McDonough pleaded guilty in July to helping to dispose of Marriott’s body and lying to investigators and was sentenced to 1½ to three years in prison, in exchange for cooperating testimony during Mazzaglia’s trial. She claims she and Mazzaglia engaged in bondage and sadomasochism sexual activities and that her former boyfriend strangled Marriott on Oct. 9, 2012, after Marriott said no to a threesome.

Mazzaglia’s attorneys allege it was McDonough who killed Marriott by smothering her during a consensual sex act.

Barth asked McDonough why, after a game of strip poker, that Mazzaglia put on a robe and served her and Marriott glasses of cider, while the women remained undressed. McDonough said she put her glasses and rings on.

The defense attorney asked McDonough what happened to the glasses of cider while Mazzaglia allegedly strangled Marriott from behind and why McDonough never mentioned the cider to investigators early in the investigation.

“Did a glass go flying out of Lizzi’s hand?” Barth asked.

“I don’t know, I assume they got cleaned up,” McDonough said. “I didn’t think about that. He was murdering her and I wasn’t thinking about the glasses.”

“Because that never happened, it was fiction,” Barth snapped back

McDonough was also asked why she told the grand jury that she and Mazzaglia had bagged all of the ropes they had in their shared Dover apartment and disposed of them.

“They had nothing to do with her strangulation,” Barth said. “They were all removed because there was consensual BDSM sex, right?”

“No,” said McDonough.

Outburst as ex-girlfriend recounts rape, killing

DOVER, N.H. (AP) - The star witness against a man charged with raping and strangling a University of New Hampshire college student broke down on the stand Tuesday, saying she can’t get the image of the victim’s death out of her mind.

Defense attorney Joachim Barth immediately challenged the authenticity of her outburst.

“You cry without tears, Ms. McDonough?” he said.

McDonough originally told defense investigators that she and Marriott were engaged in rough sex involving restraints when Marriott died. She said she lied to protect Mazzaglia but changed her story after being given immunity from prosecution. She is serving a 1 1/2-to-3-year sentence after pleading guilty last July to conspiracy, hindering the prosecution and witness tampering. Her plea deal hinges on her testimony against Mazzaglia.

Barth has peppered McDonough with questions in a bid to undermine her credibility. He questioned her about details she omitted from her grand jury testimony last year, including a text message she received from Mazzaglia that she has testified was a coded reference to an imminent sexual advance on Marriott in the Dover apartment the couple shared. She testified she lured Marriott, her friend and co-worker, to the apartment because Mazzaglia wanted women to join their sexual relationship.

McDonough talked with investigators from Barth’s office two days after Mazzaglia’s arrest on Oct. 13, 2012. She had testified she told them one of the stories she had Mazzaglia had concocted to cover the killing, saying Marriott had a seizure and died during rough sex.

“In our office you didn’t cry, you didn’t flinch,” Barth pointed out to her Tuesday.

She answered that it was because she was telling them a lie.

“It wasn’t real,” she said. “I was able to push the images aside and keep up with the fake story I was telling you.”

Defense lawyers played an hour-long videotape of then-18-year-old Kathryn McDonough reviewing a statement in which she said she caused the death of 19-year-old Elizabeth “Lizzi” Marriott during rough sex on Oct. 9, 2012. McDonough is a former girlfriend of 31-year-old Seth Mazzaglia, who is charged with first-degree murder.

The video was made a week after Marriott died and two days after McDonough told defense investigators Marriott, of Westborough, Massachusetts, had a seizure and stopped breathing during sex with McDonough involving restraints.

Defense grills McDonough about night of Marriott's death, past sworn statements in Mazzaglia murder trial

DOVER – A public defender questioned accused murderer Seth Mazzaglia’s former live-in girlfriend extensively Wednesday morning about her actions and thoughts on the October 2012 night when a student died in their apartment, grilling her about numerous uncertainties and inconsistencies compared to her testimony last week and her statements to a grand jury in February 2013.

The questioning suggested a starkly different version of events – and a much greater role for the witness, Kathryn "Kat" McDonough, in the Oct. 9, 2012, death of 19-year-old Elizabeth “Lizzi” Marriott than what McDonough described in her direct testimony last week.

McDonough began her seventh day on the stand in Mazzaglia’s trial Wednesday morning.

Defense attorney Joachim Barth resumed his questioning about the moment when McDonough had testified she walked to a window of the Dover studio apartment that she and Mazzaglia shared while, McDonough said, Mazzaglia strangled Marriott from behind with a rope.

McDonough has testified that she went to the window overlooking the Bellamy River during the murder because it was a place she previously had gone to in times of stress.

Barth disagreed.

“You went over to the window to hide what you had just done,” said Barth, who accused McDonough in opening statements May 28 of killing Marriott during a night of rough sex.

McDonough reiterated Wednesday that she “had no idea what to do” as Mazzaglia began to strangle Marriott.

“I had to get away from the murder. I didn’t think there was anything I could do to stop it,” McDonough said. “I was afraid that he would kill me if I tried to stop him.”

Barth questioned McDonough's decision to move toward a window and her lack of action while there.

“You did not go in the opposite direction, toward the door,” Barth said. “Your instincts for survival did not prompt you to scream out the open window as you stood in front of it. …Your instincts for survival did not prompt you to try to get the attention of neighbors directly across the river.”

DOVER — Assistant Attorney General Peter Hinckley characterized the story Kathryn "Kat" McDonough told Seth Mazzaglia's public defenders in 2012 as a fantastical lie as he began his redirect examination of the state's star witness Thursday morning.

Yesterday, jurors saw a video of McDonough, who was 18 at the time, getting down on her knees to demonstrate how she sat on Elizabeth "Lizzi" Marriott's face for 10 to 15 minutes on the night the University of New Hampshire transfer student died.

"You said you were both slapping and choking Lizzi with a rope?" Hinckley asked McDonough. "And then you sat on Lizzi's face, right?"

McDonough confirmed that she "made it all up."

Hinckley asked McDonough if she had ever been tied up using a complicated harness like the one she told public defenders Marriott willingly put on.

"Have you ever been tied up like that and had your mouth duct-taped shut?" Hinckley asked.

"No," McDonough responded.

DOVER — Codefendant in the Seth Mazzaglia murder trial, Kathryn “Kat” McDonough was described Thursday as delusional, a chronic liar and callous with regard to her role in the death of Elizabeth “Lizzi” Marriott.

“In addition to your challenges of truth and reality, you have no appreciation for Ms. Marriott’s life,” defense attorney Joachim Barth told McDonough.

But when prosecutor Peter Hinckley later took a turn questioning McDonough, her testimony changed to include descriptions of Mazzaglia as a dominating liar, with multiple “personas,” who consulted tarot cards to pick his lawyer to defend against murder charges.

Hinckley later questioned McDonough about a six-page letter Mazzaglia had given her with “his own lies.” The letter included a detailed script of what McDonough was supposed to tell investigators about Marriott’s death, Hinckley said. That version was similar to, but had different details than a story McDonough first told police, but later said was a lie, she concurred.

“The two of you can’t get the lies straight, right?” Hinckley asked McDonough.

“Right, it was a lie,” she said.”

“These are very different versions of events that the two of you can’t get straight because they’re lies,” Hinckley said.

Grand jury testimony on student’s slaying heard

DOVER, N.H. (AP) - Jurors in the murder trial of a man accused of killing a University of New Hampshire student listened Friday to his ex-girlfriend’s grand jury testimony last year of what she says happened the night 19-year-old Elizabeth “Lizzi” Marriott was raped and strangled.

Kathryn McDonough, 20, sat in the witness chair as prosecutors played the tape of her February 2013 testimony, in which she says Seth Mazzaglia strangled Marriott when she rejected his sexual advances and then raped her motionless body.

McDonough, who spent her ninth day on the witness stand Friday, has said her grant jury testimony marked the first time after the killing that she told the truth about Mazzaglia.

Damage control for star witness in Seth Mazzaglia trial

DOVER, N.H. — The prosecution in the sex game murder trial of Seth Mazzaglia scrambled to restore credibility to the state’s star witness yesterday by attacking defense lawyers for cherry-picking details.

Granite State Assistant Attorney General Peter Hinckley said Mazzaglia’s lawyer ignored claims by eyewitness Kathryn “Kat” McDonough that the accused murderer participated in bondage sex with the victim, who had her mouth duct-taped.

Mazzaglia, 31, is relying on an initial admission to defense lawyers by McDonough, 20, that she suffocated Elizabeth “Lizzi” Marriott, 19, on Oct. 9, 2012, during rough sex by sitting on her face to set him free. It’s a claim McDonough reneged after securing a plea deal, she has testified. That plea deal gives her no more than three years in prison in exchange for her testimony.

Hinckley called the claim Marriott would agree to “extreme” bondage sex that included duct tape with McDonough and Mazzaglia as “fantastic” and “ridiculous.”

DOVER — Thursday started and ended with a bang at the Seth Mazzaglia murder trial.

During the morning session, star witness Kathryn “Kat” McDonough told public defender Joachim Barth off after he finished her cross-examination.

And just before the day ended at 4 p.m., Assistant Attorney General Peter Hinckley revealed passages from Mazzaglia's online profile at Fetlife.com, a free social networking website for BDSM and fetish enthusiasts.

Mazzaglia, 31, of Dover, was actively searching for “two slaves and one or two switches” for sexual satisfaction when he allegedly raped and killed Elizabeth “Lizzi” Marriott on Oct. 9, 2012.

Before the day ended, Hinckley read jurors postings from Mazzaglia's Fetlife.com account.

Mazzaglia, who described himself as “in a relationship,” was openly soliciting a couple of different companions to fulfill his sexual desires. He listed a lifetime relationship, a play partner and a “princess by day, slut by night.”

Mazzaglia hoped to recruit two 'slaves' and one or two 'switches' for BDSM.

Mazzaglia said one slave would need to be available 24 hours a day, seven days a week to “keep house and serve us at any time.”

Slaves would have to be athletic/slim/slender, Mazzaglia wrote. At least one of the slaves must have “long, dark hair.”

The switches and subordinates Mazzaglia was hoping to find were “another story.” Mazzaglia wrote that he was open to just about anything. He said he was looking for someone to be “my company, my friend.”

The Judge has ruled on the audio tape requests... the 'tarot card' call ... he doesn't see how its within the scope of re-direct... so it is denied. DOVER – Defense attorney Joachim Barth asked Kathryn “Kat” McDonough on Monday morning why she wouldn’t tell his office the truth about the death of UNH student Elizabeth “Lizzi" Marriott if McDonough knew his legal team was trying to help her ex-boyfriend, accused murderer Seth Mazzaglia.

Barth pounced on the point after McDonough said, in her 10th day on the stand in Strafford County Superior Court, that when she gave a statement in Barth’s office just days after Marriott’s death on Oct. 9, 2012, she could have told the l;awyers Mazzaglia “had murdered 1,000 people” and Barth’s team, as Mazzaglia’s defense, still would have tried to help him.

He checked the area around and in the vehicle without entering it.. and had it towed to the police secure facility in Dover. He told the tow driver to wear gloves and touch the vehicle as little as possible.

The officer says the made an inventory of what was in the vehicle... and while he didn't find a GPS, he did find a power chord for a TOMTOM as well as an owner's manual.
