Breeann Rodriguez's Parents 'At Peace' With Her Death

Senath, MO) -- The parents of a 6-year-old girl found in a Missouri waterway are now speaking out.

Breeann Rodriguez was found 10 days after she disappeared. Shawn Morgan, her neighbor, admitted to killing the child.

He says he dumped the little girl's body and her bike.

Breeann's mom and dad say the news of their daughter's death is hard, but they're at peace.

Claudia Ramos says knowing water patrol officers found her daughter's remains brings some peace to her, and her husband Edgar Rodriguez.

"Yeah we feel a little better because they found her now we know she's not suffering she's in a better world," says Claudia.

Claudia says the family is planning a public memorial so the community that spent days searching for her can say goodbye.

ST. LOUIS • The man accused of killing a 3-year-old Missouri girl has a criminal record in Arkansas for threatening to blow up the factory where he worked, according to court records obtained Thursday by The Associated Press.

Meanwhile, the small town of Senath, Mo., prepared to say goodbye to Breeann Rodriguez with a memorial service at the town park at 5:30 p.m. today and funeral on Saturday.

Records from Greene County, Ark., show that Shawn Morgan of Senath pleaded no-contest in 2004 to a misdemeanor charge of making a terroristic threat. He served one year of probation and was fined $1,000.

SENATH, Mo. -- On Friday evening, area residents came together in prayer to celebrate the life of the late BreeAnn Rodriguez.
Rodriguez and her family became known when she went missing on Saturday, Aug. 6, while riding her bicycle near her home in Senath.

Immediately, members of the community joined forces and came together to assist in the search for BreeAnn and to show unwavering support for her family.

A community-wide Candlelight Prayer Vigil was held in Williamson Park on Wednesday, August 10, with several hundred people in attendance.

Ministers from the community as well as law enforcement officials spoke concerning the disappearance of the child while offering support, hope and encouragement to the family. At the end of the service, lit candles were placed on the stage, giving light in the darkness.

SENATH, Mo. -- Area residents filled the sanctuary, foyer, and spilled into the parking lot of the Senath Church of Christ on Saturday afternoon in support of the family of BreeAnn Rodriguez, a local three-year-old who's life was tragically taken on Saturday, Aug. 6, 2011.

The funeral service began at 3:45 p.m., and was officiated by the Rev. Dagoberto Barbosa, the Rev. Kevin Sullivan, and Jody McFadden, as a standing-room-only crowd of family, friends, and supporters gathered amongst the multitude of flowers and balloons to pay their final respects to the young child.

SENATH, MO (KFVS) - More than 500 people in the Senath community came together Saturday to mourn the loss of a 3-year-old girl.

A visitation for Breeann was Saturday at 1 p.m. at the Church of Christ in Senath and funeral services followed at 4.

"It was important for us to be here to support the family," said Kim Castro of Senath.

To date, more than $20,000 has been raised in a fund put together by the community for the family for funeral and other expenses. Donations can be made at Senath State Banks.

Earlier this week, Breeann's mother and family indicated the family wanted to welcome the public to the service so that Breeann would know all the hearts she touched.

According to Sokoloff, one count of child kidnapping—a class A felony—is to be added to three existing accounts of first-degree murder, armed criminal action and tampering with evidence against the 43-year-old Shawn Morgan.

Shawn Morgan, 43, of Senath, who is accused of killing three-year-old BreeAnn Rodriguez, also of Senath, appeared in a Dunklin County courtroom on Tuesday, August 30, again without an attorney. This is Morgan's second appearance before presiding Judge John C. Spielman. Morgan's previous arraignment hearing was at 9 a.m., Tuesday, Aug. 16 at the Dunklin County Courthouse.

Morgan was escorted into the Dunklin County Courthouse this morning, Tuesday, Aug. 30, by Dunklin County Sheriff Bob Holder and Sheriff's Deputy Wallace Poynor.

KENNETT, MO (KFVS) - The man accused in the murder of a 3-year-old Senath girl now faces a possession of child pornography charge.

Shawn Morgan, 43, from Senath is charged with the class C felony offense of possession of child pornography.

He is also charged with 1st degree murder, armed criminal action, tampering with physical evidence, and child kidnapping in the disappearance of Breeann Rodriguez.

The 3-year-old and her bike went missing on August 6 in front of her home on Ode Johnson Road.

According to the probable cause statement, Morgan suffocated the girl using a white plastic trash bag.

KENNETT, Mo. -- New charges of possession of child pornography have been filed against a Senath, Mo., man accused of murdering his 3-year-old neighbor.
Shawn Morgan, 43, appeared in a Dunklin County courtroom Tuesday morning before Judge John C. Spielman, his third appearance since being charged with the disappearance and death of 3-year-old BreeAnn Rodriguez, also of Senath.

On Monday it was learned that Dunklin County Prosecuting Attorney Stephen P. Sokoloff had filed a second amended complaint against Morgan, accusing him on the child pornography possession charge. The new charge is a result of a continuing investigation into the case by Dunklin County law enforcement officials.

Other charges against Morgan include felony counts of first-degree murder, armed criminal action and tampering with physical evidence in connection to the case.

She was taken from the Orange County jail in a secured area, transported and then released in a secured area within the Orange County Court House complex and escorted to the court room.

The general public, such as you and I, would not have assess to the secured areas.

The Dunklin County Court House does not have secured areas via underground or otherwise for an inmate to be taken to court. The inmate is in the open public and the general public can see the inmate.

In my county, our county jail has a secured area for loading and unloading inmates at the jail. Our Court House does not have a secured area, i. e. underground or adjacent.

The Sheriff's Office vehicle parks on the street by the Court House, in a designated parking space, and the inmate is escorted by deputies to the Court Room. They are in handcuffs and shackles. If it would be a high profile case and the inmate was in danger, the inmate would wear a protective vest.

It is the responsiility of the County Jail to protect the inmate to and from court appearances if they are in custody of the County Jail as is the case with Shawn Morgan.

Thanks Ann, I understand that. Like with Elisa Baker, when she goes to court in Catawba County, where she is being held in jail, she does not have to wear the vest. But when she has to appear in Caldwell County, and has to be driven there, she has the vest on.

I didn't know that where Morgan was being held wasn't close to the courthouse.

Shawn Morgan, 43, of Senath, Mo., appeared in a Dunklin County courtroom on Tuesday morning before Judge John C. Spielman, his third appearance since being charged with the disappearance and death of three-year-old BreeAnn Rodriguez, also of Senath.

Early in September, following the arrest of Shawn Morgan, 43, of Senath, Mo., a petition for divorce and a request for a temporary restraining order was entered into the Dunklin County court docket by his wife, Tonya, 39, also of Senath.

According to reports, Morgan's wife, Tonya filed with the courts a petition to dissolve her marriage to Morgan on Sept. 6, 2011.. Also filed that day was a proposed parenting plan and a certificate of inability to pay costs, fees, and expenses.

Suspect enters plea of not guilty during today's arraignment hearing

SENATH, Mo. -- Senath firefighters responded to a structure fire this morning (Tuesday, Dec. 14) that turned out to be the home of alleged child murderer Shawn Morgan, 43.

According to Ken Johnson, of the Senath Fire Department, the fire occurred at Morgan's home on Ode Johnson Street at approximately 12:30 a.m., and when crews arrived, the structure was fully involved. Johnson said firefighters were on the scene until approximately 6 a.m.

"Thankfully the wind was out of the south and the houses on the east and west received no damage," Johnson said.

According to the Dunklin County Sheriff's Department the fire was at a home on Ode Johnson St.

KENNETT, MO (KAIT) – The man accused of killing Senath 3-year-old Breeann Rodriguez is set to appear in a Dunklin County courtroom Wednesday.

According to the Dunklin County Prosecutor's Office, Shawn Morgan is schedule to appear in court again on February 8 at 10am for a motions hearing.

Morgan pleaded not guilty in court on December 14 and his lawyers filed a change of venue request. The request was granted with stipulations, meaning the trial will still be in Dunklin County, but the jury will come from Phelps County.

The man accused of killing a three year old girl from his southeast Missouri neighborhood appeared in court today ahead of next month's trial.

Shawn Morgan of Senath is scheduled to stand trial in four weeks. The trial will be held in Dunklin county, but jurors will be selected from around Rolla because of pre-trial publicity. Morgan is charged with first-degree murder in the death of Breeann Rodriguez.

The girl went missing in the summer of last year. Her remains were found 10 days later about eight miles outside of Senath. The Dunklin county prosecutor is seeking the death penalty in the case.

The jury trial was to begin December 10th in Kennett. But the public defender has filed to continue it. A motions hearing is set for the 10th instead. Morgan allegedly suffocated Rodriguez with a trash bag after finding her near his pool August 6th, 2011. Police recovered her remains and her bike in a floodway 10 days later. Morgan is in Dunklin County Jail without bond. The prosecutor has filed to seek the death penalty and that will be considered December 10th. A new trial date is pending.

KENNETT, MO (KAIT) – The man accused of killing Senath 3-year-old Breeann Rodriguez appeared in a Dunklin County courtroom Wednesday and requested a change of judge.

According to the Dunklin County Prosecutor's Office, a change of judge motion was granted in Shawn Morgan's capital murder trial.

The decision removes Judge Robert Mayer from presiding over the case, and assigns Judge Stephen Sharp as the new of the case.

The motion has been sent to the Missouri Supreme Court for approval. No date has been set for Morgan's trial.

Change of judge granted in Morgan case

A change of judge motion was granted in the case of Shawn Morgan during a court appearance on February 13.

During the appearance, a decision was made to grant the motion to take Circuit Judge of the 35th Judicial Circuit Robert N. Mayer off of the case, without objection from the defence, and the motion to assign Mayer's predecessor, Judge Stephen R. Sharp as Senior Judge on the case. This motion has been sent to the Missouri Supreme Court for approval.

Shawn Morgan, of Senath, accused murderer of three-year-old Breeann Rodriguez, has been scheduled to stand trial beginning, Monday, Nov. 18, 2013, according to Missouri court records. Court proceedings will begin at 8:30 a.m., and will continue every day until the conclusion of the trial.
