~Snipped~
As 24 Hour News 8 first reported in November 2010, Stewart's defense attorneys asked Judge Paul Stutesman to recuse himself after they claim they overheard a conversation between Stutesman and prosecuting attorney John McDonough.
Court documents stated the phone call started as a conference call between the defense, prosecution and judge. After the call was over, the defense attorneys stated they heard Stutesman and McDonough discussing the case, and even claimed the judge offered McDonough help with the case.
Both men denied any wrongdoing and several courts agreed that nothing improper happened. Stutesman went on to preside over the case.
~Snipped~
The court of appeals made no decision Wednesday. Generally, the court issues a ruling within two to four weeks.

Venus Stewart, Michigan Mom, Killed By Husband 700 Miles Away
by 2Paragraphs in Culture | May 17, 2015
Venus Stewart, family photo
Venus Stewart, a young mother of two, went out to the mailbox one morning in her pajamas and hadn’t been seen since. She left her purse, her car, her kids – she left everything behind. She and her two children were staying at her parents’ home in Michigan. Her father called 911 that morning. When a young person disappears, police usually ask family to wait 24-48 hours. Stewart was 35. But one police officer sensed Venus didn’t just leave on her own volition. He was correct.
Venus Stewart was abducted and killed by her estranged husband Doug Stewart. Doug had an accomplice, a friend named Ricky Spencer, who acted as Doug’s impostor and alibi after Doug killed Venus. Spencer dressed like Doug and used Doug’s credit cards in Virginia while Doug was killing his wife in Michigan, 700 miles away. Spencer testified that he was hoping Doug wouldn’t go through with it but he did agree to help Doug carry out his plan. One year later, in 2011, Doug Stewart was sentenced to life in prison without parole. He continues to plead his innocence. Stewart's body has not been found. Dateline NBC will feature the murder case of Venus Stewart on May 17 at 7pm.

Re: Venus Stewart Never Found -- Douglas Stewart Convicted of Murder
Murdered But Without a Body, Family Still Searching for Answers
On April 26, 2010, Venus Stewart was abducted -- but her body has never been found. Her aunt, Mary Hopkins, says she feels the loss of her beloved niece every day. And Mary is doing whatever she can for her.
The case of Venus Stewart, whose estranged husband Doug was convicted of murder in 2011, aired on Dateline NBC Sunday night.
As producer of the program, I know how much Mary has taken Venus's loss to heart. From the beginning, she organized searches for Venus's body throughout the vast western Michigan countryside of fields, woods and farms.
And today, she and other dedicated friends and family are still searching, "about twice a month, as tips come in," Mary said in a telephone interview. The searchers look in places where Doug Stewart "rode his four-wheeler," she said, and wherever leads about possible shallow graves take them.

Mary said she hopes The Venus Foundation will help Venus be remembered as "more than a victim," not only for Venus, but for the two people she cherished most in the world -- her daughters, who were 3 and 5 when she went missing.
Since that day, her daughters have been living with Venus's parents.
