Vinnie Politan just said, "Come on, the jury has been deliberating for over 5 hours."

Beth Karas said the jury will be breaking for lunch soon. At this time, Tammi is not at the Court House. She lives about 45 minutes away.

I have court seal showing now.

#TammiSmith trial have reached a verdict. It is scheduled to be announced at 3:30 p.m. EST.

Setting up cameras. Voices. Color bands.

TS and JS shown entering court.
Asked how "they" were doing?
TS states the timing couldn't be any worse.
Asked how they are feeling?
Both reply in positive.
Asked if they are ready for verdict?
TS replies oh yes.

Further found TS conspired to keep Gabriel out of state.

Forgery: Guilty

Jury has to determine if specific aggravating circumstances existed. Forms being passed out now. Jury to retire to consider these issues.

State presenting before jury:

Logan was worried when the child was with the Smith's He did not know where Gabriel was. Last time he saw his son Dec. 8, 2009. Cause irreparable damage to Logan. Logan's father mentioned Logan had tears and depression.

Logan suffered emotional harm due to the actions of TS and EJ.

Was an accomplice involved?
She was with EJ filling out the court docs. No doubt this aggravating factor was there.

Special Circumstances:
Defense atty addressing jury:

Maintains TS acted alone with no accomplices.

Rebuttal from State:
The co-conspiracy was to permanently deprive Logan of his son. Not just for a week=end but to be so stressed out he would sign away his rights.

You heard TS state she planned to fill out docs with EJ.

Jury is being returned to jury room.
TS looks befuddled. Chest is red as are her cheeks. She is uncertain.
JS is concerned.

Judge is asking everyone to stay close until jury returns.
Defense has asked about a legal action:
Judge will deal with that at sentencing.
703 motion

Judge:
TS will not be taken into custody today.
Unsure whether TS will serve prison time.
Oral arguments re sentencing will be in @ 30 days from now.

Thank you J4A. I am pretty much useless trying to understand this legalese. I can read it and just when I think I have it, something else is thrown in and I lose it. I think that Tammi is a repetative offender but I don't know what catagory and how to figure the class of Felony. Bottom line is, I think she will get some prison time. It might do something to put her priorities in a different order. Poor Logan will not find out what happened to his son, and IMO tammi has a lot of that responibility.

If I understood this right.....the original charges were Class 6 felonies. With the aggravating factors proven, that elevates them to Class 4 Felonies.

Beth Karas just tweeted that jury refuses to talk with media. Judge has talked to them and both sets of attornies in talking with them.

Anyone know the minimum/max the judge could sentence on each account?

Yeah! TS DID say the 13th did not work for her! Judge looked to the 20th and found nothing so backed it up to the 6th.

She surely did...leaned over to her attorney and (smiling) said that day wasn't good for her....so the Judge chose a date one week earlier. Hahahaha....

Speculation Only: When polling the jury the 2nd time after "provens", both TS and JS were watching the jurors very closely. TS said something to her atty, and JS said something to the young man next to him. JS was glaring.

Do you think they suspect some kind of juror misconduct that they can grasp onto re appeals?

P.S. Not that I think there was any kind of midconduct at all, but they saw something that made them react, and we all know what drama queens they are. LOL

Tammi Smith convicted in Baby Gabriel case

This is a really good article which outlines the actions TS took which led to this guilty verdict.

The charges on which Smith was found guilty are Class 4 felonies that each carry sentencing range of 1 to 3.75 years. Smith's eligibility for probation on either of the charges is to be determined at a hearing before sentencing. The judge set sentencing for July 6.
