Jaycee and her girls are living in hiding again. They need to be free to go wherever they want. Maybe the public's curiosity will begin to cease over time.

It's sure taking a long time and costing a lot of money to prosecute two people who are obviously guilty.

El Dorado County Superior Court Judge Douglas Phimister had scheduled the preliminary hearing to begin Oct. 7, but that date was suddenly thrown into question when Phillip Garrido's attorney indicated she had some doubts about her client's mental ability to assist in his defense.

"Given the current pace, the preliminary hearing may not happen until deep into the year 2011," said Portanova. "The trial may not be for another year or two after that, if it happens at all. It could be two, three, four years away," he said.

In the meantime, the meter's running for El Dorado County taxpayers. Both of the Garridos' attorneys are on the county payroll, as are the prosecutors, investigators and expert witnesses.

SACRAMENTO, CA - After 18 years trapped in a dirty shed and trashy backyard, Jaycee Dugard and her two daughters are traveling, finishing their education and exploring a world kept from them for most of their lives, according to Jaycee's family.

Two family members who spoke to News10 on the condition they remain anonymous said Dugard and her children have not sequestered themselves in their compound.

Dugard has been seen in Old Sacramento, at amusement parks with her children and after receiving her driver's license last January, she has enjoyed taking road trips.

I'm glad to hear Jaycee her daughters are out enjoying life, that is really good to hear. All the time and money being spent on Garrido is ridiculous, he admits what he did. The two children that were produced from Jaycee's capture and rape is more than proof. There is no reason for this to be carried out longer than it already has been.

SACRAMENTO, Calif. (AP) — The board that considers compensation for California crime victims has denied a claim by the mother of kidnapping victim Jaycee Dugard.

The Victim Compensation and Government Claims Board on Thursday rejected Terry Probyn's claim that she deserved to be compensated for emotional injury because state parole agents did not find Dugard while she was being held by her alleged kidnappers.

I think if anyone should sue it would be the step-dad. He also loved Jaycee, missed Jaycee and was always considered a POI in her disappearance.

If I were him, I would have already filed a suit against the local LE, state LE and FBI as well as the city officials, county officials and state officials.

Prosecutors in the kidnap-rape trial of Phillip and Nancy Garrido apparently have changed gears, moving to get the El Dorado County grand jury to indict the couple and move the case to trial without going through a preliminary hearing, Nancy Garrido's attorney said this afternoon.

Stephen Tapson said he had been told that the couple were indicted by the grand jury Tuesday or this morning but that he would not receive official word until a transcript of the grand jury session was completed.

PLACERVILLE -- A judge temporarily suspended criminal proceedings Friday against the man accused of kidnapping Jaycee Dugard when she was a child and holding her prisoner for 18 years near Antioch, citing concerns about the defendant's mental state.

El Dorado County Superior Court Judge Douglas Phimister made the decision after a short pretrial hearing for Phillip Garrido.

Phimister said he had concerns about Garrido's mental competency to participate in his defense on 29 counts of kidnapping, rape and false imprisonment in the 1991 disappearance of Dugard. A preliminary hearing in which prosecutors would have laid out their evidence against Garrido had been scheduled to start Oct. 7.

The judge did not halt proceedings against Garrido's wife, Nancy, who faces similar counts. The two are accused of holding Dugard captive in a backyard jumble of tents and sheds for nearly two decades until they were arrested in August 2009.

NEW YORK (AP) - Jaycee Dugard, who survived being kidnapped at age 11 and held captive for 18 years, is writing a memoir.

Dugard's book is scheduled to come out next year, Simon & Schuster announced Monday. Financial terms were not disclosed.

According to the publisher, the 30-year-old Dugard will write the currently untitled book herself and cover her life from her abduction in 1991 to how she is doing now.

I look forward to reading Jaycee's memoir. I would think her writing about all of those years in captivity would be therapeutic for her as well. She appears to be a very intelligent woman.

Though the specific details of the indictment are unknown, sources told KCRA 3 the couple will be arraigned together.

The Garridos have been in custody for more than a year, charged in the kidnapping and rape of Dugard. She was taken from her home near Lake Tahoe in 1991, only to surface 18 years later in the Bay Area with her two children.

The allegations are included in a multi-count indictment of Garrido and wife Nancy, the couple accused of taking Dugard from a Meyers bus stop in 1991.

The couple is accused of holding Dugard captive in a backyard compound in their Contra Costa County home for 18 years. Phillip Garrido is also accused of fathering Dugard's two daughters.

The Garridos were indicted on 18 counts each in a process that will eliminate the need for a preliminary hearing, where their alleged victim may have testified.

PLACERVILLE, Calif. - Phillip and Nancy Garrido, accused of the kidnapping, rape and imprisonment of Jaycee Dugard, were indicted by an El Dorado County grand jury on 18 charges in court Friday.

Although the grand jury transcript remains sealed by court order, the indictment shows four witnesses testified, including three working in law enforcement and a "Jane Doe." Nancy Garrido's attorney, Stephen Tapson, confirmed that Jane Doe is, indeed, Jaycee Dugard.

The prosecutor in the case against Phillip and Nancy Garrido wants a judge to keep grand jury transcripts sealed until a criminal jury is picked, arguing that releasing them would violate Jaycee Dugard's privacy rights and could compromise the couple's right to a fair trial.

El Dorado County District Attorney Vern Pierson on Wednesday filed a challenge to a bid by several news agencies to release the transcripts, which include testimony from Dugard, two El Dorado County investigators and a Contra Costa sheriff's detective.

Dugard, whose 18-year ordeal of childhood abduction and captivity drew an international spotlight last year, testified in detail about "extremely private and violent sexual acts," wrote Pierson, referring to her only as "Jane Doe."

"If these transcripts are unsealed prior to trial, the details of the repeated rape of Jane Doe will be splashed all over the media. Jane Doe does not deserve this disrespect," he wrote. Pierson added that making the details public could spur the Garridos to seek a change of trial venue.

Lawyer: Dugard told 'tale of terror' to grand jury

PLACERVILLE, Calif. (AP) -- A lawyer for a California woman charged with her husband with holding Jaycee Lee Dugard captive for 18 years said allowing the "tale of terror" told by Dugard to a grand jury to become public before a trial would make it impossible to find an impartial jury.

"I have examined hundreds of transcripts that vividly describe murder, rape, pillage, but nowhere in my experience have I seen a transcript that describes evil as is contained in the grand jury transcript for People v. Garrido," Stephen Tapson, the court-appointed lawyer representing Nancy Garrido, said in a written filing Wednesday objecting to news media requests to unseal the testimony.

Dugard was the star witness before the grand jury that indicted Phillip and Nancy Garrido in September. Dugard, however, has not appeared or testified at any public court hearings.

She is writing a memoir for Simon & Schuster scheduled to come out next year. The publisher says the book will cover her life from the abduction to how she is doing now.

PLACERVILLE -- Their jail scrubs have turned from "high-risk" red to orange, and Phillip and Nancy Garrido managed a few grins in the courtroom on Thursday as a judge weighed whether to unseal grand jury transcripts that contain explicit firsthand details of Jaycee Dugard's abduction and years of sexual bondage at the couple's home near Antioch.

El Dorado County Superior Court Judge Douglas Phimister delayed a decision on the transcripts and other sealed documents, which a group of media organizations seek over the objections of the Garridos and District Attorney Vern Pierson.

Nancy Garrido's attorney said the transcripts describe "evilness," arguing that releasing them now would taint any jury pool. Pierson argued that they would violate Dugard's privacy.

Karl Olson, an attorney for the media organizations, noted that details of the case already are widespread.The transcripts include testimony from Dugard, now 30, and three investigators.

"This thing oozes prejudice. Every page," said Stephen Tapson, Nancy Garrido's lawyer. He said they detail "the actual events of what this girl went through when she was 11 years old in nitty-gritty detail. The public doesn't need to know that."

Nancy Garrido’s Letters To Prison Pen Pal Surface

SACRAMENTO (CBS13) — For the first time ever, a look inside the mind of a woman accused of kidnapping and raping Jaycee Dugard. These letters from Nancy come from a prison pen pal, a woman who she befriended at the El Dorado County Jail. That pen pal wanted Nancy’s story to be told.

At first glace, you’d never know these were words from a prisoner; A friendship that started in the El Dorado County Jail, and continues with Nancy Garrido’s pen pal serving a sentence in state prison.

Nancy’s love for Phillip and God was a constant theme throughout her letters.

“Phillip sends me Bible studies that I truly enjoy and bring me closer to our God,” writes Nancy.

But, it’s clear Nancy knows she and Phillip will never reunite on this Earth.

Accused kidnapper Phillip Garrido is expected to plead guilty Thursday to the 1991 abduction of 11-year-old Jaycee Lee Dugard in a bid to show compassion for Dugard as well as his wife, Nancy, one of the lawyers in the case told The Bee today.

Stephen Tapson, Nancy Garrido's attorney, said this afternoon that a deal was reached last week that calls for Phillip Garrido to enter a guilty plea and spend the rest of his life in prison. However, Tapson said he expects Nancy Garrido to face trial unless El Dorado County District Attorney Vern Pierson agrees to a compromise that might allow Nancy Garrido to be released from prison in 30 years or so.

Not guilty plea from sex offender in Dugard kidnap

PLACERVILLE, Calif. – A convicted sex offender pleaded not guilty Thursday to charges of kidnapping and raping a Northern California girl when she was 11 and holding her captive for nearly two decades.

The plea came as a surprise after an attorney said Phillip Garrido had made a deal with prosecutors to plead guilty. It would have sent him to prison for the rest of his life.

But Phillip Garrido's attorney, Susan Gellman, contended the grand jury was improperly selected and did not act appropriately during its proceedings. Gellman did not elaborate in court.

"There are issues about the process itself before the grand jury," said Judge Doug Phimister.

Garrido, who fathered the two children of victim Jaycee Dugard, made the plea to an amended indictment that added allegations of kidnapping of a person under 14, kidnapping for sexual purposes and other claims.

His wife, Nancy Garrido, also pleaded not guilty to the charges. The next hearing was set for May 5, and the trial for Aug. 1.

Both defendants were in court for the 10-minute hearing, wearing orange jail uniforms. They didn't speak, and neither showed much emotion during the hearing.

I wonder what he hoped to accomplish by pleading not guilty? He is obviously guilty and will be convicted. He probably wants to cause Jaycee and her girls as much grief as possible by making them go through a trial.

I was hoping Jaycee and her family would not have to go through the emotional torture of a trial. Damn this beast and his attorney. I think it's pretty much a given that this couple will never see the light of day again. There are two children that share this rapist's DNA. Jaycee is successfully rebuilding her life with her mother and children. This is so wrong that he could make a deal last week and then now say there was a problem with the grand jury and start this all over again. Shame on these people...

Garridos plead guilty in Jaycee Dugard kidnapping

Los Angeles (CNN) -- Phillip and Nancy Garrido pleaded guilty Thursday to the kidnapping and sexual assault of Jaycee Dugard, whom they held captive from age 11 through 29, the El Dorado County, California, district attorney said.

Both Garridos will receive life in prison at a sentencing hearing scheduled for June 2, District Attorney Vern Pierson said in a statement.

Through a representative, Dugard, now 30, expressed relief that her abductors "confessed."

"I'm relieved that Phillip and Nancy Garrido have finally acknowledged their guilt and confessed to their crimes against me and my family," Dugard said in a statement released by her representatives at Nancy Seltzer & Associates, Inc., in Los Angeles.

The married couple abducted Dugard when she was 11, and they held her in a hidden compound on their home's grounds in Antioch, California.

Kidnapper Told Girl She Was 'Help' For Sex Problem

She followed the orders of the serial sex offender who had immobilized her with a stun gun in June 1991, stashed her in his car and then laughed to his accomplice-wife that he couldn't believe he had gotten away with it.

Over the following months, if Dugard balked at his commands, Phillip Garrido terrorized her by turning on the gun so she could hear it "zap."

"I didn't want it to happen again, so I was good," she recalled in vivid grand jury testimony released Thursday after her abductors were sentenced to prison. She "tried to do what he wanted me to do even though I didn't like it."

And there's a good chance that after the appearance is aired, she will not speak with other media outlets and will let her much-anticipated memoir do the talking, in print and through an accompanying audiobook narrated by Dugard herself.

Jaycee Dugard describes giving birth in backyard prison

NEW YORK (ABC News Radio) - For the first time ever, Jaycee Dugard, the California woman kidnapped and imprisoned for nearly two decades, is describing giving the birth at the age of 14 in a backyard prison.

Three years into her captivity, Dugard went into labor with the first of her daughters fathered by her abductor, Phillip Garrido. She was locked in a room in Garrido's backyard compound when she began having pains.

"I didn't know I was in labor," Dugard told ABC News' Diane Sawyer in an exclusive interview. "I was still...locked at that time. Just scared."

J4A, thanks for posting all of this information. I watched the interview and I am in total awe of this young woman. Many times I had tears in my eyes for her. She's so strong and she held onto hope. Those babies were her hope, they kept her from feeling alone. I never realized how long she was kept handcuffed and naked. It broke my heart. She was just a little girl and she said she thought sex was two people laying next to each other. She didn't see sunshine for six years! This couple is pure evil. Jaycee's positive outlook and her recovery is astonishing to me. Her mother holds the hatred in her heart, not Jaycee. It's amazing. I am going to order her book, A Stolen Life. Her recounting the horror she survived in her book to be able to help other abuse victims makes Jaycee a true hero. District Attorney Release Regarding Jaycee Dugard Abduction

On June 10, 1991, Phillip and Nancy Garrido abducted Jaycee Lee Dugard in South Lake Tahoe. On August 24, 2009, 18 years later, Jaycee was finally discovered. Both Phillip and Nancy Garrido were charged with, and ultimately convicted of, kidnapping and rape – sending them both to prison for life. The primary responsibility of the El Dorado County District Attorney’s Office in this case has been to seek justice for Jaycee, Terry Probyn and their family with the criminal prosecution of Phillip and Nancy Garrido. The District Attorney’s Office has received numerous requests for information from the media pursuant to the public records act. In order to highlight the gravity and severity of the mistakes made, and in hopes of improving the supervision and detection of sexual predators, the District Attorney, at the request of the victim’s family, has determined that certain details of this horrific case need to be revealed.

The District Attorney’s Office is releasing: a video of a CDCR parole officer’s search of the Garrido residence (circa 2000-2007), two video clips showing some of the Garridos’ activities videotaping children in public (circa 1989-1993), a map of South Lake Tahoe showing Garrido victims known to law enforcement prior to the abduction of Jaycee Lee Dugard, and various additional documents (4 pages of federal parole documents, 1972 booking photo, 7 pages related to Phillip Garrido 1977 conviction, 2 photographs showing the condition of the tapes, and note signed by Jaycee Lee Dugard). It is hoped that these details begin to shed some light on several lingering unanswered questions, such as: How did Phillip Garrido get paroled from a 50 year Federal sentence and a five-to-life Nevada sentence after only 11 years? How did Phillip Garrido, a repeated kidnapper and rapist, with a history of kidnapping and raping in Lake Tahoe, who was on Federal parole, and was registered sex offender, avoid becoming a suspect in the disappearance of Jaycee in 1991? How did Phillip
Garrido keep Jaycee hidden for 18 years while on Federal and State Parole?

All of this will be discussed at the August 3, 2011 public meeting at the State Capitol with Senator Ted Gaines, District Attorney Vern Pierson, various law enforcement leaders and victims’ rights organizations as they seek to explore deficiencies in state law and identify potential legislative solutions to prevent these kinds of tragedies from ever occurring again.

He chuckles and says no. I ask him when I can go home. He says he doesn't know but he will work on it. I say my family doesn't have a lot of money, but they would pay a ransom to get me back. He looks at me and smiles and says, really?"

Jaycee Dugard sues feds for Garrido parole failures

Many of the claims made in the complaint were acknowledged in a federal report on Garrido's parole supervision released earlier this year as well as a state audit in November 2009, two months after Dugard resurfaced near Antioch.

In a statement, Seltzer says Dugard is not seeking money for herself but rather her nonprofit JAYC Foundation, which is aimed at providing treatment and support for victims of abductions and traumatic experiences.

Dugard is leaving it up to a judge to decide any monetary settlement, Seltzer said.

Jaycee Dugard talks of personal growth in afterword to memoir

Nearly three years after Jaycee Dugard was rescued from the ramshackle compound where she gave birth to two daughters while being held captive, she is still learning how to be a free woman.

“My growth has not happened overnight, and every day brings new challenges and choices that I have to make,” she writes in a new afterword to her 2011 memoir, “A Stolen Life,” which comes out in paperback July 3. “Living out in the world has its share of problems, and I am learning what works and what doesn’t.”
