Gary De Toma, Jr, 5 year old murdered, 4 year old brother attacked

Gary De Toma Jr was found dead in the bedroom with his father, when his 4 year old brother opened the door to a fellow worker of his father's. Gary DeToma, 41, accused of murdering his five year old son, Gary DeToma Jr., and attempting to murder his four year old son in his Decatur, Ga., apartment.

What would possess a parent to murder their child is beyond me. Gary DeToma Sr., 41, of Decatur, Ga., is accused of soffocating his five year old son, Gary DeToma Jr., to death and attempting to do the same to his four year old son inside his apartment Monday. He and his wife are currently estranged and he did not return the children after a weekend visit. DeToma, who is expected to go before a judge Tuesday, remained in jail Tuesday charged with murder and aggravated assault.

DECATUR, Ga. - A DeKalb County man accused of killing his own child is due in court Tuesday to face murder charges.

Police say Gary Detoma confessed to killing his 5-year old son in an hour long interview Monday night. Detoma also faces aggravted assault charges in trying to harm his 4-year son.

The child was discovered Monday at the father's apartment in Decatur

Ga. Father Gary DeToma Allegedly Murders 5-Year-Old Son in Midst of Custody Battle

DECATUR, Ga. (CBS/AP/WGCL) Gary DeToma, a Georgia father involved in a bitter custody battle with his wife, murdered his 5-year-old-son and attempted to kill his other son, a 4-year-old, authorities said.

The boys' mother, Melanie DeToma, became alarmed Monday morning when Gary DeToma failed to return the two boys to her, as per the terms of the couple's custody agreement. Police paid a visit to DeToma's suburban Atlanta home, but no one answered and the officers saw nothing out of the ordinary, said police Deputy Chief Keith Lee.

Ga. Father Gary DeToma May Face Death Penalty for Murder of 5-Year-Old Son

DECATUR, Ga. (CBS) Prosecutors who are going after Gary DeToma, a Georgia father accused of murdering his 5-year-old son and attempting to kill his other son, a 4-year-old, say they will seek the death penalty.

According to The Atlanta Journal-Constitution, the 42-year-old was indicted by a grand jury Tuesday in DeKalb County for the death of his son, Gary DeToma, Jr.

On 12/17/10 superior court Judge Scott ordered the state of Georgia, and the defendant to file all motions by May 02, 2011. He also set a motions hearing for June 20, 2011.
