Legally, how can something be shown during a trial to a seated jury and then not have those items submitted into evidence? Any legal eagles know??

Jurors saw it during trial, but it was just demonstratives for lawyers to use, not evidence to be admitted

I was watching a documentry last night about Dennis Rader the BTK. He had said that he was surprised at how much pressure it took to strangle someone.

Which is why this death has bothered me. I just cannot see how a leather magazine rack filled with magazines would have caused a strangulation. I still question why she didn't have a scrape or 2 on her forehead from falling foward.

One, I am not sure she was strangled. There is a little bone in the front of your neck called the hyoid bone and there are horns (small bones) of the thyroid. In almost all strangulation cases, the hyoid especially is broken. Hers was not. I think the postural asphyxiation that Dr. Mancini was talking about was just a step in the total death. He maintained that she had a heart condition which made her pass out and fall on the rack in such a postion that it blocked air. She had injuries that had to have happened while blood was still flowing. I am not sure if they could have happened while cpr was being administered because you would have manuel moving of blood at that point. Anyway, that was what I took away

This is precisely why there should be a NG verdict. If there are more questions than answers, you shouldn't be able to send a man away for life.

Just got back...see that jury is still out...Good sign??? At least they are deliberating and looking at both sides of the coin...

estee, did you see/hear that the jury requested 2 items:
The transparencies from Dr. M and the large Demo aid.(one item from the Def and one from the pros showing Lina's neck injuries) Both requests were denied as they were not entered into evidence. They have since ordered lunch...lol

Jury has a question

I have tried so hard to keep an open mind during this trial. Have been on the fence, fell off on either side on any given day. Listened to you guys, listened to the trial .
On day 1 they played his 911 call and I thought it rather odd. If the LE hadn't botched so much, things would be clear to me - maybe.

So - have concluded that I am an idiot - have a lot to learn ...and will spend the $49.00 on that Critical Thinking book - to catch up with you guys. tiny -g

Summer you are not alone. This is a botched case. If everyone had done their jobs, things might be more clear. They aren't because there are things that weren't done and we will never know the answers. You are just fine.

Yes, CB I didn't see or hear from IS, but read comments here at RC...Vinny is on the fence as to when a verdict will come...All I can say is they will find him "guilty" NG or they will be hung up...I personally don't think he is guilty...One thing sure is it is one big mess.

VP asking the reporter if she is sure this is not a verdict...she is sure it is only a question.

Yes, Tess a school run....Leave at 2:15. Not home until 3:30 or so. One gets out at 2:30 and one at 3:20. Too far to run home, drop one off with Papa then turn around and run back to get the other one. So we sit and play games, read books, color etc.
Thank goddness next year everyone goes and gets out at the same time.

I believe you are right summer. The judge said she would send someone up there for them, in the event they needed to.

I am encouraged that they are asking questions. It tells me that they are interested in more than the dessert lady.
