Toronto cop to appear in court on murder charge in streetcar shooting death

TORONTO - A Toronto police officer is set to appear in court today to face a rare murder charge in the death of a young man on a streetcar.

Const. James Forcillo was charged Monday with second-degree murder in 18-year-old Sammy Yatim's death last month.

Yatim's shooting was captured on cellphone and surveillance video on which nine shots can be heard, seconds after shouts for Yatim to drop a knife.

Ontario's Special Investigations Unit says Forcillo has arranged through his lawyer to turn himself in this morning, at which time he will be taken into custody and appear in court.

Since the officer has received threats, the SIU would not say where Forcillo will surrender himself.

here's the 18 year old getting killed ~

the 18 yr old called the cop a "Pussy" so the cop shot him 9 times. Shot him 3 times, the kid fell, then the cop shot the kid 6 more times. The cop only had 9 bullets.

I would like to add that my grandfather was a cop for 32 years. Never once in 32 years did he ever draw his gun from its holster.

My grandfather knew how to "Talk anyone down..........."

A judicial pretrial has been set for James Forcillo for this September, but the Toronto police officer is not expected to stand trial in the shooting death of Sammy Yatim until late next year.

Attempted murder charge in Forcillo trial continues to puzzle legal experts

A significant decision made quietly by the Crown this summer in the prosecution of Toronto police officer James Forcillo in the shooting death of an 18-year-old man on a streetcar last year continues to puzzle legal experts who say it is a highly unusual strategy in a murder trial.

Constable Forcillo was originally charged with second-degree murder in the July 2013 shooting death of Sammy Yatim.

After the officer was committed by a provincial court judge this summer to stand trial on the murder charge, Crown attorney Milan Rupic submitted a new indictment which includes a second count of attempted murder.

Lawyers for the Crown and defence met with an Ontario Superior Court judge for a standard judicial pretrial meeting this week – one of many court appearances likely to occur before a jury is selected some time next year.
