The John Goodman retrial starts today, 10/6/2014, with jury selection in Tampa, Florida.

Six jurors and 4 alternates will be selected and they will be transported to West Palm Beach, FL for the trial.

They will be sequestered for the entire proceedings and watched closely until they reach a verdict
on the charges of DUI manslaughter, failure to render aid and vehicular homicide.

Second trial for Goodman set to get underway with Tampa jury selection

For 200 people reporting for jury duty Monday in Tampa, there are two key questions: Can you serve on a four-week trial in West Palm Beach, and have you heard about the John Goodman DUI manslaughter case?.

The answers will tell attorneys if they can easily find 10 people to sit in judgment of Palm Beach County's most high-profile criminal defendant.

Chief Circuit Judge Jeffrey Colbath says the whole point of traveling 206 miles to pick six jurors and four alternates at the Hillsborough County Courthouse is to make sure the Wellington polo mogul's second trial is his last.

So there is tremendous pressure to find a fair and impartial jury — people unaware of the relentless media coverage about Goodman, 51, previously convicted in the Feb. 12, 2010 death of Scott Patrick Wilson, 23, and sentenced to 16 years in prison.

Goodman won a new trial because his high-powered lawyers exposed injustices: a juror in Goodman's first trial in March 2012 didn't tell the truth during jury selection and then later broke court rules.

What is this high-profile case about?

The allegations: Goodman was driving his Bentley Continental GTC convertible southbound on 120th Avenue when he ran a stop sign at 63 mph and smashed into Wilson's Hyundai Sonata, traveling west on Lake Worth Road. The force of the impact flipped the Sonata upside down into a canal, where Wilson drowned.

Prosecutors Johnson and Sherri Collins say Goodman walked away from the 1 a.m. crash, and didn't call 911 until nearly an hour later from a nearby trailer, after first calling his girlfriend in Atlanta.

First responders said they smelled alcohol on Goodman when they encountered him. Goodman's blood was drawn about 4 a.m. at Wellington Regional Medical Center, registering a blood-alcohol level of .177 percent, more than twice the .08 legal limit to drive.

Prosecutors plan to introduce evidence that Goodman had been drinking at two establishments that cater to the polo community in Wellington: White Horse Tavern and the Players Club.

UPDATE: Attorneys began questioning  a pool of potential jurors in Hillsborough County Monday for the retrial of John Goodman.

When asked this morning whether any had heard of Goodman, a handful raised their hands.

The judge also wanted to know if prospective panel members would mind spending almost a month sequestered in what he called "a very nice" a hotel room in Palm Beach County.

I got a PM inquiring if the trial video will be archived by WPTV or other news media. At this time, I do not know.

I am so happy to see that WPBF is also streaming live.

When watching a trial, it is always good to have a Plan B (second option)
in the event there are technical difficulties with the "live" stream that one
might be watching.

Perhaps by the time the Opening Arguments/Statements get underway, I will have a list
of who is streaming "live." If so, like in other trials, all will be posted in one comment.

I have been gone so long from RC that I had to think about how to post pics, video, etc.  LOL . . .but it all came back!

I think this will be a very interesting trial .. .like the first one was.

Without a doubt, John Goodman is guilty.  Because of him driving while drunk, Scott Wilson, an innocent and recent college graduate, was killed.  And John Goodman did nothing whatsoever to attempt to save Scott.  

Goodman was more concerned about saving himself.  This man deserves to spend many years in prison.   Nothing will bring back Scott Wilson .. . .but justice needs to be served in this case!

Scott Wilson was young and had his entire life ahead of him until John Goodman took it away.  Who knows what kind of greatness Scott Wilson could have achieved .. . if John Goodman had not taken it all away from Scott!

All of the above is my personal opinion!

What's the best fib to tell the jury for Wellington polo club founder John Goodman's DUI manslaughter retrial?.

Palm Beach County Chief Circuit Judge Jeffrey Colbath, defense attorneys and prosecutors agreed during a hearing Wednesday that in order for Goodman to get a fair trial, the jurors must not find out he was found guilty after his first trial in 2012.

But the dilemma is how to twist the truth for the jury about why Goodman's Bentley from the case is no longer in evidence. The fact is that prosecutors released the smashed car to an insurance company after the verdict and long before the conviction was tossed because of juror misconduct.

"We're going to have to create a fiction for this jury," Colbath said, promising a decision before the start of jury selection Monday in Tampa. The chosen jurors will travel to West Palm Beach for the expected four-week trial.

TAMPA, Fla. —The prospective jurors for the John Goodman trial included a neuro-psychologist, a Ph.D. student, salespeople, retirees and a massage therapist.

Chief Judge Jeffrey Colbath told them bluntly, "I'm not going to sugar-coat this. It's going to be an inconvenience. "We're going to put you up in a very nice hotel at our expense, but you’re going to be sequestered."

The final jury of six jurors and four alternates will leave Tampa in a Sheriff's Office bus, either Wednesday night with just a few hours for packing, or Thursday morning after a night at home. Once in an undisclosed Palm Beach County hotel, they will be under guard after being in court each day from 8 a.m. until 6 or 7 p.m., including Saturdays.

Day two of jury selection for the DUI manslaughter retrial of polo magnate John Goodman is happening now in a Tampa courtroom..

Fifty prospective jurors will be questioned this Tuesday morning about whether they've seen media coverage of the case and whether they'd face any major hardship from being sequestered for three and a half weeks.

Palm Beach County Judge Jeffrey Colbath had planned to ask more detailed questions of the 40 jurors called back from Monday's jury screening. But instead he has asked only 19 people to return — those who said they had to check on whether they could be away for the duration of the trial.

Attorneys questioned nearly 200 potential jurors for the retrial of polo mogul John Goodman by Tuesday afternoon in Tampa.

Questioning on Tuesday was predominantly about whether jurors could suffer the hardship of coming to Palm Beach County for a long trial and also whether they knew about Goodman through the media.

TAMPA, Fla. - At the end of jury selection for the John Goodman retrial on Wednesday in Tampa the judge said he is considering options to find more jurors.

They are now down to 52 potential jurors.

Many have been eliminated because of the hardship of moving to West Palm Beach for nearly a month. Others heard of Goodman in the media.

Attorneys said Wednesday they are hopeful they will be able to pick a jury from the current pool, but the judge told them to consider the other options as a last minute resort.

TAMPA, Fla. - A 23-year-old prospective juror for the John Goodman trial is under arrest for contempt of court.

A member of the defense team reportedly heard the man in the hall say that he knew the case was a retrial.

Judge Jeffrey Colbath called in Travis Van Vliet, a 23-year-old college student, to question him.

He was nervous -- quivering -- and told the judge he did "research" during lunch -- and learned that this was a retrial.  

The judge told the juror, "you are starting to make me upset. I don't want to throw you in jail."  But that's exactly what the frustrated judge did.

TAMPA, Fla. —Just as lawyers were finally poised to pick a jury after four days of questioning in the John Goodman trial, one juror was found to be in contempt of court, handcuffed and led from the courtroom to jail.

After four days of intense questioning to weed out jurors who had heard of the highly publicized case and find out who could endure the hardship of being sequestered in Palm Beach County for three weeks, a defense assistant alerted the judge she had overheard a juror talking to another about the case, specifically the highly guarded information that this was a re-trial. Jurors are forbidden from knowing this about a defendant, and it could trigger a mistrial.

I think this will be a very interesting trial (the first trial certainly held my attention).

I hope Goodman is found guilty and is sentenced to prison for a very long time. Because of him being drunk and electing to drive, an innocent recent college grad, Scott Wilson, lost his life. The horrific part about this is that Goodman made no effort to immediately call 911 or to save Scott Wilson from drowning. Instead, the drunk chose to walk away. I wonder how he can sleep at night!

I wonder if Goodman will take the stand this time. I will watch the trial but due to other commitments, I will not be able to watch it continuously. Some days, I will have to be out of town for part of the day.

I hope when the trial starts that some of the trial watchers will comment here. Freckles does an exceptional job of posting in "real" time as she watches a trial. She is amazing. I always wondered if she was a Court Reporter at one time!

I am hoping that perhaps one of the media sources will archive it.

Both sides in Wellington polo mogul John Goodman's DUI manslaughter retrial agreed on 10 jurors late Thursday — but not before a juror's gossip took the proceedings off course and ended in his arrest.

Prospective juror Travis Van Vliet was handcuffed and hauled to jail after Palm Beach County Court Circuit Court Judge Jeffrey Colbath learned he told another man in the jury pool that the case was being tried for the second time.

Among them: a salesman, a phlebotomist, a Navy veteran who now makes parts for ATMs, a retiree, a former child protective investigator who now teaches parenting and a YMCA group exercise director

Great to see you as well, Ann!  Glad to see this trial get underway as well as JA and Master Bob.  It will be a busy fall for trials!

Here is an article which gives some insight into the defense strategy.  IIRC, the Bentley will not come in as evidence, but it seems as if they are still going with the "dazed and confused" angle as to why he did not render aid.

Parts of the defense's strategy came out in Richardson's line of questioning, which touched on blood draws, concussions and faulty equipment.

Jurors were asked about whether they had ever had an expensive piece of equipment malfunction and whether they'd known anyone who had a concussion.

The defense has been arguing that Goodman's Bentley surged forward or failed to brake, which caused the car to blow through a stop sign and slam into Wilson's car.

The team has also been arguing that Goodman suffered a concussion after the crash, and they he only walked away from the scene because he was in a daze

But after dismissing the juror to whom Van Vliet spoke, and confirming the rest of the panel had not heard anything, the attorneys chose six jurors and four alternates. They will be sequestered in Palm Beach County for the trial, which is set to begin at 8:30 a.m. Saturday.

"......Colbath announced the chosen jury nearly two hours after Van Vliet was taken into custody. Jurors are not allowed to know of Goodman's previous conviction and 16-year sentence. When Van Vliet mentioned to another juror that the case had gone to trial before, he was overheard by an assistant to one of the defense attorneys, who reported it to the judge.

An angered Colbath asked Van Vliet for the context of the conversation and details of how he knew the case was being retried. His anger was exacerbated when Van Vliet was seemingly not forthcoming.

"Do you want to go out the front door of this courthouse or do you want to go out the back door is what I'm asking you," the judge said. "The way for you to have the keys out the front door is for you to be honest with me. … If you're going to try to skate around my questions, that's going to encourage some wrath."

Under questioning from Colbath and the attorneys, Van Vliet admitted he did an Internet search of the word "sequester" on Thursday. He said he saw a headline about the trial being moved.
Reduced pool of potential jurors raise red flag in Goodman retrial

Van Vliet, who is studying criminal justice online and said days ago that the trial would be "an opportunity for me to see the inner workings of things," faces a misdemeanor charge of indirect criminal contempt of court. He's set to be arraigned early Friday.

Juror misconduct is what got Goodman's prior conviction and sentence overturned. Last year, Colbath threw out the verdict and sentence because juror Dennis DeMartin did a drinking experiment and failed to reveal during jury selection that his ex-wife had been arrested for DUI. ...."

It has been a long time since we've watched a trial together! Thank you so much for your posts.

So good to see you! I've been gone for several months and it is really nice to "see" folks again and say hello.

One Wonders and Curious, also so good to "see" both of you again.

All of us have spent a lot of time together, in the past, blogging about various cases and trials.

Since this thread was set up on 10/6/2014, there have been 717 Views!

The John Goodman trial is expected to last at least 3 weeks. It will be interesting to see the number of Views at the end of this trial.

I have missed you, Ann. Hope everything is okay on the home front.
Now AD is missing! So hard to keep all the little ducks in a row... sigh.


Goodman Trial is so boring so far.
The first person up today testified to coming across the abandoned and badly damaged Bentley. She was the one who first called 911. She did not see the second car with Scott Wilson in the drainage ditch; she did not see Goodman anyplace and she tried to determine if there was a person in the midst of the crash. When she called 911 she gave the registration/license plate info to dispatcher.
