What's the point in declaring a person dead? I mean if not for insurance payout....why else would a parent want to do this when they have on proof she is dead? Is it just a way of closing the door on it?

BIRMINGHAM, Ala. -- A judge ruled Friday that Natalee Holloway's father has met the legal presumption of her death and now it's up to someone to prove she did not die six years ago on a high school graduation trip to Aruba.

Jefferson County's probate judge rejected a request by Dave Holloway's ex-wife, Beth Holloway, not to proceed with steps to declare their oldest child dead.

BIRMINGHAM, Alabama -- The five months since Natalee Holloway's father asked a Jefferson County judge to officially declare her dead have gone like the excruciating 78 months that preceded it: with no proof of his missing daughter's fate.

Lawyers for Dave Holloway don't expect to get the answer their client really wants -- evidence that the then-18-year-old who disappeared on a class trip to Aruba in 2005 is really alive.

Instead, they expect to convene in Probate Judge Alan King's courtroom on Jan. 12, and for the judge to quickly sign an order of legal presumption that she is dead, said Karen Hennecy and Mark White, Dave Holloway's lawyers.

Natalee Holloway Is Dead, Judge Decides

Missing teen Natalee Holloway was officially declared dead today in a somber courtroom in Alabama, according to an attorney representing the girl's father.

Judge Alan King signed the declaration following a hearing attended by both Holloway's parents in Brimingham, according to Mark White, the attorney for Holloway's father. The declaration will then go to the Bureau for Vital Records, which will produce a death certificate, White said.

Beth Holloway sat quietly in the back of the court room for the proceeding, according to her attorney John Q. King. She had been opposed to the idea of declaring her daughter dead because she was unwilling to give up the slight hope that Natalee might be alive somewhere, King said.

The chief suspect in the unsolved 2005 Aruba disappearance of Alabama teen Natalee Holloway appears to have made a shocking confession to an undercover reporter about having murdered her.

Dutch convicted killer Joran van der Sloot, who is in a Peru jail for the 2010 murder of a 22-year-old woman there, was captured on an undercover video admitting that he lied to the police about Holloway’s death, Radar­Online.com reported Wednesday.

Joran van der Sloot’s lawyer is disputing a video posted online Wednesday showing the convicted Dutch killer allegedly admitting to killing U.S. teen Natalee Holloway more than a decade ago in Aruba.

Van der Sloot’s lawyer, Maximo Altez, told Fox News Latino that the admission, recorded surreptitiously in prison during an inmate visit, is a fabrication.

“It’s a total lie, it’s a distorted, the video has been edited to make it look like that,” Altez said.

'And he says [to his son], "OK, wait here," and he goes back to the house and gets a burlap,' says Gabriel of Paulus' next move.

'So they grab her and put her in the back of [Paulus'] car and they drive her to a park. Amd they pick a spot, puts her in, covers her up and his dad goes, "grab that cactus, that will just cover everything up,'' continues Gabriel.

'And his dad goes, "Don't you tell nobody. Nobody." But he told John.' ..."

Ludwick, a friend of Van der Sloot's, said he helped the prime suspect in her death.

Ludwick agreed to talk after an informant provided evidence that he had been paid by Van der Sloot to dig up the body of the 18-year-old, who disappeared in Aruba on May 30, 2005.

The plan, according to Ludwick, was to try to get her remains cremated.

But in order to comply with Aruba's laws about cremation, the pair, according to Lucwick, hoped to crush her bones to the point where they would not be recognizably human.

He said: 'The idea was to crush everything to the point where it wasn’t recognizable as her bones or skull or anything like that.' ..."

Skeletal remains discovered in Aruba do not belong to Natalee Holloway

Bone fragments found during a search in Aruba do not belong to Natalee Holloway, an Alabama teenager who vanished on the island in May 2005 during a high school graduation trip.

Tests on the fragments came back negative for a possible match to Holloway, forensic scientist Jason Kolowski told the Oxygen cable network.

Natalee Holloway, a teen from Alabama, went missing in Aruba in 2005 when she was on a graduation trip.

"Out of the four individual bone samples only one was found to be human,” said Kolowski, who led the testing and interpretation of the results for the six-part Oxygen series, "The Disappearance of Natalee Holloway," that aired in August.

The DNA bone sample was ruled out as Holloway after it failed to match to her mother, Kolowski said.
