On Oct. 11, Kaine Horman's lawyers faxed to Terri Horman's lawyers a notice that they wanted to convert the civil deposition of the landscaper, Rudolfo Sanchez-Estrada, into what's called a "perpetuation deposition,'' meaning the questions and answers would be preserved in writing, and audio and video recorded and could be presented as evidence at a trial at a later time.

"It is anticipated that the witness will testify concerning factual recollections and observations,'' Kaine Horman's lawyer Brett Engel wrote Oct. 11 in a legal notice about the deposition.

Usually, such depositions are sought if the person being questioned is ill, elderly or about to leave the state.

Stephen Houze, Terri Horman's defense lawyer, said Kaine Horman's lawyers must show either that the landscaper "may be unavailable'' at a later time, or it would be "an undue hardship on the witness'' to appear at a trial or hearing, or "other good cause exists'' for such a deposition.

Houze wrote in a court document that his client "strongly objects to the conversion of the Civil Deposition into a Perpetuation Deposition because she has not been given enough information regarding the anticipated subject matter of Mr. Sanchez-Estrada's testimony.''

The divorce trial for Kaine Horman and his estranged wife Terri Moulton Horman will move forward at the start of the new year, while the child custody and parenting trial to determine what's in the best interests of their 4-year-old daughter will be delayed until June, a judge decided Friday.

Terri Horman, stepmother of missing 7-year-old Kyron Horman, attended the latest hearing in Multnomah County Circuit Court with her attorneys, but Kaine Horman, Kyron's father, didn't show.

The judge closed the proceedings to cameras for the first time. One of the parties made the request, Judge Henry Kantor said, and he granted it.

Terri Horman will ask for temporary parenting time and support for the couple's daughter, Kiara, prior to the divorce trial. She hasn't been permitted to see the girl in more than three years. A hearing on that request was set for the mornings of Dec. 19-20.

The trial on their divorce and financial matters is scheduled for Jan. 2. The full child custody and parenting trial will wait until mid-June.

"I just felt like I needed to make a statement to her, that Kyron is a priority and we are not going to go away," said Desiree Young, the mother of Kyron Horman.

On Saturday, Young and a group of friends protested outside of Terri Horman's house. The demonstrators carried signs. They also wrote on the street in bold letters with chalk asking, "Where's Kyron?"

...On Saturday, Roseburg Police responded to the protest after Terri Horman's mother called 9-1-1 to complain about vandalism and trespassing.

In court documents filed last week, Terri Horman's attorneys state she "should have frequent and continuing contact with Kiara, as it is plainly in Kiara's best interest for that to occur."

The court documents cite information from a deposition of Kaine Horman, where he stated they were "average" parents and admitted Terri Horman cared for Kiara between 50 and 75 percent of the time, "at minimum."

Terri Horman's attorneys said her husband confirmed in his deposition that concerns were never raised about her parenting skills by Skyline School, her doctor or Kiara's pediatrician.

A hearing on temporary custody of the girl is scheduled for Dec. 19. The couple's divorce trial is set to begin Jan. 2.

PORTLAND – Terri Horman is asking the court to allow her to spend time with her 5-year-old daughter, according to court documents obtained by KGW Monday.

In court documents associated with the divorce case filed Nov. 26, Terri's attorney Peter Bunch said Kaine has shown no evidence that should keep her away from the child and that Terri should have "frequent and continuing contact with Kiara."

Bunch stated in the document that he would present "expert testimony" to assist the case for restoring Terri's parenting access.

A court date is set for Dec.19.

PORTLAND -- A landscaper who used to work for Terri Horman said in his depostion that she solicited him to "get rid" of her husband Kaine in murder-for-hire plot that would be "made to look like a mugging."

Court documents obtained by KGW Monday included quotes from the deposition interview

Landscaper Rodolfo Sanchez-Estrada said Terri Horman told him she was afraid Kaine Horman was going to try and take her daughter away from her, so she wanted Sanchez to "get rid" of him, as first reported by The Oregonian.

On Friday KATU disclosed details from a deposition given by the landscaper, Rodolfo Sanchez, that included his claims that Terri had told him Kaine regularly carried $10,000 and a computer, and his murder could be made to look like a mugging.

In court papers, Kaine’s lawyers draw a connection between that and the disappearance of his son, Kyron, who was last seen shortly after being dropped off at school by Terri, his stepmother, almost four years ago.

They use the landscaper’s allegations to argue that Terri should not be allowed to spend time with their daughter, now 4 years old.

"The Sanchez testimony establishes an extreme risk of harm to" Kiara as well as Kaine, they argue. "The Sanchez testimony establishes a motive surrounding the disappearance of Kyron Horman."

Boy, I wouldn't let her take Kiara. She could take her and kill her and then herself as a don't mess with me Kaine attitude. She has nothing to lose cuz she will forever be known as the reason for Kyron "missing" most likely killed him imo.

PORTLAND, OR (KPTV) - A landscaper in an alleged murder-for-hire plot to kill Kaine Horman will testify in court this week, and his statements may determine whether Terri Horman is given any parenting time with her daughter.

"He will be testifying, but as I understand Judge Kantor, there will be certain areas we will not be going into," said Adam Thayne, Sanchez's attorney. "Obviously, this is something he would prefer not to be a part of, but he's in the position that he's in and he's doing his best to comply with what the court needs him to do."

Stephen Houze, a high-profile attorney representing Terri Horman, repeatedly called Sanchez an "agent of law enforcement" at the hearing and questioned his credibility. Houze also suggested Sanchez wore a wire when he talked to Terri Horman for the final time, and he asked the judge to be given documents related to Sanchez and the search for Kyron.

Kiara is set to start kindergarten in the fall of 2014, according to the court documents, and child support will be recalculated at that time to take into account possible new day care costs.

That's a good question, Puzzler.  As a local to the area, I haven't heard of any "pending criminal charges" against Kaine.  The only thing I can think of is that Terri Horman is alleging (via DeeDee Spicher's old interview with BOC) that Kaine was using illegal steroids.  As far as I know, there are no charges against Kaine; only Terri hoping there will be.  But of course that's only my guess.  I suppose it's possible that there's more to the story than what has been released to the public.

Terri Horman fights to question landscaper

PORTLAND -- Terri Horman's lawyer wants to question the family landscaper in connection with an alleged murder-for-hire plot against her estranged husband Kaine Horman.

The issue first came up during divorce proceedings, but has resurfaced as the two sides prepare for a custody battle.

Last month a judge ordered that Terri Horman's lawyers could not cross-examine Rodolfo "Rudy" Sanchez about a brief 2010 meeting with their client. Police helped set up the sting operation after Terri Horman's stepson Kyron disappeared from Skyline School on June 4, 2010.

In a recent court filing, Horman's lawyer wrote: "There is no more important decision for the court to make regarding custody and parenting time in this case than its decision regarding the scope of the Sanchez testimony and the circumstances surrounding his involvement with law enforcement."

Lawyers for Kaine Horman and his ex-wife Terri Moulton Horman return to court Thursday to debate how a judge should consider testimony from the Horman's former landscaper in the pending custody case involving their daughter.

Terri Moulton Horman is in court with her attorneys, as his Kaine Horman.

Kaine Horman's attorneys have argued in court papers that "no restrictions'' should be placed on their ability to use the testimony they've obtained from Rodolfo Sanchez, the landscaper.

Sanchez, in a deposition, said Terri Horman had solicited him to help kill her husband five months before Kyron Horman - Kaine Horman's son and Terri Horman's stepson - disappeared in June 2010, according to court documents.

Said there's no basis for him to reconsider the ruling, and is not going to do.

If he were to reconsider the ruling, I'd adhere to my initial decision. "It would not change,'' Kantor says.

I will allow Mr. Horman and Ms. Horman to provide a complete record.

It is likely that I will give zero to very little weight that cannot be held up to cross-examination or impeachment.

So if the Sanchez testimony turns out to be the only basis to the Kaine Horman case, "perhaps a fresh look has to be in order,'' judge says.

Judge : "I am not going to abate this case.. People's lives have to move on.''

There may be appellate review of my decisions. "It's only going to get worse or more difficult,'' if there's a delay. "So we're going to go forward. There is no plan for me to delay or abate these proceedings.''

Terri Horman can't escape her suspicious past

Missing child Kyron Horman still hasn't been found, but his stepmother is still trying to escape from the notoriety of her name. Various media reports shared on Wednesday that Terri Moulton Horman is trying to change her name to Claire Kisiel. This is the second time Terri has tried to change her name to escape her shady past. The first time failed when a judge decided against the name change, but a decision has not been made yet on this second attempt. It's expected to be considered in just over a week.

Terri Horman, the stepmother of missing Portland boy Kyron Horman, has left her job as a caregiver for nonprofit Shangri-La Corp., the organization said Friday.

Investigators have suspected Horman played a role in the disappearance of her 7-year-old stepson, who vanished after Horman took him to an early-morning science fair at Portland's Skyline Elementary School on June 4, 2010.

The largest search-and-rescue operation in Oregon history never turned up any signs of the boy. No arrests have been made and no charges have been filed in the case.

Horman had worked in Eugene for the nonprofit since December, after applying for the job under the name Terri Moulton. Salem-based Shangri-La provides residential care for adults suffering from mental illness.

When Horman's job became public knowledge, Karen Rutledge, Shangri-La's chief executive, said the nonprofit followed all applicable laws in hiring Horman, and that the hire reflected acceptance, trust and compassion.

Friday's statement from Shangri-La said Horman quit her job because she "recognized the impact her employment had" on the nonprofit since it had been made public.

In the attached statement, Rutledge said Horman performed her job to their expectations and "showed compassion to people with special needs." ....."

As the fifth anniversary of Kyron Horman's disappearance approaches, the Multnomah County Sheriff's Office is publicizing its ongoing $50,000 reward for information that leads to the discovery of the missing boy.

...Multnomah County Sheriff Dan Staton and District Attorney Rod Underhill declined to answer questions about the status of the case, but instead the sheriff's office put out a four-paragraph statement Thursday.

The case remains active, with a full-time sheriff's detective "primarily assigned'' to the Kyron missing child investigation, according to the sheriff's office.

June 4, 2015 marks the five year anniversary of the day Kyron Horman disappeared from Skyline Elementary School in Northwest Portland.  Kyron was seven years old at the time of his disappearance and will turn 13 this September.

The Kyron Horman case remains active with the Multnomah County Sheriff’s Office. A full time Sheriff’s Office detective is primarily assigned to the Kyron Horman missing child investigation, and efforts to locate Kyron. Additionally, a now retired FBI Agent with years of experience in the Child Abduction Rapid Deployment teams (CARD) continues his involvement in this case, reviewing the evidence amassed by investigators. PORTLAND, Ore. (AP) — It’s said that time heals all wounds. For Desiree Young, it’s not worked out that way.

The pain she first felt five years ago when her son Kyron disappeared from Skyline School in Portland hasn’t softened. If anything, her emotions are more ragged today, she said. Tears flow often. The gnawing hole inside hasn’t filled, not even a little.

“It doesn’t get easier with time,” Young told The Oregonian. “I still wake up crying and praying, hoping today will be the day.”

...In September, Young is planning another search.

She hopes to bring in 15 tracking and cadaver dog teams from Washington, Idaho, California and Florida to search in the Portland area, but wouldn’t say where. She’s organized several other searches in the past.

She said they’ve turned up evidence implicating Terri Moulton Horman, who was married to Kaine Horman at the time Kyron went missing. Terri Horman took the boy to a science fair before class at Skyline School and then walked him to his classroom before leaving.

“We’ve found evidence to suggest that Terri might have been trying to get rid of things connected to Kyron,” Young said, referring to the previous searches. “She’s not going to talk until we have evidence to confront her. We have to find it.”

Vigil for Kyron Horman on 5-year anniversary of disappearance

PORTLAND, Ore. -- The mother of Kyron Horman held a candlelight vigil on the fifth anniversary of her young son's disappearance.

Hundreds of people attended the vigil next to the Kyron Horman Wall of Hope in Beaverton.

The boy's mother, Desiree Young and her husband, Tony Young, spoke and placed items at the wall. Supporters were encouraged to bring items to place along the wall before a balloon release and lighting of the candles.

I'm on pins and needles this weekend as I think about a new search happening for Kyron.  I pray they turn up something--anything--that will provide Desiree with the clue she is seeking.

Since it is late summer, I'm concerned vegetation growth will be so advanced that searching will be very, very difficult.  Still, miracles do happen.

There is a video at the link below in which Desiree says she thinks there may have been at least three people involved, or who know what happened to Kyron--I had never heard that before.  She mentions one of them is Spicher.  That comes as no surprise.

We've had an unusually dry and very hot summer here in Oregon, so everything is bone dry (until the rains started last week). A lot of vegetation has died off because of the heat and dryness, so hopefully it won't be so bad.

Heard on the local news last night that:

- they are trying to keep the location of the search quiet
- they had a false alarm yesterday; some bones were found, but they turned out to be animal bones.  I'll see if I can find an article.

On Saturday searchers found bones near Forest Park and called police. By evening the medical examiner determined the bones were from an animal, and the search for Kyron continued.

Searchers looking for 'any clue' about Kyron Horman

PORTLAND, Ore. -- Searchers on Sunday continued to look for any clues in the disappearance of Kyron Horman five years ago, when he was just 7 years old.

"We are looking for anything that would give us a clue as to where he [Kyron] might be, looking for any of the clothing he might have been wearing,” said Dennis Herring with the KlaasKIDS Foundation.  “Anything like that could give us an indication of where he was."

...This latest search has focused on areas traveled by Terri Horman the day her stepson vanished.  Specially trained dogs, from as far away as Florida, were aiding in the effort, along with more than 60 volunteers.

Thanks, CP!  It's nice to see you, too; and thanks so much for all your updates on Kyron's case!

Now I'm regretting posting my map, but all I really meant to show was the old, old locations that were released in the beginning.  I meant it more of a timeline review than anything, I guess.

I know the belief that most victims are found within a 20 mile radius of their last known location, so I did assume that somewhere in that vicinity they would be searching.

There was a little tip of the location with the bones, too.

Gosh my heart goes out to Desiree--I wouldn't be surprised if she was almost incapacitated with emotion until she was notified it was animal bones.

I don't really understand why the secrecy--maybe because they don't want unauthorized people to show up in case they end up destroying evidence?  I heard a short radio interview that Desiree's sister gave, and one thing she mentioned was all volunteers have to sign a non-disclosure agreement.

Please, please--I beg--let this be the search that busts this case wide open.

I'm glad you posted that map.  I find it very helpful, pinpointing all the important locations.  It's pretty obvious in what general vicinity they are searching. (I used to work within a mile of that Fred Meyer store she went to that day, so I'm familiar with part of the area.)

I think you're right about why the secrecy.

I'll keep watching local media and checking for latest news.

PORTLAND, Ore. -- It's "agony" waiting for word on clues in each search for Kyron Horman, but Desiree Young also says that it means everything to her, to get some answers.

...The latest search for clues started on Saturday and will wrap up on Monday, Young said.  She did not comment on any specifics about clues, but said this effort was "more strategic" than any others in the past.

...Young said she has learned more about Terri's behaviors and thinks that is the key to solving this horrible mystery.

..."Even though you hope to find answers, you really don't want to find answers, too. So finding bones is very upsetting.  It scared me and it upset me a lot and it will probably take me a couple weeks to be able to sleep again," Young said.

Thanks for this link, CP.  Gosh, I think we have a bit of new information.  (Or maybe it is just new to me--not sure.)

I went back and played that a couple of times, and I can't be sure--but I believe the interview is taking place off to the side of Skyline School.

So, in the picture below, would you say the soccer field is at the top of the picture with the gravel road faintly showing as circling it?  (I remember trying to get all that straight as they asked for witnesses to come forward but I always did find it confusing.)

But in the most recent video, Desiree may be standing somewhere on that gravel road.

Do you think I have things anywhere close to correct?  I would really appreciate any input.

I'm all fired up about this as it is the very first time I'm hearing that anyone saw Kyron outside of the school that day.  I believe Desiree is very guarded in everything she says; so this must mean they have a witness who can be relied on.  Now, if we could only know if he was alone or if he was with someone.  And if so, who.  



Here is another picture from a screen shot of an old video.  I'll add it because it gets in a little closer to the side of the school, which I think is quite near where Desiree gives the interview and gestures that it is where Kyron was seen walking.  (It is an old video from 2010, but I added the link just to source it.)

As time has moved forward I have felt less optimistic about Kyron.
Periodically, a friend asks me if the child has ever been found or a trial taken place...
The last few days, I have been more upbeat about a resolution than in the past years.

Something just popped into my mind. Trying to remember...not easy!
Didn't Terri Horman supposedly tell someone in the school office Kyron had a medical appointment that day? IIRC, LE had called the medical offices and Kyron did NOT have any appointments that morning; it was kind of believed the school was confused or misunderstood...

Speculation here:
1. Could TH have told Kyron they would go to the morning science fair and then he had to leave for a medical appointment?

2. TH then takes the final picture of Kyron (interesting how suspects feel this need to take that picture) showing what a loving person she is and how happy Kyron was.

3. TH tells Kyron she will drive around to the parking lot/the gravel road and he is to come out to the vehicle. She tells Kyron she has already checked him out of school but he will be back. Leave his stuff.

4. TH DID tell the school the lie of Kyron having the doctor's appointment.
She told Kyron the same "innocent" or believable lie because it is easier to keep one lie straight (and say she was confused IF she gets caught in the lie) than it is to explain TWO lies.

I, too, got the impression that Desiree did the interview from the grounds of Skyline School.  It would make sense if all the volunteers met there, and hence returned there after the search.  However, I can't for the life of me figure out where on the property.

If you look at a screen capture of her interview:



she's standing by a stairway with two reddish-brown railings; grass behind her, trees off to her left.  I can find no such place at the school.  I even used this view, which allows you to zoom way in.

The only stairways I can find that are narrow enough to have only two railings are on the left side of the building towards the soccer field, but there are no trees nearby.  Of course, who knows when the Google map images were taken; maybe they were taken before the trees grew.  (When I google map my house, it shows shrubs I had cut down years ago.)

So I'm really not sure where she was.

On the news tonight, they said the search took place in Forest Park.  That's roughly 5 miles east of the school:

PORTLAND, Ore. - There was no expectation on the part of Skyline School that Kyron Horman would be in class after the science fair the day he disappeared, according to multiple sources.

Prior to his June 4 disappearance, Kyron Horman’s stepmother, Terri Horman, informed his teacher he had a doctor’s appointment on Friday, the sources said, and it was why there was no expectation Kyron would be in class after the science fair. Once class began at 10 a.m., his teacher marked him absent.

According to sources, investigators believe Terri Horman was vague about which Friday she was referring to when she gave notice to the school Kyron would be gone and only after he was missing did she clarify that the doctor’s appointment was on June 11, the Friday after the science fair.

I think your speculation about what happened is right on!  That's exactly what I have believed happened.  Between that and the fact that she borrowed Kaine's truck that day to supposedly bring home his science project, which she never did, is evidence to me of premeditation.

So, Desiree must have been standing somewhere in the front of the school, with her back to the playground/road.

Do we have a statement from TH as to when she supposedly found out Kyron was not in school, ie, missing?

I am wondering if she "messed up" by going to the school and forgetting she was to pick up the science project. Did the school inform her he was not there?

Her "confusion" on which date Kyron was to see the doctor:
Perfect set up to blame the child for "walking off campus" because, "He thought he had a doctor's appointment. I must not have been clear on that. After all, I had a lot of things on my mind that morning..."
