DOVER — There was no way Elizabeth "Lizzi" Marriott was dead when two grey plastic bags were put over her head, witness Roberta Gerkin of Rochester testified Monday afternoon at the murder trial of Seth Mazzaglia.

Gerkin testified on Friday and again Monday morning that Marriott's "head was purple" when she went to the Sawyer Mill apartment with her boyfriend Paul Hickok on Oct. 9, 2012. Marriott was lying on her back with one arm crossed in front of her and one behind her back. She was wearing nothing but a pair of blue thong underwear.

Mazzaglia's defense attorneys claim that it was McDonough that killed Marriott. They say Marriott suffocated during "breath play" after she put on a harness that restricts arm movement and a choker. McDonough allegedly got on top of Marriott to asphyxiate her for pleasure, a technique called "Queening."

Defendant's cellmate testifies in slain coed case

DOVER, N.H. (AP) — A former cellmate of the New Hampshire man prosecutors say raped and killed a University of New Hampshire co-ed is testifying about the defendant's plans to escape jail and to have two witnesses killed.

Cellmate Ryan Bachman says Mazzaglia gave him the code to his bank cards and instructions to buy a gun for his getaway. Bachman says he wanted him to find someone to get rid of a couple who saw Marriott's body in Mazzaglia's apartment.

Bachman says he stole Mazzaglia's money when he got out to buy drugs.

DOVER, N.H. (AP)  A University of New Hampshire student was strangled by a man who had demanded that his then-girlfriend bring him a friend to have sex with, the ex-girlfriend testified Tuesday.

Nineteen-year-old Elizabeth “Lizzi” Marriott, of Westborough, Massachusetts, went to the couple’s home thinking she was going to watch a movie or play a videogame, Kathryn McDonough testified. In reality, Seth Mazzaglia had demanded that McDonough find him a sex partner as punishment for leaving him alone for 12 days, McDonough told jurors.

Prosecutors say Marriott was raped and killed inside the couple’s Dover apartment after she rebuffed Mazzaglia’s sexual advances.

Mazzaglia “strangled her with a rope,” McDonough testified Tuesday. When asked how she knew who the killer was, she replied, “I was there.”

McDonough, 20, is the key witness against the 31-year-old Mazzaglia at his first-degree murder trial, which began last week. The case is plumbing the sexual relationship between McDonough and Mazzaglia, including their obsession with bondage, discipline and sadomasochism and their practice of inviting others to join them.

McDonough is serving a prison sentence for lying to investigators about Marriott’s disappearance and death.

She testified for hours Tuesday about her sadomasochistic relationship with Mazzaglia and the lead-up to Marriott’s killing. She didn’t give a detailed account of the Oct. 9, 2012, killing, but she was expected to return to the witness stand Wednesday.

Mazzaglia’s lawyers have told jurors that McDonough killed Marriott during rough sex. They say Mazzaglia helped dispose of her body and initially took the blame to protect McDonough. They say McDonough was the dominatrix, a woman who made Mazzaglia her sexual slave and was obsessed with finding another woman to dominate.

McDonough testified she was always the submissive or slave in their relationship and was never in the dominant role.

DOVER — Kathryn “Kat” McDonough, the former live-in girlfriend of accused murderer Seth Mazzaglia, took the stand first thing Tuesday morning at Strafford County Superior Court and immediately testified that it was Mazzaglia who killed Elizabeth "Lizzi" Marriott in October 2012.

Prosecutor Peter Hinckley’s first question to McDonough on Tuesday morning was direct.

“Ms. McDonough, who killed Elizabeth Marriott?” he asked, immediately after she was sworn in and identified herself to the jury.

“Seth Mazzaglia,” she replied, before testifying that Mazzaglia strangled Marriott with a rope and raped her limp body.

Hinckley also asked McDonough if she helped “cover up” Marriott’s death and rape afterward.

“Yes, I did,” McDonough said

After the stunning start to the fifth day of the murder trial that has horrified and riveted Strafford County and New Hampshire, Hinckley moved his questioning to 2011, when McDonough and Mazzaglia met, and began questioning her about the origin and early days of their relationship.

‘Soulmates beyond time’

McDonough said she met Mazzaglia in the spring of 2011, when they were in a theater production together in Portsmouth. She was 17 and he was 28. The relationship became romantic and sexual in October 2011, she said, when they were both working at a haunted house.

Rebuffed twice by a 19-year-old University of New Hampshire student, a man quickly incapacitated her with a rope and raped her while calling her names, the defendant's ex-girlfriend said Wednesday in emotional testimony that forced a pause in his trial.

Kathryn McDonough spent her second day on the stand Wednesday in the first-degree murder trial of Seth Mazzaglia, who is charged with killing Elizabeth "Lizzi" Marriott of Westborough, Massachusetts, at his Dover apartment on Oct. 9, 2012.

After a game of strip poker, Mazzaglia suggested to Marriott that she kiss McDonough. When Marriott said no, saying she was in a committed relationship, he said he wanted Marriott to watch McDonough and Mazzaglia have sex. Marriott again refused.

McDonough, who previously told the jury about the couple's sadomasochistic relationship, testified that Mazzaglia was unaccustomed to hearing "no."

"That's when he moved up behind her and he pulled the rope up over her head and he strangled her," she said. "She let out a quick noise and she sort of stopped. Her arms curled up against her chest and her eyes were closed."

Mazzaglia was wearing gloves and had a soft, white cotton rope the couple used in bondage sex. After Mazzaglia strangled Marriott, McDonough went into the bathroom, she said.

When she returned to the main part of the studio apartment, she said she saw Mazzaglia raping Marriott and calling her names -- her motionless body prone on the floor. Then Mazzaglia went into the bathroom and told McDonough to hold the rope around Marriott's neck, she said. McDonough said she laid the rope loosely over Marriott's neck.

DOVER, N.H. — A tearful Kathryn "Kat" McDonough said "it was because of us that she never got to live her life," as she testified Wednesday about witnessing her then-boyfriend strangle and rape Elizabeth "Lizzi" Marriott in 2012.

McDonough also testified she helped the Dover man cover up Marriott's death after she watched him strangle her from behind with a rope and rape the student's lifeless body.

At one point, prosecutor Peter Hinckley asked McDonough whether she had any remorse for not helping Marriott and remorse that, because of her actions, Marriott's body has never been found.

Near the end of a long day of questioning, Hinckley also instructed McDonough to face the jurors to answer questions about her responsibility in the cover-up.

"The horrible, horrible acts that you admitted to doing, from exploiting Lizzi, setting her up, all of the cover-up acts afterward — did you do all of that?" Hinckley asked.

"Yes, I did," said McDonough, who is serving 1 1/2 to 3 years in jail after admitting to prosecutors she helped hide evidence and get rid of Marriott's body. The jail sentence was part of an agreement in exchange for her testimony and cooperation.

Moments later, when a prosecutor projected a timeline of events on a screen, McDonough started sobbing uncontrollably. The judge called a break and she was escorted from the courtroom, still sobbing and trembling.

When court resumed, McDonough described the couple's efforts to get rid of the body.

They folded Marriott's body into a suitcase and took her to an island where she knew the currents were strong, she said. They tossed the body over a railing, but the body fell on rocks short of the water, McDonough said. DOVER — Lewd letters from an incarcerated Seth Mazzaglia to Kathryn "Kat" McDonough were revealed in court Wednesday afternoon. The writings detailed last rituals McDonough should take part in before she killed herself.

McDonough told Assistant Attorney General Peter Hinckley that Mazzaglia, who allegedly raped and killed Elizabeth "Lizzi" Marriott on Oct. 9, 2012, told her to blame witness Paul Hickok of Rochester for the crime. If that didn't work, McDonough was to say it was just an accident and get rid of Hickok and his live-in girlfriend, Roberta Gerkin.

"Paul and Roberta must leave or die appropriately," Mazzaglia wrote.

Mazzaglia planned to escape from the country with McDonough. He wanted to flee to a nation that would not extradite the couple back to the United States. If those plans did not work, McDonough said she was instructed to "commit suicide and start our life again."

McDonough explained that Mazzaglia told her they had lived together in past lives and they would be together in future lives. If their plans went off track, McDonough was to "give up on this life."

DOVER — “It was because of us that she never got to live her life.”

Those words were among many that Kathryn “Kat” McDonough, 20, tearfully uttered in court Wednesday as she testified about how she witnessed former boyfriend Seth Mazzaglia, 31, kill University of New Hampshire sophomore Elizabeth “Lizzi” Marriott in October 2012.

McDonough, formerly of Portsmouth, also testified that she helped the Dover man cover up Marriott's Oct. 9, 2012, death after she watched him forcibly strangle Marriott from behind using rope and rape the student's lifeless body.

Hinckley also asked McDonough to admit that she committed “more” than the crimes for which she has pleaded guilty to “cover up what happened to Lizzi” and to tell jurors that she won't be punished for additional crimes if she provides truthful testimony against Mazzaglia.

McDonough said she also agreed to do a variety of things to help cover it up that night. She testified that she, allegedly at Mazzaglia's request, helped transport Marriott's body to Portsmouth, drag her body into the water below a rocky cliff off Peirce Island, and cover the body with seaweed.

McDonough said she helped Mazzaglia dump the body after two of his friends, Roberta Gerkin and Paul Hikock, saw Marriott's lifeless body in the apartment on Oct. 9, 2012. Before Gerkin and Hikock arrived, McDonough said, Mazzaglia had her stage the body to make it look like Marriott died during bondage sex. McDonough said Mazzaglia also asked her to put a plastic grocery bag over Marriott's head and tie it tightly in order for Gerkin and Hikock to not be able to identify Marriott.

The actions to cover up Marriott's murder continued in the following days and weeks during conversations with investigators, Mazzaglia's defense team and others, according to McDonough. She even talked with Mazzaglia over a jailhouse phone about marriage, how he was “going to be getting out soon” and how they were going to start a bed and breakfast together.

Hinckley asked McDonough to explain how she could, at the time, still desire a life and future with a man she “saw murder and rape Lizzi Marriott.” McDonough responded with two different explanations.

“I was just so in love and enthralled by him,” she said. “It was also just easier and not having to deal with the truth of what was happening. It was easier to just play along … and pretend that everything was going to be OK.”

McDonough said she ultimately decided to tell the truth for the first time, before a grand jury on Feb. 15, 2013, after being granted immunity in exchange for her testimony against Mazzaglia. That immunity means she cannot be prosecuted for crimes she committed on Oct. 9, 2012, so long as she tells the truth, according to Hinckley.

While explaining why she told the truth for the first time, McDonough didn't reference Marriott by name and didn't express any statements of remorse about her death.

Prosecutors done with girlfriend in "Lizzi" Marriott case

DOVER, N.H. - Prosecutors have ended two-plus days of questioning the key witness in the trial of Seth Mazzaglia - the man charged with raping and killing University of New Hampshire student Elizabeth "Lizzi" Marriott.

Mazzaglia is charged with first-degree murder in connection with the October 2012 death of the 19-year-old Marriott of Westborough, Massachusetts. Prosecutors say he strangled her, raped her then helped dump her body in a river after she rejected his sexual advances.

Thursday morning, Assistant Attorney General Peter Hinckley dismissed Mazzaglia's ex-girlfriend, Kathryn McDonough, with the question: "Who strangled Lizzi Marriott to death?"

McDonough answered: "Seth did."

Defense: Key Witness In Lizzi Marriott Murder Changed Story For Lighter Sentence

DOVER, N.H. (AP) — The defense attorney for a man charged with raping and killing a University of New Hampshire student spent his first day cross-examining the state’s star witness trying to convince jurors she was possessed by imaginary characters she had created.

Defense attorney Joachim Barth also asserted the witness, Kathryn McDonough, changed her story and shifted the blame from herself to defendant Seth Mazzaglia, her ex-boyfriend, just to get a reduced sentence.

McDonough, 20, testified Thursday the imaginary characters she began creating during childhood were to help her get through difficult situations.

Barth opened his cross-examination reminding McDonough that she gave a statement to him and his investigators two days after Mazzaglia’s arrest and told them Marriott died while McDonough was having sex with her with a restraint that kept Marriott from raising her head. McDonough told the defense team that Marriott had a seizure and died.

McDonough agreed that was what she said at the time.

Barth emphasized that she changed her story only after she was given an immunity deal “to reduce your years in prison.” McDonough agreed with the timing.

Barth spent several hours going over Facebook pages dating to 2011 and other conversations with Mazzaglia, 31, and others in which she talked of other characters or personas she had created. She testified repeatedly Thursday that they were “masks” she would use when she wanted to be stronger.

DOVER — The defense for accused murderer Seth Mazzaglia began its cross-examination of Kathryn “Kat” McDonough, Mazzaglia’s former live-in girlfriend, Thursday by attacking her credibility on multiple fronts.

“Were you affected on the night of Oct. 9, 2012, when Lizzi Marriott was in your apartment, by voices and characters in your mind?” defense attorney Joachim Barth asked McDonough.

“No,” she replied.

Barth then cited transcripts of a November 2012 conversation McDonough had with Roberta Gerkin, a former psychic and friend of Mazzaglia’s. Barth said McDonough told Gerkin a “spirit” was “leading” her and struggling for control of her body.

McDonough said she never truly believed that statement to Gerkin and meant instead that the spirit had since been “blocking her memory of what happened that night.”

Barth reminded McDonough, 20, that they had met at his office just days after Mazzaglia was arrested for murder on Oct. 13, 2012.

Barth said during that meeting, McDonough told him Marriott died at least partially of natural causes after participating in sexual acts with her and Mazzaglia.

“You described that she had a seizure, and subsequently died,” Barth said. “You have since changed that story, is that right?”

When McDonough agreed, Barth noted that the changes to McDonough’s version of events that night came while McDonough was engaged in pursuing an immunity agreement that would reduce her years in prison and prevent her from facing any other related charges.

DOVER — Seth Mazzaglia's defense team used its first day of cross-examination of the state's star witness Thursday to try to show that the witness, Kathryn “Kat” McDonough, has told people she has been hearing voices for years and has claimed she had a spirit in her head fighting for control of her body the night Mazzaglia allegedly strangled a college student.

“These are your words — '(Anay) was leading me with adjectives,'” said Barth while reading from transcripts of the conversation. “What you're talking about here is Anay trying to get control of (your) body.” McDonough replied that she had no “effects” of any spirits or voices in her head on Oct. 9, 2012, and that she lied to Gerkin because she didn't want to reveal what really happened that night. She claimed she was trying to convince Gerkin that she couldn't remember anything that happened to Marriott because Anay had the ability to “control” and “block” her memory of different events.

“I was trying to make it sound believable,” McDonough said. “I knew what happened to Lizzi that night. I was aware, but I did not want to tell Roberta.”

Testimony on coverup

Thursday's portion of the trial began with the state asking McDonough about a coded, three-page letter that Mazzaglia sent to McDonough after he was arrested for Marriott's murder. The detailed and sexually explicit letter, which prosecutor Peter Hinckley read aloud in court, allegedly described a false version of Marriott's death as well as how Mazzaglia wanted to cast blame onto someone else for killing Marriott.

McDonough testified that the letter instructed her to tell police that Marriott expressed an interest in joining them in bondage-style sex after they began playing strip poker in Mazzaglia's apartment on Oct. 9, 2012. She said the letter instructed her to say that the trio engaged in a number of sexual acts before Marriott began having a seizure while Mazzaglia had sex with Marriott and McDonough was sitting on top of Marriott.

The letter also instructed McDonough to tell police that Marriott began having difficulty breathing because of the way she was restrained with rope and because of the nature of the sexual act she was performing on McDonough. Upon seeing that Marriott's eyes began “rolling up and fluttering” and her arms began “flexing up,” Mazzaglia began to “panic” and stopped having sex with Marriott, according to the story described in the letter.

DOVER — Kathryn “Kat” McDonough, the state's star witness in the murder trial for a man accused of killing a University of New Hampshire student, admitted on the stand Friday that she didn't describe the man, her former boyfriend, as “controlling” until after the state granted her immunity in the case.

While testifying in court for the fourth straight day and the second straight day of cross-examination, McDonough publicly admitted for the first time Friday that it wasn't until the state offered her immunity and a plea deal that she started to consider Mazzaglia's words, actions, and bondage-style sex preferences as dominant behavior.

“I started realizing how many decisions and how many opportunities I had lost because I was in a relationship with him,” said McDonough, who prior to her immunity described Mazzaglia as loving and supportive. “I felt like I didn't have any control in the relationship. It wasn't until I was (out on bail and given the offer) that I had a lot of time to think (about this). I did a lot of thinking.”

The admission came on the eighth day of Mazzaglia's trial. Earlier in the trial, McDonough testified that she watched Mazzaglia use a rope to strangle Marriott from behind after Marriott declined several invitations to engage in sexual activity after a strip poker game in Mazzaglia's apartment.

The defense insists that 'Kat' sexually dominated Seth.

Mazzaglia's lawyer is laying the foundation to accuse 'Kat' of the killing of Lizzi Marriott.

He is trying to switch the blame to 'Kat', who already made a deal with the prosecution, to exonerate his client of the murder.

I hope his tactic does not resonate with the jury.

I think the defense "impeachment" of Kat's testimony is a total distraction from the facts that have been presented to the jury.

DOVER — The defense team for a murder suspect Seth Mazzaglia attempted to show during the ninth day of his trial on Monday that Mazzaglia's bisexual former girlfriend wasn't forced to lure alleged murder victim Elizabeth “Lizzi” Marriott to his apartment.

Instead, the defense claimed it was girlfriend Kathryn “Kat” McDonough — not Mazzaglia — who was interested in dominating another woman during sex.

McDonough, 20, the state's star witness, admitted on the stand Monday during her third day of cross-examination that she was “intrigued” about sexually dominating another woman and about “what being a dom was like.” McDonough has previously accused Mazzaglia, 31, of Dover, of strangling to death Marriott, a 19-year-old University of New Hampshire sophomore. The death allegedly occurred on Oct. 9, 2012, after Marriott rebuffed his sexual requests. The defense used McDonough's admission Monday, though, as well as a number of Facebook exchanges to cast doubt on that notion while trying to show jurors it Mazzaglia was the submissive one in their relationship.
