, everyone. Tonight, who is speaking for 32-year-old Nicole Pietz? Certainly not her husband. Her body was found completely naked 30 miles from their condo, that I might point out she put the down payment on. Yes, it`s in both of their names. But I dug into this. And I found out it was her savings and put up by her family to make the down payment on their condo and to pay off his car.
OK, neither here nor there. Her body is found out in a blackberry field wearing -- Jean Casarez, wearing nothing but her dental retainer that she wore at night. Now, doesn`t that say to you, Jean -- doesn`t it give you a little bit of a clue as to who`s responsible?
CASAREZ: Yes, completely no clothes at all, pristine condition, her feet completely clean. But Nancy, let`s talk about her injuries. She was beaten so bad, her face, her torso and her legs, and it was asphyxia due to strangulation was the cause of death.

UNIDENTIFIED FEMALE: He gave a 94-minute statement to police and broke down one time during that recording.
UNIDENTIFIED MALE: I don`t have much of a libido.
UNIDENTIFIED FEMALE: The police statement contradicted four women saying they`d either made out or had sex with him when he was married.
UNIDENTIFIED FEMALE: We had sex.
UNIDENTIFIED FEMALE: And is that the only time that it happened?
UNIDENTIFIED FEMALE: Yes.
UNIDENTIFIED MALE: Nicky (ph) Pietz vanished. After a massive search, her body was found dumped in a wooded area. She was naked and had been strangled. Prosecutors contend her husband was unhappy with their marriage and killed her during an argument the same day she found out he`d been having an affair.

GRACE: Welcome back. For those of you just joining us. Who is left to speak out for Nicole Pietz? The cause of death was asphyxiation. And this is a conundrum. Her body found staged, which means the killer took the time and forethought to place her body in a certain place.
This was not the location of the murder itself. She was not only asphyxiated but beaten badly. What`s the point of that type of beating when you`re going to asphyxiate the person? Was there a fight? Was there a fatal fight to the finish? Why was her body posed? Why was the scene staged?
We are live -- we are taking your calls. Another thing I want to look at is surveillance video that has just emerged. Let`s show the video, Liz. While we`re looking at this, Jean, tell me, what we learned about the husband Martin David Pietz`s shopping spree, just before her death?
JEAN CASAREZ, HLN LEGAL CORRESPONDENT: Well, the shopping spree at the grocery store, he got Drain-O and he got some hard liquor and I just heard drain know and some hard liquor and I just heard testimony that he got gloves?
GRACE: Rubber gloves.
CASAREZ: Rubber gloves.
GRACE: OK. Out to Ben Levitan, telecommunications expert, you have taken a look at the case. What is jumping out at you, especially -- I`m interested especially, Ben Levitan, about a call made from her cell phone after I believe she`s already dead.
BEN LEVITAN, TELECOMMUNICATIONS EXPERT: Nancy, these -- she supposedly makes a phone call for him on her cell phone. If we look at the records, the cell phone calls, if they`re made from the same cell tower we have to assume that maybe the phones were together, we don`t know.
But the police can`t really, you know -- was her phone with her? That`s the question, if -- you`re calling someone, obviously --

GRACE: Well, she was found without her cell phone.
LEVITAN: Maybe she was at work and he was at the -- at the gym.
GRACE: She was found with nothing. Especially not that diamond tennis bracelet that he popped up with days after trying to get it appraised.
Clark Goldband, what do we know? Let`s follow up on Ben Levitan. Ben, joining me out of Raleigh tonight.
Clark, what do we know about the cell phone records? What can we learn from that?
CLARK GOLDBAND, NANCY GRACE PRODUCER, COVERING STORY: Well, Nancy, prosecutors say there was a cell phone call from Nicole`s phone to make it look like she was still alive. But it shows the call came from the area around the job at the gym, as you were just saying.
Prosecution also is saying, Nancy, that phone records show her cell phone was used to call that gym about 11:50 in the morning, the day after she vanishes. Nicole --
GRACE: Clark, hold. Clark, I want to follow up on something you just said. An AT&T wireless frequency -- wireless radio frequency engineer states that there was a 90 to 95 percent probability her cell phone was in the same cell tower sector as his gym?
GOLDBAND: Yes. Yes, and Nancy, here`s something to dovetail on that. Surveillance footage from the gym shows Pietz was gone from his work area about 10 minutes during the time of that alleged call according to the state.
GRACE: Now what`s the extrapolation on that, Clark?
GOLDBAND: Well, I think what the state is trying to show there is that Pietz was not in sight during the time the phone from his wife`s -- the call from his wife`s phone was made. So I think the state is trying to show that Pietz`s whereabouts into question, during that specific 10-minute timeline?
GRACE: Now, Jean Casarez, I`m going to follow up on the cell phone records.
CASAREZ: Yes.
GRACE: So a phone call was made to him at work from her cell phone after we think she`s dead.
CASAREZ: Right.
GRACE: So --
CASAREZ: The morning after, he says he saw her in bed, and that`s the last time he saw her.
Nancy, here`s what`s significant. There`s surveillance video of him leaving the gym a little before noon and shortly thereafter. A phone call is made from her cell phone to inside the gym where he should be working.
GRACE: There`s the video right there, Jean. Look at your monitor.
CASAREZ: Yes.
GRACE: That`s him leaving his work area cops say to go out and place a call to himself with her cell phone.
CASAREZ: Exactly.
GRACE: Look at him looking back. Check it out. Look, look, look, look. He`s leaving the gym, 24-Hour Fitness, where he works. Around all those buff bodies. He leaves -- he takes a look back to see who`s looking.
That`s from ABC`s "Good Morning America." Then he goes out, and suddenly, and miraculous, it`s during those 10 minutes he gets a call from her.
Jean, was her cell phone ever recovered?
CASAREZ: Not that I know of, no. And then eight minutes later, Nancy, the surveillance video shows him walking back into the gym to keep working.
GRACE: OK. Everybody, take a look at the video we`re talking about right now.
Ben Levitan, what can we learn?
LEVITAN: But, Nancy, this is pretty clear cut. Every time you make a call or you receive a call, the phone company keeps an accurate record of which cell tower you use. In this area, that cell tower doesn`t cover more than about a mile in radius around that gym. If -- so there`s going to be two records, the call out from the phone and the call into his phone. If the cell tower recorded by AT&T for both those phones is the same, there`s only two possibilities. Either she was within that area, she was fairly close to him, or he made both those calls.
GRACE: Or another killer happens to have her cell phone and is going through her cell phone list calling everybody, and he happens to be right outside where the husband works.
Out to the lines, Lisa, Ohio. Hi, Lisa, what`s your question?
LISA, CALLER FROM OHIO: Hi, Nancy. I have a couple of things.
GRACE: Yes.
LISA: First, it doesn`t seem like they have enough evidence against this husband. And I think he`s guilty. But how are they going to prove it? And really, what evidence is out there?
GRACE: Hold Lisa. I want to address the evidence with her.
You`ve got the fact that he`s the last one to see her. The fact that he tells police she had on the tennis bracelet, the diamond tennis bracelet, when she was killed. When she went missing. Then he`s out trying to prepare to sell it or pawn it, getting it appraised.
Also, his DNA in her Jetta. Now you may say that -- I haven`t brought this up.
Marc Harrold, Kipling, Ohio -- Marc Harrold, former officer with APD and lawyer.
Marc, in the Jetta, her car, it was found about 14 miles -- let`s see the map -- from where they lived, was parked at a university. In that car, not only is his DNA and fingerprints, and that can be argued that it should have been in there because he got to drive the car.
But interestingly and probatively, Marc Harrold, his fingerprints were the last ones on the stick shift. The last person to have driven the car. It was found abandoned there.
OK, Marc, weigh-in.
MARC HARROLD, FORMER OFFICER, ATLANTA PD, ATTORNEY, AUTHOR OF "OBSERVATIONS OF WHITE NOISE": Well, obviously, if the fingerprints are in a place that they`re clearly the latest prints, the most -- the latest latent prints, that`s going to go to the chronology. And if he says he didn`t drive car, I don`t think this is quite a weak as case as everybody is saying.
Circumstantial cases can sway juries for finding of guilt. There`s a lot here. But yes, absolutely the DNA in the car by itself means very little because he could drive the car. But if the expert testimony could come out that it shows that he drove the car last or he drove the car at a time he just said he didn`t, then it could be very probative evidence.

UNIDENTIFIED FEMALE: Witness after witness testified that there was trouble in paradise, before David and Nikki Pietz tied the knot.
UNIDENTIFIED FEMALE: I asked him why he was getting married. And he said that at that point it was too late to back out of it.
UNIDENTIFIED FEMALE: Did the defendant ever help you look for her?
UNIDENTIFIED FEMALE: No.
UNIDENTIFIED FEMALE: Did he ever help you post the flyers?
UNIDENTIFIED FEMALE: No.
UNIDENTIFIED FEMALE: Did you ever see him make any phone calls related to her disappearance?
UNIDENTIFIED FEMALE: No.
UNIDENTIFIED REPORTER: The case against David Pietz is completely circumstantial but prosecutors say he left a mountain of mistakes that will prove his guilty.

GRACE: Welcome back, everyone. For those of you just joining us, who is to speak out for 32-year-old Nicole Pietz tonight. Her body found naked in a blackberry field. She was still wearing interestingly the retainer, the dental retainer she wore to keep her teeth straight every night. In a glass beside her bed in jewelry cleaning solution, she cleaned her wedding band and engagement rings every night. Still there.
In her stomach, undigested, fast food Mexican, which helps us date and time the time of death.
Out to the lines, to Tom in Florida. Hi, Tom. What`s your question?
TOM, CALLER FROM FLORIDA: Hey, Nancy. Thanks for taking my call. I`ve been following this case for a while. And my question is this. I definitely don`t think the husband`s story adds up. But do you know if police are looking at any other suspects? Like is there anyone else who may have been close to the couple?
GRACE: From what I can understand, they have been looking at sex offenders in the area. But I don`t think they have another prime or secondary suspect other than the husband.
Out to Dr. Bill Manion, medical examiner joining me out of Philadelphia tonight. How does the food, the fast food help us identify the time and date of death, Bill?
DR. BILL MANION, M.D., MEDICAL EXAMINER, BURLINGTON COUNTY, NJ: Well, if someone has a large meal, it will generally take five or six hours for the stomach to completely empty. If you have a small snack, it may only take two or three hours. She bought a large meal at the Taco Bell, came home around 7:00, 7:30, had dinner then, and as we`ve discussed, the medical examiner found food residue in her stomach, undigested food.
And you can identify beans, pieces of potato, pieces of bread, even the hours after you`ve ingested it. So that puts her death around midnight.
GRACE: Puts her death around midnight that night, and Jean Casarez, if they`re placing her death around midnight, what time did he get home that night?
CASAREZ: He said about midnight. That that`s the last time he saw her. And Nancy, there were also some non-narcotic prescription pills in her for colic, I believe it is. But they were undigested in her stomach.
GRACE: I`m interested also about how much character evidence is coming in against him.
Out to the lawyers, Peter Odom, Anne Bremner. Anne, joining me who practices in the Seattle jurisdiction. Peter in Atlanta.
To you, Anne Bremner, with the prints in the car, his prints should rightfully be in the car, that`s the car the two of them.
BREMNER: Right.
GRACE: Both of them drove, it was her car, her Jetta, he had an expensive Nissan SUV, I think, which she paid off. But that aside.
BREMNER: That aside.
GRACE: I wouldn`t be surprised to find his prints in the car. What`s interesting, though, is apparently his -- you cannot date fingerprints. OK.
BREMNER: Right.
GRACE: But what`s interesting is, it`s his print on the stick shift, if somebody else had abandoned the car, wouldn`t you expect their print to be there, unless they were wearing gloves?
BREMNER: Well, the question is, we don`t know where she would put her hands on the stick shift, whether it`s the side or the top or anything else. We can`t date fingerprints. And you know, we just heard about a mountain of mistakes that he made. I think there`s a mole hill. I mean this case is almost seven years in the making and it`s really not made right now. I mean, if that`s the best they can do --
GRACE: Well --
BREMNER: Why didn`t they discover this a long time ago, along with everything else with the surveillance --
GRACE: I don`t know that they didn`t.
BREMNER: Well, if they did -- I mean, we flow there`s recent surveillance, we know this information about the bracelet is more recent. And so, you know, what in the heck have they been doing for the last almost seven years? Because they`re just in it --
GRACE: Well, the reality is, Anne -- you know, saying, what have the police been doing is not really the issue. The issue is, did he commit this crime? And if they have just found out about the tennis bracelet, it`s my understanding, Peter Odom, that an employee at I think it was a bank, where he was getting a job, at a Chase Bank, she had a history of appraising jewelry, and he approached her.
And that person, when she found out about the murder investigation came forward. That`s why that`s one of the final pieces of the puzzle.
I want to go back to you about two things, the prints and the car, and also the defense regarding the cell phone records. Their defense is that there was a maintenance problem in the cell phone tower, and so you can`t believe the cell phone records.
And may I ask you, Peter, the last time you bought Drain-O just hours before your wife is murdered?
ODOM: Well, first, Nancy, and I`ll try and address all your questions. But the first thing about the car and the fingerprints on the stick shift, all that shows is that he was the last person not wearing gloves to drive the car. If this in fact were another killer, that person would have worn gloves, it would not eradicate his fingerprints.
And when you look at it that way, that ends up being, you know, as Anne puts it, a mole hill, not a mountain. In terms of the cell phone record that shows that somebody made a call right around noon the day after she was killed that cell phone tower as I understand the person that you had on, that cell phone tower only shows within a mile radius.
I`d like to know how many people there are within a mile radius? That doesn`t show that it was he that had the telephone in his hand. This is a heavily populated area.
GRACE: Well, obviously --

ODOM: And this is really kind of the problem with this case.
GRACE: It was the killer because she was already dead based on science.
ODOM: Even assuming -- even assuming it was the killer, how many people are in that mile radius.
GRACE: And how many of them would be calling him to set up a phone call to make it appear as if she was still alive? And you know what, you didn`t even address the Drain-O. I`m going to give you a pass on that one.
ODOM: I`ll get there, if you`ll permit me. He did not just buy Drain-O and gloves. If you believe that evidence, he bought Drain-O, gloves and hard liquor. He might have bought --
GRACE: No, no, he bought --
ODOM: -- those things incidentally, too.
GRACE: He bought hard cider.
ODOM: Hard lemonade.
GRACE: Yes, lemonade.
ODOM: Hard lemonade.
GRACE: So he bought -- he got something to drink along with the Drain-O and the rubber gloves. Is that --

ODOM: Nancy, don`t you ever buy incidental things when you go to a store for one thing?
GRACE: Would I buy things for a murder? I don`t know, I`ve never had to do that.
Very quickly, everybody, to the Heartland, Kansas. Did a school boy set his own home ablaze with his family in it? Killing his own mother and little sister asleep in the same bed, and do Facebook postings hold the key to the case?

There were numerous occasions when he would very, very confidently tell me that he was in control of my career at Bally Total Fitness, that I shouldn`t go against him, that he was the golden boy of the company.
He would make statements in front of other trainers asking to rate, you know, what looked better on me -- my butt or my arms? He made comments about, you know, would I -- was I putting on weight because my breasts were getting bigger?
He was very, very, very controlling when can came to any of the females in Bally Total Fitness at that time. And the first --
PINSKY: Jackie, let me ask you this. Let me ask you this. What did you think when you heard that Nicole had been murdered?
MORALES: I knew he did it. There was not one doubt, not one question.
PINSKY: Mark, you have a question for Jackie. One of our panel or most of our panel --
EIGLARSH: Jackie, tell me if this is -- Jackie, tell me if this is true. I heard that in your presence, this guy not only bragged about being an expert on CIS, but he actually diagrammed on a board how to get rid of bodies and how to get rid of evidence? If that`s true, why aren`t you testifying in this case?
MORALES: I have said numerous times that -- that is true. That is 100 percent true. I have made statements numerous times as to why I`ve not been called. I`m actually very, very shocked that I have not been called.
PINSKY: I want to point out that we have reaped out to Pietz`s attorneys, and have not heard back.
Jenny, do you have a question for Jackie?
HUTT: I do. Jackie, did he ever have confrontations that you were aware of? That you saw that you witnessed?
MORALES: Confrontations, no. David was very, very good at -- when you stand up to him, he has the power to manipulate you into thinking that you are wrong.
PINSKY: I understand also he seemed to be sort of almost bipolar, judging from what I`ve heard him describe, very high and very low.
MORALES: Hot and cold, hot and cold. If you do what he says, and you do it the way he wants you do it, he`s your best friend. The second you crossed him, you can see him calculating how he`s going to get back at you.
PINSKY: Did he ever talk about his wife?
MORALES: Yes. He would speak about her. We would have our sales meetings, and he would make comments like, you know -- she was very good friends with our V.P. at the time, and how it was more -- she was keeping him his job. She got him that job. She was -- he needed her at that time for job security.
PINSKY: I wonder who else -- anybody else have questions for Jackie?

BERRY: Jackie, I have a quick question. I understand you had complaint to your superiors about being sexually harassed. We are they sort of under David`s so-called spell as well that he was able to control everyone around him because of his personality?
MORALES: Yes, I`m told he was the golden boy of the company and he would never hurt a soul.
BERRY: Even when you described those interactions that you had?
MORALES: Yes.
PINSKY: Judge Young?
YOUNG: Jackie, I understand that David would not qualify for sainthood until any circumstances. But did you ever hear him have any fights with either his wife or any of the female workers at the gym? And what was his temperament like when he was working at the gym?
MORALES: Oh, he was -- he would yell. I mean, if you didn`t close a deal, if you didn`t do something the way he told you to do it, he would raise his voice. He would get very, very agitated, and it would rise to the level where you could see him shaking, I mean, you could see him shaking, and then he would control himself, it was like he caught himself what he was doing, and then he would go calm.

A man is on trial for allegedly strangling his wife and dumping her naked body in a field. What was the motive? The prosecutors say David Pietz was in a troubled marriage, had financial problems and was a serial, serial cheater take a look at this.

UNIDENTIFIED FEMALE: My daughter is gone. Her little body was dumped fear the airport for the animals to just chew away at.
UNIDENTIFIED MALE: The suspect in this incident may have started to think that he was going to get away with this one.
Martin David Pietz, age 34, for the 2006 murder of his wife, Nicole Teresa Pietz.
UNIDENTIFIED MALE: Cell phone tracking provided enough evidence to charge Pietz with murder.
UNIDENTIFIED MALE: This was her husband David caught on a surveillance tape 3 minutes before midnight on a seemingly odd shopping trip.
UNIDENTIFIED FEMALE: Is he really suggesting that his wife took her clothes off, got naked, took a bunch of pills, strangled herself and tossed herself in the woods?
UNIDENTIFIED FEMALE: When did murder become the way you deal with a problem relationship? He said he had a low sexual libido and he wasn`t that into sex.
UNIDENTIFIED FEMALE: Women came forward yesterday, saying they either made out or had sex with him when he was married.
UNIDENTIFIED FEMALE: He`s a liar.
UNIDENTIFIED FEMALE: I just don`t know how you live with yourself and I`d like to call him a few names, but I won`t.

KELMAN: Yes.
PINSKY: -- just the fact that he is a liar and a cheater, should we necessarily be looking at him as a murderer?
KELMAN: Absolutely not. I have two words for you. So what? He`s a liar and he`s a cheater, he`s a philanderer. That does not make a murder.
This case at best, at best, we`re looking at a man that has no morals here. But in terms of evidence, this doesn`t rise to being reasonable doubt. There`s no way.
PINSKY: Georgianna, when you said that, I watched Judge Young sort of cringe.
Do you have different opinion, Judge Young?
YOUNG: No, not all. I looked at the tape, I looked at the case, I researched it. I thought to myself, why in God`s man does they charge him with such flimsy evidence? So many years after the fact, and all you have is a cell phone which may or may not have been in his control? And you have the fact that he happened to be a scumbag? That equals a murder charge?
I don`t get it Dr. Drew. I just don`t understand.
PINSKY: Well, let`s look at what the police found on his computer. They found searchers for swingers clubs? Searchers for how to cheat on your wife?
Lynn, this guy sounds like a barrel of fun.
BERRY: Yes, he`s a real keeper, huh? I mean, listen, the thing that scares me about this guy is that he seems like a complete narcissist. And narcissism is something that -- I mean, you can speak to as far as the medical side of it, but that kind of ego and power trip is something that scarce me, because they`re charming. And they tend to lure in women with being so attractive and --
PINSKY: Right. They seem powerful. They can seem attractive. But they don`t understand or don`t appreciate that you exist really. Really bad narcissist certainly doesn`t appreciate you have feelings.

But first, I want to give Danine a chance to respond to her comment about lying down with dogs last night, if you recall. Let me revisit that for us. My executive producer and I were talking about how we need to compile a daily dose of Danines, because you come up with some zingers.

PINSKY: Explain the lying down with dogs for us.
(CROSSTALK)
MANETTE: The thing is is that when I made the comment about some women being so desperate that they`ll just for a pair of pants in the house, that they`ll just take any, you know, philandering pig, and lying down with dogs. I was not talking about the deceased`s betrayed wife. I think a lot of people were the impression that I was bashing her. I was talking about the home wreckers.
That`s where my issue is. I would never bash a betrayed. I`m very protective of betrayed spouses. But the home wreckers? It`s open season on then. I have no love for them. None. So, that`s who I was directing my comment.
PINSKY: Jenny?
JENNY HUTT, ATTORNEY: Yes, but Danine, listen, I don`t think it`s right, and I would hope that that`s not what like my daughter would grow up to be, but isn`t the duty, really -- doesn`t it really belong to the husband? Shouldn`t he be the one who`s faithful to his wife? I mean, you would think that these women would do the right thing and not want to interfere in a marriage, but a girl`s going to do what a girl is going to do, I suppose.
MANETTE: Right. That`s correct, Jenny. And I see him in custody, in his jumpsuit, with his handcuffs on, and I feel real good about that, because --

MANETTE: But then I see those little home wreckers parade around on the stand, you know, it was a threesome, and they just enjoying this limelight, because they`re feeling so special about themselves. And that makes me sick. So, I`m calling them out at this poont (ph), because he`s getting his just rewards right now.
PINSKY: I` m going to go to Sam next, but I got to say all the narcissistic males are certainly reassured by your ladies` attacking the women who participated in this --

SAMANTHA SCHACHER, SOCIAL COMMENTATOR: No, they`re attacking both of them. And I agree with Danine. Danine, I agree with you tenfold. I think that the man is in the wrong, but why are we excusing these women? I mean, give me a break. She`s right. He is a pig.
MANETTE: Home wreckers.
PINSKY: I want to get to Laura who had worked with David Pietz in 2011 and ultimately left her job because of the constant inappropriate behavior. She says he actually traumatized her. And Cheryl and Judy, I want you to stand by. We`ll talk about how that would happen. Laura, what did happen to you?
VOICE OF LAURA, FMR. CO-WORKER OF DAVID PIETZ: Hi. Well, I worked with Dave. I was transferred under him as a personal banker at the bank. And, well, for one thing, he just wasn`t supportive at all, but that`s obviously away from the issue. It first kind of came on to me, his odd personality. He had these big mood swings like he would come in in the morning and have bags under his eyes.
He was all depressed, and had, you know, kind of smelled like he`d been drinking, some days. And then, some days he would come in and be happy as a clam, talking about how he hooked up with some girl.
PINSKY: And what was it that traumatized you?
LAURA: Well, he would push the boundaries. So -- push the limits as far as his behavior with me. I`m a young woman, and I had been married for three years at that point, happily married, and, you know things like I wore a skirt to work and he would comment about how my legs looked really nice in the skirt.
And I, you know, told him, excuse me, I`m happily married and he was like, oh no, I didn`t mean it like that. So, he always had like a comeback for me, whenever I would say, like, oh that`s inappropriate. He would always say like, oh, well, I didn`t mean it like that.
PINSKY: Again, remind people again that we did reach out to Pietz`s attorney but have not heard back. Judy, I understand you have a question for Laura.
JUDY HO, PH.D., CLINICAL PSYCHOLOGIST: Yes. Hey, Laura. Thanks for being with us. And you know, I`m sorry to hear that you were basically sexually harassed. You know, what I think about when I hear about David`s story is that he`s a male borderline. I mean, he`s really pushing the boundaries all the time.
He`s always testing his limits. I was just wondering, were you kind of part of that bad side/good side part of his behavior where one day he loves you and one day he hates you? Did you see anything like that, that polarity
LAURA: Yes. I mean, he -- yes, Wednesday, he were doing great, and another day, you know, your job performance was terrible. And it was just based on how he was feeling for the most part.
PINSKY: It could be bipolar, though. Danine, you have a question?
MANETTE: Yes. I`m wondering. Did he ever put his hands on you? Because if he did, I`m hoping you slapped the hell out of him, but did he ever touch you or did he just make these comments.
LAURA: It was mostly comments. I mean, it might have been like a hand on the shoulder, but nothing that I can point to as particularly sexual. I mean, he -- at one point, he brought up pornography, and I was like, that`s inappropriate to be talking about in the workplace, and he`s like, you know, I don`t know, it`s -- it was just always something different. It was very weird.
PINSKY: Cheryl, I`m going to give you a chance to ask Laura questions? Hang on a second. Cheryl, go ahead.
CHERYL ARUTT, PSY.D., CLINICAL & FORENSIC PSYCHOLOGIST: Laura, I`m so glad you`re with us. And I think that you have such great instincts that you noticed how uncomfortable it was and you kept maintaining those boundaries with him, even though he was pushing back.
Do you think that maybe this guy`s behavior was more apparent and easier to address in a work environment like a bank than it was in the health club where he was before where it was all about like bodies and all of that?
LAURA: I would say so. Working in especially the bank we were in, very small branch. So, there`s only so much space and so many places you can be without having -- mean, you got cameras on you, but as far as, you know, having other people --
PINSKY: Sam, finish me up here. Sam.
SCHACHER: Right. Well, clearly, my question is, clearly, this guy is a jerk and inappropriate, but I`m curious if he was ever dangerous? Did you ever fear him?
LAURA: When I found out about his past, I was definitely afraid. When I quit my job, my exit interview --
PINSKY: What past? What are you talking about, Laura? What do you mean?
LAURA: From that -- what happened to his wife.
PINSKY: You mean the wife -- OK. Go ahead.
LAURA: Yes. So, when I heard about that, I was literally in shock, because I had no doubt in my mind that he did it.
PINSKY: There you go. We`ll leave it at that. We`ll leave it at that, Laura. That`s -- enough said. All right. Thank you very much for joining us. Thank you, panel.
