A family is certain justice was not served. Charles Makofski, 20, pleaded guilty in Grimes County to molesting a child but, will not serve one day in prison.

"To find out he's only going to do 90 days in county jail and have 10 years of deferred adjudication is ridiculous," said the victim's stepmother. "It is not justice."

The victim's parents declined to give News 3 their names in order to keep their daughter's identity a secret. The stepmother and father were outraged by the judge's decision.

This is outrageous! Judge McCaig needs to be removed from office. I hope the citizens of Grimes County, Tx vote this disgusting judge out of office.

Justice was not served in this sexual assault child case.

If you have read the article from The Examiner - Navasota, Tx, Charles Makofski got a slap on the hand and the judge is going to let this Sex Offender be around children at a church! How disgusting!

Judge McCaig would not allow the victim's family to read the Victim's Impact Statement and he would not read the statement.

This Sex Offender needs to be in prison - Life without Parole. I agree with the Grimes County District Attorney. Sex offenders can not be rehabilitated.

Based on this judge's track record, it appears he favors Sex Offenders. I wonder if this judge has children or grand children. If he does, I wonder if he would allow these two guys to be with them. I wonder what sentence he would have handed down if the victim was his child or grandchild.

These guys will probably sexually assault an innocent child again and ruin another child's life. Maybe the next time they will brutally rape and beat the innocent child to death like Lucas Coe did to Emma Thompson, Spring, Tx. I wonder what the Judge will say then.

Child abuse and sexual assault of a child is rampant in our nation. Our justice system should be protecting the children of our nation. In my opinion, Judge McCaig is a disgrace to the State of Texas and our justice system.

What about the innocent child in this case? I wonder how Judge McCaig can sleep at night. Absolutely disgusting and outrageous!

This is outrageous. The fear of prison usually doesn't keep sex offenders from re-offending, but it does often cause their crimes to escalate to murder in an attempt to avoid being caught again.

Charles Makofski, Sex Offender, is back in the news! It has not even been a year after Judge McCaig of Grimes County, Tx gave Makofski, a convicted sex offender, a slap on the wrist with probation and it is alleged he violated 12 probation conditions.

Judge McCaig will oversee Makofski's hearing in April and decide whether or not to send him to prison for the rest of his life.

I wonder if Judge McCaig will do the right thing this time and send Makofski to prison where he should have been sentenced last year!

A 20 year-old convicted child molester has broken his probation after admitting to having a 6th grader as a friend on facebook.
The Grimes County District Attorney says that's just one of 12 probation conditions Charles Makofski has violated.

1. Failed to maintain employment since being placed on probation
2. Failed to pay court costs and supervision fees as ordered
3. Failed to pay the sex offender fee as ordered
4. Failed to perform community service hours as ordered in that the defendant has not completed or presented proof of community service hours completed since November 2011
5. Failed to attend sex offender counseling as directed, specifically, the defendant has missed 25% of his group sessions
6. Failed to pay the counseling fees for sex offender counseling as ordered and is at least $340 delinquent in paying said fees

8. The defendant admitted to having a facebook account, email account and internet access without required monitoring software

11. Failed to pay the GPS monitoring system fees as ordered and is at least $1,045 delinquent in payments
12. Failed to properly charge his GPS device, resulting in periods of time where he is unable to be tracked by Health Care Recovery Systems

A judge in Grimes County could have sent a convicted child abuser to jail today, but instead, 21 year old Charles Makofski remains free, even though he's accused of violating his probation.

The victim's family members are so upset about today's outcome.

Good Friday, four days from now, marks the three year anniversary of when a little girl told her parents what her uncle did to her.

HOUSTON - In his YouTube video, Judge Albert "Buddy" McCaig shares his love of God, country and family.

But as far as this mother is concerned, Judge McCaig cared more about a child molester's future than his victim, her 10-year-old daughter.

"Why does he take the sexual assault of children so lightly? Why does he not realize, what if it was his child, what if this was his family?" asked the victim's mother who we are only identifying as Jessica.

When Jessica's daughter was only 7-years-old, she was molested by her uncle, 21-year-old Charles Makofski.

"We had DNA evidence, taped confession, my daughter's testimony," Jessica said. "We were pretty confident that we were going to get a conviction for sure and most likely prison time, he could have gone up to 99 years."

"Since I've been here, we've never had a jury give probation to a sex offender," said Grimes County District Attorney Tuck McClain.

That doesn't surprise the long time DA one bit. He grew up here and knows the mindset of folks who call Grimes County home.

"They don't understand people who steal, they don't understand people who sell drugs, and they don't understand people who mess with kids," McClain said. "They're pretty stiff on that."

Makofski didn't need a jury of his peers to decide his guilt or innocence.

"He actually pled guilty, it wasn't even a trial where we had to prove anything, he did go ahead and pled guilty," Jessica said.

As part of the guilty plea agreement, Judge McCaig would decide Makofski's punishment for aggravated sexual assault of a child.

Charles Lee Makofski is guilty of at least 12 probation violations including being a Facebook friend of a sixth grader.

Judge takes back 'big break' he gave to child molester

HOUSTON (FOX 26) -
It's a day of reckoning for 21-year-old convicted child molester Charles Makofski who had nothing to say to FOX 26 Investigates as he entered the Grimes County Courthouse.

It's hard to say who was more upset to see us there: Makofski or Judge Buddy McCaig who would soon decide the sex offender's fate.

In his YouTube video, Judge McCaig is all about God, country and family.

But in an exclusive investigation last month, we told you how McCaig gave big breaks to Makofski and another child molester by giving them deferred probation. That meant if Makofski would have done what the judge ordered him to do, he would have no felony conviction for molesting his 7-year-old niece.

Needless to say, the judge's gift to Makofski didn't sit well with the victim's mother.
