Ann - they are the papers she is going to have Steven served on the Civil Suit she is filing today, she is representing the neighbor's, the two girls Steven cataloged videos/pictures of.

Just a note on Civil Suits: If anyone is following the Kyron Horman Case, it is important to understand the difference in proving the Civil Case. In this case, Bremner has stated that she waited until today to file the "Civil Suit" as it is the end of the Criminal Case for Steven, she is entitled to ALL the public records, testimony, evidence, etc. Too, Steven has been convicted of a crime.

In Desiree's Civil Suit against Terri Horman, she is not entitled to ANY of LE's evidence/case against Terri, Desiree & her attorney have to create ALL the evidence in her Civil Suit & prove in a Court of Law, Terri unlike Steven is NOT convicted or even charged in any crimes. Desiree is not entitled to any evidence in the case, LE's case is ongoing & an open case. It's not impossible, but terribly terribly expensive for Desiree/her attorney to pursue if it is not thrown out.

Estee, I was reading up on the case earlier today & strangely, the laws changed in 2006 or 2007 making voyerism a heavier sentence. BUT! unfortuately, there is no date on some of the videos/pictures, that's why the Defense is trying hard so hard on this issue, they claim some of the videos are OLDER than the new laws & wouldn't warrant the stiffer penalty. imo, what difference does it make? A pervert, Steven, recorded/photographed children a long time, he is still a freakin PERVERT & a meance to society!

Another case children's rights aren't as great as that of a pervert, imo.

The problem: Most of the video/pictures aren't dated. The analyst seemed to think the Judge isn't going to rule on the newer laws which give stiffer penalities. They predict the Judge to err on the side of the Defendant, his rights.

Art...That seems to be the consensus of opinion...Even if he gets 10yrs that would probably mean his demise would occur during incarseration...I could live with that decision...One thing for sure is he needs to be put where he can't get his jollies off by looking at little girls.

Estee, Josh & Steven both royally give me the creeps, blantant perverts imo. Steven P has been fired from his job for his behavior/charges, he has nothing imo positive to donate to society, statistics tells us perverts don't change their behavior, so being locked up is the least the Judge could do for all young women & children imo.

The Coxes are challenging the Insurance Claims of Alina & Micheal, 2 of Josh's siblings, Mrs. Graves, Josh's other sibling & formerly one of Susan's best friends, has aligned herself with the Cox family in FIGHTING over the insurance policy.

There was a $ 250,000.00 ryder on EACH of the boy's, in addition to the 1 million dollar policy on Josh, the total payout is to be: 1.5 million dollars. To think Josh profited for the murder of Braden & Charlie to give $$$$$ to his family makes me sick. Steven is to get 6 0r 7% of the insurance.

The Problem for the Powell family: The Cox family & their attorney's have tied up the payout! It may be years before this is settled even though Alina/Micheal called the Insurance Co. only days after the murder's of the boys. The Insurance Co. is GLAD to tie up the pay out.

The Cox family is raining POOP on the Powell family from the perverted dad to the greedy money hungry siblings of Josh's more than glad to accept money for the murder's of Charlie/Braden. KUDOS to the Coxes.

If the first offender punishment were stiffer there might not be a second or subsequent offense...Oh sure let him off easy so he can figure out a way to continue his activities without being caught or worse yet so he can act out his sexual fantisies by actually assaulting/molesting a young person.

Reading from charges ? and asking some not to be included. Re-offending, risk to community, Powell be prohibited from using internet, be subjected to screening for mental health, drugs, etc.. Atty says no indication Powell has a mental diagnosis. No formal sense of MH issues. Request Powell not own a cam-corder, etc., but attty believe it is too broad. Again, believes 12 months is just.

12 months??? Wow. That is ballsy. Wonder if he could then get credit for time served! No to county jail! Send him to prison. In some states, less than 12 months in jail is a misdemeanor; 12 months in prison IS A FELONY. Wonder about the atty's request.

There WERE injuries. Emotional injuries are harder to heal from than physical.
Atty downplayed this stating Powell never touched them. Just took pics. And atty wants Powell to keep his camera an internet! Gawd.

Freckles, imo, Steven's crimes stand on their own merit. He is a proven pervert/voyuer, the statistics are poor for these individuals to quit. It seems his Attorney's are mucking up the issue of what Steven has done.

Analyst said it is a Maximum of 10 yrs that Steven can recieve, the Prosecutor's have ask for this, imo, Steven doesn't deserve any lienacy. This crime involved children, my blood pressure is rising!

Calling for this to be a sexual offense. Feels State's request is excessive. Notoriety is a concern. Believes 30 months in custody followed by 36 month probation. Can not use internet unless permission is given. No MH required. Must complete sexual deviancy program. Powell should stay from cameras, camcorders. DNA testing. Trial costs of $2000, $500 fine.

I turned on late. I do think I heard her statement. It was most emotional. She called him a creep. Said he would have to answer to a much bigger person and hoped that person would forgive him because she will never. He stole the sense of security from her girls.

Restitution Hearing scheduled for Friday, 8-17-12. No time stated.

Judge told Powell he has the right to be at that Hearing.

Ann - tx, I'm irked to death about this. There is nothing being done about rehabilitation for Steven, his education DIDN'T PREVENT him from spying on vunerable children even in the bathroom. This is ridiculous. Steven's education, that his attorney's thought meant something, didn't give Steven the brain power or impulse control to prevent himself from spying on children & SUSAN.

I am interested in the perimetors of the Community custody & what that entails, is it a half way house of sorts for criminals? I still don't see how Steven can be kept off a computer once released, he can access anybody's laptop he is with even if just visiting.

Tacoma, Wash. — A judge here on Friday sentenced the father-in-law of missing Utah woman Susan Powell to serve 30 months behind bars and 36 months in community custody on voyeurism charges.

Pierce County Superior Court Judge Ronald Culpepper handed down the sentence to Steve Powell on 12 felony counts of the crime, ordering the sentences to be served concurrently after calling the 10 years in prison prosecutors had suggested "excessive."

In the UK if the proscutors or anyone think the sentence is too lenient it can be appealed. The Attorney general can look at it and has the option of sending it to the court of appeal asking for the sentence can be reviewed. Even if a case is passed on to it, the Court of Appeal might not change the sentence. If the Court of Appeal decides a sentence is not 'unduly lenient', the original sentence will stay in place.

If the Court of Appeal decides a sentence was too low, it can give advice to judges and the sentence may be increased.

I am not sure if you have this in the states, if not maybe you can demand it be introduced.

We have also abolished double jeopardy and if new and conving evidence is uncovered or the person confesses they can be retried. This only applies to the serious cases and not all cases are deemed suitable.

In the racist murder of Stephen Lawrence, new evidence (forensic - a microscopic speck of blood on one of his killers trainers in this case) resulted in 2 of the gang being charged again and found guilty. The other members of the gang whom the police know wee involved could be charged if enough evidence is found.

If you had it then cases such as casey anthony could be retried if new and compelling evidence was found ie she admits it in an interview or book or cindy or george come clean about what really happened.
