...With many other pretrial motions to be decided, prosecutors told Colbath they wouldn’t be ready for Goodman’s retrial until July 15.

A judge signed off yesterday on an agreement between prosecutors and defense attorneys in Wellington polo mogul John Goodman’s DUI manslaughter case that will allow Goodman’s lawyers to get information from the auction company that sold his Bentley.

...Now, according to Colbath’s order signed Tuesday, Goodman’s attorney will be able to ask the auction company for records from the day they picked up the car.

Goodman seeks trial delay because of blood appeal

Wellington polo club founder John Goodman wants his DUI manslaughter retrial — slated for jury selection in Tampa Oct. 6 — to be postponed while a state appellate court considers his challenge concerning blood evidence.

Attorneys for Goodman, 50, have asked Palm Beach County Chief Circuit Judge Jeffrey Colbath to delay the trial pending the outcome in the 4th District Court of Appeal.

...Goodman is appealing the state judge's July 30 rejection of Goodman's claim his blood test results were not scientifically reliable, mainly because the diameter of the needle used to draw his blood on Feb. 12, 2010 was too small.

The retrial of Wellington polo mogul John Goodman on a DUI manslaughter charge will be heard by a jury chosen outside Palm Beach County.

Judge Jeffrey Colbath decided last week that jurors will be chosen beginning Oct. 6 in either Tampa or Jacksonville.

Colbath says there's little chance of picking an impartial jury to hear the high-profile retrial.
 
The exact location of jury selection will be revealed Sept. 29.

I once asked a college instructor just how was an impartial jury found during the days of the "wild west"? Small towns and counties had limited population to draw from, many persons were related, they interacted with business/employment. He told me it was NOT unusual to have a jury that was RELATED to the accused any more than it was not unusual to have a jury member related to the JUDGE!!!

They took an oath to set aside their biases and opinions and to evaluate the case upon the merits of its presentation.... I have to wonder if that is something that can be done today or have we lost the intrinsic value of fairness?

"....WEST PALM BEACH, Fla. - Former polo mogul John Goodman was in court again Tuesday morning for a hearing.

Goodman was driving a Bentley that hit Scott Wilson's car in 2010. Wilson's vehicle went into a canal, causing him to drown.

His defense team on Tuesday asked Judge Jeffrey Colbath to suppress blood alcohol tests that were taken at the hospital after the fatal crash.

The defense claims that following the wreck, the nurse who collected Goodman's blood used a very small needle typically used for infants instead of a larger needle that police use.

The trial is set to start in about two weeks. ...."

Sept. 23--It may be impossible to tell jurors that prosecutors released John Goodman's Bentley two years ago without also revealing to them that there was another trial in his DUI manslaughter case two years ago, the judge in the case said Tuesday.

...But Colbath, speaking to Goodman attorney Scott Richardson and prosecutor Alan Johnson, said Goodman's defense team would have to rethink their strategy of castigating prosecutors for releasing the car. Such a move, Colbath said, could allow him to rule that prosecutors could defend themselves against the allegations by bringing up the fact that jurors had already convicted Goodman at the time they allowed his insurance company to reclaim the Bentley.

Judge orders jury selection to Tampa

WEST PALM BEACH, Fla. —Making official what he has hinted at for weeks, Judge Jeffrey Colbath Monday morning signed an order saying jury selection for John Goodman's retrial will occur in Tampa on October 6th.

Colbath denied a defense motion to hold the entire trial there.

...Colbath has not ruled on whether he will allow the blood sample to be included or which experts can testify about the sampling methods and possible flaws.

Goodman appears to be more concerned with the aspect of DUI (and punishment of that) than the death of Scott Wilson.

Here we go again. Take Two for John Goodman's DUI manslaughter trial. This time we get a traveling circus to start, with a road trip to Tampa to select jurors next week. (I hear the wine cellar at Bern's Steak House is top notch; here's hoping Goodman has his chauffeur on duty). Then the circus returns to West Palm Beach for the trial, with the imported jurors sequestered in a hotel.

Goodman, a polo mogul and air conditioning heir from Wellington, got his March 2012 conviction — and 16-year sentence — tossed because of the actions of a renegade juror. In golf, they call this a mulligan. I don't know what they call it in polo. All I know is this whole long-running saga makes me want to up-chukka.

I have to add "allegedly" again to all the things that were proven beyond a reasonable doubt at the first trial.

So now we have to say, "After a night of allegedly drinking tequila and vodka in February 2010, Goodman allegedly blew through a stop sign going as fast as 63 mph. His $250,000 Bentley allegedly plowed into Wilson's Hyundai, which landed in a canal. Wilson drowned as Goodman allegedly left the scene on foot. When Goodman found a phone in a nearby trailer an hour later, the first call he allegedly made was to his girlfriend in Atlanta, not 911."

A last-minute hearing has been scheduled for this afternoon just days ahead of what is supposed to be the start of Wellington polo mogul John Goodman’s second DUI manslaughter trial.

The 1:30 pm.m. hearing will likely be about an issue surrounding Goodman’s request for Chief Circuit Judge Jeffrey Colbath to throw out test results from blood a nurse drew from Goodman on the night of the 2010 crash that killed Scott Patrick Wilson.

Judge denies John Goodman's request to delay trial
Defense motion comes just before jury selection set for Monday

WEST PALM BEACH, Fla. —The John Goodman retrial will start Monday in Tampa, despite a last minute evidence discovery that had the defense filing for a delay.

Defense attorney Douglas Duncan told Judge Jeffrey Colbath he got a call from prosecutors Thursday night alerting him that a key point in the defense was in jeopardy.

Prosecutors said while preparing for trial they reviewed a emergency room nurse’s deposition and realized she had said she wasn’t sure the needle she used to draw Goodman’s blood was a 25-gauge needle or not.

...Colbath denied the motion to continue, saying both sides had ample opportunity to research the nurse's testimony about the needle size.

In another ruling, he also denied the defense's bid to exclude the blood alcohol reading altogether, saying there was no evidence that it was flawed and not done by state rules.

Jury selection begins Monday morning in Tampa, and after a probable three days picking the nine-person jury, the trial will begin in Palm Beach County.

The 6 jurors and 4 alternates will be transported to West Palm Beach, FL and
sequestered for the retrial of John Goodman.
