Waller attorney refiles appeal of federal prison sentence

The federal government miscalculated sentencing guidelines, erroneously alleged Clay Waller killed his wife and used that alleged murder to give him a maximum sentence on Internet threatening charges, Waller's attorney wrote in an appeal that became available to the public Monday.

Judge Stephen N. Limbaugh sentenced Waller to five years in federal prison Jan. 3 after Waller confessed to threatening Cheryl Brenneke, his sister-in-law and guardian of his three children, on an Internet message board in July. Brenneke's sister, Jacque Waller, has been missing since June 1, and Clay Waller is considered a suspect in her disappearance, although no charges have been filed against him.

Judge denies motion to dismiss Waller's state charges

CAPE GIRARDEAU, Mo. -- A judge has denied a request by Clay Waller's lawyer to dismiss state harassment and stealing charges against him.

Scott Reynolds, Waller's lawyer in the state case, submitted a motion last month to dismiss the case on the grounds that Waller, who is in prison on federal charges, can't get a speedy trial.

Judge Scott Thomsen denied the request last week.

Federal prosecutors have responded to Clay Waller's appeal of a five-year sentence imposed on him for a federal Internet threat conviction.

Assistant federal prosecutor Larry Ferrell responded to the appeal with a 69-page brief April 17.

Waller, 41, pleaded guilty Oct. 3 to threatening Cheryl Brenneke, his wife's sister and the guardian of his three children, on the Internet site Topix. After hearing emotional testimony from Brenneke and Ferrell's plea to significantly vary from the suggested six- to 12-month sentence, Judge Stephen Limbaugh imposed the maximum sentence of five years on Clay Waller.

As friends prepare tributes to Jacque Sue Waller, who went missing June 1 last year, prosecutors are trying to return her estranged husband James Clay Waller to Cape Girardeau County to face a murder charge. And Clay Waller continues the appeal of a five-year sentence for making an Internet threat against Jacque Waller's sister.

Authorities issued a murder warrant for Clay Waller on April 23, the same day he was charged with first-degree murder in connection to Jacque Waller's disappearance. Prosecutors filed a writ April 30, requesting he be transported to the county in the murder case.

Clay Waller to make court appearance on murder charge June 4

A little more than a year after his wife's disappearance, Clay Waller will make his initial court appearance on charges that he murdered her and tampered with evidence to hide the crime.

Waller will make his initial court appearance June 4 in Jackson, Cape Girardeau County Prosecuting Attorney Morley Swingle said. He will appear in front of Circuit Court Judge Gary Kamp at the county courthouse. Swingle said the purpose of the appearance will be to determine if Waller will have a private attorney or a public defender and to establish a date for a preliminary appearance, which usually takes place within 30 days.

Clay Waller is accused of the murder of his wife Jacque Waller last June. Prosecutors allege Clay Waller killed his wife after the estranged couple visited a divorce lawyer on June 1. Jacque Waller never showed up that day at the Ste. Genevieve, Mo., home where she had been staying since March, and her abandoned Honda Pilot was found on the side of Interstate 55. Her body hasn't yet been found.

CAPE GIRARDEAU, Mo. -- Clay Waller, the man accused of killing his estranged wife in Cape Girardeau County last year, was arraigned on a murder charge Monday.

Circuit Court Judge Gary Kamp set a preliminary hearing in the case for 9 a.m. July 25. Clay Waller's case was also assigned to the public defender's office. Clay Waller appeared in court via video conference from the county jail.

Dr. Scott Gibbs, who owns the home where Clay Waller was staying when he allegedly killed his estranged wife, testified that he found suspicious signs that something violent had happened in his home.

"I found blood spatter on the bathroom tile and cabinet and also on the fireplace mantle," said Gibbs, who also said he had experience with forensic investigations.

A Missouri State Highway Patrol crash reconstruction expert said he found three punctures on a flat tire on Jacque Waller's Honda Pilot, which was found abandoned on Interstate 55 when she disappeared. The punctures, the expert said, couldn't have been made by running over an object, and the vehicle hadn't moved at all after the tire was punctured.

Matt Marshall, a heavy equipment operator who worked briefly for a business Waller operated, recalled Waller coming to his home one night with the triplets and expressing anger that she was seeing another man. Marshall said Waller sent the children outside and told him, "I'll definitely kill her before my kids will call another man 'daddy.'"

Marshall admitted under cross-examination that he never went to police about the threat.

Another man who once worked with Waller, Edwin Rhodes, recalled that about two months before Jacque Waller's disappearance, Clay Waller told him, "I ought to just kill her."

At the end of the day on Wednesday, the judge did not make a decision on whether there was enough evidence to head to trial.

Cape County Prosecuting Attorney Morley Swingle said he expected Judge Kamp to make a decision by the end of the week.

JACKSON, MO (KFVS) - Clay Waller is scheduled to be arraigned on a murder charge on Monday in Jackson, Mo.

He'll appear for the first time before Judge Benjamin F. Lewis at 9 a.m. at the Division I/II Courtroom.

The change comes after prosecutors asked for a new judge.

Assistant Prosecuting Attorney Angel Woodruff filed a motion to remove Judge William Syler from the case. No reason needs to be given for the move.

Clay Waller pleaded not guilty Monday to a first-degree murder charge, as the high-profile case involving the disappearance of his wife nearly 14 months ago continues to grind its way through the criminal court process.

In a hearing that lasted just a few minutes, Waller never spoke as his public defender Chris Davis entered a plea of not guilty to the murder and two evidence tampering charges. Davis also waived the rest of the arraignment proceedings just before Judge Ben Lewis scheduled a case review for 9 a.m. Oct. 22.

Waller entered a not guilty plea to murder and tampering with evidence charges earlier this month.

Attorney Christopher Davis is now representing Waller who prosecutors say killed his estranged wife Jacque Waller on June 1, 2011.

Her body has not been found.

A United States Appeals Court upholds the five year federal prison sentence handed down to Cape Girardeau County murder suspect James Clay Waller.

Back in January, a federal judge sentenced Waller to five years in prison for using the Internet to threaten Cheryl Brenneke, the sister of his missing wife Jacque Waller.

The Eighth Circuit justices wrote in the ruling handed down Friday, "the district court did not err in finding by a preponderance of the evidence that Waller murdered his missing wife and that the alleged murder is inextricably intertwined with the threatening communication to Brenneke".

Search for Jacque Waller moves into Illinois

Jacque Waller was last seen on June 1, 2011.

MCCLURE, IL (KFVS) - The search for missing mother of three Jacque Waller continued on Sunday in southern Illinois.

K-9 units from Clarksville and McQueen, Tennessee were assisting in the search near McClure.

There were also three boats, and IDNR Officers, along the river around Devil's Island.

And, search teams from Little Egypt Search & Rescue, Scott County Emergency Management Search & Rescue and Southeast Missouri Search & Rescue.

At least 40 plus people were searching the area.

The jury will be selected from Cole County, Missouri, then brought to Cape Girardeau for the trial.

Waller is accused of killing his wife, Jacque Waller, who went missing in the summer of 2011.

The trial is set to begin on September 9th of 2013.

JACKSON, MO (KFVS) - Clay Waller will stand trial for the murder of his estranged wife Jacque Waller next year, and an outside jury will hear the case.

Waller was in court Monday morning at the Cape Girardeau County Courthouse in Jackson.

Both the prosecution and defense reached an agreement on change of venue.

Judge Benjamin Lewis set aside two weeks in September of 2013 for the trial.

A jury from Cole County, Mo will be brought to Cape County to hear the case.

Jury selection is set to begin in Cole County on September 5, 2013.

CAPE GIRARDEAU COUNTY, Mo. (KSDK) - Nearly two years to the day of Jacque Waller's disappearance, the Cape Girardeau County prosecutor has confirmed her remains were found Wednesday.

Jacque was 39-years-old when she was last seen in June 1, 2011 after meeting her husband, Clay Waller, to finalize plans for a divorce.

Dozens of searches for Jacque turned up nothing.

In October 2011 Clay Waller pleaded guilty to threatening Jacque's sister on the Internet. He was sentenced to five years in prison.

Jacque Waller's sister expresses 'shock' at news of remains found

"Just shock," is what Jacque Waller's sister, Cheryl Brenneke, said she felt when she heard her sister's body had been found earlier this week.

"You anticipate how you're going to feel for two years," Brenneke said. "You just can't prepare yourself, really. You just can't."

Brenneke, who has custody of Jacque Waller's 7-year-old triplets, Maddox, Avery and Addison, told the children the news Thursday morning --"that was the hardest thing I have ever done in my life," she said.

Brenneke said the children seemed stunned, but OK.

Brenneke said the family's hands are tied as far as releasing any more information about the circumstances of the discovery of the body. She did say that the family was told to expect a plea from Clay Waller in the murder case, but didn't know authorities were going to recover Jacque Waller's body.

The following is just my opinion:

I suspect that Clay Waller told law enforcement where Jacque's remains could be found . . . as part of a plea deal.

I am glad that her remains have been found and can be returned to her family.

Heartland community held out hope to find Jacque Waller

CAPE GIRARDEAU, MO (KFVS) - Friends, family and strangers said they never gave up hope that they would eventually find Jacque.

Patti Davis, the owner of Tans R Us in Cape Girardeau first put up a “Justice for Jacque” sign in her business window two years ago when Jacque Waller went missing. She still had the “J4J” sign up this week when authorities found her remains.

Davis said Jacque was a client at the tanning salon, and said everyone loved her. Davis never took down the sign and always held out hope.

"We put it up there and we decided we weren't going to take it down until she was found, so I've had people criticize me and say when are you taking that down, it looks terrible and I'm like nope, I'm not taking it down till they find her,” said Davis.

While Judge Benjamin Lewis has not issued a gag order in the Jacque Waller homicide case, legal experts say authorities have good reasons to be tight-lipped in the wake of the discovery of Waller's body last week.

Waller disappeared June 1, 2011, after saying she was going to the home of her estranged husband, Clay Waller, to pick up one of her children.

Clay Waller was charged with first-degree murder in 2012 in connection with the death of his wife, whose body was found Wednesday at an undisclosed location.

The Cape Girardeau County prosecuting attorney's office confirmed Thursday the discovery of the body but declined to release any additional information.

Bar Association rules forbid prosecutors from discussing the details of a pending case, said William Schroeder, professor of law at the Southern Illinois University School of Law in Carbondale, Ill.

The following is just my opinion:

I suspect that Clay Waller told law enforcement where Jacque's remains could be found . . . as part of a plea deal.

Ann, I also believe that Clay gave the police the information about the location of Jacque's remains in exchange for a plea deal.

Waller expected to plead guilty during hearing Thursday

(KFVS) - Clay Waller is expected to enter a guilty plea at a hearing Thursday at 1:30 p.m.

Waller is awaiting trial for charges related to the disappearance of his estranged wife Jacque Waller. He will be sentenced after the hearing.

The prosecutor's office confirms that the remains of Jacque Waller were recovered by law enforcement on Wednesday, May 29. They are not releasing where the body was found. Sources do tell Heartland News Jacque Waller was found in the Devil's Island area of southern Illinois.

There will be a news conference after the sentencing with the prosecutor and sheriff's department.

Waller will plead in front of Judge Benjamin Lewis.

Heartland News will be only TV crew in the courtroom.

Coroners on both sides of the Mississippi River are trying to determine who will be responsible for signing Jacque Waller's death certificate.

Waller's body was found Wednesday, prosecutors said.

Cape Girardeau County Coroner John Clifton said Tuesday he was not familiar enough with the area where the body was found to address persistent rumors that Waller's remains were discovered on Devil's Island near McClure, Ill., but he said an Illinois coroner was at the scene.

"I was over there, but so was the Alexander County coroner," Clifton said.

Clifton said the two coroners are trying to sort out which of them has jurisdiction over the body.

JACKSON, MO (KFVS) - The Circuit Court of Cape Girardeau County, Mo. Division II has issued the following order regarding security for the Clay Waller hearing.

This cause is set for hearing on Thursday, June 6 at 1:30 p.m. in Jackson, Mo.

The following procedures will be implemented:

1. No phones, computers, cameras or electronic devices will be allowed in the courtroom with the exception of one television camera and one still camera providing pool coverage as arranged with the Circuit Court Media Coordinator.

2. The bailiffs will not store phones, computers, cameras or electronic devices.

3. No cameras will be allowed in the courthouse or on the courthouse grounds.

4. No signs, buttons, t-shirts, hats or any other materials advocating any outcome in this case or any other cause will be allowed in the courtroom or on the courthouse grounds.

5. All persons will be scanned and/or searched prior to entering the courtroom.

6. A fixed number of seats will be available for the victim’s family, for the Defendant’s family, for law enforcement, for counsels’ office personnel, and for the press. The remaining seats, if any, will be available to the general public on a first come, first served basis. All seats will be assigned. No standing will be allowed.

7. The courtroom doors will be secured at the start of the hearing and will remain secured until the Defendant has exited the building.

Funeral arrangements set for Jacque Waller (Video)

KFVS) - Funeral arrangements have been set for Jacque Waller.

Visitation is set for Saturday at 9 a.m. at Esther Baptist Church in Park Hills, the funeral will begin at 1 p.m.

According to Jacque's parents, the services could not be held at the family's home church in Leadington due to the small size of the location.

In lieu of flowers, donations can be made to the Jacque Waller Children's Fund at any U.S. Bank or you can call your local domestic violence shelter in Jacque's name.

CAPE GIRARDEAU COUNTY, Mo. (KSDK) - On Thursday, Clay Waller pleaded guilty to second-degree murder. He was sentenced to 20 years in prison.

A press conference was held at 3:30 p.m. to praise law enforcement, prosecutors, and the family. Sheriff John Jordan with the Cape Girardeau County Sheriff's Office called Thursday a "bittersweet ending." Sweet because Clay Waller had to admit to being a murderer in public, and sweet because the family now has Jacque back and can honor her with a proper burial.

Sheriff Jordan went on to say it is bitter because Clay Waller's punishment does not fit his crime. He was sentenced to 20 years in prison, while Jacque was sentenced to death, and her family was sentenced to life without Jacque.

Hundreds Attend Funeral For Jacque Waller

PARK HILLS, Mo. (AP) - Funeral Services have been held for a 39-year-old Missouri mom of triplets who was missing nearly two years before her body was found last week.

The Southeast Missourian reports that hundreds turned out Saturday to attend services in Park Hills for Jacque Waller, who had been missing since June 1, 2011. Her body was recovered May 29 after her husband, Clay Waller, led authorities to her remains as part of a plea deal.

Clay Waller pleaded guilty Thursday to second-degree murder in her death and was given a 20-year prison sentence.

JACKSON, MO (KTVI) – Clay Waller entered a guilty plea on Thursday to 2nd degree murder in the death of his estranged wife, Jacque Waller. The plea agreement came with a 20 year sentence.

Jacque Waller’s family did not feel the 20 year sentence was long enough but they accepted it because the deal allowed them to find Jacque`s body. Clay Waller agreed to tell authorities where he buried his wife in exchange for the sentence.

When Clay Waller entered the courthouse, he was handcuffed and chained at the ankles. He rarely raised his head and kept it bowed forward during most of his appearance.
