Defense lawyers urged jurors to be cautious in evaluating DNA evidence linking their client, Jesse Matthew, to a brutal attack in 2005 on a woman in Fairfax.
Matthew's trial in the Fairfax case began Monday. He also is charged with the abduction and death last year of University of Virginia student Hannah Graham.
During opening statements, prosecutor Ray Morrogh said a struggle between Matthew and the victim produced the DNA evidence that links Matthew to the crime.
But public defender Robert Frank warned jurors that DNA sometimes is transferred from one person to another inadvertently.

FAIRFAX, Va. — Jesse Matthew’s attempted capital murder and sexual assault trial will move forward Monday in Fairfax.
Fairfax County Circuit Court Judge David Schell denied a defense motion to continue the June 8 trial.
For the first time in 10 years, the alleged victim in the September 24, 2005 sexual assault, known as “RG,” was in the presence of her alleged attacker when she took the stand to testify.
The defense called her in a motion to suppress any court identification of Matthew. Judge Schell denied that motion.
RG was asked several questions by the defense about her conversations with the state over the past 10 years, and most recently after Matthew was arrested and charged with the murder of University of Virginia second year, Hannah Graham.
DNA connects Matthew to the 2005 attack in Fairfax, Hannah Graham’s 2014 case, and Virginia Tech student Morgan Harrington when she disappeared in 2009 night from UVa’s John Paul Jones Arena and was later found murdered.
RG testified that the state informed her of Matthew’s arrest and the media interest in the case, but never showed her pictures of Matthew. RG stated out of her own “curiosity,” she searched Matthew’s photo online in October. She noted that his hair had changed, but his face was the same.
RG was not present at the start of Thursday’s 3 p.m. hearings. She arrived in Fairfax from India at 1 p.m. with her small children and was sleeping at a hotel when the judge ordered the prosecution to pick her up to testify. The prosecution had to awaken her and transport her to court, despite a request from Fairfax County Commonwealth’s Attorney Ray Morrogh to continue the hearing Friday to allow her to rest and take care of her children...

A jury was chosen on Monday for the rape trial of a Virginia man also charged with the high-profile murder of college student Hannah Graham.
Jesse Matthew Jr., 33, of Charlottesville, is charged with attacking a woman in Fairfax, a Washington suburb, in 2005.
A jury of seven men and seven women, including two alternates, was chosen in Fairfax County Circuit Court after nearly three hours of selection. Opening arguments could take place later on Monday.
Matthew, a former hospital worker, appeared wearing a dreadlocked ponytail, beige dress shirt and slacks. He is accused of grabbing a 26-year-old woman walking home from a grocery store, dragging her into nearby woods and sexually assaulting her.

RG says her attacker was straddling her during the attack. She says she doesn't remember when her attacker moved off of her.
RG tells defense one of her shoes came off during the struggle with Matthew.
RG says her attacker told her to let him sexually assault her. If she didn't, her attacker said he would kill her.

Nurse talking about the PERK, Personal Evidence Recovery Kit, in this case. Includes swabs, samples
Nurse collected pubic hair, DNA, swabs, smears, fingernail clippings, fingernail scrapings, clothing from RG
NURSE: Fingernail scrapings means you scrape underneath the nail. Also clipped RG's nails and put into evidence bags.
Nurse is putting on gloves right now. She is opening the kit and will identify the contents for the jurors, courtroom.

Witness says he found right Reebok shoe and cell phone along with a pair of glasses near the crime scene. He also found a pair of underwear
The glasses did not have any lenses in them. Red stains were found, along w white fiber. Items were collected/transported to @fairfaxpolice

The alleged victim in the Fairfax case was flown back from India to testify against him. The woman, emotional during her testimony, says he picked her up, took her to the bushes, slammed her head against the ground, before the assault, according to WRIC. A bystander reportedly intervened leading to her escape. She answered questions from prosecutors and the defense.

On Monday, the jury was seated, heard opening arguments from both sides and then heard testimony from the victim of the alleged attack.
In her testimony, the victim described in detail what happened to her on the night in question.
The jury also heard testimony from the man who helped the victim, including describing her condition when he found her.

FAIRFAX, Va. (WJLA) - Mark Castro said he did what anyone else would have done. But what he did nearly 10 years ago may have saved a life according to authorities.
Castro testified in court Monday, June 8 in the Jesse Matthew criminal case. Tuesday he talked publicly for the first time to ABC7 News about what happened a decade ago.
Authorities allege Matthew sexually assaulted and savagely beat a young woman in a wooded area near a Fairfax City townhouse complex back in 2005. Castro said he was a passer-by visiting a friend in that complex that night. He said when he got out of his car to park he heard something disturbing.
Castro said, “I heard someone faintly screaming out help. And when I went to look at them and talk to them this lady, this girl, she was screaming at the top of her voice but hardly anything was coming out.”
The woman was standing up but could barely move, Castro said, she was covered in mud and blood.

FAIRFAX, Va. (WJLA) - Mark Castro said he did what anyone else would have done. But what he did nearly 10 years ago may have saved a life according to authorities.
Castro testified in court Monday, June 8 in the Jesse Matthew criminal case. Tuesday he talked publicly for the first time to ABC7 News about what happened a decade ago.
Authorities allege Matthew sexually assaulted and savagely beat a young woman in a wooded area near a Fairfax City townhouse complex back in 2005. Castro said he was a passer-by visiting a friend in that complex that night. He said when he got out of his car to park he heard something disturbing.
