FARMINGTON, Utah - The couple accused of killing 4-year-old Ethan Stacy waived their right to a speedy trial, delaying the case briefly while attorneys go over thousands of pages of evidence in the child homicide. Meanwhile, Davis County Attorney Troy Rawlings told Fox 13 the case was "on track" for the death penalty, if Nathan and Stephanie Sloop are convicted.
The Sloops are facing aggravated murder charges in the death of Ethan, who was staying with his mother and stepfather when he died. His body was found in a canyon near Eden. Prosecutors allege he had been abused so severely, he died as a result.
In Farmington's 2nd District Court on Friday, Nathan and Stephanie Sloop both agreed to a delay. Prosecutors said that to date, they had provided defense attorneys with 3,200 pages of evidence and another 182 CDs of data.

These two people need to fry, immediately. What they did to this child is too horrible to read. They've admitted it, told what torture Ethan suffered at their hands and they led police to his tattered and broken body. The mother is just as bad as the man.

Prosecutors and defense attorneys on Thursday agreed some records of communications between murder defendants Nathan and Stephanie Sloop and their therapists are protected by patient-physician privilege.
But a dispute remains on whether prosecutors are barred from using all of the records in court against the Sloops.
Second District Judge Glen Dawson asked attorneys to submit briefs on the issue by the end of May with oral arguments scheduled for June 3. The judge also scheduled a July 29 hearing to discuss whether materials seized from Nathan Sloop’s cell at the Davis County Jail might be admissible as evidence.

A married couple, Nathan and Stephanie Sloop, are each facing their own charges in connection with the death of 4-year-old Ethan Stacy.
Ethan's disfigured body was found buried in Weber County on May 10 after Stephanie Sloop called to report Ethan, her son, missing.
Both Sloops could face the death penalty. Prosecutors will decide if they will pursue the death penalty after the Sloops enter a plea at a future hearing.
Rawlings could not comment specifically on either Sloops' case, but did say, "In general, some of these cases are eligible for the death penalty as a realistic course of action."
Nathan Sloop has a five-day preliminary hearing scheduled to begin March 19. At that hearing, a judge will decide if there is enough evidence against him for the case to go forward to trial. No hearing has been set for Stephanie Sloop at this time.

One of the more emotionally-traumatizing child abuse cases covered here at The Hinky Meter was the brutal, horrific death of 4-year-old Ethan Stacy in 2010. Shortly after his mutilated little body was found and the terrifying and gut-wrenching details of his last days on Earth were revealed, it was reported that authorities did not think there was enough evidence to charge anyone with his murder. OGDEN – A memorial marking the two-year anniversary of the murder of Ethan Stacy was held on Saturday morning.
Police say 4-year-old Ethan died in 2010 after being abused by his mother and step-father Stephanie and Nathan Sloop. They pair the allegedly hid the boy’s body in a shallow grave near Powder Mountain Ski Resort.

How in the h*ll do you allow a man to beat up your 4yr son and not call the police and get medical attention. Then lock him in a room to marry the man that beat the sh*t out of your son that you know needs medical attention. Then your child still needs medical attention but you go to Wal-Mart to get husband medicine, and you find that your child has been burned but you still don't call 911.
Then she writes a little to the news saying she would trade places with her son, I don't think so.
This case is really sick and I hope they go for the death penalty.
Oh, the letter to the press also says that she is upset with the press. Did she think that people would think more about what this child went thru without his mother stepping in to stop the abuse and get him medical attention.

FARMINGTON — Plea bargain negotiations are being discussed in the high profile murder of 4-year-old Ethan Stacy, defense attorneys confirmed on Tuesday.
Following a court appearance for Ethan’s stepfather, Nathan Sloop, defense attorney Richard Mauro told FOX 13 they have been in talks with Davis County prosecutors to resolve the aggravated murder case before trial.
“There are always plea deal negotiations that go on in every case. There just are, and I want to emphasize that we have not reached a resolution in this case,” he said. “Certainly we have discussed the possibility of that occurring.”
In court, Mauro told the judge they were working to resolve a number of issues ahead of trial, including legal motions. Davis County Attorney Troy Rawlings would not comment following Tuesday’s court hearing. In court, he told the judge “significant progress is being made in discussions.”

I'd be very disappointed if the prosecutor offers a plea. Nathan Sloop did his level best to disfigure the corpse of this child-- destroyed his face and teeth with a hammer to try to prevent identification.
I don't want to see that POS get any kind of plea, nor Ethan's POS egg donor. Take it to a jury and let them hear EVERYTHING about Ethan's murder. This was horrific, and premeditated.

I would agree, KZ.
Ever time I see this child's sweet and trusting face I feel sick to my stomach knowing how these two evil people took his trust and love and violently abused him. And when he was dead, they continued to abuse him. I rarely hope people to hell but I certainly hope these two "custodians" spend the rest of their lives in hell.

The Davis County Attorney’s Office intends to seek the death penalty for Nathan Sloop.
The attorney’s office filed their notice of intent to seek the death penalty Thursday in 2nd District Court, where Sloop, 34, is accused of aggravated murder in connection with the 2010 death of his 4-year-old stepson, Ethan Stacy. Sloop’s wife, Stephanie Sloop, 29, is also charged with aggravated murder in Ethan’s death, though the attorney’s office has not filed the same intent in her case.

On Thursday of last week prosecutors decided to seek the death penalty against sloop. On Tuesday December 11th the case that's been going for more than 2 years got closer to trial.

Parts of a video recording of an interview police did at the Davis County Jail with Sloop shortly after his arrest in May 2010 was shown in 2nd District Court.
Those recordings documented what Sloop said he and his wife, Stephanie Sloop, did to the small body in an attempt to cover up the boy’s death.
In one segment, Sloop tells officers he had the hammer because Stephanie Sloop was worried the small boy’s body would be identified through dental records. He admitted to using the hammer to break the boy’s jaw.

UPDATE 7:25 p.m.: “We’re going to argue that it shouldn’t be bound over,” defense attorney Richard Mauro told reporters outside of court after the day’s testimony had ended.
Defense attorneys are expected to cross examine Detective Roderick tomorrow afternoon.
“There’s lots of information and that’s why we have an opportunity to cross-examine the witness. Because there’s some different evidence that exists and we hope to explore those avenues tomorrow and the next day,” Mauro said.
Asked about his claim that Ethan Stacy died of a drug overdose and and not abuse, Mauro told FOX 13: “It helps our client because he didn’t intend to kill Ethan Stacy.”
UPDATE 4:32 p.m.: After Ethan Stacy had been buried in a shallow grave on May 8, Davis County Attorney Troy Rawlings said Nathan and Stephanie Sloop had decided to “move on.”
They purchased cleaning supplies and a new vacuum, Rawlings said.
The day the boy was buried, Nathan Sloop allegedly sent a text message to his wife: “Baby can you get antioxidant vitamins please. That would be great. I can’t wait to take you to Happy Sumo. Memories. Love you!!!”
The pair also exchanged more sexually charged text messages over the next few days, Rawlings pointed out. They also went out to restaurants after cleaning, he alleged.
Rawlings switched to a series of text messages Nathan and Stephanie Sloop allegedly sent to Ethan’s biological father, Joe Stacy.
On April 30 (two days after Ethan arrived to be with his mother), Nathan Sloop allegedly sent Joe Stacy this text message:
“Your boy will be safe here and I’ll protect with my life and yet respect your position as father. Your a good man Joe Stacy. I’m honored to know you. Wish it was other circumstances but I truly have been impressed to see how you have handled yourself as a Man. Much Respects from a Man to Man.”
A few days later, the tone changed. Rawlings highlighted one that he believed Stephanie Sloop sent using her husband’s phone:
“You asshole. You have brainwashed my son so bad i don’t know what to do. i hate you, you selfish prick. Ethans not coming back and because of this lovely law called interstate custody laws you can kiss your son goodbye.”

This is a heart breaking case. Precious little Ethan was abused so badly. The above article states that folks in the court room were crying during some of the testimony and playing of videos.
This case was followed by many at The Hinky Meter. I remember how "touched" Val was by this case.
She so generously donated money, towards a burial fund, on behalf of The Hinky Meter and its members. Like many, Val hoped that her donation, would help Joe Stacy, Ethan's father, bring Ethan home to VA for a proper burial.
Joe Stacy did get to bring his precious Ethan home . . . from the west coast to the east coast.

Farmington • A Utah medical examiner testified Friday that Ethan Stacy’s death in 2010 was caused by a combination of drug toxicity, scalding injuries and aspiration pneumonia.
During a hearing in 2nd District Court, deputy chief medical examiner Edward Leis classified Ethan’s death as a homicide.
His testimony came during the third day of a preliminary hearing for Nathan Sloop, 34, who is charged with aggravated murder, intentionally inflicting serious physical injury on a child, obstructing justice and abuse or desecration of a human body in the death of his stepson. His wife and Ethan’s mother, Stephanie Sloop, 30, faces the same charges. No date has been set for a preliminary hearing in her case.

FARMINGTON — Nathan Sloop and his new wife, Stephanie, believed they needed to "break" her 4-year-old son, Ethan Stacy.
The discussion was part of a series of disturbing text messages between the couple that was read in 2nd District Court Wednesday during the first day of a three-day preliminary hearing for Nathan Sloop, 34. Both face capital murder and other charges in the boy's death.
"I told you we had a pit bull on our hands, but they learn," Nathan Sloop messaged Stephanie Sloop on May 3, 2010.
"Just like Mommy LOL," she replied.
"I told you we had to break his ego," Nathan Sloop said.

Prosecutor David Cole said it was Sloops' "reckless indifference to human life" that caused the boy's death. He said Ethan was scalded, beaten, overmedicated and not given the medical care that he needed.
But defense attorneys told 2nd District Judge Glen Dawson for the first time on Wednesday that Ethan didn't die of severe abuse, but because of dehydration from overmedication.
The 4-year-old Layton boy was given too much Benadryl, Tylenol and decongestant, attorney Richard Mauro said.

Nathan Sloop led investigators to a trailhead near Powder Mountain in Weber County and took them to a burial site off of the trail that had been sprinkled with dog food. He was then taken back to the police station.
Roderick said the burial site was "in layers" and he identified a number of items that were found in the dirt, including a curtain, lighter fluid, a shovel head, a broken hammer, melted ammonia packaging, a burned glove, Ethan's "Florida" sweatshirt and his body, wrapped in black plastic garbage bags.
Roderick said the medical examiner determined that Ethan was burned over 17 percent of his body from the scalding incident. Water temperatures in the apartment could reach around 152 degrees, the sergeant said.
The Sloops took the boy to a chiropractor, who apparently recommended honey for the boy's wounds, according to court testimony.
The autopsy report also listed bruising injuries to the child's privates, which Nathan Sloop initially said, in a police video, were caused by scratching. He then said the injuries were there when the boy arrived before saying they were a result of the way the child sat on the toilet.
Sloop also told police he didn't discipline the boy any more harshly than his own father had disciplined him.

Before Ethan was buried, prosecutors said his face had been disfigured. Nathan Sloop told police he used the hammer to do so and then packaged up the boy's body. Both were the ideas of the boy's mother, he told police.
"Stephanie was worried about his dental records," Nathan Sloop explained.
The couple was married May 6 and Sloop told police that they didn't take the boy to the ceremony because of his injuries. He said they should have gone to the emergency room, but they were "afraid I was going to go to prison."

In addition to capital murder, Sloop is charged with obstructing justice and intentionally inflicting serious injury on a child, second-degree felonies; and desecration of a dead body, a third-degree felony. He has pleaded not guilty to the charges, although Mauro said Wednesday they will not dispute the obstruction or desecration charges, as well as a charge of damaging a jail, a third-degree felony.
Stephanie Sloop faces identical charges, except for damaging a jail. A preliminary hearing in her case has not occurred.

FARMINGTON — The obvious injuries to 4-year-old Ethan Stacy did not cause his death.
Instead, his death was classified a homicide due to a combination of scalding injuries, drug toxicity and aspiration pneumonia, Utah deputy chief medical examiner Edward Leis testified Friday.
The boy suffered some obvious second- and third-degree burns, bruising to his head and legs and lacerations to his head, but Leis said those injuries did not cause his death. The lacerations were caused after he died and the bruises were not serious.

Attorneys will argue Thursday whether Nathan Sloop should be eligible for the death penalty for allegedly killing his 4-year-old stepson Ethan Stacy in 2010.
Prosecutors have framed Sloop’s charges based on "Shelby’s Law," a 2007 amendment to Utah’s homicide statute which allows prosecutors to seek the death penalty without having to prove a killing was intentional when a child dies during an act of abuse, sexual assault or kidnapping.
