On Tuesday, even as authorities announced the arrest of a 21-year-old suspect on suspicion of murder, Marlene LaMar vowed not to stop looking for her daughter.
"Her body hasn't been found," Marlene LaMar said at a news conference, her voice breaking. "I believe there was a reason she wasn't found. We're not giving up on that."
But Santa Clara County Sheriff Laurie Smith said there was "direct and circumstantial" evidence that led investigators to believe that Antolin Garcia-Torres, 21, kidnapped and killed the Morgan Hill girl, who disappeared in March on her way to school.
Investigators think Garcia-Torres, a Morgan Hill resident, picked Sierra at random.
"We believe this is the worst kind of crime: a stranger abduction of a young girl," Smith said at Sheriff's Department headquarters in San Jose.
Investigators found the teenager's cellphone March 17, the day after she was last seen walking to her bus stop. The next day, they found a Juicy bag with her clothes folded neatly inside.
DNA was found on the items in the bag, Smith said. After receiving lab results March 28, Smith said, investigators identified Garcia-Torres — already in the system for a previous arrest — as their suspect and began around-the-clock surveillance.
"We needed additional information," Smith said. "We were hoping he would lead us to where Sierra was."
Smith did not elaborate on why detectives made the arrest Monday night at a Morgan Hill Safeway grocery store except to say that "public safety was our primary concern."
"Even though we had been surveilling him, surveillance is not perfect," she said. "We wanted to make sure this did not happen again."
After officials recovered Garcia-Torres' red Volkswagen Jetta, they found additional evidence linking him to Sierra, Smith said. She declined to elaborate on the evidence but said it did not include blood.
The DNA also connected Garcia-Torres to a March 2009 assault in Morgan Hill, Smith said. She did not disclose the specifics of that incident.

Garcia-Torres, who was previously convicted on a misdemeanor charge of interfering with a police officer, was also arrested but not prosecuted in connection with a felony assault. Smith said that the assault was not sexual, but that the arrest resulted in Garcia-Torres' inclusion in the DNA database used to identify him as a suspect.
Garcia-Torres' sister told the San Jose Mercury News, "It's not him."
"I honestly feel they don't have enough evidence to convict him," 26-year-old Lucero Garcia said.
Garcia said her brother is married with a young daughter. His wife is three months pregnant.
"It feels like we're in a movie right now," she said. "An unfair movie."
Several details are still not known about Sierra's disappearance, Smith said, including where her body is, how she was killed or when.
Other suspects were identified and watched during the investigation, Smith said, but detectives believe Garcia-Torres acted alone.
Although neither a weapon nor a body has been found, Smith said, investigators have "strong facts" indicating that Sierra was murdered.
"These are very, very difficult cases to prosecute, a homicide when you have not found a victim," she said. "But it has been done."
Marlene LaMar begged her daughter's suspected killer to "say where she is."
"Please, please give the information that you have to lead us to Sierra to help end this nightmare," she said.
The highlighted sentences for me say the whole story... she did not say my brother did not do this... just that they did not believe there was
enough evidence to convict... the family knows something IMO.

Here is a statement by Alondra Garcia. IMO she uses the word "YET" review her statement and tell me what you guys think.
Alondra Garcia: I don't think he's capable at all of doing something like that.
I don't really see him as that violent - you know, like- he's pretty mellow. So, he's not like a violent guy at all. He's a good guy. He's social. He likes- he likes fishing, he likes doing outdoor things, he's with his family a lot- you know, he's a hard worker. He works a lot, too. I don't think they have enough proof yet. Like, substantial proof. I think he's innocent, you know. What I have in my mind is innocent until proven guilty- but like, full- you know, full proven, you know?

MONTEREY, Calif. —The man accused of killing Morgan Hill teen Sierra Lamar has again failed to enter a plea during a court appearance Thursday.
Antolin Garcia Torres is charged with the kidnapping and murder of Lamar in March 2012. A legal analyst said defense attorneys likely won't enter a plea until they've received all the evidence from prosecutors.
On Thursday, attorneys told a judge they haven't received all the evidence. The defense also said since they don't have all the evidence this could be a missing person's case not a murder investigation.
"This was the first time that we’ve seen the defense come out and start to give us a signal as to where they’re going in this case, at least preliminarily,” said legal analyst Steven Clark. “And until Sierra’s body’s found, they’re going to pursue this avenue of defense.”

I am hoping that on November 15th AGT's next court date that a plea will be entered. I still find it strange that the man would rather sit in Jail than enter a plea and take his chances.. if they don't think there is enough evidence to prove she isn't alive then plead not guilty and hope for the best. There has to be some other reason they are waiting!! JMO

Antolin Garcia Torres, 22 of Morgan Hill, appeared at the hearing at the Hall of Justice in San Jose. He was handcuffed and wearing County Jail inmate scrubs - a contrast to recent previous hearings where he wore a brown suit and tie.

Garcia Torres’ attorney Friday told Superior Court Judge Sharon Chatman that a spreadsheet listing items of evidence, provided by prosecutors and requested at Garcia Torres’ last hearing in October, was “inadequate.” The list only indicated evidence provided by the Santa Clara County District Attorney’s Office so far, while Garcia Torres’ attorney Al Lopez was under the impression the spreadsheet would include a list of items that are “going to come our way.”
Santa Clara County Deputy DA David Boyd was consequently perturbed that the defense waited until Thursday’s hearing to let him know their view on the completeness of the list of evidence.

how is it possible that this is dragging out with AGT not pleading... lets move on!! maybe he has some twisted belief that he can not say he is not guilty if he is and he doesn't want to admit it... twisted morality of sorts. let him rot and run the trial in absentia!

New Lead in Sierra Lamar Case Sends Divers Searching South Bay Lake

A Santa Clara County Sheriff's Office dive team returned to a South Bay lake Thursday, combing the waters for evidence in the case of Sierra Lamar, the 15-year-old girl who vanished while on her way to school two years ago.
NBC News spotted the divers supposedly training at the lake, but sources close to the investigation later told the news station that the divers were actually there looking for evidence in that murder case after potentially new leads had surfaced. They were reportedly equipped with new powerful sonar that allows them to better locate bodies in murky waters.
NBC News wouldn't reveal the location of the lake so as to not hurt the investigation. The same undisclosed sources also told the news station that this was the second time divers had gone out to this particular lake, which they described as a "high interest" to investigators.

On March 16, 2012, Sierra LaMar never caught her morning bus ride to school. Her cellphone and handbag with clothes folded inside were found on March 17 and 18 on the side of a road two miles from her house
SAN JOSE, Calif. —Nearly two years after Antolin Garcia-Torres was arrested and charged with kidnapping and murdering Morgan Hill teenager Sierra Lamar, he finally entered a plea Thursday: Not guilty.
The defense team of 23-year-old Antolin Garcia-Torres entered the plea for him in a San Jose courtroom.

SAN JOSE, Calif. – Prosecutors are seeking the death penalty against a man charged with kidnapping and killing a 15-year-old Northern California girl whose body has not been found, the District Attorney's Office said on Monday.
Santa Clara County District Attorney Jeff Rosen said he made the decision to seek capital punishment against Antolin Garcia-Torres in the 2012 disappearance of Sierra LaMar after a "comprehensive review" by a committee of senior prosecutors.
"I have concluded that this defendant should face the ultimate penalty," Rosen said. He said he would not be making any additional comments to ensure that Garcia-Torres receives a fair trial.

Sorry, I am so far behind can anyone tell me what happened during the September hearing… after unsealing the Grand Jury record… reading that it was hair on a rope that was found makes the earlier question we all had about what was found in the car make much more sense.. I wish that they would find her.

AGT finally pled...not guilty. Awaiting trial. Both attorneys are preparing for the capital case. I expect the trial will begin early next year. Nothing more on the hair on the rope or any other evidence.

I still can not comprehend why someone would sit in custody all that time and not plead… unless they are planning a huge lawsuit for being in custody for so long without a trial… but can't see that working.. or maybe it was his way of not going back to visit the crime scene (didn't trust himself not to go) … or showing a partner that he is loyal and not saying anything… alright so my mind has raced trying to figure out why someone would sit that long..

The first deputy who responded to the March 16 missing person's report on Sierra knew immediately she was not a runaway, Smith said. But Sierra was not taken off the missing person's list until 10 days after her disappearance.
Two days after she was reported missing, Sierra's bag and some clothing were found.
"It was that clothing that was really instrumental in identifying the suspect," Smith said.
Smith said from March 28 on, Garcia Torres was under 24-hour surveillance, hoping they would find Sierra.

Morgan Hill: Missing girl's cell phone found three-quarters of a mile from her home
"...A Morgan Hill teen girl who was last seen Friday morning before heading to school remains missing, according to the Santa Clara County Sheriff's Office.
The Santa Clara County Sheriff's Office, which led the weekend search efforts for 15-year-old Sierra Lamar, on Monday morning confirmed the girl's cell found was discovered Saturday shortly before 7 p.m. about three-quarters of a mile from her house at Dougherty and Palm avenues, according to Sgt. Jose Cardoza.
Sierra's phone was located at the northeast corner of Scheller Avenue and Santa Teresa Boulevard. Investigators are examining the cell phone and Sierra's computer. "...A Morgan Hill teen girl who was last seen Friday morning before heading to school remains missing, according to the Santa Clara County Sheriff's Office.
The Santa Clara County Sheriff's Office, which led the weekend search efforts for 15-year-old Sierra Lamar, on Monday morning confirmed the girl's cell found was discovered Saturday shortly before 7 p.m. about three-quarters of a mile from her house at Dougherty and Palm avenues, according to Sgt. Jose Cardoza.
Sierra's phone was located at the northeast corner of Scheller Avenue and Santa Teresa Boulevard. Investigators are examining the cell phone and Sierra's computer. They are also interviewing students at Sobrato High School and Fremont's Washington High School, where Sierra attended before transferring to Sobrato last fall...."

Human Remains Found in Gilroy Not Sierra LaMar: Sheriff's Office
"...The prosecutor in the Sierra Lamar murder case spent Thursday afternoon in Gilroy, looking at the remains of a body found in the outskirts of town the day before.
Santa Clara County Sheriff's Office authorities said the remains were not those of LaMar, who was murdered in 2012 and whose body has yet to be found. Sgt. James Jensen said dental work found on the teeth of the remains had gold caps.

FINALLY ~ The date for the trial has been set for: April 25, 2016. These trials should not be allowed to drag on and on, when there is enough evidence to convict.
It is costly, and extremely emotionally painful for the family of Sierra La Mar. I feel so sad for them.

Snip Garcia-Torres' lawyers filed a motion in court Thursday, requesting the profiles of the other 11 people who also were hits in the DNA database. If the defense attorneys get their wish, Clark said the trial will likely not start next month, as scheduled. End Snip

Attorneys representing the suspect in the Sierra LaMar murder trial will now be getting access to a potential key piece of evidence: DNA analysis.
The lawyers for Antolin Garcia-Torres filed a motion last week to obtain the evidence. A crime lab previously tested the DNA on LaMar's pants and received a hit on 12 profiles, with one of those profiles being Garcia-Torres.
Lawyers representing Garcia-Torres escorted the suspect into court on Monday and announced the defense "went over both protective orders and came to an agreement" to gain access to the evidence.
The defense wants to know who the other 11 profiles from the lab test belong to.

Vid indicates a rope was found in trunk of his car that had hair belonging to her...
I was not aware a rope had been implicated in this crime... Wow. More evidence is coming to light.

Testimony in the trial for Sierra LaMar’s suspected killer continued this week, with more witnesses from the Santa Clara County Sheriff’s Office taking the stand to answer questions about the investigation that led to the arrest of Antolin Garcia Torres.
On Feb. 14, sheriff’s deputies and sergeants spent hours in court at the San Jose Hall of Justice offering details of their surveillance of Garcia Torres in the days after Sierra disappeared March 16, 2012. Santa Clara County Deputy District Attorney showed numerous video clips from a security camera outside Garcia Torres’ neighborhood, Maple Leaf RV Park in south Morgan Hill, from March 16 to March 18, 2012.
The videos showed Garcia Torres coming and going in his red Volkswagen Jetta, as well as arrivals and exits of his mother’s Toyota RAV4.
Garcia Torres went on a ski trip with a friend all day March 18, a Saturday, defense attorney Al Lopez said.
Other law enforcement officers testified about the GPS tracking device they attached to Garcia Torres’ vehicle shortly after he became a suspect in Sierra’s disappearance. Multiple agencies, including the FBI, assisted in the surveillance, which did not lead to the discovery of Sierra’s body.
