ORLANDO, Fla. (WOFL FOX 35 ORLANDO) - The trial of an Orlando-area real-estate agent accused in a murder gets underway Monday morning.

Caryn Kelley is charged with the murder of her boyfriend, 46-year-old Phillip Peatross, in July 2011 in the College Park home they shared.

Kelley's lawyers say Peatross shot himself during a struggle at the home on West Smith Street.

Peatross had four daughters.

Woman accused in boyfriend's death describes shooting to officers

ORANGE COUNTY, Fla. — Later this week, jury selection is expected to begin for a real estate agent accused of killing her boyfriend in College Park.

WFTV obtained video police recorded the day they said Caryn Kelley shot her boyfriend, Phillip Peatross, in July 2011.


In the video that was taken outside Kelley's home right after the she called 911 for help, she appears to be intoxicated as she tries to explain to officers what happened.

Police arrived and began recording.

"He said, 'Do you want to shoot me? Do you want to shoot me?' I go, 'Don't do this. It's loaded,'" said Kelley in the video.

Peatross was shot to death after a night of drinking and arguing, authorities said.

ORLANDO -- Cell phone video released in the case of a College Park woman accused of killing her boyfriend shows the night of the shooting nearly two years ago.

But police say the video proves Caryn Kelley has been changing her story since her arrest.

Her trial is set to start next week.

Kelley is charged with second degree murder in the death of boyfriend Phillip Peatross.

During an interview recorded on a cell phone camera, Kelley said Peatross was drunk, and it was self-defense. She has also said Peatross shot himself.

The trial began Monday for a College Park real estate agent charged with manslaughter.

Caryn Kelley is accused of shooting and killing her boyfriend, Phillip Peatross, in July 2011.

In court, she broke down when the defense began to talk about Peatross and the night of the shooting.

Prosecutors started opening statements by highlighting her words the night she called 911.

An accident, a "self-defense thing," a struggle or a suicide: Caryn Kelley seemed to suggest each explanation in her panicked 911 call and subsequent statements after her boyfriend, Phillip Peatross, was shot in the head in 2011.

In her opening statement at Kelley's manslaughter trial on Monday, prosecutor Candra Moore said that's a few explanations too many. She asked jurors to focus on what Kelley said right after the July 27, 2011, shooting.

"Did he shoot himself, yes or no? No. No. It was like self defense and then an accident," Moore said, describing the alleged inconsistencies in Kelley's account. "... She said specifically when asked, did you have the gun? 'Yes, I had the gun, but it was an accident,' those are her words."

But defense attorney Diana Tennis argued that "seconds after" her initial confusion, Kelley settled into the account she'd stick with thereafter: Peatross had left her College Park home drunk after an argument. When he returned in the early morning hours, she armed herself, fearing he was an intruder

Caryn Kelley's is accused of shooting Phillip Peatross at her home in July 2011. Tuesday was the second day of her trial.

Prosecutors put into evidence pictures taken by crime scene technicians after the shooting. The pictures included Peatross' body, the gun, bottles of alcohol on the counter and in the trash can, bottles of Ambien and Xanax and a pair of women's panties on a patio.

During cross examination, the defense accused authorities of contaminating the crime scene.

On Monday, Kelley, 48, broke down in court as the jury witnessed evidence in the case.

Her defense argues that Kelley and Peatross struggled over the gun and it went off.

Caryn Kelley says her boyfriend killed himself inside her College Park home in July 2011, but the doctor who conducted the autopsy testified Wednesday that it's unlikely he fired the fatal shot.

It was the second consecutive day that jurors saw bloody photos from the aftermath of the shooting. On Wednesday, the testimony of Orange-Osceola Chief Medical Examiner Dr. Jan Garavaglia was accompanied by close-up photos of the gaping wound to 46-year-old Phillip Peatross' face, as well as images of his brain and the inside of his skull.

Jury won’t hear of Xanax, Ambien ties in Kelley trial

Prosecutors in the Caryn Kelley trial wanted a medical examiner to talk about the effects drugs may have had on Kelley the night her boyfriend Phillip Peatross was shot to death in July 2011.

Both Ambien and Xanax were found in her home after the shooting, and Kelley admitted in a jailhouse call that she had been on Ambien during the incident.

But, in a hearing outside of the presence of jurors, the judge ruled on Wednesday that testimony about the possible effects of those drugs wouldn't be allowed into the trial. The judge said that the defense didn’t have enough warning about this testimony to be able to prepare for it.

During testimony for the defense Friday, prosecutors realized that the expert called to rebut testimony from the Orange County chief medical examiner was talking about evidence they didn't know he had examined, and the judge ruled that the defense inadvertently failed to share information with the state.

Kelley is accused of killing Phillip Peatross, 46, who died of a gunshot wound to the face at a home in the College Park area of Orlando.

ORLANDO, Fla. (WOFL FOX 35 ORLANDO) - It was a surprising moment when an Orlando real estate agent, on trial for manslaughter in the 2011 shooting of her boyfriend, decided not to testify.

After hours of waiting, Caryn Kelley told a judge she that wasn't going to take the stand. With that, the defense rested its case.

"After discussing this with my attorney, I've decided not to testify, because I am too emotional over the situation," she said.

Pathologist William Anderson took the stand on Friday, saying the gun was closer to Peatross than the medical examiner determined.

"It concerns me that they didn't take the proper photo with the measurements," he said. "You can't tell where he was shot. You can tell where he started bleeding, but you can't tell where he was shot."

A tearful Caryn Kelley told the court she was too emotional to testify before her defense rested its case on Friday. She's on trial for manslaughter in the death of her boyfriend, Phillip Peatross.

Kelley says Peatross accidentally shot himself as the two struggled over her gun. But the prosecution says it was Kelley who had her finger on the trigger when the gun fired.

The defense scored some key points earlier in the day when they got to mention an incident in 2006 where Peatross threatened to kill himself in front of his ex-wife. He was involuntarily committed.

Investigators added they observed “blood on his face, hair, and clothing,” as well as “blood spatter on the night stand” and a pool of blood on the bed.

Garavaglia told jurors that Peatross died after a bullet entered his right cheek, moving through his brain stem and into the left cerebral hemisphere of his brain.

Garavaglia said the gunshot resulted in "unsurvivable injury" and Peatross, 46, would have died quickly.

"I would say most probably he's dropping right where he is," she said.

Garavaglia said she ruled the death a homicide, not a suicide, due in part to the bullet's trajectory and the gun's likely 3-to-6-inch distance from Peatross' face.

That’s the major question jurors face as they decide whether or not the 48-year-old Florida woman is guilty of manslaughter. They began deliberations Tuesday evening after six days of testimony.

In closing arguments, Kelley’s defense attorney called Peatross’ death a tragedy, not a crime. But prosecutors say the father of four didn’t deserve to die that night and that it was Kelley who had her finger on the trigger when he was shot.

Flanked by a crowd of supporters, Caryn Kelley left the Orange County Courthouse late Tuesday a free woman after a jury found her not guilty of manslaughter in the fatal shooting of her boyfriend.

"I'm going to sleep very well tonight, thank you," Kelley said. "It's been a long time coming."

The three-man, three-woman jury deliberated for about an hour and 35 minutes before reaching its verdict.

It took jurors less than two hours to decide that Caryn Kelley wasn't at fault for the death of her boyfriend Phillip Peatross. The 48-year-old Florida woman was facing a possible 30 years in prison for manslaughter.

When reporters asked her what was next for her life, she told them, "I'm going to Disney World!"
