ORLANDO, Fla. -- Judge Belvin Perry made a change as to what controversial issues he will consider at a hearing in the Casey Anthony case on Tuesday.
The prosecution and defense have been going back and forth regarding how much prosecutors must reveal about why they're seeking to have Anthony executed.
Both sides have insisted they're right. The defense filed a motion to strike the state's so-called notice of aggravating circumstances because it lacks the detail to which they believe they're entitled.
When Perry ordered prosecutor Jeff Ashton to reveal the aggravating factors the state will argue to seek death against Anthony, attorney Jose Baez called it a major victory.
"We're elated by the fact that the judge is ordering this to occur," Baez said.
From elated to deflated: When Ashton filed that list, it was nothing more than five citations of law with no detail -- so little that Anthony's defense filed the motion to strike it as deficient. That motion will be argued before Perry at Tuesday's hearing.
"The aggravating factor issue is not complicated," defense attorney Richard Hornsby said.
Hornsby said prosecutors are not required to justify those aggravating factors or reveal before the trial their theory of how Caylee Anthony was killed or why her mother deserves to die for the crime.
"To Jeff Ashton, this aggravating factor issue is over. He has complied with it to the letter of the law, and he knows thatPerry is not required to give him any more information," Hornsby said.
Perry will consider the defense request to reopen four prior rulings by Judge Stan Strickland on Tuesday. He'll also rule on the motion to strike the state's list of aggravators as insufficient, and he'll also consider a defense motion for more forensic evidence.

More Death Penalty Motions Expected In Casey Case

ORLANDO -- Several motions ruled on by Judge Stan Strickland will be back in court Tuesday.

There will also be more challenges to the death penalty.

The list came within days. The defense says it's not specific enough.

Later this week, the defense will begin a vigorous schedule of depositions.
When Perry took over the case, he put strict deadlines on attorneys and ordered them to get to work.
On Friday, three people are set to be questioned under oath, including two sheriff's officials and Casey’s ex-boyfriend, Ricardo Morales.

Judge Belvin Perry will reconsider four different motions Tuesday afternoon, including a request made by Anthony's defense team to throw out the death penalty.
Anthony, 24, is jailed on first-degree murder charges in the death of her daughter, Caylee, whose remains were found in a wooded lot in December 2008. Caylee was 2 years old when she was reported missing in July 2008.
Last month, the prosecution revealed the reasons they say Anthony should be put to death if she's convicted, including that the murder was committed during another crime -- aggravated child abuse. The state will also argue Caylee's murder was especially heinous or cruel.
Meanwhile, Anthony's defense team wanted the state to turn over forensic documents, including results on tests performed on evidence, but the state told the judge they didn't have the results. Other motions that will be addressed Tuesday include the use of certain forensic evidence.
Court officials told Local 6 the defense team is also asking the court to seal jail visitation logs.
Anthony has pleaded not guilty, claiming that she left Caylee with a baby sitter and the two were gone when she returned to pick up her daughter.
Tuesday's hearing is scheduled to start at 2 p.m. at the Orange County Courthouse and it will be streamed live on ClickOrlando.com.

Today’s Hearing: Death or Cake

Today’s hearing will be over four defense motions. The first is a motion requesting the court strike the prosecutors’ response to the court’s order that they produce the aggravating circumstances that would justify seeking the death penalty in the Casey Anthony murder trial. The prosecution responded to this order by simply listing the Florida statutes for the specific aggravating circumstances they believe apply in this case. The defense had hoped to get specificity in the response (i.e. insight into the prosecution’s case). Mr. Richard Hornsby has stated in an interview with WESH that the prosecution is not required to give further justification as to why they believe the listed aggravating circumstances apply in this case. Since the defense has repeatedly refused to produce discovery, or publicly produce names of certain experts they plan to use based on their own argument that they are not required to divulge their strategy, the defense’s request that the state produce what would amount to “work product” is a case of the defense wanting to save the cake and eat it too.
Also up before the court today will be a motion for reconsideration of several motions previously heard by Judge Strickland. Included in these motions are the defense’s request to be provided a copy of the illegally-obtained recording of the conversation between Joseph Jordan and the defense’s investigator, Mort Smith; to be provided a copy of the same portion of the grand jury testimony of George Anthony that the State has been provided via ruling by Strickland; as well as other defense motions concerning tips and the TES records.
The third motion has to do with Linda Kenney Baden’s motion to compel certain forensic discovery the defense states they have previously requested but have yet to obtain. A large amount of this evidence is attached with the work at ORNL and as the state has previously argued, it is not the state of Florida’s obligation to produce this evidence, but the defense’s responsibility to subpoena whatever they want from either the FBI laboratory or ORNL. In other words, the state feels they have produced all evidence they have and intend to use from these entities and if the defense wants more that the state is not interested in, they need to be attempting to force the individual laboratories, who fall outside the jurisdiction of the State of Florida, to produce whatever it is they want.
And then lastly, the defense is requesting that Casey’s visitation log at the OCSO jail be sealed. Here’s “the cake and eat it too” syndrome rearing it’s ugly head again. The defense’s hypocrisy knows no bounds – while in the same hearing they are attempting to force the state to reveal the prosecution’s strategy, they are making yet another attempt to hide their defense strategy behind a veil of secrecy by trying to prevent others from seeing what type of experts will be spending time with Casey leading up to her trial.

The first is a motion requesting the court strike the prosecutors’ response to the court’s order that they produce the aggravating circumstances that would justify seeking the death penalty in the Casey Anthony murder trial. The prosecution responded to this order by simply listing the Florida statutes for the specific aggravating circumstances they believe apply in this case. The defense had hoped to get specificity in the response (i.e. insight into the prosecution’s case). Mr. Richard Hornsby has stated in an interview with WESH that the prosecution is not required to give further justification as to why they believe the listed aggravating circumstances apply in this case. Since the defense has repeatedly refused to produce discovery, or publicly produce names of certain experts they plan to use based on their own argument that they are not required to divulge their strategy, the defense’s request that the state produce what would amount to “work product” is a case of the defense wanting to save the cake and eat it too.
Also up before the court today will be a motion for reconsideration of several motions previously heard by Judge Strickland. Included in these motions are the defense’s request to be provided a copy of the illegally-obtained recording of the conversation between Joseph Jordan and the defense’s investigator, Mort Smith; to be provided a copy of the same portion of the grand jury testimony of George Anthony that the State has been provided via ruling by Strickland; as well as other defense motions concerning tips and the TES records.
The third motion has to do with Linda Kenney Baden’s motion to compel certain forensic discovery the defense states they have previously requested but have yet to obtain. A large amount of this evidence is attached with the work at ORNL and as the state has previously argued, it is not the state of Florida’s obligation to produce this evidence, but the defense’s responsibility to subpoena whatever they want from either the FBI laboratory or ORNL. In other words, the state feels they have produced all evidence they have and intend to use from these entities and if the defense wants more that the state is not interested in, they need to be attempting to force the individual laboratories, who fall outside the jurisdiction of the State of Florida, to produce whatever it is they want.
And then lastly, the defense is requesting that Casey’s visitation log at the OCSO jail be sealed. Here’s “the cake and eat it too” syndrome rearing it’s ugly head again. The defense’s hypocrisy knows no bounds – while in the same hearing they are attempting to force the state to reveal the prosecution’s strategy, they are making yet another attempt to hide their defense strategy behind a veil of secrecy by trying to prevent others from seeing what type of experts will be spending time with Casey leading up to her trial.

(WOFL FOX 35) - A Florida mother charged with murdering her 2-year-old daughter missed a pretrial court hearing Tuesday after she suffered some minor injuries in a fall at an Orlando courthouse. Casey Anthony, 24, fell before entering the courtroom when her hand and leg restraints became entangled. She fell forward, and officers escorting her were unable to stop her fall, officials said.
Anthony has pleaded not guilty to first-degree murder and has said a baby sitter kidnapped her daughter, Caylee. Her trial is set to start next May.
During the hearing, which was held without Anthony present, her attorneys asked a new judge on the case to reconsider a previous judge's ruling that keeps the death penalty as a possible sentence if she is convicted.
Chief Judge Belvin Perry denied their request for more details supporting prosecutors' decision to seek the death penalty. Prosecutors have listed five aggravating reasons for why they are seeking the death penalty: the especially cruel nature of the crime, the victim's age and Anthony's relationship to the victim as her mother among them.
Perry ruled prosecutors have satisfied their obligations. Anthony's attorneys also tried to prevent the media from seeing records of who is visiting Anthony in jail, reasoning the records might reveal high-profile witnesses the defense does not want publicized. Perry planned to rule on the motion by next week.
FOX 35 put in a public records request to see who has been visiting Casey Anthony in behind bars. In the month of May, the 24 year old only had five visitors. Jose Baez visited once. Michelle Medina, who is an attorney at the Baez Law Firm, visited twice. Andrea Lyon and her private investigators Mortimer Smith also visited Casey Anthony last month.
Other visitors have included Jeanene Barrett, she's a mitigation specialist. She will working on saving Casey from the death penalty if Casey is found guilty of murdering her daughter. Casey's parents minister also visited once. That was in December of 2008, about a week after 2 year old Caylee's remains were found.
Anthony's murder trial is set to begin on May 9, 2011. All depositions of witnesses are to be completed by October 31, 2010. She remains jailed on a charge of first-degree murder in the death of her daughter Caylee who was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's home on December 11, 2008. Investigators say the toddler's body was found with duct tape over her mouth.

"Based on all information available, this was purely an accident."
Anthony has received treatment from medical personnel in an undisclosed location. Orange County Corrections Internal Affairs will be conducting an inquiry, which is standard procedure according to Moore. "I am told her legal team is aware of the incident," Moore added.
Before the hearing began, Anthony's attorneys Jose Baez and Cheney Mason met behind closed doors. Then a prosecutor and the court reporter were asked to join them. Then everyone came out and Baez pulled Casey's mother, Cindy, and her attorney out into the hallway for a quick discussion. It was shortly after their meeting that Judge Perry allowed Cheney Mason to waive her presence as soon as court was in session.

I didn't think Perry would over-rule any of Strickland's rulings. That would be putting down one of his judges, and I think this guy is much smarter than any one of the defense team.
He knows this defendant's story, he knows the facts of the case and he knows she is guilty.
The defense made this choice, and now they have to live with it. Too Bad.

I couldn't believe the gall of the defense wanting to overturn how many? of Judge Strickland's rulings. They forgot to ask to overturn the sealing of Casey's nervous breakdown video when the news broke that a child's remains were found around the corner from her house.

Cindy does look like a blowfish....it's probably the result of her wallering that gum around in her mouth trying to hide that she was disobeying Judge P's rule about not chewing gum in his courtroom. Did you all see her with her doing that with her gum?

Julie, to me, Cindy looks very scary.... and not quite all there..... when I first saw the picture, I thought someone doctored it.... until I realized it was from the myfoxorlando website.
If you want to see what was going on when this picture was taken, this is the part of the hearing ( at about 9:00 into the video) in which it occurs. She is sure doing some funky things with her mouth and face..... and for a few seconds there, she looks very glazed over. That seems to be the moment the took the picture!

No, Lottie, I missed it, unless it is the time I posted above. I was mostly listening to the hearing rather than watching closely. If that's not it, any chance you could find the time when she was chewing that gum. I've read quite a bit about how she was chewing away.......

Snaz, I only saw the beginning of the hearing and every time they panned to Cindy she was making that face while wallering her gum around in her mouth with an occasional bite to the wad she couldn't leave outside the courtroom. She was trying to be so discreet! Now, per my sense of humor, THAT was funny! And if she looks worried it was probably only for fear she'd get caught with her gum.
