Casey Anthony's attorneys want Texas EquuSearch to turn over all of its records

Attorneys for Casey Anthony want Texas EquuSearch, a nonprofit volunteer search group, to turn over all of its records regarding the search last year for slain toddler Caylee Anthony.
Jose Baez filed the paperwork in court Monday asking the judge to order EquuSearch founder Tim Miller to turn over information — such as names and phone numbers — for the thousands who volunteered to look for the missing 2-year-old Orange County girl.
The nonprofit, represented by Orlando attorney Mark NeJame, has given Casey Anthony's defense attorneys information about 32 people who searched in the area between Hidden Oaks Elementary School and the area near Suburban and Hopespring drives, where Caylee's body was found.
The child's remains were found Dec. 11 less than a mile from her home in a wooded lot near Suburban and Hopespring drives.
Casey Anthony was indicted in October 2008 on a first-degree murder charge in the death of her daughter.
Casey Anthony waited 31 days to report her child missing to police, and claimed the girl's nanny kidnapped her. Investigators determined the nanny does not exist.
EquuSearch scoured several hundred acres throughout Orange County on two occasions to search for the girl last year.
EquuSearch claims none of the thousands of volunteers ever searched the exact area where Caylee's remains were found, according to court documents.
The motion was filed after Casey Anthony's defense attorneys found two people, not listed in EquuSearch's documents, who stated they searched the exact area where the skeletal remains were found.
Searcher Joe Jordan claims he searched the area on Sept. 1, 2008 with five or six others, including a dog handler named Danny Ibison and another dog handler from the Panama City Sheriff's Office, court documents show.
Another woman, Laura Buchanan, of Mendham, N.J., said that on Sept. 3, 2008 she searched "near the privacy fence and worked my way towards and then beyond the spot where the body was found," according to a sworn statement.
Both Buchanan and Jordan said there was no indication a dead or decaying body was in the area when they searched.

seriously, would you spend your valuable time to volunteer to help search for a missing child, if you KNEW one day your name, phone #, ect would be out there.. and you would then be a potential scape goat for murderers and their bottom feeding attorneys...

Give him an inch and he'll take a mile...I just knew he had to come up with another tactic to keep this in the limelight...All he has more than likely done is re-word his first request for these records...I hope Mr. Nejame sticks to his guns with TM representation...Aren't there still motions that Good Judge Stan needs to rule on before this one???

Texas EquuSearch already turned over records for a few dozen volunteers but the defense wants all the names and phone numbers of thousands of volunteers.
Casey Anthony has pleaded not guilty on charges that she killed her daughter, 2-year-old Caylee Marie , claiming a babysitter kidnapped her toddler. Caylee was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's Suburban Drive home in December.
Volunteer Joseph Jordan says in a signed written statement that on September 1, 2008 he and a couple dozen other search volunteers searched the stockade fence along the south side of Suburban Drive near Hope Springs Street. Jordan says one of the volunteers with him was a man with his search dog and a Panama City Sheriff’s Deputy with one of his dogs.
Another volunteer, Laura Buchanan who now lives in Mendham, New Jersey, says in a signed written statement that she was part of a search team who on September 3, 2008 also searched the same area where Caylee’s remains were found and did not find anything unusual.
Casey Anthony has been behind bars in the Orange County Jail since October 14, 2008 after a grand jury handed down a murder indictment that day. Her defense team has said that someone else placed Caylee’s remains where they were found after Anthony was locked up.
The court has not scheduled at date for the motion to be heard.

Here's what I find interesting. Baez, you can't have it BOTH ways. First he wants to say the dog's aren't reliable and give us all the records on these incompetent animals. Even CA said the dogs aren't consistent and hit inconsistently. They all claim junk science.
But NOW, well, there was a dog THERE in the woods and he DIDN'T smell ANYTHING!

If the witnesses claim proves true, it could support the defense's claim that a stranger dumped the toddler's body in the woods while Casey Anthony was already in jail.
In 2008, Texas Equusearch's founder, Tim Miller, recruited hundreds of volunteers to search for Caylee Anthony. Earlier this year, a judge ordered Miller to give Casey Anthony's defense team the names of 32 volunteers who searched the woods off Suburban Drive, where Caylee's body was later found.
The defense team said Monday they've located two additional volunteers whose names did not appear on the list provided by Miller, both of whom claim they were in the same area on where the toddler's body was found, but did not find Caylee.
One of the volunteers, Laura Buchanan, of New Jersey, submitted a sworn statement that may provide ammunition for Casey Anthony's defense.
In the statement, Buchanan wrote:
"On Sept. 3, 2008 … I personally searched near the privacy fence and worked my way towards, and then the spot, where the body was found.
I did not notice anything unusual. I did not notice a strange smell. I noticed no buzzards, nor unusual animal or insect activity.
It is my opinion that the remains of Caylee Anthony were not there during the time of our search."

IMO, the uphill battle of the defense here is they they are trying to prove a NEGATIVE. You can't prove a negative. The forensics say the remains were there for upwards of 4 months..... a searcher could easily have missed seeing the bag in that dense brush.... even if they were practically right up on top of it.
Not only that, these two searchers say they searched Sept. 1 and 3...... wasn't that area under water then? I wonder who the jury will believe. Tim Miller (and the meteorological reports from that time) or these two people who could have completely missed seeing the remains?? They may have good intentions (I don't know...), but I believe they are COMPLETELY MISTAKEN.

This is a picture of TES searchers searching near the Anthony home off of Suburban Way.... it shows just how dense those woods were.... how can ANYONE prove Caylee's remains weren't hidden among this brush. They can only prove they didn't find her!!!!

Since then, Caylee's mother, Casey Anthony, has been charged with child neglect, making false statements and obstructing an investigation for allegedly lying to the police.
"It was close to home. We wanted to help," Jordan said. "The family seemed really frustrated and, initially, that's what prompted us to go out and try to help."
Jordan began looking for information online and quickly found others who also were eager to volunteer for an independent search, but law enforcement experts question how much amateurs can really help and point out that, in some cases, they can even do harm.
Using message boards on the Web sites Websleuths.com and Sacredmonkeys.com, Jordan found those fellow amateurs -- other concerned citizens who wanted to organize search parties for the young girl.
"I've been going out every day after work and we do a big group thing on the weekends," Jordan said. "The [Orange County] Sheriff's office has been phenomenal. They've been very responsive to our calls."
In an unsolved case such as Caylee's, tips from authorities are constantly solicited from the community and, in this case, stoked by sordid allegations and the media frenzy that followed, tips have been coming in droves.
Earlier this week, the state's attorney's office released more than 400 pages of court documents that included an arrest report and transcripts of witness interviews. Those documents included allegations that Caylee's mother wanted to give her up for adoption while she was pregnant, and deleted more than 200 online digital photos of her daughter.
A $225,000 reward is being offered for information that could lead to Caylee's safe return.
The sheriff's department has received more than 2,000 tips, according to Jim Solomons, a spokesman for the department.
"Anything that comes to us that's open-ended, they are looked at without hesitation. We let the investigators pick and choose what they want to follow up on," Solomons said. "But in a case like this, and I've been doing this for 23 years, I go back to that [idea]: it's that one little obscure piece of information that can turn the light in the right direction."

Just like Roy Kronk, IMO. I think there were a lot of people who lived in that area who probably searched a lot and couldn't get this out of their mind. I just know if I lived there, I would have been searching too. I don't know that I would have only looked with organized searchers. Unfortunately for Kronk, it was him who found her. Fortunately for Caylee, of course.

another q about the dogs presence in november... I wonder, IF the claims are true from KCs friends, that this was virtually a pet cemetary, if the handlers (people WITH the dogs) didnt allow them to pay too much interest to the area because it was known to contain remains of several deceased animals... i know the dogs can differenciate between animal and human decomp, but could it possibly have been a distraction??

Thank you for the cadaver dog link, AJ.... very interesting.
We have heard several experts says that under the conditions of that area at that time, Caylee's little body could have been completely skeletonized within just weeks.

This poor child's body is nothing but ashes now, and yet the defense will continue on with their despicable carnivorous claims, hoping to locate something that will provide that one little seed of doubt to use in their juror intimidation ploy. They will then attack every potential juror until they find the chosen one. A candidate who is possibly hesitant, who lacks the confidence of self-esteem, and who could be intimidated by an intentional emotional display by a intelligent hard-nosed defense attorney.

I am very well aware that 11 new motions and memorandums were filed on the day before Thanksgiving, but I think because this one was quietly introduced and sandwiched between Roy and the latest round, no one noticed it. I did. I might write something about those new court filings, but until then, I’ll be content with Richard Hornsby’s explanation in response to a comment query:
All of these motions are standard motions filed in Death Penalty cases. They are necessary to preserve constitutional objections in the event the United States Supreme Court later decides that certain death penalty procedures are unconstitutional.
However, the Statement of Particulars should have been filed a long time ago. It will help enlighten us as to what exactly the State’s theory is behind the First Degree Murder charge.

A critical part of any homicide case, for both the prosecution and defense, is determining how and when the victim died. Necessary to this determination is finding the deceased’s body and determining at what time it was placed in the location it was found. While the Casey pundits were screaming, “They went that-a-way,” and all eyes focused on the Memorandum of Law in Support of Defendant’s Motion in Limine to Introduce Prior Bad Acts and other Circumstantial Evidence Pertaining to Roy M. Kronk, I was looking there and somewhere else. Four days after the “perverted” Roy Kronk motion was filed, another one was, too. Quickly, does anyone know what it was?

The Hinky Meter
On November 23, 2009, Casey’s defense team filed a motion to modify the courts order in request to the defense’s previous application for a subpoena duces tecum requesting documents from Tim Miller’s Texas Equusearch (TES) concerning the volunteers involved in the search for Caylee in 2008. In particular this motion requests all records for all searchers. Previously the court had ruled that the documents that TES would have to turn over to the defense would be limited to information on those volunteers who searched within a given radius of the location where Caylee’s remains would ultimately be found. This new motion requests a modification to allow the defense copies of information on ALL volunteers involved in the TES searches. The request is backed by the argument that the defense team, has on their own, found two witnesses who claim to have been involved in the TES searches and whose information was not turned over in the previously limited subpoena duces tecum.
