RALEIGH — Jason Young, the medical software salesman accused of killing his pregnant wife inside their Wake County home eight years ago, has been through two protracted trials already.

On Tuesday, the N.C. Court of Appeals vacated the 2012 guilty verdict from the second trial and ordered a third trial.

The reason?

A three-judge panel ruled that evidence presented from two civil proceedings against Young had severely influenced his ability to get a fair trial.

Young, seven days shy of his 40th birthday, is incarcerated in Alexander Correctional Institution in Taylorsville, serving the life sentence he received in March 2012.

The N.C. Attorney General’s office has weeks to decide whether to ask the N.C. Supreme Court to review the appeals court ruling – 58 pages that provide a summary of the trial evidence and address arguments posed before three appellate judges in a December 2013 hearing.

Third trial ordered for N.C. man in wife's 2006 killing

RALEIGH, N.C. - The North Carolina Court of Appeals on Tuesday ordered a third trial for a man convicted of murdering his pregnant wife in their Raleigh home seven years ago, saying a judge should not have allowed evidence about a wrongful death lawsuit, reports CBS affiliate WRAL.

Jason Young, 39, is serving life in prison for first-degree murder in the Nov. 3, 2006 beating death of his wife, Michelle Young, who was five months pregnant when her sister found her body in a pool of blood in the Youngs' bedroom.

He originally went to trial in 2011, but Superior Court Judge Donald Stephens declared a mistrial after a jury deadlocked on a verdict. Prosecutors won a conviction on March 5, 2012, during a seven-week retrial.

Jason Young's appeal focused on several decisions Stephens made during the second trial, including allowing testimony about the judgment in a wrongful death case brought by Michelle Young's mother, reports WRAL.

Court orders new trial for NC man in wife's death

RALEIGH, N.C. A Raleigh man convicted of killing his pregnant wife may get a third trial after the state Court of Appeals ruled Tuesday that a judge shouldn't have allowed evidence about a wrongful death lawsuit and a custody challenge for his daughter.

At a hearing before the Court of Appeals in December, Young's attorney argued that state law prohibited the introduction of evidence about the wrongful death and custody civil proceedings to which Young never responded.

Stephens, who presided over the civil and criminal proceedings, had declared Young responsible for his wife's death after he failed to respond to a civil claim in 2008 — a default judgment that does not declare innocence or guilt.

Prosecutors then introduced information about those cases at the criminal trial.

"If this type of evidence is admitted, for what will apparently be the first time in the country in a homicide prosecution, I think it's simply going to open the door to the pursuit of civil litigation before indictment in order to manufacture evidence for a criminal trial," Blackman argued in December at the appeals court hearing.

RALEIGH – Some seven years after the murder took place, Jason Young will once again go on trial for the crime of allegedly brutally killing his pregnant wife Michelle Young in their home in 2006. The upcoming case will be Jason Young’s third trial on those charges. The third trial was just ordered by the North Carolina Court of Appeals yesterday, on Tuesday, April 1st.

The first murder trial in 2011 resulted in a hung jury, with eight jurors wanting to acquit him and four wanting to convict him. The second trial in 2012 resulted in a guilty verdict and the 39 year old Jason Young has been in prison since then.

In a long, drawn out case that has drawn nationwide attention, Jason Young is accused of brutally beating to death his wife Michelle Young on November 2, 2006. Although he claimed he was in a motel room in Virginia, prosecutors said that the motel stay was a ruse and that Young made an overnight trip back to his house in Wake County to brutally beat and murder his wife.

NC Supreme Court OK to take Jason Young trial

RALEIGH, N.C. -North Carolina's highest court has agreed to consider whether a Raleigh man convicted by jurors of killing his pregnant wife in 2006 should get a new trial that a lower court ordered in April.

The state Supreme Court announced Wednesday it had granted the request by state attorneys for justices to review the case of Jason Lynn Young.

North Carolina Supreme Court justices had lots of questions Tuesday for attorneys arguing for and against a third trial for Jason Young, the medical software salesman convicted of killing his pregnant wife.

At issue was whether prosecutors went too far when they introduced evidence about rulings in civil proceedings for which Young did not participate.

NC Supreme Court denies Jason Young new trial

RALEIGH, N.C. (WNCN) – The North Carolina Supreme Court on Friday overruled a Court of Appeals decision that Jason Young, convicted of murdering his wife in their Raleigh home, should get a new trial.

...However, Young’s attorneys appealed. They argued that two pieces of evidence should not have been admitted, one that Jason Young had not defended himself in a civil case and also that he had given up custody of their young daughter to Meredith Fisher, the sister of Michelle Young.

The Court of Appeals  agreed on April 1, 2014. But on Friday, the Supreme Court issued a thunderous rebuttal, saying the Court of Appeals erred in those decisions. The Supreme Court sent the matter back to the Court of Appeals.

“We now reverse the Court of Appeals’ decision and remand this case to the Court of Appeals for consideration of defendant’s remaining challenges to the trial court’s judgment,” the Supreme Court wrote.

The decision this week adds another twist in a murder case that has been to a jury twice, seen the conviction vacated by the N.C. Court of Appeals and the order for a new trial halted by the N.C. Supreme Court.  End
