He is telling her what would have impacted him and she is memorizing these lines. She is crazy and will use those words for her own gain.

Judge called her out! Said TS appeared/acted as IF she KNEW when in fact she did NOT know. (She goes to the appearance, IMO.)

Will we know what the probation terms are? 3 years is a long time for TS to follow instructions - she didn't listen to her atty nor the CPS, so if I were a betting person.... I hope the probation has stringent terms and prohibits any "business or non profit" activities having to do with young mothers, young children, etc.

ETA: Logan knows her and his letter indicated that he felt probation would be more difficult for her than "time"...remains to be seen but I am again reminded that we have a legal system, rather than a justice system. Just sayin'

State request limiting contact with women/children: 501-C. Judge is concerned with her contacting others women/children. Judge is not sure whether to limit profits from books, media. Judge wants the defense to have chance to respond. State will file additional terms.

Work furlough: Wow. State objects.
Work release is not monitored and State would object.
Asking for TS to be released each day from jail to go to work. Judge is going to allow it for 8 -6, MF during jail time.

(Totally watered this case down!)

Restitution request not entered. Judge will consider it however.

Get someone to help her? He has to be kidding! Why didn't the judge just simply say TS needed to get her husband, or her minister, or the crazy sister to help run the place? Yeah. That would do the trick!

I came back tonight to read the 'transcript' of these last few pages, expecting a little Justice to shake the '1yr anniversary blues' and this is what we get.

I hate to be cynical, but the 'mother' will probably get off easy too.

He did. But, but, but I don't think she should be allowed to have any dealings with charities or foundations much less start one that have to do with expecting mothers and children of any sort.

Freckles, I tried to find the pic that was posted on THM of the "mama" bear sitting calmly at the computer with a robe, curlers in her hair, house shoes on, coffee mug, etc. (Maybe it was a lady) I think Blue put Hinky Meter on the screen or somewhere on the pic (maybe the coffee cup). It was funny. I've seen it many times when I've searched for "images - Hinky Meter" over the past several weeks. Can't find it now. Darn!

I am disappointed in the sentence that Tammi Smith was given.

It is a slap on the wrist! I feel sorry for the McQueary family.

I can not believe that the judge will allow Tammi to still be involved with children! He said maybe she needs some help with her so called "business." Disgusting!

The defense attorney compared Logan's record/sentencing to Tammi's conviction and what her sentence should be. Really? One has nothing to do with the other. Logan was NOT the one convicted in this case.

I found it disgusting and despicable that Tammi Smith compared herself to Christ! She said she is a "servant" of God, blah, blah, blah.

This woman is really nuts. But then again I felt she would play her so called "religious" card.

As a result of Tammi's involvement, I think she contributed to Elizabeth Johnson going "over the edge." If it had not been for her involvement and her fraudulent acts, maybe Elizabeth and Logan would have worked things out in court and Baby Gabriel would still be here today.

In my opinion, this judge sent a message to folks in AZ that it is okay to tamper with government documents (fraud) as you will only get a slap on the wrist, 30 days in jail but can leave from 8 to 6 pm on work release and then only serve a 3 year probation.

I bet when Tammi leaves on work release Monday thru Friday, she will go home, drink her wine, relax, play with the kids, take a bubble bath, go out for fine dining and enjoy life! Or maybe she'll cruise airports, fast food places and dollar stores looking for her next victim. Then she will go back to jail to spend the night. How nice! Go to jail to sleep and not have to be there 24/7.

If I had spent over 3 weeks serving on this jury and deliberating the case, I would be very disgusted and disappointed in the sentence by the Judge.

All of that taxpayer money spent for nothing. Why even bother to have a trial in this case?

The most disgusting thing is that Tammi Smith showed no remorse for what she was found guilty of. Even the Judge said so. I think, in Tammi's sick mind, she thinks she did no wrong and the jury erred! This woman will not take responsibility for her actions.

Another thing, the probation folks did a report without lots of info. What the heck? And it appears that was okay with the Judge.

I wonder what the female detective is thinking. (Ramirez?). She spent hours with Tammi and her lies during the investigation.

It appears the Judge is not going to let Tammi profit off of her conviction. He can't keep her from writing a book or doing interviews but indicated he can prevent her from receiving monies for aforementioned.

All of the above: Just my opinion!

A Review Hearing is set for 12/7/12.

A judge has sentenced Tammi Smith to 30 days in jail and three years of supervised probation for forgery and conspiracy to commit custodial interference in the Baby Gabriel case.

The would-be adoptive mother of an Arizona baby missing for more than two years made a last plea before a judge at her sentencing hearing in Phoenix.

Smith, 40, said she's never been able to tell the "true story" of what happened because she said she's never been allowed that chance.

Smith addressed the judge for about thirteen minutes. Much of her statement centered around her Christian faith. Near the ten minute mark Smith apologized, but not necessarily for her actions.

Tammi Smith, the would-be adoptive mother of Baby Gabriel, was sentenced Friday to a 30-day jail term and three years' probation in Maricopa County Superior Court Friday for her role in the child's disappearance.

Last month, a jury found Smith guilty of forgery and conspiracy to commit custodial interference. The judge said a prison term for Smith was unwarranted given she had no previous criminal record and given the nature of the offenses.

Smith was also sentenced to a 30-day deferred jail term, which will go away with good behavior and mental health counseling.
