Judge Orders Hearings In Casey Anthony Case

Posted: 1:10 pm EDT May 3, 2010
Updated: 1:26 pm EDT May 3, 2010

ORANGE COUNTY, Fla. -- WFTV obtained two orders from Judge Belvin Perry Monday in the case against Casey Anthony. In one, he orders three more hearings
(read it) and the other order is regarding a deposition schedule (read it).

The first hearing that Judge Perry ordered is scheduled for May 6 at 9:00am, which will address the budget.

The second hearing is on May 10 at 9:00am. The court will hear any pending motions. The defense is ordered to provide the court with a list of motions identifying those that will require the presentation of witness testimony or other evidence.

A hearing is also scheduled on May 11 at 9:00am, where the court will hear any pending motions related to the death penalty.

In the order regarding the deposition schedule, both sides must submit a schedule by May 17 with names and addresses of witnesses to be deposed on each date.

Meanwhile, attorneys will return to court for a hearing in the civil case against Casey Anthony Tuesday on the defamation lawsuit filed by a woman named Zenaida Gonzalez. She claims her reputation was ruined when Casey said a babysitter named Zenaida Gonzalez took Caylee Anthony.

Judge sets tough new schedule for attorneys

By Rene Stutzman, Orlando Sentinel
3:20 p.m. EDT, May 3, 2010

The judge in the Casey Anthony murder case has set a new deadline for attorneys.

He is giving them two-and-a-half weeks to file a detailed deposition schedule.

That's a huge undertaking. It means that by May 17, attorneys must contact more than 50 witnesses and schedule them for sessions during which they'll be questioned – sometimes very sharply - under oath about the case.

Anthony, 24, is charged with murdering her 2-year-old daughter, Caylee Marie, in 2008. The state is seeking the death penalty.

The order is from Chief Circuit Judge Belvin Perry Jr., who took charge of the case two weeks ago.

He signed it Friday. It is another signal that he intends to move the case forward aggressively.

At a hearing Friday, Assistant State Attorney Linda Drane Burdick told the judge that the state has listed 250 witnesses. She predicted that defense attorneys would want to depose about 90.

Defense attorney Jose Baez said they had finished only 36.

That leaves more than 50 yet to do.

At the hearing, and in Friday's order, the judge said he'd help attorneys with uncooperative witnesses by issuing orders, requiring them to come to court or be held in contempt. He also said he'd use deputies to haul them in, if need be.

There's a hearing Tuesday afternoon in another Casey Anthony case, a lawsuit by a woman who says Anthony told lies that damaged her reputation.

Zenaida Fernandez-Gonzalez is seeking unspecified damages, saying she was harmed when Anthony told authorities that Caylee disappeared after she left the child with a babysitter named Zenaida. After investiigating that claim and many others, prosecutors charged Anthony with murder, and the child's body was found several months later in a patch of woods not far from Anthony's home.

Tuesday, that case is set for a routine pretrial conference before Circuit Judge Jose Rodriguez.

Events in the murder case against her, though, have begun to move more rapidly. Perry, the judge in that case, has scheduled hearings this week and next.

On Thursday, Perry will hold a hearing about defense public spending in the case.

In March, Circuit Judge Stan Strickland, the judge handling the case at the time, concluded that Anthony is now indigent, and, thus, the public should cover her defense costs, minus attorney fees.

Thursday's hearing could be the first time defense attorneys disclose just how much money they expect to spend.

They will talk about what experts they've hired, how much they charge per hour and how many hours they're expected to work. There'll also be talk about other expenses, such as travel.

Next week, on Monday and Tuesday, Perry will listen to attorneys argue a variety of motions.

On Monday, that will include a defense request that the case by tried by jurors from another county; an attack on physical evidence gathered by the state; whether jurors should be allowed to view party photos of Anthony and whether they should hear allegations of domestic violence against the former county employee who discovered the victim's body.

Tuesday, May 11, will be dedicated to defense motions attacking Florida's death penalty.

Hearings both days start at 9 a.m.

copied and BBM from above post..

well, honestly, they have had 2 years to make a dent in this... it wouldnt be such a HUGE UNDERTAKING of they would have been doing their jobs up to this point...

so, no sympathy from me with the new "tough" judge.. asking them to get the trial started BEFORE KC dies of old age so the state can kill her 1st is not TOO much to ask in my book!!

Of course, you know Baez is going to play act like he wanted this all along...and prosecution just wasn't giving him discovery in a timely fashion. Rolling Eyes

Big hearings in days ahead

posted by halboedeker on May, 3 2010 10:33 PM

Television stations tonight provided a schedule in the Casey Anthony saga.

WESH-Channel 2, via its 10 p.m. news on WKCF-Channel 18, quickly noted the three hearings coming up in Anthony’s murder case. She is charged with first-degree murder in the death of her daughter, Caylee.

Anchor Jim Payne listed the hearings: On Thursday, there’s a hearing on taxpayer money that Anthony will receive for her defense; on next Monday, there’s a hearing on a change of venue; and a week from Tuesday, Chief Judge Belvin Perry will consider a motion that challenges the death penalty in the case.

WFTV-Channel 9, on its 10 p.m. news on WRDQ-Channel 27, reminded viewers that a pretrial hearing will be held Tuesday afternoon in the defamation suit against Anthony. Zenaida Gonzalez is suing Anthony for defamation for linking her to the disappearance of Caylee.

UPDATE:

WOFL-Channel 35 said the hearing in the civil case would start at 1:30 p.m. Tuesday.

Judge Finalizes Casey Anthony Case Schedule
Judge Says Hearing Will Not Be Private

POSTED: 5:03 pm EDT May 3, 2010
UPDATED: 7:04 am EDT May 4, 2010

ORLANDO, Fla. -- Judge Belvin Perry finalized a schedule Monday shoehorning three critical hearings in the next eight days.

On Thursday morning, a hearing will be held to talk about how much taxpayer money Anthony should be budgeted to aid in her defense, now that she has been declared indigent.

On Friday, defense attorney Jose Baez asked Perry if the budget concerns will be discussed in private. Perry decided the budget hearing will be held in open court Thursday.

Perry said he he wanted to know how many hours the defense team's experts will require and if they are willing to abide by the fee schedule set by Florida's Justice Administrative Commission.

Next week, a series of important defense motions will be heard, including a hearing on the trial's location and another to discuss whether evidence can be introduced suggesting the man who discovered Caylee's remain, Roy Kronk, should have been investigated as a possible suspect.

Perry said he also plans to consider a series of defense motions challenging the death penalty.

WESH 2's Bob Kealing said, by next week, followers of the case should expect to know how much money it will cost taxpayers to defend Casey Anthony, where her trial will be held and whether the state can keep pursuing the ultimate punishment against her.

Meanwhile, Anthony's civil case will be back in court Tuesday. A status hearing is scheduled for the defamation suit brought by the woman Anthony said was Caylee's nanny, Zenaida Gonzalez.
