Horn's death penalty motions fail

In an unusual move Wednesday, homicide suspect Brian Horn filed two handwritten motions attempting to take the death penalty out of consideration if he is convicted in the death of a 12-year-old Stonewall boy.

Horn, 37, of Keachi, filed the motions pro se, meaning he filed them on his own and without the assistance of his court-appointed attorney. Horn wanted the judge to declare the death qualification process a violation of the political and constitutional rights of the potential jurors and to prohibit the death qualification of the capital jury, District Attorney Richard Johnson said.

District Judge Robert Burgess, who is presiding over the jury selection process in the East Baton Rouge Parish Courthouse, denied Horn's request, prompting an objection from Horn. Burgess forbade him from addressing the court. Burgess reminded Horn he is not the counsel of record. Horn's lead attorney is Daryl Gold.

After gaining only 9 more prospective jurors at day’s end today for a DeSoto Parish capital murder trial, District Judge Robert Burgess will make a decision Monday on whether additional people should be summoned from East Baton Rouge Parish for jury duty.

The 9 bring to 29 the number of people remaining in the jury pool for general questioning in Brian Horn’s first-degree murder trial. A total of 80 people separated into five panels had been questioned as of tonight. Court is recessed for Sunday.Sixty people remaining from the original 300 summoned for jury duty will be told to return to court Monday morning.

DESOTO PARISH, LA (KSLA) - A jury has been chosen in the capital murder trial of Brian Horn.

Prosecutors say the jury will report back to the courtroom at 1 p.m. for a meeting to discuss plans to transport the 12 to DeSoto Parish.

DeSoto Parish District Attorney Richard Johnson said 61 potential jurors were chosen for the trial and selection for the final 12 jurors and 3 alternates began Monday in East Baton Rouge Parish. The trial will be held in DeSoto Parish.

The jury in the Brian Horn first degree murder trial this afternoon got a look at the actual crime scene where 12-year-old Justin Bloxom was found suffocated and face down in a pool of water on March 30, 2010.  

District Judge Robert Burgess, the prosecution and defense teams, along with Horn went to the wooded area off Highway 171 where Bloxom allegedly was smothered by the defendant.  Desoto Parish Sheriff Rodney Arbuckle said security was provided by six members of his staff

Text messages start of day 3 of the Brian Horn capital murder trial

DESOTO PARISH, LA (KMSS) — It was another day of emotional testimony in the Brian Horn capital murder trial.

This morning Detective Robert Greer read aloud the text messages from 12 year old Justin Bloxom the night of his murder.

During the testimony, Bloxom's mother, Amy Fletcher had to leave the courtroom, over come with emotion.

DeSoto District Attorney Richard Johnson explains his reason for reading them, "we wanted to show the fact that Brian Horn had lured Justin Bloxom out of the house. And we think, we thought the jury would better understand it by being able to see those text messages and know the exact conversation that ensued between Brian Horn and Justin Bloxom."

The cab allegedly used by Brian Horn to pick up 12-year-old Justin Bloxom.

MANSFIELD, LA (KSLA) - Jurors in the capital murder trial of Brian Horn saw disturbing and sexually explicit text messages Monday that prosecutors say were exchanged between 12-year-old Justin Bloxom and a twice-convicted sex offender in the hours before the boy's death in March of 2010.

Prosecutors say Horn posed as a 15-year-old girl, sending the text messages to set up a meeting with Bloxom and telling the boy that "she" was sending a cab driver to pick him up.

Bloxom's body was found the following morning, March 30, in a wooded area off of Highway 171.

In the exchange of text messages read aloud Monday in court, Horn tells Bloxom, "He went to the end to get you. I'm just watching porn." "Yeah," Bloxom replies, "but are you sure he can get me back in 30 minutes?"

Horn guilty of capital murder in death of Justin Bloxom

Justin Bloxom was 12 years old when prosecutors say he was lured to his death by Horn via text message.

DESOTO PARISH, LA (KSLA) - Brian Horn has been found guilty in the kidnapping and murder in the death of 12-year-old Justin Bloxom.

Prosecutors convinced the jury that Horn, 37, posed as a 15-year-old girl to entice Bloxom via text to meet up with him for sex.

The boy's body was found in a wooded area off Highway 171 on March 31, 2010.

The jury of six women and six men from East Baton Rouge Parish were given their instructions and sent to deliberate just after 2 p.m. after a quick round of closing arguments. Word of the verdict came less than an hour later.

During closing arguments, prosecutor Dhu Thompson told the jury to recall the text message sent by Justin Bloxom in response to explicit photos sent to him by Horn, which said, "you gotta remember, I'm only 12." When that portion of the text conversation was read aloud in on Monday as the state presented its case, an audible reaction was heard in the courtroom

DESOTO PARISH, LA (KSLA) - Brian Horn, the man convicted of kidnapping and murdering 12-year-old Justin Bloxom four years ago, was formally sentenced to death on Wednesday morning by DeSoto Parish District Judge Robert Burgess.

Amy Fletcher, Justin's mother, directly addressed Horn while in court.
