Jose Baez faces two Bar complaints stemming from Casey Anthony trial

Two complaints against Jose Baez have gone to a grievance committee, Florida Bar confirms.

The Florida Bar confirmed today that a pair of complaints filed against Casey Anthony attorney Jose Baez have gone to a grievance committee.

This means the complaints have moved from staff level to the next point in the process.

The grievance committee is the rough equivalent of a grand jury. The nine-member panel will ultimately determine whether to bring charges against Baez under Florida Bar rules of conduct.

It is not clear exactly what the two complaints involve, but they do cover Baez's representation of Casey Anthony, according to the Bar.

Judge Belvin Perry ruled that Anthony must serve probation from a check fraud conviction following her release from jail, but when Anthony was initially sentenced after her acquittal on a first-degree murder charge, probation was not included.

Perry later said in an order that Baez took advantage of a clerical error.

"It is very clear that the Defendant and her attorney knew she was to start her probation upon release from the Orange County Jail. Despite this fact, they took advantage of a scrivener's error which started the probation while she was being held in the jail pending trial," he wrote.

For the first time, the Florida Bar is confirming the general nature of the two ongoing complaints lodged against Casey Anthony defense attorney Jose Baez.

One complaint stems from Baez's failure to share discovery information with the prosecution last winter as the Anthony case was heading to trial, according to Francine Walker with the Florida Bar.
That was not a surprise because Baez was sanctioned in January by Chief Judge Belvin Perry and made to pay a fine for his "willful violation" of a court order.

The other complaint, which was less apparent before today, involves Baez's failure to disclose to the court that Casey Anthony was being allowed to serve probation for her check-fraud case while in jail awaiting trial for murder in the death of her 2-year-old daughter Caylee.

Walker was able to confirm the cases under a Bar rule that lets representatives respond to specific questions about matters already in the public domain and before the organization.

The Bar confirmed last week that both complaints against Baez had progressed to a grievance committee. That means the complaints have not closed without discipline and moved from staff level to the next point in the process.

The volunteer grievance committee is the rough equivalent of a grand jury. The nine-member panel will help determine whether to bring formal charges against Baez under Florida Bar rules of conduct.

It may take weeks or months to determine if there is probable cause against Baez. The end result of any Bar grievance process could result in various forms of professional punishment, including reprimand, suspension or disbarment.
