State rested its case this afternoon. Palm Beach Sheriff's Office Toxicologist spent most of the afternoon on direct and cross. He kept testimony strictly on the science of calculating BAC, etc. I'm impressed with Ms. Collins (state) and how coherently she asks the questions and keeps an organized flow of information going. Drama this morning with Juror #3 who said a laptop "mysteriously" appeared on his bed this morning. They are strict court orders not to have any computer device on their persons but only in common areas with deputy supervision. #3 was called before the Judge and he was not quite buying the "aw shucks, Judge, I was only looking up football scores" routine but kept him - for now - on the panel.

Defense has just started their case with Stacey Shore...does anyone know if JG will be testifying again? That I need to see!

John Goodman retrial: Juror broke court rules with personal laptop in hotel room
Oct. 20, 2014 2:18 p.m.

A 5 a.m. text message to Palm Beach County Chief Circuit Judge Jeffrey Colbath Monday delivered the news of yet another problem with a sequestered juror serving on Wellington polo magnate John Goodman's DUI manslaughter retrial.

Juror 3 violated a court rule Sunday by using his laptop computer in the privacy of his hotel room instead of accessing the Internet in the presence of a Palm Beach County Sheriff's deputy, Colbath announced to the attorneys before the scheduled start of testimony on the trial's eighth day.

...On Monday, the judge said he was concerned the juror wound up with the laptop in his hotel room when the devices are supposed to be logged in and out and only permitted in a common room at the hotel where the jurors assemble.

"It flies in the face of their procedures," Colbath said. "It flies in the face of common sense. It's difficult to accept that ... He's not following the court's instructions."

John Goodman retrial: More Goodman juror problems

WEST PALM BEACH, Fla. -- The John Goodman retrial started Monday morning with yet another juror problem.

...According to the PBSO deputy, deputies realized the juror's computer was missing late Sunday night.

Investigators eventually found the missing computer in the juror's hotel room.

According to the deputy, the juror was "vague and evasive" about how the computer ended up there.

IIRC, the female server / bartender stated JG had more than one drink.
Again. IF were are to believe JG, he just happened to stumble into some barn where his footprints did not lead, and presto! There was a bottle of booze just lurking in the shadows, and it called to him as some story book character out of Alice in Wonderland. And he felt it was okay to consume this sweet treat... and then going stumbling about to the next farm.

Alice in Wonderland? No. More like Goldilocks breaking into the bear home and helping herself.

There is NO evidence he was even at the other property!!!
Bootprints say naught.

WEST PALM BEACH, Fla. - Polo mogul John Goodman took the stand in his DUI manslaughter retrial late Wednesday morning.

Goodman testified he was not intoxicated when he got behind the wheel of his car.

Goodman was driving a Bentley that hit Scott Wilson's car in 2010. Wilson's vehicle went into a canal and he drowned. A jury found Goodman guilty of DUI manslaughter in 2012 but Goodman was awarded a new trial because of juror misconduct.

Goodman says most of the drinks he ordered before the crash were for other people.

WEST PALM BEACH, Fla. - John Goodman was on the stand for over four hours Wednesday as the defense and state questioned him about the crash that killed Scott Wilson in February of 2010.

Goodman blamed his Bentley for malfunctioning and causing the crash.

"I went to put on my brakes and it wasn't stopping normally and I pushed harder and it felt like it wasn't stopping so I went for the emergency brake...that is what I remember," Goodman said.

Goodman said he was dazed and confused after the crash.

He says his cellphone was dead, so he went to a barn close by where he found alcohol while searching for a phone.

"I looked around for a phone for a long time and then I was in a lot of pain so I drank the liquor," Goodman said.

John Goodman took the stand in his own defense Wednesday in his DUI manslaughter retrial, telling the jury the brakes of his car didn't work correctly in the seconds before he ran a stop sign and plowed into another car..

The Wellington polo magnate said he is positive he tried stop his Bentley before going into the intersection and slamming into the Hyundai driven by Scott Patrick Wilson, 23.

The lead crash investigator, Palm Beach Couny Sheriff's Sgt. Troy Snelgrove, testified earlier in the trial that there was no evidence of braking.

Goodman said he tried pumping the brakes and then tried to pull the emergency brake.

Makes no sense.
He is involved in a serous auto accident.
He goes looking for a working phone.
He stumbles into a barn but does not find a phone.
He finds a bottle of alcohol!
He decides to drink the alcohol and phooey on getting help?

No alcohol bottle located at that barn.
No evidence he was even in the barn.

He has to be drunk to come up with this alibi and then expect sober persons to believe it.

Apparently, everything was working at the LAST stop sign because JG said he had stopped there!

I am curious as to what JG regards as " along time"...
We know about when he left the last watering hole;
We know about when the motorist called 911 (and he was not present);
We have reason to believe JG spent time walking to the trailer home.
We know when JG called 911 from Lisa Pemeberton's cell phone;
AND
According to JG, he was knocked unconscious for a period of time after the auto accident.

HOW LONG WAS HE SUPPOSEDLY DRINKING AFTER HE AWOKE, REGAINED CONSCIOUSNESS, AND BEFORE HE ARRIVED AT THE TRAILER? What is a long time?

Wit says he does speak English. He has been here 11 years. From Brazil. He is a horse trainer. Worked for Mr. Canton . Canton or Canson. Clarity is bad. He has living arrangements with Canton.

Speaking of lights turning on/off automatically.
He lived in the barn. No overhead just 9X11 being held up in front of jury.
Wit lived in barn with his wife.
Separate living qtrs for him.
Says there WAS liquor in the office: wine, tequila, and he tapers off...
Says the door to this office was unlocked.
Said he goes to bed @ 11 PM.
Said he heard 3X someone banging on his door.
Said he answered the door; wife followed him to door.
Said clock near door. It was 3 AM.
Officer at door: asked if he had seen anyone looking for a phone; he said NO.
Said @ hour earlier he had heard banging but he ignore it!!!
Officer left;
Said he got up next day @ 6 AM; looked up to Canton's office after he was outside.
Said he saw lights, TV on in the office. They had been off the night before.

(So he did NOT get up; there was an intruder; he did NOT hear the TV or see the lights; no telephone in the office!!!! This is so bad...)

Yep, the blonde Ms. Parker seemingly "barks" her questions and at times is more like a statement. Today, when the State declared an objection and began speaking, Parker jumped in and interrupted. Judge dressed her down by saying "It's not your turn, let's have a little decorum in here". lol

Defense witnesses in general have been weak today and state is having no problems in discrediting most of them - IMO

Freckles, I have found the Sun Sentinel court twitter reporter to be doing a much better job. More frequent and better at capturing the questions and answers.

WEST PALM BEACH, Fla. - An emergency room doctor who saw John Goodman after a deadly crash in 2010 was among the witnesses called on Day 11 of the polo mogul’s retrial.

Wellington Regional Hospital ER Dr. Adam Bromberg said he did not document a smell of alcohol coming from Goodman.

But Dr. Bromberg says just because he did not write it down, it doesn't mean there wasn't a smell of alcohol -- it just means it wasn't relevant to his medical care.

Goodman Retrial: Witnesses heard banging near man cave (Video)

WEST PALM BEACH, Fla. - Two witnesses backing up the defense's theory that John Goodman did go to a man cave after the crash that killed Scott Wilson.

Mark Da Silva lived near the mancave on Kris Kampsen's property.

They did not specifically see Goodman at the mancave, but they say they heard banging noises near the time he would have been there.

Goodman claims he drank alcohol in the mancave after the February 2010 crash that killed Scott Wilson.

The Da Silva's say a deputy showed up to their apartment around 3:30 a.m.

Testimony backs John Goodman’s man cave defense

WEST PALM BEACH — A hard knock on the door woke Marcos DaSilva at about 3:30 a.m., just hours after the February 2010 crash that killed Scott Patrick Wilson.

At the door, DaSilva said, was a Palm Beach County Sheriff’s deputy who asked if anyone had been there earlier looking for a telephone. A few hours later, DaSilva said, he awoke at 6 a.m. to find lights and a TV on in the man cave next to DaSilva’s apartment — a thread that tied John Goodman to the place where he said he drank after the 1 a.m. crash, causing a high blood-alcohol reading hours later.

(WELLINGTON, Fla.) — Neither of the cars at the center of Florida polo mogul John Goodman’s DUI manslaughter case will be seen by jurors during his retrial.

The Palm Beach Attorney’s Office ordered the release of the $200,000 Bentley driven by Goodman and the Hyundai driven by Scott Wilson after Goodman was convicted in the first trial. The two cars were to be crushed.

Goodman was speeding when he crashed into Wilson’s car in Wellington, Florida, sending it into a canal, prosecutors allege. Wilson, 23, drowned.

Palm Beach Homicide Detective Troy Snelgrove testified earlier this week that Goodman appeared inebriated in the hours after the crash. Goodman had watery eyes, slurred speech, and smelled of alcohol, he said.

I took some notes today:

Friday, Oct. 24th, 2014

Defense putting on car "expert"; didn't catch his name

Discussing that the Bentley stores info that can be downloaded
Reviewing downloaded report
This car did NOT have a crash data recorder, as most cars made more recently do
Error code seen indicates throttle valve opened and closed too slowly
Discussing what other tests he wanted to run that he couldn't
His tests would have been destructive to data on the system, so he was not allowed to do it
report shows air bag being deployed
There are redundant systems; one is reporting something that doesn't agree with the other one; one of them is wrong/malfunction of diagnostic/reporting system
Bank 1 device reported mileage of 0 at the time of the crash - can't be
Bank 2 device reports correct mileage
Once the Bentley was released, ended up being owned by private citizen in TX
Witness went to TX to do further testing
A number of components, including front hood, side fenders, etc., were not there (missing)
Engine components were also missing; including the two computers that controlled and recorded info were gone
Stereo, seats, door panels, all gone
Since the seats were gone, so were the seat belts
Ha - he just said the brake system was fine (this witness helps JG how?)
This witness has billed for over $100K!
Three sidebars within 4 minutes
Car witness now being cross-examined
Witness again says there was nothing wrong with the brakes
Nothing wrong with the ECM: Electronic Control Module
JG had taken his car in a month before and the brakes were checked at that time
No technical bulletins from Bentley regarding any mechanical issues
The throttle error he mentioned earlier was only found during "key on, engine off" condition; not while engine was running
Attny points out that if JG tried to start the car again after the accident, it could have accounted for the error codes found
Now the witness is saying these codes were generated pre-crash
He cannot say this "fault" caused the accident
It sounds like his bill was closer to $154K for consult fee
Total bill was over $200K!!!
That was thru March; doesn't include since then

My two cents: the title of the article is very misleading. The malfunction that he reported does not appear to have anything to do with the accident, and he stated he couldn't say it caused the accident. He actually stated that the brakes worked fine (he said that twice), and Goodman is saying the brakes failed. So his testimony did not support JG's story at all.

WEST PALM BEACH, Fla. - Saturday will likely be the last full day of testimony in the retrial of John Goodman. Closing arguments are expected on Monday.

...The state will have a rebuttal witness to argue against some of Sedar's claims.
