Hearing date set in Casey Anthony case
Several motions in the first-degree murder case against Casey Anthony will be addressed at a hearing next Friday.

Several motions in the first-degree murder case against Casey Anthony will be addressed at a hearing next Friday.
One of the topics to be discussed is a defense motion to dismiss. Casey Anthony's defense claims they and their experts were prevented from properly inspecting the crime scene where her daughter's remains were found in December.
Orange Circuit Judge Stan Strickland will hear the arguments for the motions at 9:30 a.m. on Oct. 16. Strickland will also preside over a status hearing in the check fraud case against Casey Anthony on the same day.
Casey Anthony is charged with first-degree murder in the death of her 2-year-old daughter who went missing last summer. Casey Anthony waited 31 days to report her daughter missing and blamed her disappearance on a nanny, who investigators don't believe exists.
Caylee Anthony's remains were found in December, five months after she was reported missing, in a wooded lot just blocks from the Anthony family home.
In other developments today, Casey Anthony's defense team will receive more investigative reports from prosecutors, a notice filed by the State Attorney's Office said.
About 40 pages will be released to the defense. Most of those will be forensic entomology investigative reports, the state's court filing said.
The documents are being released to the defense as part of the discovery process. The items will later be released to the public.

Local 6 investigative reporter Tony Pipitone said this will be the 19th court hearing held in the case against Anthony, dating back to her first court appearance on July 18, 2008.
The next hearing is scheduled for Friday, Oct. 16. Judge Stan Strickland wants to put lawyers from Anthony's defense and the state attorney's office in the same room in an attempt to resolve several issues and get the case moving.
Anthony is charged with first-degree murder in the death of her daughter, Caylee Anthony. Caylee was reported missing in July 2008 after being missing for a month. She was 2 years old.
Caylee's remains were discovered in a wooded area near Anthony's parents' home in east Orange County.
Anthony's defense has repeatedly claimed the case against its client is weak and should be dismissed. The defense said evidence in the woods where Caylee's body was found was spoiled by authorities before defense experts could examine it.
The defense has also claimed that the failure to discover Caylee's body in the months before it was found, despite searches near the area, is also evidence of Anthony's innocence.
The prosecution said the defense has yet to substantiate its claims of innocence and the state is demanding a list of witnesses the defense plans to call to support their claims.
Earlier this week, the prosecution ridiculed the defense's motions to dismiss, saying they were legally flawed and should not even be called for a hearing.
Strickland did not call the motion to dismiss to be heard at next week's hearing, but did set for hearing the state's move to have that motion to dismiss cleared from the record because it is flawed.
In an attempt to correct itself, the defense recently added a sworn statement from Anthony, which said she did not report Caylee missing until July 15, 2008, one month after the toddler was last seen alive. Anthony claimed she left Caylee with a baby sitter named Zenaida Gonzalez.
It is unclear how those facts, which are not new, will prove Anthony's innocence in her daughter's death.
Strickland also set a status hearing in the check fraud case against Anthony for the same day as the hearing in the murder trial.
Pipitone said it looks like Strickland is trying to clear the clutter over the defense's claims that she case should be dismissed. Strickland also did not call the defense's motion to bar the state from seeking the death penalty to be heard next week.

Snaz, I totally agree that this should be good. I think some of the state's strongest evidence will be in the forensic entomology investigative reports.

And the presence of "coffin flies" Not blow flies. Which shows Caylee was very possibly, IMO, put into that trunk either alive or before any decomposition had occurred. She then attempted to clean it up with the paper towels. Unless of course, there was a decomposing pig in her car, as those are the only two things consistent with the compounds found on those paper towels, if I read that correctly.

Whether or not a jury wants to believe the tape is a match or not, had a heart sticker on it or not, will Baez, Lyons or Baden, please explain WHY in the world KC had paper towels with human or pig fat breakdown on them in HER trunk? So, let's see if Conway, Baez, Baden, Macaluso or Lyons goes on television to try and explain THAT away!

Apparently there are two separate hearings tomorrow in two separate court rooms.
The first is for the fraud case at 9:00 a.m.
The second is the murder case at 9:30 a.m.

Tracey, you didn't miss much... it was a wham, bam, thank you ma'am kind of hearing..... Judge S did grant defense's motion to copy photos to disc and send them to their experts out of state. I know most people don't agree with that, but I think the Judge is doing everything he can to make sure there are no grounds for appeal later......
As far as them all laughing, the Judge said something that was apparently funny to the whole courtroom because everyone seemed to laugh.... but I couldn't hear what he said.....

ORANGE COUNTY, Fla. -- The case against Casey Anthony headed back to an Orange County court Friday morning where her defense team tried to convince the judge to dismiss her murder charge.
Casey Anthony appeared before Judge Stan Strickland Friday wearing a turquoise blouse and her hair seemed longer (see images).
Circuit Judge Stan Strickland didn't immediately rule on the prosecutor's request. Anthony's attorneys had asked that first-degree murder and aggravated child abuse charges against Anthony be thrown out, claiming they were based on "circumstantial and speculative" evidence.
The defense filed a motion claiming the prosecutors refused them access to the crime scene, but it was actually prosecutors who asked for the hearing.
In the motions set to be heard Friday, the two sides accuse each other of everything from lying to the court to posing for inappropriate pictures at the crime scene where Caylee's body was found.
Prosecutors say the defense team is withholding trial and hearing witnesses from a required list.
Out of six experts the defense had at the crime scene where Caylee's body was found, only one, forensic expert Dr. Henry Lee, has been listed as a witness to date.
The state also claims the defense has refused to give up information they say proves Caylee's body was dumped after Casey was already in jail.
In August, the defense claimed to have "substantial evidence" of that timeline, but prosecutors say they have not disclosed that evidence. Defense attorneys say it is already in the court file, but will not say where.
Meanwhile, Casey's attorneys will level some heavy allegations against prosecutors Friday, insisting that the state intentionally misled the court and prevented the defense team from inspecting the crime scene where Caylee's body was found in December of 2008.
Defense lawyers argue that now they cannot effectively challenge prosecutors. For that the defense wants the judge to dismiss the charges against Casey.
Prosecutors claim that motion is legally flawed and should be thrown out.

ORANGE COUNTY, Fla. -- The case against Casey Anthony headed back to an Orange County court Friday morning where her defense team tried to convince the judge to dismiss her murder charge.
Casey Anthony appeared before Judge Stan Strickland Friday wearing a turquoise blouse and her hair seemed longer (see images).
Circuit Judge Stan Strickland didn't immediately rule on the prosecutor's request. Anthony's attorneys had asked that first-degree murder and aggravated child abuse charges against Anthony be thrown out, claiming they were based on "circumstantial and speculative" evidence.
The defense filed a motion claiming the prosecutors refused them access to the crime scene, but it was actually prosecutors who asked for the hearing.
In the motions set to be heard Friday, the two sides accuse each other of everything from lying to the court to posing for inappropriate pictures at the crime scene where Caylee's body was found.
Prosecutors say the defense team is withholding trial and hearing witnesses from a required list.
Out of six experts the defense had at the crime scene where Caylee's body was found, only one, forensic expert Dr. Henry Lee, has been listed as a witness to date.
The state also claims the defense has refused to give up information they say proves Caylee's body was dumped after Casey was already in jail.
In August, the defense claimed to have "substantial evidence" of that timeline, but prosecutors say they have not disclosed that evidence. Defense attorneys say it is already in the court file, but will not say where.
Meanwhile, Casey's attorneys will level some heavy allegations against prosecutors Friday, insisting that the state intentionally misled the court and prevented the defense team from inspecting the crime scene where Caylee's body was found in December of 2008.
Defense lawyers argue that now they cannot effectively challenge prosecutors. For that the defense wants the judge to dismiss the charges against Casey.
Prosecutors claim that motion is legally flawed and should be thrown out.

Tracey, you didn't miss much... it was a wham, bam, thank you ma'am kind of hearing..... Judge S did grant defense's motion to copy photos to disc and send them to their experts out of state. I know most people don't agree with that, but I think the Judge is doing everything he can to make sure there are no grounds for appeal later......
As far as them all laughing, the Judge said something that was apparently funny to the whole courtroom because everyone seemed to laugh.... but I couldn't hear what he said.....
OK.. here's why they were laughing:
They are in a different judge's courtroom...... Judge Strickland said, "Whose courtroom is this? I've never seen so much handcream in my life". That's when everyone laughed. (I guess you had to be there.....LOL)

The decision on the check fraud trial date was initially put off due to several new motions recently filed by the defense in relation to that case. However, just after 11:00am, less than an hour after the hearing had ended, the court said a pretrial status hearing was set for Friday, December 18, 2009 at 10:00am and the trial date was set for Monday, January 25, 2010.
The defense’s motion to dismiss the case was not ruled on by Judge Stan Strickland. He said he would rule on it later Friday in writing and will either uphold the defense’s motion or uphold the state’s own motion to strike the defense’s motion. Prosecutors is court Friday called the motion legally a “farce.”
In response to the state’s motion to compel the defense to provide the evidence supporting their allegations that someone else dumped Caylee’s body other than Casey, the judge ruled the defense has to turn over the supporting evidence by February 1, if it exists.
The judge was supposed to hear a defense motion regarding jail photos, however they incorrectly noticed the sheriff’s office about the hearing instead of the county, which actually runs the jail. That issue will have to be heard at a later time.
The only victory so far for the defense was that the judge granted them access, in a limited way, to CDs of the remains so their own experts can do more detailed work. To this point, access to those CDs had been restricted.

If Casey Anthony's defense team has evidence that their client is innocent of a murder charge then they must hand over that evidence to prosecutors.
That's what Orange Circuit Court Judge Stan Strickland ruled this morning in the latest hearing of motions in the murder case against the 23-year-old mother accused of killing her daughter.
Strickland granted the state's request and asked the defense to turn over its evidence by Feb. 1 or else explain why it can't do so.
This request followed a statement made by defense attorney Todd Macaluso at a previous hearing that the defense had evidence that would prove Casey Anthony was innocent. He was not specific about what that evidence is.
Anthony is accused of killing her 2-year-old daughter, Caylee Marie. The toddler was reported missing in July 2008 -- although Casey Anthony told investigators that she had not seen her child since she left her with a babysitter mid-June. Investigators determined the nanny never existed.
In December, a meter reader found the girl's remains scattered in woods less than a mile from her family home in east Orange County.
The state is seeking the death penalty in the first-degree murder case against Anthony, who remains in the Orange County Jail.
Defense attorney Jose Baez said his case is based primarily on evidence provided by the state. And, he said, the defense should not be obligated to show its hand to the state.
He said her defense team has discovered evidence that Caylee's body was put in the woods - where her remains were later found - while Casey Anthony was in jail.
The judge did not rule on the state's issue to strike the defense's request to dismiss the first-degree murder and aggravated child abuse charges. The state claims the request is legally insufficient.
Strickland said he may rule by this afternoon.
The defense will be allowed to get copies of crime scene photos, including autopsy pictures, to share them with their experts. Strickland ruled in their favor after Baez explained the defense experts were having trouble accessing a computer server created to house the pictures.
Authorities feared the photos would be leaked to the public.
Media, law students and other spectators packed a courtroom for this morning's hearing. Casey Anthony smiled at her parents, Cindy and George Anthony, as she walked into the courtroom.
Late Thursday, prosecutors filed transcripts of depositions that have been taken while preparing for trial.
Interviews with Anthony's parents were made public, as was one with Anthony's brother, Lee Anthony.
The transcripts total more than 1,300 pages.

Casey was in court Friday for the first time in months. Casey appeared before Judge Stan Strickland Friday wearing a sea-foam green, puffed-sleeve, belted shirt and her hair looked longer (see images).
The court hearing was a lot shorter than it was supposed to be, because Casey's defense team made some legal snafus. The defense took a pounding in court; it couldn't have some of the hearings it wanted to have because it didn't do what it should have.
The defense failed to provide a witness list for one of the issues and gave legal notice to the sheriff's office instead of the county to prepare for the jail camera issue (read motion), but the sheriff has not run the Orange County jail since 1987.
“It’s a farce. It doesn’t even come close to the legal requirements necessary for the court to even entertain a motion to dismiss,” state prosecutor Linda Drane-Burdick argued Friday.
That's how prosecutors described Casey Anthony’s defense team motion (motion | state response | defense reply) for the judge to throw out the murder and child abuse charges against Casey.
“The entire motion, from top to bottom, it is replete with errors, it’s insufficient as a matter of law,” Drane-Burdick said Friday in court.
“It cannot be the intent of the Florida legislature that a person swear to something that they do not have personal knowledge,” Casey’s attorney, Andrea Lyon, argued.
The judge decided not to rule on whether he'd throw out the charges against her during the hearing, but issued his order not to dismiss the charges just after noon.
“The content of the motion, as well as Ms. Anthony’s brief affirmations, are not enough to carry the day under Florida Rules of Pleading,” Judge Strickland wrote in his order.
Meanwhile, the defense was ordered Friday to turn over, by February 1, any evidence it might have to back up its claim that someone else placed Caylee's body in the woods last year (motion | defense response).
“Is there gonna be a bombshell on February 1st,” WFTV reporter Kathi Belich asked Casey’s attorney, Jose Baez.
“There will be something. There definitely will be something,” Baez said.

I just heard something interesting on the check fraud charges and the murder trial and the order in which they are heard. Beth Karas said an attorney told her why the state may want the check fraud trial to go first. He said that if the check fraud trial were to go after the murder trial, and she was convicted of murder, and evidence of the check fraud case was admitted into the murder trial, but she was then acquitted of the check fraud charges, that would throw out the conviction of the murder trial and would create a re trial.
However, no lawyer involved in the case said this. It was just an attorney in FL. Makes sense though.

hmmm.. i BET their "evidence" that caylee was placed there when KC was in jail will be the testimony of those people with the dogs that supposedly searched that area thoroughly..
oh.. having a brain fart, and cant remember the name of the organization, but i bet they use them to "prove" that she wasnt there when they "searched"...
do i think it will work, NO.. do i think they will try it, FOR SURE...
and again.. IF you had PROOF your client was innocent, wouldnt you bring that up in your PRE TRIAL arguments and motions, OR would you let her sit in jail for 2 YEARS before you bring the evidence at trial... i call BS!!!

Randilynn, I couldn't agree with you more. And not only that but it's always the same thing with Baez. He only says when the entire story comes out, we will all understand why KC'S actions were what they were.
I have thought about every possiblt explanation a MOTHER could come come up with for the way she acted and I'll tell you as a mother, not ONE thing could make me act like that if I was away from my child for 30 minutes, let alone 31 days and not knowing where she was. Heck, even if I knew where she/he was, if I was away from my child for 31 days, I would NOT act like she did....EVER, NEVER, EVER!
And if her excuse would even be, I didn't think she was in danger, uhm, still, wouldn't you want to talk to your child? Like I said, there isn't anything the defense can concoct ever, that would make me buy her actions. Anyone else????? Am I crazy?? Or missing something??

I'm really not surprised the Judge granted the state's motion to strike this motion. but now all I can think is, Great, just great, does this mean the defense will file it AGAIN, seeing he dismissed it without prejudice. My goodness, how many chances does a guy (Baez) get to make a motion correct? I could see if his motions were at least correctly written and formed and then maybe them getting denied or granted. But geez, how many of these motions have we seen now that just get denied outright because they are done incorrectly? Geez!

They are going to have to learn Fla law and how to write a motion better if that is their plan! The entire motion was flawed from beginning to end. They knew that when they went in there. They didn't even bother come prepared to argue it in court... because they have no argument. kh
