ORLANDO -- Prosecutors in the case against Casey Anthony want jurors in her upcoming trial to hear the now infamous 911 calls made reporting 2-year-old Caylee missing a month after she was last seen alive.
Just days after Judge Belvin Perry denied a series of motions filed by the defense, Casey and her attorneys face the possibility that more incriminating material could be allowed in her murder trial.
It’s just the latest blow to Casey’s defense as they try to keep what they said they consider hearsay out of court.
Prosecutors Wednesday filed documents laying out their arguments for why the jury should be able to hear 911 calls made by Casey’s mother, Cindy Anthony, in July 2008.
Casey’s lawyers have been trying to keep those calls from her mother excluded from the upcoming trial, but according to published reports, prosecutors want those calls allowed as evidence.
The state said it shows a progression of stories Casey told to explain her daughter’s sudden disappearance.
“There’s something wrong. I found my daughter’s car today, and it smells like there’s been a dead body in the damn car,” Cindy said during one of the calls.
Prosecutors said the series of calls Cindy made to 911 lays out a timeline of how Casey created a kidnapping story to cover up her daughter’s disappearance after initially denying that Caylee was missing.
Still, the defense argued the calls should excluded because they are testimonial and hearsay.
It remains unclear when Judge Perry will rule on the motions.
Casey’s murder trial is scheduled to begin in May 2011.

i think this one is a no brainer.. the 911 calls cindy made cannot be ruled as hearsay IMHO because...
1. it is considered an excited utterance. the emotion in her voice is such that she was so shocked about what she just discovered that she blurted it out without any questioning or provocation.
2. her now infamous statement "it smells like there has been a dead body in the damn car!" is a personal observation. it is something that SHE saw, smelled and is conveying to LE. IF she would NOT have actually smelled the car in person (ie. GA telling her what it smelled like and her telling 911) that could in essence be considered hearsay. however something that you experienced personally and have 1st hand knowledge of is not hearsay as defined by law.

Now, Cindy could soon have to answer questions about what she told the operator.
News 13 spoke with her attorney, Brad Conway, who said prosecutors served a subpoena to Cindy more than a week ago.
Conway said while the 911 calls could come up, the subpoena doesn't specify what prosecutors will ask his client.
Casey’s lawyers have vigorously tried to prevent the calls from being allowed as evidence.
The defense said there are "factual disputes" and that Cindy "made that up in an effort to cause police to come more quickly to her residence for investigation."
However, prosecutors said the calls show the progression in how Casey explained her daughter's disappearance.
Cindy is expected to be at a hearing July 15.
It will be a big week in the case against Casey Anthony.
On July 13 and July 14, the defense team will be looking at evidence at the Orange County Sheriff's Office.

Just read that WFTV has apparently reported that Lee Anthony will also be testifying at the hearing. It is not up on the WFTV website yet.

Boy, oh boy...this should be one very interesting hearing...Has anyone heard anything about George, or had a George siting lately???? One would think that someone would have the house staked out just to catch a glimpse of him...Maybe he moved out under cover of darkness...Poor thing, can't take the heat or has he decided to stick to his guns and not back Cindy's delusional statement about the odor...Wonder if he'll be in court on the 15th???

In the 10 p.m. news on WCKF-Ch. 18, WESH anchor Martha Sugalski said the State Attorney’s Office had served up a subpoena that Cindy would have to testify about the 911 call, which could be key in the case.
WESH reporter Michelle Meredith reminded viewers that Cindy had signaled the alarm in the case with her 911 call two years ago. But Cindy had little to say on Friday at Casey’s last hearing, Meredith noted.
Orlando defense attorney Richard Hornsby, who offers legal analysis for WESH, said prosecutors are “not offering to prove anything Cindy Anthony said is true. They’re only offering it purely to show why Casey Anthony did something.”
Hornsby theorized that Cindy Anthony will verify that Casey was sitting next to her during the 911 call and that it will put Casey’s version of events in context.

July 15..... Interesting that the day Cindy will have to take the stand and tell the truth (?????) under oath is two years to the day after she first learned positively that something had happened to Caylee.

Casey Anthony's defense attorneys are trying to stop the use of the tapes, arguing that 911 calls are hearsay and therefore cannot be used in court.
On July 15, 2008, Cindy Anthony called 911 three times trying to locate her 2-year-old granddaughter, Caylee, CBS affiliate WKMG reported June 9.
In the second recording, Cindy Anthony exclaims, "There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car."
Cindy Anthony later claimed that smell came from a slice of rotten pizza, WKMG reported.
By the third call Cindy Anthony is crying and tells the dispatcher "I found out my granddaughter has been taken, she has been missing for a month. Her, her mother finally admitted that she's been missing," according to reports by the Orlando Sentinel.
Casey Anthony's daughter, Caylee, was reported missing in July 2008, a month after Casey claims to have last seen her daughter. Caylee's remains were found five months later in a wooded area near the Anthony family's east Orange County home.
The hearing on the 911 tapes is set to be held in mid July. Anthony has pleaded not guilty to murdering Caylee and her trial is set to start in May 2011.

Actually, J4A, I just read something interesting by another blogger:
The jist of it was that if Cindy gets on the stand and says that she only said the car smelled like a dead body in order to get the police to arrive faster, that she would not be guilty of perjury. The reason is because it is not a different statement from what she previously made under oath (during the State depo she stated the same thing).
What confuses me is that just because she is stupid enough to lie under oath more than once, IMO, does NOT make her NOT GUILTY of perjury. IMO, it just means she perjured herself more than once regarding the same topic.
I wish I knew the law better..... there's just so many little "ins and outs" that the average layperson (that would be me) just doesn't know.

Snaz, I agree that it would mean she perjured herself more than once, but they can't charge her with perjury unless they can prove she is lying. Our common sense might tell us that her excuse about getting police to arrive faster is total BS, but I'm pretty sure that isn't enough proof to charge her with perjury.

I agree with you, J4A..... I just can't wait until this hearing. It should be quite a sideshow with LEE and CINDY, who are both known to flat out LIE to cover for KC.
I would call them mistruths or partial truths, but everyone (with the exception of the A family) knows in the real world... that means LIE.

I agree with all of you guys........I was re-listening to the 911 calls and thought of something: Besides what Cindy is actually saying to the 911 operator, you can hear bantering between her and Casey........ i.e.: you can hear Cindy telling Casey (while they are still in the car I believe)... "... because my next thing will be down to a child thing, and we'll have a court order to get her. If that's what you want to play, then we'll do it, and you'll never ..." and Casey says... "Well that's not the way I want to do it." Stuff like that.
I believe all the 911 calls will be allowed. Worst case scenario- they put Cindy on the stand and grill her...... with all those lovely tv interviews, newscasts of her outbursts and previous official statements to LE being brought to bear if she tries to deviate from the actual call.

I know this family is upsetting but I think Lee has done his best to stay out of the limelight...I'm surprised that the press hasn't dogged him more...He just might be the key, once on the stand, to get his parents to fess up...I just hope his nervous laugh doesn't do him in...

Casey Anthony's mother must answer questions about a series of 911 calls she made after learning that her granddaughter was missing, according to her mother's attorney.
Brad Conway, Cindy Anthony's lawyer, confirmed today that she and her son Lee were served with subpoenas in late June to be available for testimony for a critical hearing next week.
Part of the hearing, scheduled for Thursday, July 15, will focus on whether 911 calls Cindy Anthony made two years ago should be admitted during trial.

OK.... Mama, I will be happy to give you my opinion about the hearing. I'm no expert, but here goes:
I do believe JP will allow the 911 calls into evidence. The State when they filed their motion clearly stated they wanted to use the two tapes (the first and the last ones) to show how KC came up with her kidnapping story. You can see within the tapes how it progressed into that lie..... They were very clear that they do not want to use the tapes to prove that what CA said was true..... (there's lots of other evidence to prove that!)
Here's an interview by Richard Hornsby which explains that:
The State isn't trying to prove that WHAT CA said was true..... only that KC was in the presence of CA when she made the calls and heard what she said to the 911 operator.... that's when she came up with her 'nanny stole Caylee' story.

So, yes, I believe the tapes will come in. I think the State will make their argument and Judge Perry will grant their motion.
To answer your other question, even if by some chance their motion were to be denied, I believe CA, GA and LA will still testify at the trial..... they know too much.... and I just can't help but feel that between LDB and JA, they can get CA and GA so rattled, they won't know if they are coming or going. And they HAVE to answer. They cannot take the fifth. When you are subpoenaed, you are given use immunity. That means the State can't use anything you say against you... but anything they learn on their own from anything you say CAN be used.
So I think the A's will find themselves in a real little pickle come July 15......

In that case, the court upheld the introduction of a taped interview of the defendant which included statements attributed to third party witnesses which implicated the defendant – those third party witnesses did not testify.
The court said that the statements of the third party witnesses were not being offered to prove that they could actually implicate the defendant, rather the statements were being offered to provide context to the defendant’s subsequent incriminating statements when confronted with the third party claims. Thus the way in which they were being offered was not hearsay at all.
And it appears to me that this is precisely why the State wishes the jury to hear the 911 calls – so that the jury has a full appreciation of the circumstances under which Casey Anthony made up the ridiculous Zenaida Gonzalez story.
And because this is such an important issue, the Judge Perry is likely to allow the 911 calls to be introduced because they are not hearsay – regardless of whether they are non-hearsay!
So, yes, I believe the tapes will come in. I think the State will make their argument and Judge Perry will grant their motion.

okay, maybe i am a LITTLE dim here, but could someone tell me HOW the 911 calls are considered hearsay AT ALL??

When someone introduces a statement of a third-party, whether it is a written statement, a recorded statement, or a verbal recount of what the third-person said – the statement is still hearsay. Because the medium (writing, recording, orally) is being used to introduce the third-party’s statement.
And in America, a criminal trial by affidavit is unconstitutional. If a person has first-hand testimony to offer, they need to come into court and be subjected to cross-examination.
So if the 911 recordings are introduced to prove what Cindy Anthony said, they are hearsay. As the only admissible evidence to prove what Cindy said would be for Cindy Anthony to come into court and simply testify to what she saw, heard, or did.

Would the 911 operator be able to testify as to what CA said to her, since CA will be in the court room.
When my daughter appeared in court last month on the custody hearing for her son, she was able to testify as to what her ex's aunt told her, since the aunt was in the court room, and then she took the stand and verified the info.

This is a bit confusing. So if somebody killed somebody and they called 911 and said I just shot & killed so & so, would the tapes be hearsay & inadmissable if later the person who called 911 changed their story and claimed not to have shot & killed the person? (I always thought 911 tapes were admissable.......confused look on my face.)

Did you notice where Hornsby said Cindy could still be impeached with the 911 call if she denies that Casey's car actually smelled like a dead body. I think this is because two of Cindy's coworkers are on record as stating that Cindy told them the car smelled like a dead body.

oh,... estee, great point, i did forget.
those statements are VERY damning.. he is actually giving a statement to LE, therefore it is admissable.. i remember the things he said about being ex law enforcement and KNOWING that smell specifically. that is all they need to back up the forensics, forget CA's statements, GA's are MUCH more damning... IMHO!!

Cindy Anthony and her son Lee may testify at a hearing Thursday afternoon. Cindy Anthony threatened to call the police, hoping the threat would force Casey Anthony to describe where her daughter was. The third and final call was placed immediately after Cindy Anthony overheard what Casey Anthony told her brother. Cindy Anthony appeared to be agitated and excited as she told the dispatcher that her granddaughter had been missing for a month and that her daughter’s car smelled “like there’s been a dead body” in it.
Cindy Anthony has since explained that the odor emanating from the car could have been from rotting garbage. However, the State believes that Caylee’s decomposing body was in the trunk of the car at some point in late June 2008.
Caylee's skeletal remains were found in the woods about one quarter mile from the Anthony home in December 2008.
The State intends to prove at trial “the progression of [Anthony’s] lies about the fate of her daughter.” These 911 calls are a critical part of that progression. “It is only in the face of repeated threats by her mother to contact authorities and falsely accuse her of a crime, that [Anthony] finally fabricates the ‘Zanny story,’ prosecutors asserted in their papers. In the calls, Cindy Anthony reported that Casey Anthony stole the car, which was not true.
Thursday’s hearing is also expected to focus on a motion from the defense. They’ll ask the judge to modify a ruling by Judge Stan Strickland, who stepped aside in April. The motion concerns a review of documents from Texas Equusearch, a private company that assisted in the search for then-missing Caylee. While Strickland’s order allowed the defense attorneys to review thousands of documents created by TES, the attorneys were prohibited from taking notes during the review. The defense maintains the current arrangement is inefficient and they’re seeking a more workable resolution.

Orlando, FL – Casey Anthony may be face-to-face with her mother and brother this week if they take the stand in an Orlando, Florida courtroom. Cindy Anthony and her son Lee may testify at a hearing Thursday afternoon. The State is expected to argue that 911 calls placed by Cindy Anthony in July 2008 should be admitted at her daughter’s murder trial next year. The defense says the taped phone calls are hearsay and should not be admitted.

Cindy Anthony will testify about her 911 calls at the hearing, and her son, Lee, will testify, too. Casey Anthony, Cindy’s daughter and Lee’s sister, is charged with first-degree murder in the death of her daughter, Caylee.
On the noon news today, WESH-Ch. 2’s Bob Kealing said he had talked to Cindy’s attorney, Brad Conway. “He tells me ‘Cindy is doing well and she is ready to testify,’ ” Kealing said.
Casey Anthony’s defense team continued to inspect evidence today at the Orange County Sheriff’s Office. The defense team’s scientific and forensic experts began their examination yesterday.
“Their focus was firmly on one thing — Casey’s car,” WKMG-Ch. 6 anchor Erick Weber said.
“Any time you get a chance to inspect something you’ve never seen before … only in photographs, it’s a completely different way of looking at things,” defense attorney Jose Baez told reporters.
Baez’s comment that he wants a number of items tested grabbed the attention of WESH’s Kealing. “It certainly makes you wonder … how much material we’re talking about and could that further delay Casey Anthony’s trial,” Kealing said. The murder trial is scheduled for May.
WFTV-Ch. 9’s Kathi Belich said the defense wouldn’t say if it found “a significant amount of new evidence” in its examination. “They don’t want us to know exactly what they’re looking at even though the sheriff’s office is videotaping their examination of this evidence and we will see that videotape,” Belich said.

ORLANDO, Fla. -- On the two year anniversary of her 911 call that began the investigation into Caylee Anthony's disappearance, Cindy Anthony will testify Thursday about her state of mind when she discovered her granddaughter was missing.
Casey Anthony's defense team wants the calls made by their client's mother dismissed, claiming they are inadmissible at trial.
Cindy Anthony's attorney said his client will tell the truth in the hearing, which will be held at 2 p.m. Thursday, about her state of mind when she made the calls on July 15, 2008. The calls launched a months-long search for 2-year-old Caylee, which ended in December 2008 when her remains were found in a wooded area near the Anthony family's east Orange County home.
Cindy Anthony has not testified in two years, when things got tense between her and prosecutor Linda Drane-Burdick.
According to Brad Conway, the Anthony family's attorney, Cindy Anthony will answer questions about the 911 calls calmly. He said she will acknowledge she was frantic when the call was made, even though that admission could hurt her daughter in her trial for first-degree murder in Caylee's death.
"There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car," Cindy Anthony told a 911 dispatcher.
During the hearing, Casey Anthony's lawyers must establish that Cindy Anthony had several hours to calmly contemplate her words before calling 911.
"I found out my granddaughter has been taken. She has been missing for a month," Cindy Anthony told a 911 dispatcher.
Prosecutors argue that Cindy Anthony displayed raw emotion in the 911 calls, and so her comments should be allowed at trial under an exception to the hearsay rule called "excited utterance."
In addition, prosecutors said the 911 calls are admissible because they show the moment Casey Anthony first mentioned her daughter's alleged kidnapper.
"Who has her? Do you have a name?" the dispatcher asked Casey Anthony when she was put on the phone.
"Her name is Zenaida Fernandez-Gonzalez. ... She has been my nanny for about a year and a half, almost two years," Casey Anthony replied.
Conway said Cindy Anthony does not have a problem with the calls being used in the trial. He said, "it is what it is," and he believes the judge will allow the calls to be admitted into evidence.
Anthony's defense had a team of experts examine evidence in the case on Tuesday and Wednesday, including the Pontiac Sunfire Cindy Anthony referenced in her 911 calls.
The defense is hoping its team of experts will find something in the car that proves Anthony's innocence in Caylee's death.
