Defense Files New Motion to Seal Jail Records
Casey Anthony team cites new ruling in latest attempt to seal jail records
Releasing visitation logs, commissary records and telephone conversations 'serves only to embarrass and invade the privacy of the defendant,' the Casey Anthony defense team says in a new request.

Her lawyers cite a new ruling out of the 4th District Court of Appeal, stemming from a public-records request by the Sun-Sentinel in South Florida.
The newspaper made a public-records request through the Broward County Sheriff's Office for the recordings of phone conversations of incarcerated defendants in a high-profile criminal case there.
The defendants, minors charged as adults in a second-degree murder case, argued that release of their calls "would prejudice their defense by increasing public scrutiny on issues collateral to the case and would violate their rights to due process and a fair trial."
The trial court there issued an order for the Sheriff's Office not to release any recordings that included admissions; but the department could release any other recordings to the paper.
But the appellate court late last month found that the newspaper was not entitled to any of the recorded phone calls. The ruling found that treating such calls as public records would allow "anyone to request the recorded calls."
It found that "an accused child should be able to consult with a parent without the communication becoming a public record."
Finally, the DCA concluded, "An inmate's personal phone calls do not in any way reflect the actions of government and releasing the calls would not further the purpose of the Public Records act."

The next to the last paragraph explains it to me...Casey is not a child!!! Therefore IMO she doesn't qualify for the sealing...The only sealing she qualifies for is plastic wrap...need I explain???

Does no one on the defense team have a brain? Can they not look at that fat bitch and tell she is not a child, and hasn't been a child for almost 10 years.

I hope Judge Perry rips him a new one while explaining to him that "child" here sounds as if it is being defined as "an underaged juvenile" not simply "biological offspring", aka "spawn".

On October 15, 2010, criminal defense attorney Jose Baez filed a Motion For Reconsideration of his previously rejected request to seal from the public jail records of his client, convicted felon Casey Anthony.

The Orlando Sentinel has filed a motion in court arguing against the Casey Anthony defense team's efforts to have Orange County Jail records sealed in the high-profile case.
Citing a new appellate court decision in South Florida, the Casey Anthony defense team recently filed a motion to seal the woman's jail commissary records and telephone and visitation logs.
But today the Sentinel responded with its own motion, saying the Casey Anthony team's "argument is misplaced."
" Florida's Constitution and Public Records Act contemplates the disclosure of all records made or received by an agency in connection with the transaction of official business," states the Sentinel's motion to intervene. "The fact that there is no exemption for the public records at issue means that the legislature never contemplated that the documents would remain secret."
