Pistorius selling house where he shot Steenkamp

JOHANNESBURG (AP) — Oscar Pistorius is selling the house where he killed Reeva Steenkamp to raise money for his legal bills, the athlete's lawyer said Thursday.

Pistorius has not returned to the upscale Pretoria villa since the day he shot his girlfriend in a bathroom over a year ago and "cannot contemplate ever returning to live there again," lawyer Brian Webber said.

Pistorius had planned to keep his home "sealed" until after his ongoing murder trial, Webber said, but it is now necessary to sell it to fund his defense because the double amputee's trial will last longer than the initial three-week period that was predicted.

Thank you for the correction on Reeva being shot thru the elbow and NOT the hand. Tardy in my response.

Double tap: I am presuming this is important because IF OP paused between the shots it would have given him time to have heard the screams from Reeva... And IF OP heard the screams then he would know it was NOT a stranger/home invader in the home. And that would lead to murder of Reeva if OP continued to shot after hearing Reeva's screams. Would it be enough for premeditated?

I was visiting some of the twitter sites and saw some of the telephone evidence. Of interest (perhaps because it supports one of my loosely constructed theories) is the evidence showing OP had searched for cars with free porn.... at that was at 1830  (6:30 PM) of the evening before Reeva was killed. My theory is OP was amorous because of Valentine's Day and Reeva refused him.  He felt totally rejected and killed her. Perhaps, she had told him she was moving on without him? She had a new venture starting with her career and the TV....

You are correct, Reeva was shot through her left hand, that's what the Pathologist who perform the autopsy told the court when he testified. He also called the shot through the hand a defensive wound, he said that she was trying to shield her head when a bullet went through the hand before penetrating her skull. I'm sorry for the misunderstanding.

I believe in the prosecutor's contention that there was an argument before he fired the shots.

"A witness has told the murder trial of Oscar Pistorius that she heard "loud voices" arguing followed by "shots or explosions" the night Reeva Steenkamp was killed.

Estelle van der Merwe, who lived just under 100 metres from Pistorius' Pretoria house, said she was woken just before 2am on St Valentine's Day by the row, which went on for around an hour before she heard shots fired."

Oscar Pistorius murder trial extended

JOHANNESBURG - The murder trial of paralympian Oscar Pistorius at the High Court in Pretoria has been extended until mid-May, the office of the chief justice said on Sunday.

"The Oscar Pistorius trial continues... on Monday 24 March to Friday 4 April," said spokeswoman Lulama Luti in a statement.

She said the court would then be in recess until April 11.

"After the recess, the trial will resume on Monday 14 April until Friday 16 May."

Previously, the trial was scheduled to continue until April 4. It was initially set down from March 3 to 20.

Expert clarifies ‘premeditated murder’

When the State said they intended proving “premeditated murder” during Oscar Pistorius’s bail application, some people questioned if such a charge existed in South Africa.

The argument was that for a killing to be murder, it must have an element of premeditation in any case.

The Daily News approached a legal expert to get some clarity on the difference between dolus (intent) and premeditation.

Franaaz Khan, an attorney and a criminal law and commercial law lecturer at the University of KwaZulu-Natal, said that while said South African law does not recognise a charge called “premeditated murder”, the fact that it was premeditated can be used in court as an argument in aggravation of sentence.

“Intention can be formed at the instant of committing the crime and does not imply or necessitate any degree of forethought or planning on the part of the accused.

“Our courts have suggested that one would have to examine all the circumstances surrounding any particular murder, including not least the accused’s state of mind.

“This will allow one to arrive at a conclusion as to whether a particular murder is planned or premeditated,” said Khan.

Oscar Pistorius Could Take the Stand This Week

The prosecution of Oscar Pistorius is expected to conclude shortly after court resumes Monday, clearing the way for the star witness -- Pistorius -- to take the stand.

Pistorius' lawyer Barry Roux has made it clear that the legless paralympian would testify, and he has indicated that Pistorius could very well be his lead-off witness and that Pistorius' testimony would form the basis the of the defense's approach.

The trial, which is expected to last until mid May, has been in recess since Wednesday when prosecutor Gerrie Nel told the judge he wanted time to prepare the end of his case.

Nel is trying to prove that Pistorius knew who was behind the locked door and that he fired four shots during a rage fueled argument with Steenkamp.

Roux's cross examination of prosecution witnesses gives some indication of how the defense will attack the evidence presented over the last three weeks.

One potential weakness in the state's case is the doubt Roux has tried to cast on the evidence heard so far about the alleged argument between Pistorius and Steenkamp.

PRETORIA - The contents of Oscar Pistorius's phones including the device taken to the United States (US) are expected to be revealed in court this week.

The prosecution team told the court last week that it intended calling four witnesses this week before closing its case.

High on the list of expert witnesses, the state is expected to call Hawks cellphone analyst, Captain Francois Moller.

Moller is believed to have carefully studied all the messages retrieved from the three phones found at the scene.

He was also one of the officers who went to the US to ask Apple to help retrieve data from one of Pistorius’s iPhones.

The state may also call former investigating officer Hilton Botha or current investigator Mike van Aardt.

Among the lay witnesses expected, who could help the state, is Clarice Stander, daughter of the estate’s manager.

She was among the first people to arrive on the scene and collected towels from an upstairs cupboard to help stop Steenkamp’s bleeding.

PRETORIA - A woman screamed repeatedly in terror, there were lights shining from the toilet window at the time, and her cries died out with the last gunshot heard.

These were among the elements of evidence by witness Anette Stipp, which the defence has found to be unshakeable.

PRETORIA, South Africa (AP) — Phone messages between Oscar Pistorius and the girlfriend he shot dead indicate that she was sometimes afraid of him.

The couple had also argued about what she alleged was the athlete's short temper and jealousy, police Capt. Francois Moller testified Monday, citing text messages he extracted from cell phones.

Moller says that about 90 percent of the messages he downloaded were what he called normal and "loving" exchanges. But there were exceptions that he printed out for the court in Pistorius' murder trial.

In another message, Pistorius told Steenkamp that his friends will take the blame for a shooting incident that occurred a month before Steenkamp was killed.

Text messages between Oscar Pistorius and girlfriend Reeva Steenkamp revealed in court painted a picture of a jealous man who "snapped" at her and often accused the model of flirting with other men, his murder trial heard.

In a Whatsapp conversation, Ms Steenkamp wrote: "I'm scared of you sometimes and how you snap at me."

The model also wrote she felt "picked on" and "attacked" by the one person she "deserved protection from"- referring to the athlete- and was upset by his jealous tantrums.

PRETORIA, South Africa – As the prosecution in Oscar Pistorius' murder trial rested its case Tuesday, a member of the star athlete's family told journalists from the front row of the public gallery, "He's ready" to take the stand.

Pistorius appeared resigned but resolute, murmuring as he left court, "It's a tough time. We've got a lot of stuff ahead of us."

The Paralympian, accused of premeditated murder of his model girlfriend Reeva Steenkamp on Valentine's Day 2013, is expected to testify Friday. It is respected practice in the South African legal system for the accused to give evidence before any other defense witnesses are called.

But when asked if the athlete would be on the stand before the end of the week, his legal team remained cagey. "We'll see about that," defense lawyer Kenny Oldwadge said.

"I don't think we've got a choice, it's a question of when," Pistorius' advising attorney, Brian Webber, said of the likelihood of his client's testimony. South Africa's constitution allows Pistorius to refrain from testifying in his own defense.

Johannesburg - Oscar Pistorius, the man known as the Blade Runner, is certainly no stranger to controversy.

In September 2009, Pistorius spent 17 hours in jail after being charged with common assault.

A woman, Cassidy Taylor-Memmory, who was a student at the University of Pretoria at the time, alleged that Pistorius had slammed a door on her after they had a fight at a party at his house.

The Director of Public Prosecutions decided not to pursue the matter, saying they did not believe Pistorius had any intention to assault Taylor-Memmory.

Soon afterwards, Pistorius instituted a R2.2 million damages claim against her, saying she had deliberately given the police false information.

Pistorius also instituted a R6.5m lawsuit against Police Minister Nathi Mthethwa for unlawful arrest.

Taylor-Memmory told the police he had aggressively slammed a wooden door, causing it to break, and a piece of wood hit her leg.

The remarks left him dangerously exposed to charges of hypocrisy. For years he had been railing against critics who claimed that his prostheses invested him with an unfair advantage, and now here he was impugning the integrity of a fellow athlete on the same issue. The apparent double standard also smacked of a worrying arrogance.

Loving Reeva Steenkamp blew a kiss to Oscar Pistorius in a selfie then told him “this is going to be a good year”.

The 29-year-old model sent him the WhatsApp message on January 10th, 2013 - just over a month later she was dead.

The love-struck law graduate told him: “I’m here next to u” and he replied: “its just a lot of pressure..I know, thanks baba...Xx means alot.”

Then nine days later she sent him another message thanking him with the kiss picture, while wearing a hoody he had given her as a present.

He asks here “you like it?” and she says “I love it...so warm...Thank u.”

JOHANNESBURG -- The murder case involving Olympic star Oscar Pistorius took another unexpected turn Sunday with the news that his older brother, Carl, is himself facing charges for the death of a woman in a traffic accident.

Carl Pistorius faces a charge of unlawful, negligent killing for a 2008 road death, `'in which a woman motorcyclist sadly lost her life," Kenneth Oldwage, the Pistorius family lawyer said on Sunday. The accident happened in Vanderbijlpark, south of Johannesburg. The charge of `'culpable homicide" was dropped and then reinstated and will be challenged in court, the lawyer told The Associated Press.

Wow. I did not know the brother, Carl, had been brought up on homicide charges Feb 2013 for a 2008 death of a woman. Seems the whole family is suffering from that new Texas illness, "affluence."

I was commenting to a friend (who is half following the case) I found the bloody bat highly questionable.
Wasn't there blood spray in the bedroom above the bed? Blood spots on carpet in bedroom? And WHERE was his bloody shirt since he reportedly carried her down the stairs? Absolutely amazing how he did not track any blood about even as he lifted her, isn't it?

I wonder if he had hit her in the nose with the bat and she fled to the bathroom; he realized he had gone to far as she had camera time coming up so he grabbed his gun and went after her to probably threaten her, convince her to tell some lie, etc.. However, locked in the cubicle, I would imagine she was terrified and held her ground.

Back to the bloody bat. IMO, he concocted some story about using it it to batter the door.
I am not buying it. There is blood spray as well as the blood drops.
Do we have an autopsy report?
IMO, He did a lot to try to set a scene to justify his killing her, to distract (stolen watches anyone? blood on jewelry case?) and then the multiple phone calls. Keep in mind, this is the same person who just a month earlier fired off a round in a restaurant and asked his friend to take the blame for it!!!
