BOSTON (Reuters) - A man who snapped secret pictures up women's skirts on a Boston subway train - a practice known as upskirting - did not violate the state's Peeping Tom law, Massachusetts' top court said on Wednesday, pointing to a loophole in current legislation.
Massachusetts law prohibits secretly filming or photographing a person who is nude or partly nude, but that does not apply to people who are fully clothed, according to a Supreme Judicial Court decision written by Justice Margot Botsford.
The ruling comes in the case of a man who was arrested by transit police in 2010 for using his cell phone to take pictures and video up women's' skirts on the subway and who fought to have the charges of voyeurism dismissed.

•Jane: This is court saying 'sorry, women, you no longer have the right to privacy'
A Massachusetts court ruled Wednesday that under state law it is legal -- I repeat, legal -- to take pictures up women’s skirts.
The practice more commonly called "upskirting" generally involves people -- let’s be real: MEN -- strapping hidden cameras to their shoes or body and secretly taking pictures of skirt-wearing women from the ground up, often exposing their undergarments or privates.
I can’t even begin to express the outrage that washes over me when I hear this. To me, this is the highest court in Massachusetts all but saying: "Sorry women of the world, you are no longer safe. You no longer have the right to privacy. If a man wants to take pictures up your skirt, sorry, our hands are tied."
