Amanda Knox acquittal for Meredith Kercher murder is overturned - video

Amanda Knox and Raffaele Sollecito have been ordered by Italy's supreme court to face a retrial for the murder of British student Meredith Kercher. An appeals court in Florence must re-hear the case against the American student and her former Italian boyfriend for the murder of 21-year-old Kercher. The exact issues to be reconsidered will not be known until the court releases its full ruling within 90 days

ROME -- American Amanda Knox and her Italian ex-boyfriend, Raffaele Sollecito, must be retried for the 2007 death of British exchange student Meredith Kercher, Italy's highest court ruled Tuesday.

The Italian Supreme Court overturned the pair's acquittal and ordered an appeals court in Florence to rehear the high-profile case that attracted international attention. Knox and Sollecito initially had been convicted of murder and served four years in prison before they were acquitted on appeal in 2011.

Knox issued a statement through a family spokesman that said it was "painful" to have the acquittal overturned but that she was "confident" about the truth.

Rome (CNN) -- Raffaele Sollecito was a 23-year-old computer science student when his girlfriend's roommate, Meredith Kercher, was found dead in the house she shared with Amanda Knox in Perugia, Italy, more than five years ago.

The discovery was the beginning of what he has called "a nightmare." And it's not over.

After being convicted of murder, along with Knox, in 2009, the pair was acquitted by an appeals court in 2011.

But Italian Supreme Court judges decided Tuesday that Sollecito and Knox should face a new trial in Kercher's death, which is likely to begin sometime in early 2014.

The BBC's Alan Johnston in Rome says there could still be "years to go" in the case

Amanda Knox and ex-boyfriend Raffaele Sollecito have had their acquittals for killing Briton Meredith Kercher in 2007 overturned and face a re-run of their appeal, Italy's top court has ruled.

The pair spent four years in jail but were freed on appeal in 2011 largely on the grounds DNA evidence was flawed.

Miss Knox said the news was "painful" but Miss Kercher's sister said she was happy with the decision.

Italian law cannot compel Miss Knox to return from the US for the review.

The American student lives in Seattle but, if convicted, Italy could seek her extradition.

"It was painful to receive the news that the Italian Supreme Court decided to send my case back for revision when the prosecution's theory of my involvement in Meredith's murder has been repeatedly revealed to be completely unfounded and unfair.

"The prosecution responsible for the many discrepancies in their work must be made to answer for them, for Raffaele's sake, my sake and most especially for the sake of Meredith's family. Our hearts go out to them.

Today's ruling by Italy's Supreme Court ordering a new murder trial for Amanda Knox guarantees the legal drama will drag on for several more years and will be expensive.

It also raises the possibility that if Knox is found guilty and that verdict is upheld by Italy's Supreme Court, Knox could eventually face a request to extradite her and put her back in prison.

An extradition request would likely turn on whether being prosecuted again after being exonerated constitutes double jeopardy.

THE sister of murdered British student Meredith Kercher has spoken of her family's ongoing ordeal after Italy's highest criminal court overturned Amanda Knox's acquittal for her killing.

The US student returned to her Seattle home when she was cleared after four years in jail in 2011.

She and co-accused Raffaele Sollecito face the prospect of an extradition request from the Italian government and a new trial in Florence.

Stephanie Kercher said it represented a step forward for the family who hope to discover what happened to the Leeds University student on the night she died.

She said: "There are a lot of unanswered questions. We are hopeful going back to court will help find those answers and find out the truth of what happened that night.

British exchange student Meredith Kercher, 21, was found dead, half-naked and in a pool of blood in the apartment she shared with Amanda Knox and two Italian roommates in the Italian university town of Perugia on Nov. 2, 2007. She died of a stab wound to the neck.

A Perugia court convicted Knox and her ex-boyfriend Raffaele Sollecito of Kercher's murder on Dec. 4, 2009, and sentenced Knox to 26 years and Sollecito to 25 years. An appellate court overturned their convictions on Oct. 3, 2011, and Knox returned to Seattle a free woman.

On Tuesday, Italy's high court ordered a new trial for Knox and Sollecito, overturning their acquittals.

Italy’s highest criminal court yesterday ordered a new trial for Amanda Knox and her former Italian boyfriend, overturning their acquittals in the gruesome slaying of her British roommate.

The move extended a prolonged legal battle that has become a cause célèbre in the US and raised a host of questions about how the next phase of Italian justice would play out.

Knox, now a 25-year-old University of Washington student in her home of Seattle, called the decision by the Court of Cassation in Rome “painful” but said she was confident she would be exonerated.

She left Italy a free woman after the 2011 acquittal and after serving nearly four years of a 26-year sentence from a lower court that convicted her of murdering Meredith Kercher.

An American judge who campaigned for the release of Amanda Knox has told Sky News she "may" return to Italy to face renewed proceedings - but that he would recommend she stay away.


Michael Heavey, a Superior Court judge in Knox's home state of Washington, says he is disappointed but not surprised that the Italian Supreme Court has ordered a retrial for her and former boyfriend Raffaele Sollecito.

When asked if Knox might return to Italy for any part of the new proceedings, he said: "She may. The intelligentsia of Italy knows she is absolutely innocent.

"But a good proportion of the population, because of what's called confirmation bias, what they've been told so many times, they can't tell you why, but they think she's guilty and that is not a healthy climate for her to be in."

(CBS) -- That line you might soon see forming outside of English-language instruction classes in Italy will not be a sudden urge by Italians to learn a second language. It's more likely Italian prosecutors fortifying themselves for when Amanda Knox and Raffaele Sollecito are once again retried for the murder of Meredith Kercher.

So why would the Knox-Sollecito prosecutors have this intense interest in the English language? Two books.

Perhaps for the first time, two defendants, each charged with a brutal, infamous murder, will have written books discussing the case against them before they go to trial.

In 2012, Raffaele Sollecito penned "Honor Bound," and made the round of talk shows in the United States. But the full title of the book may be more apt after the Italian Supreme Court ruling yesterday; "Honor Bound: My Journey to Hell and Back with Amanda Knox." Next month, Amanda Knox's own memoir, "Waiting to be Heard," will be published.

Her lawyer said the new trial will probably start again next year. He said Knox will not come back for the new trial.

The new trial does not mean that Knox would be back in an Italian prison any time soon. She would not be required to return to Italy for the trial and if she is convicted again, that ruling would be appealed up to the Supreme Court. More legal proceedings will be necessary to extradite Knox to Italy. Experts do not believe such an effort would be successful.

The court has 90 days to write their "motivation," explaining in detail why they overturned the acquittal and upheld Knox's slander conviction.

(CNN) -- Experts disagreed Tuesday over whether Amanda Knox is likely to be extradited to Italy, where the country's highest criminal court overturned her acquittal and that of her former boyfriend in the 2007 killing of her roommate, Meredith Kercher.

A U.S. court or the State Department would be unlikely to take up any extradition request from Italy, said Sean Casey, a former prosecutor who is now a partner at Kobre & Kim in New York.

He cited an extradition treaty between the United States and Italy that states: "Extradition shall not be granted when the person sought has been convicted, acquitted or pardoned, or has served the sentence imposed, by the Requested Party for the same acts for which extradition is requested."

"Under U.S. law, she was once put in jeopardy and later acquitted," Casey said. "Under the treaty, extradition should not be granted."

Maybe the US courts can find something in there, besides sex and parties and hot body contests, barf for 31 days straight while little Caylee was "missing", but yet, not "missing".....because she was really dead, her little body torn apart and rotting in the swamp. Sad

I can't believe how messed up this is!


The new trial will go nowhere, especially after the guilty verdict was overturned by the court of appeals. This is, in my opinion, a waste of time and resources.

Amanda Knox retrial: a tale of two countries' legal systems

Amanda Knox likely will not return to Italy for the murder retrial, and a new verdict is probably years away. In that time, much will be learned about the interaction of two 'very different legal systems.'

The decision by the Italian Supreme Court to retry American Amanda Knox for murder will highlight the differences between the two country’s legal systems and test how extradition treaties operate when citizens are convicted of crimes in a foreign country

“This case will be very valuable for the spotlight it shines on how two countries with very different legal systems will behave in a high-profile case,” says Robert Pugsley, a professor at Southwestern Law School in Los Angeles.

He and others say it is unlikely that Ms. Knox will go to Italy for the trial, but she could be tried “in absentia” (without her presence), and the verdict is likely still years away. Most analysts also agree that the US likely would not extradite Knox if the Italian court sentences her to more time.

General rules about extradition among Westernized countries hinge on the rights of the accused or convicted person in the country where they are located. So, for example, the US would not extradite Knox if it felt the Italian trial would expose her to "double jeopardy" – a concept that violates the US Constitution.

From what I can remember, she was convicted because of the knife, & her DNA was found on her roommates clothes. But there was nothing else actually connecting her to the crime.
Her DNA on her roommates clothes, does not really mean that much to me. When I was that young & had a roommate, we ALWAYS shared clothes! My roommate went into my closet to get a sweater or skirt whatever. I went into hers too! We did it all the time, so our DNA would be on each others clothes at any given time. I agree. It's not like there was a death smell in Amanda's car or anything. Or a death banded hair in her trunk, or incriminating Internet searches, or missing for 31 days, etc. Only a jury of idiots would find her not guilty if she had THIS MUCH evidence against her.

I was just comparing the two trials. Knife & DNA on roommate's clothing versus a mountain of evidence that the jury didn't understand or even try to interpret.

Trial won’t delay publication of Amanda Knox memoir

A decision by an Italian court to retry Amanda Knox and her former boyfriend in the 2007 murder of her British roommate will not delay the publication of her memoir, her publisher said Wednesday.

HarperCollins said the book, “Waiting to be Heard,” will be published in the United States as planned April 30. Knox will also do an interview with ABC’s Diane Sawyer that is due to air the same day.

“The publication is going along as scheduled. She is going ahead with all of the events,” said a spokesman for HarperCollins.

The evidence against Amanda Knox and Raffaele Sollecito is overwhelming. They gave completely different accounts of where they were, who they were with and what they were doing on the night of the murder. Neither Knox nor Sollecito have credible alibis despite three attempts each. All the other people who were questioned had one credible alibi that could be verified. Innocent people don't give multiple conflicting alibis and lie repeatedly to the police.

The DNA didn't miraculously deposit itself in the most incriminating of places.

An abundant amount of Raffaele Sollecito's DNA was found on Meredith's bra clasp. His DNA was identified by two separate DNA tests. Of the 17 loci tested in the sample, Sollecito’s profile matched 17 out of 17. Professor Novelli pointed out there's more likelihood of meteorite striking the courtroom in Perguia than there is of the bra clasp being contaminated by dust.

According to Sollecito's forensic expert, Professor Vinci, and Luciano Garofano, Knox's DNA was on Meredith's bra.

Amanda Knox's DNA was found on the handle of the double DNA knife and a number of independent forensic experts - Dr. Patrizia Stefanoni, Dr. Renato Biondo, Professor Francesca Torricelli and Professor Giuseppe Novelli - categorically stated that Meredith’s DNA was on the blade. Sollecito knew that Meredith’s DNA was on the blade which is why he lied about accidentally pricking her hand whilst cooking.

According to the prosecution's experts, there were five instances of Knox's DNA or blood mixed with Meredith's blood in three different locations in the cottage. Even Amanda Knox's lawyers conceded that her blood had mingled with Meredith's blood. In other words, Meredith and Amanda Knox were both bleeding at the same time.

Knox tracked Meredith's blood into the bathroom, the hallway, her room and Filomena's room, where the break-in was staged. Knox's DNA and Meredith's blood was found mixed together in Filomena's room, in a bare bloody footprint in the hallway and in three places in the bathroom.

Rudy Guede's bloody footprints led straight out of Meredith's room and out of the house. This means that he didn't stage the break-in in Filomena's room or go into the blood-spattered bathroom after Meredith had been stabbed.

The bloody footprint on the blue bathmat in the bathroom matched the precise characteristics of Sollecito’s foot, but couldn’t possibly belong to Guede. Knox's and Sollecito's bare bloody footprints were revealed by luminol in the hallway.

It's not a coincidence that the three people - Knox, Sollecito and Guede - who kept telling the police a pack of lies are all implicated by the DNA and forensic evidence.

Amanda Knox voluntarily admitted that she was involved in Meredith's murder in her handwritten note to the police on 6 November 2007. After she was informed that Sollecito was no longer providing her with an alibi, she stated on at least four separate occasions that she was at the cottage when Meredith was killed. At the trial, Sollecito refused to corroborate Knox's alibi that she was at his apartment.

Knox accused an innocent man, Diya Lumumba, of murdering Meredith despite the fact she knew he was completely innocent. She didn't recant her false and malicious allegation against Lumumba the whole time he was in prison. She admitted that it was her fault that Lumumba was in prison in an intercepted conversation with her mother on 10 November 2007.

Though there is a provision for double jeopardy cases in the 1984 extradition treaty between the US and Italy, it may not apply because Knox was never prosecuted for nor acquitted of homicide in the United States, says Mary Fan, a law professor at the University of Washington.

IN 2010, a federal court in California found that a man who was acquitted of murder in Mexico and later convicted after prosecutors appealed the acquittal, could not claim double jeopardy to avoid extradition to Mexico.

Yet others argue that, in any case, Knox could "stonewall" any extradition attempt for decades with appeal after appeal.

I agree! This case has bugged me from the beginning!

When I heard the prosecution's theory, that Amanda and her boyfriend wanted to have deviant sex with Miss Kercher, she refused, and they murdered her, I laughed out loud. Except it's not funny because they are serious. It sounds like some story Jodi Arias would invent.

Besides which, the DNA and other evidence points to Rudy Guede, who has a history of sex offenses and confessed to being in the area at the time, and ultimately to having sex with her. Nothing reliable that has stood the test of time, points to Amanda, which makes me wonder why the prosecution is so intent upon nailing her. They seem to have a personal vendetta going on, trying to paint her as a tramp (take Jodi, please) and a deviate.

I don't find some of her targeted behavior to be very weird - kissing her boyfriend or a passing giggle, to me just seems like nerves. The expression on her face after the infamous kiss was of distress. When I was young, I did things like that when stressed also. Except the split or somersault or whatever in the police station - uh,oh, shades of Jodi, LOL.

I think also the interrogation in which they kept insisting she had done something but didn't remember, screaming at her she said, confused her to the point that she did admit it, plus her statement that "I just wanted it to stop," rings true to me.

I used to have a "friend," who for some reason, seemed to delight in telling me I had a poor memory and that I didn't remember things I had said or done, and then she would ridicule me for it. I did the same thing at one point and "agreed" with her - I just wanted her to shut up and leave me alone because she just kept ragging on me. She showed up at my house one day saying we had arranged to go skating. But I was supposed to do homework or study for a test that day. I didn't remember making any arrangements to go skating, and I think my parents had forbidden me to go out that day because of my upcoming test. So after about 20 minutes of her ridicule and insisting I had agreed to go skating, I said, "Ok, I remember arranging to go skating today. Just don't tell my parents; I don't want to get in trouble." But I didn't remember; I just wanted her to stop. She later used my words against me during an argument. And she wasn't even withholding food, sleep, or water! ;)

I just saw the interview with Chris Cuomo and he asked her why she didn't contact Meredith's family with her condolences, but I don't find that too odd, because IIRC, by the time she got out of jail, they were sure she had done it. Then Chris says, "Well, only a guilty person would avoid a memorial and not approach the family." Well, ahem, look what Jodi did - sent Grandma irises, showed up at the memorial and kept acting devastated on cue.

Well, those are my thoughts. :) I guess I just identify with this girl too much. She does not at all seem to be a violent type of person, and neither does her ex-boyfriend.

Also, I think they found that bra piece had been laying on the floor for a long time (months after the crime) and there was no good chain of evidence, and even later had to retract that Amanda's DNA was found on it in the first place. IIRC

Amanda Knox's DNA was found on the handle of the double DNA knife and a number of independent forensic experts - Dr. Patrizia Stefanoni, Dr. Renato Biondo, Professor Francesca Torricelli and Professor Giuseppe Novelli - categorically stated that Meredith’s DNA was on the blade. Sollecito knew that Meredith’s DNA was on the blade which is why he lied about accidentally pricking her hand whilst cooking.

According to the prosecution's experts, there were five instances of Knox's DNA or blood mixed with Meredith's blood in three different locations in the cottage. Even Amanda Knox's lawyers conceded that her blood had mingled with Meredith's blood. In other words, Meredith and Amanda Knox were both bleeding at the same time.

Knox tracked Meredith's blood into the bathroom, the hallway, her room and Filomena's room, where the break-in was staged. Knox's DNA and Meredith's blood was found mixed together in Filomena's room, in a bare bloody footprint in the hallway and in three places in the bathroom.

Rudy Guede's bloody footprints led straight out of Meredith's room and out of the house. This means that he didn't stage the break-in in Filomena's room or go into the blood-spattered bathroom after Meredith had been stabbed.

The bloody footprint on the blue bathmat in the bathroom matched the precise characteristics of Sollecito’s foot, but couldn’t possibly belong to Guede. Knox's and Sollecito's bare bloody footprints were revealed by luminol in the hallway.

It's not a coincidence that the three people - Knox, Sollecito and Guede - who kept telling the police a pack of lies are all implicated by the DNA and forensic evidence.

Amanda Knox voluntarily admitted that she was involved in Meredith's murder in her handwritten note to the police on 6 November 2007. After she was informed that Sollecito was no longer providing her with an alibi, she stated on at least four separate occasions that she was at the cottage when Meredith was killed. At the trial, Sollecito refused to corroborate Knox's alibi that she was at his apartment.

Knox accused an innocent man, Diya Lumumba, of murdering Meredith despite the fact she knew he was completely innocent. She didn't recant her false and malicious allegation against Lumumba the whole time he was in prison. She admitted that it was her fault that Lumumba was in prison in an intercepted conversation with her mother on 10 November 2007.

Hi, Ann, what is the source of this information? I clicked the link but just got a list of articles and authors.

I've followed this case on and off and except for the fact that she implicated Mr. Lumumba, I've always read that the "evidence" against her, including the DNA evidence, fell apart, and that most of the other evidence was trumped up. Certainly never heard of her giving several stories, just that she made a confession which she later retracted because she said it was under duress. So i'm confused!

Thanks, Alessandra! One rumour you often hear about the crime is that Raffaele turned on Amanda and claimed she was guilty. I think it's so admirable of him to have suffered what he did for not having thrown her under the bus.

Seems like a wonderfu guy~

I was impressed during the interview with Chris Cuomo that Amanda does seem to have difficulty empathizing very deeply with others. That makes her odd, but I don't think it makes her a murderess.

While the retrial promises to be as circus-like as the first proceeding, one thing noticeably different will be the absence of the defendant.

"Amanda will be tried in absentia ... She won't be there to defend herself," Seattle attorney and legal analyst Anne Bremner told The Huffington Post.

Knox was convicted in December 2009 and was sentenced to 26 years in prison. Sollecito received a 25-year sentence. Prosecutors claimed that Kercher’s death was as a result of a violent sex game gone awry. In 2011, the appeals court overturned the convictions, citing inadequate evidence. The court noted that the DNA evidence in the case was false or contaminated, there was no murder weapon found, and the prosecution did not provide a sufficient motive for the crime.


She has suffered post-traumatic stress disorder and flashbacks, she has said, and the upcoming retrial has inflamed those issues.

“It’s happening so fast, and I’m not quite sure what’s going to happen," Knox told Lauer. "But I’m trying to do everything I can to make a difference.”
