Trial Venue Could be Decided Next Week for Sarah Foxwell's Accused Killer

SALISBURY, Md.- A judge expects to decide sometime next week where the trial will be held for the Salisbury man charged with the kidnapping and murder of 11-year-old Sarah Haley Foxwell in December.

Thirty-year-old Thomas J. Leggs Jr. appeared in Wicomico County Circuit Court on Thursday afternoon, just a week after he was granted an automatic change of venue for his trial because it is a death penalty case. Leggs, who was wearing both handcuffs and leg shackles, remained silent as he sat before Administrative Judge Danny Long during a status conference to discuss the change of venue for the trial as well as when it will be held.

In Thursday's courtroom action, both prosecutors and members of Leggs' defense team appeared before Long to discuss possible trial venues. Katy O'Donnell, one of Leggs' lawyers, requested that the trial "needs to be moved off the Eastern Shore."

"This is a unique case," O'Donnell said, adding that moving the trial off of the Eastern Shore would help better ensure her client gets a fair trial. She said she had concerns about all of the local media and blog attention this case has generated. She also pointed out that many people on the Eastern Shore are personally invested in the case. She mentioned how more than 3,000 people participated in the search for Sarah following her disappearance in December. O'Donnell also said holding the trial on the Eastern Shore could raise concerns about the integrity of a jury that would decide Leggs' fate.

O'Donnell also requested the trial for her client not be held in Baltimore County. According to O'Donnell, studies show that Baltimore County accounts for a disproportionate share of death penalty cases and has one of the highest post-conviction reversal rates in death cases than of any county in the country.

Wicomico County State's Attorney Davis Ruark, whose office is prosecuting the case, said he is willing to try the case in any jurisdiction. However, he added that he hopes that the trial will be held a "reasonable distance" from Salisbury so as not to impose an undue burden on the victim's family and witnesses.

Long said he would take both Ruark's and O'Donnell's concerns under consideration when he consults with other Circuit Court administrative judges across the state to decide where to hold the trial.

A trial date has also yet to be determined. It would be realistic to expect that the trial will be held sometime early next year, according to Ruark. When the trial does get under way, both the prosecution and the defense anticipate that it could last several weeks.

Leggs, a registered sex offender in Maryland and Delaware, has been charged with first-degree murder, first- and second-degree burglary, kidnapping, kidnap-child under 16 and first- and second-degree sex offenses in Sarah's death.

Sarah was abducted from her home the night of Dec 22. Her body was found on Christmas Day in a wooded area of Wicomico County near the Maryland-Delaware line after a massive search. An autopsy ruled Sarah's death a homicide and found that she died of multiple injuries.

Leggs, who has been in jail since the day Sarah went missing, continues to be held without bond in the Wicomico County Detention Center.

Trial for Sarah Foxwell's Accused Killer to be Held in Cecil County

SALISBURY, Md.- Thomas J. Leggs Jr. will stand trial in Cecil County for the kidnapping and murder of 11-year-old Sarah Haley Foxwell in December, authorities announced Friday.

First Judicial Circuit Court Administrative Judge Daniel M. Long filed the notice of change of venue in Wicomico County Circuit Court. When the trial will get under way, and its expected duration have yet to be decided. A scheduling conference will most likely have to be held first to discuss those particulars, said Sally Rankin, court administrator for the First Judicial Circuit Court, which encompasses Dorchester, Somerset, Wicomico and Worcester counties.

Leggs, 30, of Salisbury, was granted an automatic change of venue for his trial because it is a death penalty case. That meant that his case would have to be moved out of Wicomico County and to another jurisdiction in Maryland.

Wicomico County State's Attorney Davis Ruark, whose office will be prosecuting the case, said of Long's decision to move the trial to the upper Eastern Shore, "We were prepared to go to any jurisdiction to try this case, and we will be fully prepared to try this case in Cecil County."

I was shocked to read that his trial was moved to Cecil County. It was our Legislatures who fought to get tougher laws as a result of this little girl's death at the hands of this monster!
By the way, I live in Cecil County and I plan on being there at the trial if anyway possible if for no other reason but to show my support!

Sarah Foxwell's Grave Vandalized

WICOMICO COUNTY, Md. - It's an unthinkable crime, Wicomico County Sheriff's Deputies say someone vandalized the gravesite of Sarah Foxwell. They say the bottom portion of her grave was damaged and the vase sitting at the foot of it appeared to be kicked. Deputies believe it happened sometime between Thursday night and Friday morning. Anyone with information should call 410-548-4891.

The trial will begin April 18, 2011 in Cecil County, according to Wicomico County State's Attorney Davis R. Ruark. Retired Kent County (Md.) Circuit Court Judge J. Fred Price will preside.

Leggs, 30, of Salisbury, was granted an automatic change of venue for his trial back in May because it is a death penalty case. That meant that his case would have to be moved out of Wicomico County and to another jurisdiction in Maryland. Cecil County, located on the upper Eastern Shore, was the chosen venue.

Leggs, a registered sex offender in Maryland and Delaware, is charged with first-degree murder, first- and second-degree burglary, kidnapping, kidnap-child under 16 and first- and second-degree sex offenses in Sarah's death.

Sarah Foxwell's Accused Killer Gets 3 Years on Unrelated Burglary Charge

SNOW HILL, Md.- A Worcester County Circuit Court jury deliberated 20 minutes before it convicted Thomas J. Leggs Jr. of fourth-degree burglary Thursday, drawing a maximum three-year sentence from a judge.

Leggs, 30, of Salisbury, who is facing charges in Wicomico County for the kidnapping and murder of 11-year-old Sarah Haley Foxwell of Salisbury in December, was on trial in Worcester County for an unrelated incident that occurred in Ocean City in September.

According to prosecutors, a 24-year-old woman, who had already known Leggs for a few months, said she awoke in her bedroom at around 4 a.m. on Sept. 11 to discover Leggs standing by her bed with his pants around his ankles. The victim told the court that she never had given Leggs permission to enter her home and ordered him out before calling police shortly thereafter.

At least he'll be off to prison and not sitting in the county jail awaiting his murder trial. His actions with the woman above seem like more than burglary though.

I am so glad to see RC covering this case. I followed this case from day one. It was commendable that so many turned out for the search for Sarah in the cold, cold weather and if I remember correctly before a holiday. Christmas?

Sarah had a dysfunctional mother and I don't think her aunt was much better!

I signed Sarah's guest book. She captured my heart!

SALISBURY, Md. (AP) ― The family of an 11-year-old Salisbury girl kidnapped and killed in December is asking the current Wicomico County state's attorney to prosecute the death penalty case against the man charged in the child's slaying even after he leaves office.

In a statement released Friday, Sarah Haley Foxwell's parents and aunt say Davis Ruark, who lost the Democratic primary earlier this month, should remain lead counsel in the trial set for April.

Thank you for this update. I will definitely follow this trial. Sarah captured my heart. I think she had a rough life considering her parents background.

It was nice of her aunt to take her and her siblings in but I do believe that her aunt was not the best person to have guardianship . . . . . based upon what I read!

Last year, Maryland State Police Sgt. Eric Fogle helped spearhead the search for Sarah Foxwell, an 11-year-old girl reported missing from her Salisbury home Dec. 22.

Sarah was found dead Christmas Day.

Mourning his own loss this month when Christopher, his 8-year-old bloodhound, died of cancer, Fogle wasn't without a canine partner for long.

Wes King of Blackrock Kennels in Reisterstown donated a dog to follow in Christopher's footsteps within days.

Fogle named his new partner Sarah, in memory of the slain Salisbury child. Police bloodhounds are often named for murdered children, he said.

Christopher was named in remembrance of Christopher Ausherman Jr., a 9-year-old Frederick boy murdered by Elmer Spencer Jr. on Nov. 19, 2000, just days after the serial pedophile was released from prison. Spencer later died in prison after he was convicted in Christopher's death.

It is still heartbreaking to think about how Sarah died and was thrown into woods like trash.

The story of Sarah Foxwell is sad before her precious life ended in tragedy.

It is too bad that her aunt made the wrong choice in a boyfriend.

Judge J. Frederick Price denied eight motions by 31-year-old Thomas J. Leggs Jr.'s public defenders Katy C. O'Donnell and Kay Beehler. They claimed death by lethal injection is "cruel and unusual punishment" and unconstitutional.

Another Leggs death sentence motion denied

ELKTON, Md. -- A Circuit Court judge denied a motion Thursday that would have removed the option of a death sentence for the Salisbury man charged in the murder of Sarah Foxwell.

The denial came during the second day of a motions hearing for Thomas James Leggs Jr., 31, in Cecil County Circuit Court.

The victim's parents, Jennifer and Thomas Foxwell, were present for the hearing.

The motion, or request, was one of several that have been filed by Leggs' public defense team.

Public defense attorneys Katy C. O'Donnell, division chief of the Aggravated Homicide Division of the public defender's office, and Kay Beehler, an assistant public defender, argued that cell phone tower data and information related to the location of the suspect, Thomas James Leggs Jr., 31, around the time of the child's disappearance should be excluded.

ELKTON, Md. – A Circuit Court judge granted a motion that will allow the court to review testimony related to the impact of Sarah Foxwell’s murder on family members before the trial following a ruling by a Circuit Court judge Wednesday afternoon.

The review could result in a pre-trial hearing where the judge will decide whether to limit portions of the family representative's testimony.

The state is required to select one individual to represent the Foxwell family and must submit the family representative’s name to the court by March 2.

ELKTON, Md.- Public defenders for a man accused of kidnapping and killing an 11-year-old Salisbury girl are trying to suppress evidence before it gets introduced in trial.

Thomas J. Leggs Jr., 31, also of Salisbury, faces first-degree murder, sex offense and other charges in connection with the death of 11-year-old Sarah Foxwell, whose body was found in a wooded area of Wicomico County on Christmas Day 2009.

During a Thursday hearing in Cecil County Circuit Court, Kay Beehler, one of Legg's legal representatives, argued against including cell phone information.

Leggs claims to have been at a local bar on the evening of the kidnapping, Tuesday, Dec. 22. 2009. But according to court documents, that same evening a key eye witness saw Leggs leave Sarah's bedroom with the girl. The next day, on Dec. 23, 2009, Leggs was brought into police custody for approximately five hours before getting read his Miranda rights. His cell phone remained in the station as troopers looked for Sarah's body and more information.

County Approves Leggs Prosecution Funding

SALISBURY -- Wicomico County officials this week vowed to continue to spend what was necessary for the prosecution of Thomas James Leggs, accused of kidnapping and murdering an 11-year-old girl in December 2009, as the costs associated with the case start to mount.

The Wicomico County Council on Tuesday somewhat reluctantly approved a requested supplemental appropriation of $11,638 for the State’s Attorney’s Office for costs associated with prosecuting Leggs, whose trial has been moved to Cecil County. The trial is currently set to being on April 18 and is laid in on the docket for nearly a month, but there have been countless motions hearings, including a hearing on the pursuit of the death penalty in the case, with several more scheduled as the trial date nears.

Thomas Leggs pleads guilty in Foxwell murder; sentenced to life without parole

ELKTON — Thomas James Leggs Jr. today agreed to plead guilty to all charges in the murder of Sarah Foxwell in exchange for prosecutors removing the possibility of the death sentence.

Leggs, 31, was sentenced in Cecil County Circuit Court to life in prison without the possibility of parole for the murder of the 11-year-old Salisbury girl. He also pleaded guilty to kidnapping and sex offense charges.

I believe a jury would have recommended the death penalty had this gone to trial without a confession. Life in prison ~ I hope it's a miserable one. He will never be able to harm another little girl again. It amazes me that these savages are so afraid to die when they themselves raped and murdered an innocent child.

BALTIMORE -- A registered sex offender accused of kidnapping, sexually assaulting and killing an 11-year-old Eastern Shore girl in December 2009 pleaded guilty on Tuesday.

Thomas Leggs Jr., 31, of Salisbury, pleaded guilty in a Cecil County courtroom to seven counts of kidnapping, burglary, sex assault and murder in the death of 11-year-old Sarah Foxwell. He will be sentenced to two life sentences without parole.

Good that he confessed but it was only to save his neck...Sorry POS...at least he won't be able to get his hands on another little girl...Too bad he's not remorseful...that day will come I'm sure...WONDER IF HE WILL BE IN GEN POP OR A PRIVATE CELL ???

ELKTON, Md.- A plea deal has been reached in the case against a man accused of kidnapping and murdering an 11-year-old Salisbury girl.

Thomas J. Leggs Jr., 31, of Salisbury, appearing in Cecil County Circuit Court on Tuesday morning, admitted his guilt in Sarah Haley Foxwell's death.

"I am guilty," Leggs told the court multiple times, as he took responsibility for his crimes.

Under the terms of the plea deal, Leggs received two life sentences without parole: one for first-degree murder and the other for first-degree sexual offense. He was also given 30 years in prison for kidnapping and 20 years for burglary. All sentences are to be served consecutively.

There was a Press Conference in front of the Court House. Very interesting! Scroll down below the comments to view 5 videos of the Press Conference.

During the video of the grandmother speaking, things got a little testy. A reporter interrupted and started questioning the State Attorney guy.

I think the grandmother should not have used that Press Conference to attack Joe Albero. I really do not know what is going on between her and Albero. This should have been about justice for Sarah!

For those who have followed this case, we do know that some things that are not very nice came out about Sarah's family.

Today the most infamous crime in Wicomico County's recent memory came to an incomplete conclusion. Thomas Leggs pleaded guilty to 7 counts, including the kidnapping, rape, and murder of Sarah Foxwell. For this he will serve two consecutive life sentences (without the possibility of parole), as SBYNews reported earlier. According to statements by the State's Attorney's office, this arrangement was made at the request of some members of Foxwell's family to provide closure and to spare Foxwell's sister the pain of testifying in a trial.

In the photo of Jennifer (see article Link posted at 2:31 a.m.), it looks as though she is pregnant again. Commenters on some of the articles (comment board below articles) said she is pregnant.

She had 6 children and guardianship was granted to Sarah's aunt. Shortly after Sarah and her siblings moved in with the aunt, we know what happened to Sarah.

After reading the above, it appears Jennifer is not a responsible mother. . . . . unless she has changed!

I wonder if the CPS or whatever it is called in Maryland, will take the baby from Jennifer when the baby is born. Just wondering . . .

Thank you for the above article. Poor Sarah. She died a horrific death.

I am going to post this article on her thread at The Hinky Meter and snip like you did. It certainly gets a person's attention.

Leggs is a monster and I am so glad he will never get out of prison to hurt innocent children again.

SALISBURY -- At about 10 a.m. on Dec. 23, 2009, the family of Sarah Haley Foxwell contacted the Wicomico County Sheriff's Office. Deputies were dispatched to her Old Ocean City Road home to investigate the child's disappearance.

After Foxwell's aunt and guardian, Amy Fothergill, realized the 11-year-old girl was missing, her younger sister whom she shared a room with reported "Tommy" had been in the bedroom during the night. Foxwell, who was crying, left with him wearing nothing more than pajamas, her sister told investigators.

Maybe life w/o parole is best for this SOB. I hope he suffers everyday of his worthless life. If he had received the death penalty he would probably be sectioned off and die painlessly with a needle in his arm. A far cry from what little Sarah was subjected to. At least the possibility of the death penalty forced him to give more information since he was afraid to die himself. I would like to see someone go back time to time and report on these monsters in prison to see how they are treated and what their daily lives are like. No amount of suffering in prison could ever make up for what they have done, but just to see a glimpse of a miserable day to day life would be of a little comfort to me.

"The Foxwell family has told me that they do not want a lifetime of anguish and appeals, due to the extreme stress, havoc and grief the death of Sarah has caused them and their need to begin healing from this horrible, despicable crime," the Wicomico County state's attorney, Matthew Maciarello, told reporters. "And because they wished to protect Sarah's sister, a 7-year-old material witness in the case, they have unanimously requested that we withdraw our notice to seek the death penalty."


Mr. Maciarello made that statement outside the courthouse in Cecil County, where the case had been moved because of extensive pretrial publicity. He then stepped aside to allow members of the Foxwell family to comment, and that's when the girl's maternal grandmother issued a battle cry.

For 10 minutes, Roberta Wechsler ranted angrily — not against the man who had killed her granddaughter but against a man who was standing nearby and listening, Joe Albero. Mr. Albero blogs at SBYNews.com under the motto: "The pulse of Salisbury. Either you love us or you hate us!"

Even if uninitiated to Mr. Albero's brand of commentary or to the Delmarva blogosphere and the small-town gossip that is its daily gruel, you had to assume from her fiery words that Roberta Wechsler had been profoundly offended by Mr. Albero, and repeatedly, since her grandchild's murder. This was the battle cry of the blogospherically beleaguered.

Sarah's murderer, Thomas Leggs Jr, was stabbed several times Sunday during the prison's lunch time. Unfortunately, he is expected to survive.

Wow, Justice! What news!

Leggs sure did not last long! I imagine this is just the first of many attempts on his life. I doubt if he will make it in prison long term. Other prisoners do not like child rapists/child killers!

Too bad he survived.

Child Killer Slashed in Prison

CUMBERLAND, Md.- Authorities say a man serving two life sentences in prison for the kidnapping and murder of an 11-year-old Salisbury girl has been slashed by another inmate.

Thomas J. Leggs Jr., 31, of Salisbury, is being held in Western Correctional Institution, a maximum security prison in Cumberland. According to the Maryland Department of Corrections, Leggs was slashed three times in the head, neck and hand with a homemade weapon. They say the fight happened in the dining area of the prison. Police recovered the weapon, but do not know who attacked Leggs.

SALISBURY -- A second-degree assault case against Jennifer Anne Foxwell was dropped at a very short trial in Wicomico County District Court on Monday.

Foxwell, 39, of Fruitland is the mother of Sarah Haley Foxwell, the 11-year-old who was murdered in 2009. At the time, Sarah and her siblings were living with their aunt. Thomas James Leggs Jr. was later found guilty in that case.
