The bruises covering the toddler's body had allegedly come at the hands of an amateur boxer.

In flashes of rage, the 28-year-old had more than once thrown Dakoda Scott's small frame, according to court documents. He left marks, welts and a black eye on the 23-month-old. He had spanked the child with a wood fork and once squeezed Dakoda, digging his fingers into his armpits, shook the boy and then threw him sideways onto a toy.

The man, Marco Anthony Gutierrez, was dating the boy's mom, Shara Christine Scott, a 24-year-old day care worker who knew of his abuse and called no attention to it, according to court records. She did not seek medical help or report the problem, sometimes bringing her son to her job at a Humble day care and overseeing him in an area where co-workers didn't notice his injuries, said Detective Betty Silva, of the Jacinto City Police Department.

On Feb. 16, when the boy's wounds were so extreme that Gutierrez sought help, Dakoda died.

Gutierrez has since been charged with capital murder and is in Harris County Jail. Scott was arrested Thursday and charged with injury to a child by omission. She was released from Harris County jail on $50,000 bail.

JACINTO CITY, TX (KTRK) -- A mother is facing charges after her toddler son died of injuries that police say were caused by her boyfriend.

Shara Christine Scott, 24, is charged with injury to a child by omission. Back on February 16, according to court documents, her 23-month-old son Dakoda was unconscious and not breathing when he was taken to a Jacinto City fire station. Scott's boyfriend, Marco Anthony Gutierrez, 28, told paramedics Dakoda had fallen out of his crib and hit his head while Gutierrez was babysitting the child.

JACINTO CITY, Texas – A San Jacinto woman has been charged in the death of her 18-month-old son, who was killed in February from injuries sustained by his mother’s boyfriend.

Authorities said Shara Christine Scott was charged with injury to a child by omission and remained in jail on $30,000 bond.

Police said on February 16 officers received a call from Scott’s boyfriend, Marco Antonio Gutierrez. He told officers he was standing in front of a fire station and that his "boy was not breathing."

I searched the Houston Chronicle's archives. This was the initial story dated 2-17-11. Dakoda's name is misspelled. Dakota vs Dakoda.

Of course, the charges have since been upgraded to Capital Murder regarding Marcos Gutirrez.

Jacinto City Police Department has charged a 28-year-old man in connection with the apparent beating death of a toddler, Police Chief J.M. Ayala said Thursday.

Dakota Scott, who would have celebrated his second birthday later this month, died at 3:30 p.m. Thursday from injuries he apparently received when the suspect shook him and threw him into a playpen, where the child hit his head, according to a statement Ayala said the suspect gave police.

JACINTO CITY, Texas -- A mother has been charged in connection with her son's death.

Shara Scott, 23, has been charged with injury to a child by omission.

Jacinto City police said Scott's 23-month-old son, Dakota, died in February.

Scott's live-in boyfriend, Marco Gutierrez, 28, has been charged with capital murder.

Investigators said the couple argued often, and Gutierrez admitted that he took out his anger on Dakota.

Doctors said Dakota suffered brain injuries, body bruises, a black eye and torn rectal tissue.

Silva said the beatings began in December, and Scott did not protect her son. She said Scott lied to her parents when they noticed bruises on Dakota.
If convicted, Scott could get up to life in prison.

I'm thankful for the above information, I didn't know what consequences were involved with that particular charge/conviction.

I like the caption with the above pic! Little Dakoda was totally defenseless against the "boxer" and his mother did nothing to protect him. Oh, she did lie to protect her boyfriend!

The charges against Shara Scott remind me of the charges against Abigail Young in the Emma Thompson case.

Young was charged with the same as Scott but was found guilty of the lesser charge of reckless and serious bodily injury to a child by omission. The maximum sentence is 20 years. Young did get the max but will be eligible for parole in 5 years.

Jurors convicted Young of a lesser charge of reckless and serious bodily injury to a child by omission. They rejected a more serious charge of injury to a child by omission, which could have sent her to prison for life without parole.

The difference between the two charges are reckless versus knowing.

In the Scott case, there may not be a lesser charge when this goes to trial. There may be sufficient evidence to support the charge of injury to a child by omission.

Ironically, Dakoda Scott has red hair like Emma Thompson. Two precious children gone too soon at the hands of the mothers' boyfriends!

Ann, Emma Thompson immediately came to my mind when I read about little Dakoda. Like you said, he had that pretty red hair, too.

Thanks for the explanation on the charges.

Since there is only the one very serious charge against the mother, I hope there is no possibility she could walk. It appears her parents were aware of bruising on Dakoda and she lied and covered up. Abigail Young did the same treacherous thing, yet they found her guilty on the lesser charge. She should have been convicted on the more serious charge. As I hope and pray this Shana Scott thing will recieve.

Piper, Abigail Young was charged and indicted for the one charge like Shara Scott.

At Young's trial, prior to instructions to the jury by the Judge, the lesser charge was added to the instructions as an option.

Like the Casey Anthony trial, the lesser charges that a jury could have found her guilty of were included in the instructions by Judge Perry even though the indicted charge was first degree murder.
