No one is happier about Dr. William Petit Jr.'s. engagement to photographer Christine Paluf than his late wife's family, Cindy Hawke-Renn, the only sibling of Petit's late wife, tells PEOPLE.

"Mom, Dad and I have said to him since early on, 'We want you to look for love again,' " says Hawke-Renn. "We want you to be happy. We want you to find some happiness and joy. I just can't wait to dance at the wedding."

Komisarjevsky Asks For A New Trial

The defense team for convicted murderer Joshua Komisarjevsky has asked that their client be granted a new trial, according to documents filed with the New Haven Superior Court.

The motion, filed on January 10, asks that Komisarjevsky be granted a new trial of the "guilty-not guilty phase, and, should the court deny this motion, grant him a new trial on the penalty phase of the case."

NEW HAVEN --A judge denied a request Wednesday by convicted murderer Joshua Komisarjevsky for a retrial in the home invasion killings of a woman and her two daughters, saying he received a fair trial.

New Haven Superior Court Judge Jon Blue denied motions for a new trial and that the conviction be overturned.

Petit rescued the seeds after the home invasion. They've been growing at the Connecticut Science Center rooftop as part of an educational program....."

Connecticut's high court overturns death penalty
11 convicts' lives spared

"....Connecticut's Supreme Court declared the death penalty unconstitutional Thursday, sparing the lives of 11 convicts who were on death row when the state abolished capital punishment in 2012.

The death row inmates whose lives will be spared include Joshua Komisarjevsky and Steven Hayes, who were convicted of killing a woman and her two daughters in a 2007 home invasion in Cheshire, Connecticut.

The decision stems from the appeal of a defendant whose lawyers argued that execution carried out after the state abolished the death penalty would represent cruel and unusual punishment.

Connecticut's highest court voted 4-3 to overturn the death penalty.

In 2012, Gov. Dannel Malloy signed a bill into law that abolished the death penalty, making the state the 17th in the nation to abandon capital punishment and the fifth in five years to usher in a repeal...."

"....The two men who killed a mother and her two daughters in a 2007 Cheshire home invasion won't die for their crimes.

Under a divided opinion issued today by the State Supreme Court that abolishes the death penalty for those who are currently on death row, Joshua Komisarjevsky and Steven Hayes no longer face the prospect of execution.

The ruling affects all 11 inmates currently on death row in Connecticut.

The 100-page decision, issued in a 4-3 vote, says the state's current method of capital punishment violates the state's constitution.

State legislators voted to repeal the death penalty in 2012 — but only for those who committed crimes after that date.

The repeal did not include a change in sentence for the men on death row at the time, including the two men who committed the 2007 Cheshire home invasion where three female members of the Petit family were killed.

The State Supreme Court's ruling this morning applies to all those on death row....."

New details emerge about deadly Cheshire home invasion showing police were close to nabbing killers before murders

"....New details in the case of a grisly 2007 home invasion and murder of the Cheshire, Conn. mother and her two daughters show that cops were sent to stop the car driven by one of the killers moments before the gruesome crimes.

Police were ordered to find the vehicle driven by convicted murderer, Steven Hayes, while he took Jennifer Hawke-Petit to the bank to withdraw $15,000 before returning to the Petit home, where he and accomplice, Joshua Komisarjevsky, committed the sickening crimes.

A phone call was made between police stating, "head down toward that area and see if we can intercept this car," according to court documents filed by lawyers for Komisarjevsky.

An officer was within blocks of the bank at the time, but it's not clear if they ever approached the Chrysler Pacifica, the Hartford Courant reported.

Cops had previously never confirmed that they were looking for the car being driven by Hayes...."

Jennifer, Hayley and Michaela were killed by petty criminals Joshua Komisarjevsky and Steven Hayes — who followed the 48-year-old mother home from a supermarket on July 22...."



"....While Komisarjevsky stayed behind with the girls, Hayes drove Jennifer to the bank, where she got the cash — and managed to alert bank employees to her family’s plight.

The bank manager called 911 at 9:21 a.m. Jennifer left the bank at 9:24 a.m. and got into the car with Hayes. One minute later, a dispatcher called police Sgt. Chris Cote, who was just around the corner, and told him to locate and intercept the car.

At the same time, the police force’s SWAT team was told NOT to report for duty — and its hostage negotiator was instructed NOT to go to the Petit home.

This indicates police may have “doubted the veracity” of Jennifer’s claim that her family was being held hostage, said a source.

It got worse.

ANOTHER officer, who was near the Petit home, “was told not to approach the house,” the source said...."

Komisarjevsky Attempt At New Trial To Focus On Undisclosed Police Calls

"....Defense attorneys are expected to argue that Cheshire police did not turn over evidence to protect themselves from criticism over their response. Cheshire police officers were outside the Petit home for at least 20 minutes, setting up a perimeter, while Hayes raped and strangled Hawke-Petit and the two men set the fire while the girls were tied to their beds.

Officers watched as Dr. William Petit, who had been knocked unconscious with a baseball bat and tied up in the basement all night, escaped through the bulkhead and crawled to a neighbor's house to call 911. By that time Hayes and Komisarjevsky had set the fire and tried to escape.

The Courant obtained copies of 41 phone calls made on a second phone line and not among the dispatch tapes played at Komisarjevsky's trial. Among those calls were some from SWAT team members asking if they were needed and a call from the department hostage negotiator who was told not to come in.

Komisarjevsky's attorneys filed a motion with the Supreme Court arguing that some of those calls had never been turned over to the defense before trial and therefore Komisarjevsky deserved a new trial. ...."
