Clay Waller will change his plea to federal charges of making an Internet threat next week, according to court documents made public Tuesday.
Earlier this month, Waller pleaded not guilty to threatening his sister-in-law on an online message board. Waller filed a motion Tuesday to change his plea Oct. 3, when his federal trial is supposed to begin.
Waller's attorney Scott Tilsen and federal prosecutor Larry Ferrell declined to comment on the plea change.

The state anticipates filing a murder charge against Clay Waller in connection to the disappearance of his wife Jacque Waller and will try to preserve testimony from Clay Waller's father that alleges he killed her, according to court documents.
Cape Girardeau Prosecuting Attorney Morley Swingle submitted an application Sept. 22 to preserve testimony from Clay Waller's father, James Clay Waller, Sr., that alleges Clay Waller confessed to killing his wife. A hearing before Cape Girardeau Circuit Judge Benjamin Lewis Oct. 14 will decide if the testimony will be admissible in court.

JACKSON, MO (KFVS) - The Cape Girardeau County prosecuting attorney's office anticipates filing a murder charges against Clay Waller, according to a court document.
Cape Girardeau County Prosecutor Morley Swingle filed an application to obtain a video deposition to preserve Clay Waller's father's testimony.
Jacque Waller, Clay Waller's estranged wife, has been missing since June 1.
Clay Waller remains in federal custody. The investigation is not yet concluded, and the body of Jacque Sue Waller has not yet been found.

Jacque Waller has been missing since June 1, and prosecutors have named her estranged husband Clay Waller as a suspect. Authorities say Clay Waller was the last person to see Jacque Waller before she disappeared from the Jackson home where Clay Waller was staying.

Jacque Waller has now been missing for four months. But that hasn't deterred searchers from combing hundreds more acres, or supporters of her family from gathering and continuing to pray.
Bobby Sherrill led a 25-person team from the CUE Center for Missing Persons and a few community volunteers on another search of approximately 200 acres from 8:30 a.m. to 6:30 p.m. Saturday in four locations near the Jackson city limits. The places searched were determined by law enforcement to be of areas interest. Sherrill, from Jackson, is a childhood friend of Jacque Waller.

Husband of missing Mo. mom admits threat to in-law
AP) CAPE GIRARDEAU, Mo. — A southeast Missouri man suspected in the disappearance of his wife four months ago could pleaded guilty Monday to threatening the relative who now has custody of his 5-year-old triplets.
Clay Waller, 41, pleaded guilty in U.S. District Court in Cape Girardeau to threatening his wife's sister over the Internet. He could face up to five years in prison at sentencing on Dec. 19.
Waller is a suspect in the disappearance of Jacque Waller, who was last seen at her estranged husband's home in Jackson, Mo., on June 1. Although relatives fear the 39-year-old mother is dead, police continue to search for clues in her disappearance. Clay Waller has not been charged in that case.

Clay Waller struggled to speak while he stood in front of U.S. District Judge Steven Limbaugh Jr. in Cape Girardeau on Monday afternoon. He paused before answering almost every one of Limbaugh's questions with one word answers.
When Limbaugh asked Waller if he understood the Internet threatening charges against him, his answer was more than one word.
"I understand," Waller told Limbaugh. "I sent the email. I did it."
Waller pleaded guilty Monday in federal court to a charge of making an Internet threat against his missing wife's sister.

"The kids say things like, 'Where is our mommy?' and, 'Mommy should be coming home,'" Stan Rawson, 68, said. "But they're coming to the conclusion that mom must be dead because she loved them so much she'd be here with them if she could."

The attorney who is representing Clay Waller in his state theft and harassment case will also represent him in an investigation that may lead to a murder charge.
Scott Reynolds originally wrote in a motion to quash Cape Girardeau Prosecuting Attorney Morley Swingle's application to preserve Waller's father's testimony that he technically does not represent Waller in the investigation. Reynolds confirmed on Monday that he will represent Waller throughout the investigation.

A new judge will preside over the hearing that will determine whether testimony from Clay Waller's father can be preserved as evidence.
Cape Girardeau Circuit Court Judge William Syler will replace Judge Benjamin Lewis in the Nov. 18 hearing after Waller's attorney, Scott Reynolds, filed a motion for a change of judge Thursday. Lewis sustained the motion the same day, according to court documents.

Although there is no Missouri precedent that deals directly with the preservation of testimony before formal criminal charges, the testimony of Clay Waller's father should be preserved, Cape Girardeau County Prosecuting Attorney Morley Swingle wrote in a brief filed Tuesday.
Swingle lays out the legality of preserving the elder Waller's testimony in a 10-page brief that cites Missouri Supreme Court rules and other legal literature. In the document, Swingle acknowledges there is no direct precedent in Missouri history but cites cases from other states to prove his point.

CAPE GIRARDEAU, MO (KFVS) - Cape Girardeau County Prosecuting Attorney Morley Swingle filed a motion this week asking the trial court to overrule a motion made by Clay Waller's attorney Scott Reynold's to quash the state's application to get a deposition from Waller's father.
According to court documents filed October 25, Swingle wrote there is nothing in the Missouri Constitution or Supreme Court rules or statues which prohibit the taking of a deposition prior to the formal filing of charges, and given the unique facts and circumstances of this matter, the interests of justice support the taking of said deposition.
According to Swingle, James Clay Waller, II is the primary suspect in the murder of his wife Jacque Waller. The mother of three has been missing since June 1, 2011.

JACKSON, MO (KFVS) - It's been five months since Jacque Waller disappeared, and family and police say they will continue to search.
"We'll find her, I'm 100 percent confident," said Robert Sherrill, who grew up with Jacque Waller and is dedicated to finding her. "We won't stop 'till we do."
Sherrill admitted the possibility of finding Jacque alive doesn't look good, but said he won't stop searching.
"She's missing, presumed dead," Sherill said. "I'm pretty sure she is, not that far away, and that bothers me."

Jackson police, firefighters, Cape Girardeau County sheriff's deputies and FBI personnel canvassed the area where Jacque Waller's car was found for items associated with her disappearance Thursday afternoon.
Investigators were canvassing an area along Interstate 55 near the 104 mile marker looking for items that may be evidence in the case. Jackson police chief James Humphreys said the area is being canvassed again because it was mowed after the warm-weather season when grass was tall. The area had been searched after the disappearance, but this was the first opportunity police had to look over the area after the recent mowing, Humphreys said. Humphreys said he was unsure when the area was mowed.

JACKSON, MO (KFVS) - Investigators plan to be out again Friday morning just south of the Fruitland exit to search for more clues in the disappearance of Jacque Waller.
One officer was standing guard at the scene late Thursday. Much of the area was lit up and a portion of one lane of I-55 was closed to traffic.

Clay WallerClay Waller's attorney would like a judge with little or no knowledge of the Jacque Waller disappearance investigation to preside over an upcoming hearing connected to the case.
The hearing will determine whether his client's father's testimony will be preserved -- testimony that alleged says Clay Waller confessed to murdering his estranged wife and burying her body.
Scott Reynolds filed a motion Tuesday that requests a judge from outside the KFVS viewing area preside over the Nov. 18 hearing. "Overwhelming" publicity from the continuing coverage in newspapers and on television, radio and the Internet could cause the appearance of impropriety in Cape Girardeau County Circuit Court Judge William Syler's ruling, Reynolds wrote.

Police continued their search for evidence Friday, Nov. 4, 2011 in the area where Jacque Waller's car was found along the southbound lanes of Interstate 55 near the 104 mile marker.

Investigators found Jacque Waller's purse and some of its contents during a search for evidence linked to her disappearance alongside southbound Interstate 55 Thursday and Friday, Waller's father confirmed Friday.
Stan Rawson said authorities informed him of finding his daughter's personal belongings, as well as her tattered purse, which had apparently been shredded by lawn mowing equipment.
"It was all chopped up," Rawson said of Waller's purse.

Cape Girardeau Circuit Judge William Syler denied Friday the state's motion that would have preserved the testimony of Clay Waller's father, which alleges Clay Waller confessed to killing and burying his estranged wife.
Syler denied the motion because of the ambiguity surrounding pending cases in Missouri Supreme Court laws. Per Missouri Supreme Court Rule 25, "a deposition cannot be taken until after the filing of a criminal information or indictment." The law does not mention pending cases, which Cape Girardeau County Prosecuting Attorney Morley Swingle had interpreted in court briefs to be the anticipation of a criminal charge. Because no charges have been filed against Clay Waller in connection to the disappearance of his wife, Jacque Waller, any case against him is not pending, Syler said.

CAPE GIRARDEAU COUNTY, MO (KFVS) - On the six-month anniversary of a southeast Missouri mom's disappearance, authorities make plans to head back out in force to search for evidence in her case.
Jacque Waller, a 39-year-old mother of three, went missing on June 1.
Authorities say she was last seen by her estranged husband Clay Waller at the Jackson home where he was staying at the time.

FRUITLAND, MO (KFVS) - Search crews were up early Saturday to once again look for missing mother of three, Jacque Waller.
Saturday marked six months and two days since Waller disappeared. The Scott County Search and Rescue K-9 Team led another effort to find new clues.
Searchers combed through areas recommended by authorities heading up the investigation.
The search was spread out over several areas of interest including Highway Y and along the I-55 area by Saxony Lutheran School.

Officials involved in the Jacque Waller disappearance investigation no longer will have access to testimony that claims Clay Waller confessed to killing his wife.
James Clay Waller Sr., the only person Clay Waller allegedly confessed murdering Jacque Waller to, died Tuesday morning in a Cape Girardeau nursing home, Cape Girardeau County Coroner John Clifton confirmed Tuesday afternoon.
James Waller's death comes a month after Cape Girardeau Judge William Syler denied the preservation of his testimony that alleges Clay Waller confessed to murdering his estranged wife, Jacque Waller, who has been missing since June 1.

A federal judge sentenced Clay Waller to five years in a federal penitentiary Wednesday for Internet threatening charges. But first he told Waller that he was guilty of murdering his missing wife, Jacque Waller.
Clay Waller pleaded guilty Oct. 3 to threatening Cheryl Brennecke, his wife's sister and the guardian of his three children, on the Internet site Topix. After hearing emotional testimony from Brennceke and federal prosecutor Larry Ferrell's plea to significantly vary from the suggested 6- to 12-month sentence, Judge Stephen Limbaugh imposed the maximum sentence on Clay Waller, who has spent the last five months in federal custody.
"The court finds that based on preponderance, you did murder Jacque Waller," Limbaugh told Clay Waller shortly before sentencing him.

Clay Waller was sentenced to five years in prison for threatening his missing wife's sister on the website Topix.
Prosecutors convinced the judge to give Waller the maximum federal prison sentence for that charge by telling the judge that threat to Jacque Waller's sister was serious.
Judge Limbaugh in the end told the court that he believes Clay Waller killed his wife and is a dangerous man.
In October, Clay Waller pleaded guilty to threatening to kill his estranged wife's sister, Cheryl Brenneke on Topix.
Tuesday in court, Waller said, "I'm sorry for causing problems. I just miss my kids...that's it."

Clay Waller will remain in the Pemiscot County Jail for the time being. Once transferred to prison, he will be required to serve 85% of his sentence. He will also get credit for federal time served.

A timeline has been set for Clay Waller's appeal of his five-year federal sentence for his Internet threatening conviction.
Over the next month, the clerk at the federal courthouse in Cape Girardeau will turn over all pertinent files in the case, namely a transcript from the sentencing hearing and the presentence investigation report, to the Missouri Court of Appeals, Eastern District in St. Louis. Waller's attorney, Scott Tilsen, must submit a brief outlining why the sentence is legally erroneous by Feb. 7, according to court documents.

Last week a judge sentenced Clay Waller to the maximum sentence for threatening his sister-in-law Cheryl Brenneke on the website Topix. Cheryl has been carrying for her missing sister, Jacque’s, children since Jacque went missing. The judge, in deciding to give Clay the maximum sentence of 5 years in prison and 3 years of supervision along with a requirement to undergo domestic violence counseling. The judge also state…he believed Clay probably killed Jacque.

Waller pleaded guilty Oct. 3 to threatening Cheryl Brenneke, his sister-in-law and guardian of his three children. In sentencing Waller Jan. 3, federal judge Stephen Limbaugh differed greatly from federal guidelines that suggested a six- to 12-month sentence and gave him the maximum five year sentence.

Clay Waller's attorney filed an appeal for his federal sentence on Internet threatening charges Wednesday, but the details of the appeal weren't initially available to the public.
Waller was sentenced to five years in prison in January after he pleaded guilty in October to threatening Cheryl Brenneke, his sister-in-law and guardian of his three children, on an Internet message board in July. Brenneke's sister, Jacque Waller, has been missing since June 1, and Clay Waller is considered a suspect in her disappearance, although no charges have been filed against him.
