I'll educate the defense on the aggravating factors. Body found in trash bag dumped in woods with duct tape from the Anthony residence on the skull covering airways.

Of course the 14,000 pages of police reports are online for everyone to read Lyon. It's called the Sunshine Law.

I'm taping the rest of the hearing for later. I can't possibly deal with Lyon (no 's' on Lyon as Baez so 'politely' pointed out to JP the other day) before adequate amounts of coffee!

Ms Lyon cannot figure out what the aggravating circumstances are? kh

Richard Hornsby figured out the aggravating factors that apply.

• The victim was younger than 12
• Anthony was the parent
• The crime was premeditated
• The crime involved aggravated child abuse

The other two of the six are also possible.

• Anthony stood to benefit monetarily from Caylee’s death
• The crime was especially heinous, atrocious or cruel.

hmmm... he granted their motion.. the state MUST give them a list of the aggrivators they intend to argue so they can defend against them...

now, she is arguing that the defense should not have to give the prosecution the same list on mitigators before trial.. that doesnt seem fair. if the state has to show their hand, the defense should have to do the same.

Do I have this right? They want everything from the State but don't want to give anything to them because it's "personal"? kh

I think you have it right kh, but fortunately the motion just got denied.

Here's my thinking about this so far:

The defense must be thinking Casey will be found guilty or else they'd not be so concerned about the dp being on the table since even if she is found guilty the jury does not have to recommend the dp and if they did the dp could be overruled by the judge. Seems more like they'd just argue to have the charges of murder dropped in the first place, but they can't because they know better.

They know Caylee was last with Casey, and Caylee was disposed of with duct tape on her face in a garbage bag and left in the woods to rot and be eaten by scavengers. All that shows no remorse for Caylee having died even if it were an accident...but the defense has yet to even suggest an accident happened, so unless they are admitting Casey killed Caylee they are still going to suggest some mysterious nanny did it all!

Well, they can't pretend to suggest the nanny did it because if they were going to do that they should have - even to this day- private investigators out there looking for this nanny and Casey herself should be screaming from the rafters about LE needing to go find this nanny! However, it's apparent they are going to try to say Caylee was dumped (and therefore may have been killed) after Casey was arrested. But how is that going to fly since her car stank when it did?

The defense might could attempt to suggest the car stank because the nanny had borrowed the car/killed Caylee and dumped her prior to Casey being arrested. But no...that's not going to fly because said she talked to Caylee on July 15th!

The defense has no case unless they would try at some point to interject an accident confession. But would it be believed this late in the game? After Casey has been sitting there acting like NOTHING happened to Caylee that she is aware of? And if it were an accident, has Casey told Baez and company that yet? Will she now that the dp is not going to be removed from the table?

If the dp stays on the table Casey's only hope is to 'say' it was an accident that 'snowballed out of control'. But if that happens, will George be arrested for lying to LE about so much since he's also alleged to have said the same?

So much is still to come in this case. I'm very glad Judge Perry is in charge! He's doing a wonderful job being fair but cutting to the points.

Lottie, I agree that the defense thinks there is a high possibility that Casey will be found guilty. They probably want the death penalty off the table to take the pressure off of Casey. If the death penalty stays on the table, Casey has to seriously think about pleading guilty in exchange for LWOP. If the death penalty is off the table, then the defense can take it to trial and hope for an acquittal. If they don't get one, the worse possible outcome would be LWOP.
