Oscar Pistorius' prosecutors said today they "have nothing to do" with a leaked video showing him reenacting the shooting of his girlfriend Reeva Steenkamp, indicating they do not intend to extend the trial to introduce the video as evidence.
Pistorius' attorney told the court today that they are about to bring their defense to a conclusion, but asked the judge for one more day.
"It is prima facie that we plan to close our case, but I'd like to request that we stand down until tomorrow so that I can consult and receive instructions from those around me," defense lawyer Barry Roux told the High Court in Pretoria.
Pistorius' lawyers asked to consult with a state appointed psychiatrist, one of a panel of three which assessed the athlete's mental state during a court ordered 30 day psychiatric evaluation, but Judge Thokozile Masipa turned down the request, prompting Roux to asks for the adjournment.

Oscar Pistorius once took every opportunity to downplay his disability.
In 2007, Pistorius told the New York Times that he refused to park in disabled bays. “I don’t see myself as disabled,” he told the journalist: a sentiment he also expressed elsewhere on numerous occasions. “There’s nothing I can’t do that able-bodied athletes can do.”
In an interview with the Telegraph in 2005, he posed the question: “Anyway, what is disabled?”

Rosemarie Garland-Thomson, professor of Women's Studies and English at Emory University, wrote in the aftermath of the Steenkamp shooting: “As a woman, mother of daughters, and feminist, I seethed with repugnance and outrage hearing that he'd shot Reeva Steenkamp four times, that he had a history of abusive incidents against women. As a person with a disability myself –in fact, a congenital limb reduction like Pistorius – I fear the links that may be made between disability and temperament.”
As it emerged, those links would be made not by callous commentators but by Pistorius’ own defence team.

Last week the president of the US-based National Organisation on Disability, Carol Glazer, was quoted as describing the use of disability in his murder defence as “exploitation”.

Does having a disability make Oscar Pistorius a law unto himself? Certainly not – and allowing it could be devastating to others with disabilities, too.
This week’s Oscar Pistorius trial - and tribulation - has prompted me to form an opinion on the matter of “vulnerability” and its benefits or curses.
Defence witness, physician Wayne Derman, is in my understanding suggesting that disability creates vulnerability and thus a softer approach to crime and reaction. He has established this, not from his interactions with many people with disabilities broadly, but rather his interaction with Oscar Pistorius.
If these statements and observations of Pistorius were accepted by the court, then one of my questions would be: Why is “vulnerability”, its effects and consequences, not dealt with in our formal rehabilitation programmes? Some 900 people per annum in South Africa become spinal cord injured, and this constituency of paraplegics and quadriplegics are far more limited in their agility speed, height and self-defence, yet we don't promote the brand of vulnerability. We are vulnerable in many ways, by our inaccessible environments and society’s attitude and misunderstanding of our lifestyle needs, attributes and abilities.
Another outcome would be that medical aid insurance companies would have to fund psychological and psychiatric support for “vulnerability”, as a prescribed minimum benefit.
Furthermore, would employers rebuke the Employment Equity Act requirements for fear of the safety of their staff as a result of our vulnerability and perceived risk in the workplace? Would reasonable accommodation for staff without disabilities be “bullet-proof” workstations? Will we be situated in isolated areas so we are no risk to colleagues? Will we still get jobs?

"We close the case for the defense," said Roux. Some witnesses did not want to testify for the defense because of publicity surrounding the case, he said, adding that he chose not to ask Judge Thokozile Masipa to compel them to appear.

What he did to Reeva was a horrendous selfish act.
Pity he won't come clean...
The fact he waited 8 minutes or so before calling for an ambulance, the fact he told security there was nothing wrong... and he spoke normally...
IMO, this was premeditated from a spoiled brat who had to have his whiney way. Reeva must have disagreed with him over some matter and OP wasn't going to have his control questioned.

Throughout the 39-day trial, which started on March 3, defence lawyer Barry Roux has portrayed Pistorius as a victim of crime who was in a loving relationship with Steenkamp.
The defence had planned to have other witnesses on the stand, Roux told the judge. “We were unable to call a number of witnesses who simply refused to testify because they say they’re protected against television but they don’t want their voices all over the world,” he said. Witnesses could choose not to be on camera when they gave evidence.
Prosecutor Gerrie Nel has tried to portray Pistorius as a short-tempered gun-lover who shot Steenkamp in a fit of rage.
Other Charges
Pistorius has also has pleaded not guilty to three separate gun-related charges.
Judge Masipa, who will give the final judgment in the case because South Africa doesn’t have a jury system, could also consider a lesser charge of culpable homicide if she rules that the act wasn’t intentional

Analysis: Pistorius did his case no favours

This week the trial that captivated the world reached another milestone on its inevitable path towards the judgment of and possible sentencing of murder-accused paralympic sensation Oscar Pistorius.
The state rested its case on March 25 having called only 20 of a possible 107 witnesses. About three-and-a-half months and 16 defence witnesses later, defence advocate Barry Roux finally closed his case on Tuesday.
The trial, which was set down for only three weeks in the North Gauteng High Court, will likely stretch to more than five months. It must be said though that the six-week postponement of the trial due to Pistorius’s 30-day mental evaluation came as a surprise to everybody, including his own defence team.
Read into that what you will but something must be said for the defence’s own forensic psychiatrist, Dr Merryll Vorster, introducing testimony which Roux surely must have known would result in Pistorius’s referral for observation. Those conspiracy theorists among us would argue that Roux had to look to object to the referral but could have planned it that way.
You don’t have to be a legal expert to know that Nel ferociously and successfully tore into Pistorius’s version when he took the stand. Was the defence looking to change tactic to the psychiatric realm after Pistorius’s dismal performance on the stand?

Micki Pistorius, 52, is the author of 'Profiling Serial Killers and other crimes in South Africa' and spent six years in the country's police department as founder of an investigative psychology unit.
During her role, she was involved in more than 30 serial killer cases and helped train nearly 200 detectives in the investigation of serial homicides.
She regularly attended court with the rest of the Pistorius family during his bail hearing last week, but has not made any public comment about his case as yet.

Oscar Pistorius has been forced to release a statement after being spotted downing shots and engaging in “inappropriate” flirting in a South African nightclub last week.
The athlete, who is currently on trial for the murder of girlfriend Reeva Steenkamp, was seen at a trendy Johannesburg nightclub partying with friends on Saturday, with onlookers saying that Pistorius looked “relaxed” and “didn’t seem like someone [who had] lost the love of his life”.
“He’s the last person we expected to see … I can’t believe he showed his face in public, carrying on as if nothing’s happened,” said one source.
“He was greeting a couple and then gave the woman a little pat on her backside. It was just so inappropriate.”
Pistorius’ spokesperson Anneliese Burgess has since spoken out to say that the athlete ”strenuously and vigorously denies any inappropriate behaviour towards any people or women present, or ‘partying it up’ with shooters”.
“Oscar did go out last Saturday with friends. It was the first time since the tragic and horrific events of the 14th of February that Oscar went out with friends. He has been out of the house with family, but this was the first time he went out to a restaurant with people other than close family,” she said.

Johannesburg - Murder-accused Oscar Pistorius reportedly has been involved in an altercation with a fellow club-goer at the VIP nightclub in Sandton.
The Juice said Oscar’s spokesperson, Annelise Burgess, had confirmed the incident.
She told The Juice that the other man had become aggressive towards Pistorius over the trial in which the Paralympian is accused of killing his girlfriend, Reeva Steenkamp. Oscar reportedly asked to be left alone and left the club.
However, the other party, Jared Mortimer, had a different slant on the story.

The Oscar Pistorius murder trial is on a month’s break while legal teams prepare their final arguments. In the meantime, it’s been confirmed to The Juice that Oscar was at VIP nightclub in Sandton on Saturday night and was involved in an altercation with a fellow club-goer.
Oscar’s spokesperson has confirmed that he was at the club and there was an incident. “We can confirm that Oscar was at a night club with one of his cousins. They sat in a quiet area of the private VIP section when they were approached by the individual you have identified as Mr Mortimer,” Anneliese Burgess told us. “The individual in question, according to our client, started to aggressively engage him on matters relating to the trial. An argument ensued during which our client asked to be left alone. Oscar left soon thereafter with his cousin. Our client regrets the decision to go into a public place and thereby inviting unwelcome attention,” she added.
Jared Mortimer however disagrees. He tells The Juice he entered the vip area of the club as he recognised one of his friends. His friend introduced him to Oscar, who seemed to recognise him from the past. “Oscar knew one of my friends and said, ‘Oh, you are the infamous Jared Mortimer.’ He immediately started talking about his friends and how they had backstabbed him. He mentioned Justin Divaris and Darren Fresco. He then mentioned one of my friends and claimed he had a lot of dirt on that person,” says Jared. He claims Oscar was drunk and very aggressive.
And that’s when he claims things got ugly. “He was going on about how influential his family is and how connected they are. He even pulled out his phone to show me pictures of armoured cars. He said ‘My family owns SANDF. Zuma works for us. I’ll piss on Zuma.”

Oscar Pistorius Seen Downing Shots And Flirting In Nightclub During Reeva Steenkamp Trial

Oscar Pistorius has been forced to release a statement after being spotted downing shots and engaging in “inappropriate” flirting in a South African nightclub last week.
The athlete, who is currently on trial for the murder of girlfriend Reeva Steenkamp, was seen at a trendy Johannesburg nightclub partying with friends on Saturday, with onlookers saying that Pistorius looked “relaxed” and “didn’t seem like someone [who had] lost the love of his life”.
“He’s the last person we expected to see … I can’t believe he showed his face in public, carrying on as if nothing’s happened,” said one source.
“He was greeting a couple and then gave the woman a little pat on her backside. It was just so inappropriate.”
Pistorius’ spokesperson Anneliese Burgess has since spoken out to say that the athlete ”strenuously and vigorously denies any inappropriate behaviour towards any people or women present, or ‘partying it up’ with shooters”.
“Oscar did go out last Saturday with friends. It was the first time since the tragic and horrific events of the 14th of February that Oscar went out with friends. He has been out of the house with family, but this was the first time he went out to a restaurant with people other than close family,” she said.

Johannesburg - Murder-accused Oscar Pistorius reportedly has been involved in an altercation with a fellow club-goer at the VIP nightclub in Sandton.
The Juice said Oscar’s spokesperson, Annelise Burgess, had confirmed the incident.
She told The Juice that the other man had become aggressive towards Pistorius over the trial in which the Paralympian is accused of killing his girlfriend, Reeva Steenkamp. Oscar reportedly asked to be left alone and left the club.
However, the other party, Jared Mortimer, had a different slant on the story.

He is the guy who supposedly got into a fight with Pistorius at the VIP Room in Sandton, South Africa.

No, I don't know who she (Micki) is married to, the name of his uncle Arnold's wife is Lois.
His aunt Micki was present during the bail hearing but she hasn't been at the trial, apparently there is a conflict of interest.

Apparently, neither the prosecution nor the defense could consult with her because of her relation to Pistorius. I don't know if the defense has consulted with her behind the scenes.
The following article states the reason why she couldn't be consulted by the prosecution. I believe the same argument is valid for the defense. There was definitely a conflict of interest because she is a member of the defendant's family.

Hi Freckles,
Pistorius bail conditions are very lenient. He is not only allowed to drink alcohol, he can also travel outside of the country.
The alleged "brawl" with Mortimer is to show (in my opinion) how "vulnerable and defenseless" he is, that things are so bad to the point where he can't leave his house without encountering some kind of "danger".
Mortimer allegedly "pushed Pistorius, who fell over into a chair, at which point bouncers at the VIP Room intervened and the athlete left the nightclub."
"Poor Oscar" ... The bouncers had to come to his rescue ...

Evidence pictures. Comments and questions regarding the presented evidence. It is interesting to note the blood splatter patterns have nopt really been discussed. Blood in bathroom, bedroom, stairwell; blood on the cricket bat. I was not aware of the jeans w/ belt found under the open bathroom window. Also, ladder found was NOT near bathroom but near the bedroom balcony. Worried about security? Downstairs window broken with NO glass found from the resulting hole. Also, with location of ladder, any intruder would have had to go thru the bedroom to reach the bathroom... not the other way around!
Oh. Blood on the duvet was found on the visible side and photographed; then, duvet was fully opened and OTHER blood (not leaked from the top) was discovered on the INSIDE of the duvet.

I agree that it would have been possible for Reeva to have got up while he moved the fans but he claims to have placed the fans where the duvet was found lying on the floor. Gerrie Nel pointed out that the lead for the smaller fan is in fact under a speaker so it could not have been moved and the lead for the pedestal fan is not long enough for the fan to be placed where he said it was. The blood spatter on the duvet lines up with the blood spatter on the carpet so the duvet must have been on the floor when he carried her out. A portion of the jeans was on top of the duvet. Defense tried to dispute this although it was obvious in the photo and the judge concluded that it "looks as if the jeans are on top of the duvet". In short, the fans could not possibly have been where he said he placed them. Oscar alleges that as well as opening the curtains, the police moved both fans to different positions and threw the duvet onto the floor so that blood spatter (left on it when it was on the bed) lined up precisely with the blood spatter on the carpet. This is simply impossible and, to my mind anyway, proves that he is lying.
Why would the the first cops on the scene have done this when they they had no idea what his version was?
In addition if the fans were where he said they were, they would have been directly in his path when he ran to the balcony yet he was able to run around them in the pitch dark, in a panic, on his stumps with a gun in his hand without knocking them or anything else over or tripping over the cables.
The judge will not buy any of this nor can she discount the testimony of 4 very credible witnesses who said they clearly heard a woman's blood curdling screams for over 10 minutes. Barry Roux was ruthless with these witnesses under cross examination but none would concede that it could possibly have been a man screaming....."

Just guessing here....
So Reeva goes to the kitchen and gets a bite to eat.
She is in a good mood.
OP is upstairs watching his porn on computer via the tablet.
Reeva returns and prepares for bed which may involve yoga.
OP attempts to involve Reeva in his viewing on the tablet.
Reeva sees it is porn, gets angry, and damages the cover to the tablet. (Reported to have been torn off the item.)
OP tries to force Reeva into sex and rips off her jeans, leaving them inside out.
Reeva refuses his advances.
OP responds in rage; how dare someone damage his property?
He strikes Reeva leaving a bruise in her chest.
He hits her again with the bat flinging droplets across the headboard and the duvet.
OP then yells to Reeva to get the f out of his house.
He is angry a female could refuse him, make him lose his temper.
Reeva goes to the toilet and empties her bladder while starting to place a phone call....
OP, aware neighbors may have heard the commotion, goes to shut the balcony door. He wants the privacy.
His anger building and now in fear of what Reeva may state about him, he gets the gun.... and that is that!
What gets me is this:
The housekeeper. Lives off the kitchen. He would have heard all the commotion that night. He would have heard the gun go off. He would have heard the screams. He would have heard the sound of OP carrying Reeva down the stairs. He would have heard OP shutting off the alarm.
The housekeeper had NOTHING to say of that night!!!
No statements given to the police and introduced into court.

Something that I have not seen raised anywhere is the lack of bloody hand or finger prints on the scene.
Oscar claims he deactivated his alarm (on a remote) to get out of his bedroom, then he had to unlock the bedroom door and open it, and then run downstairs to open the front door. This has bothered me. I would have expected blood hand/palm prints along the stairwell. A normal person would have been struggling with the dead weight and left the prints. What about a man who has false legs?
We have seen the blood in the bathroom and trailed along; we have seen the blood on OP's body.
There were NO hand-prints on ANY of the evidence... not even the bloody cricket bat, the rail on the stairs, etc..
I wonder if his cell phone even had bloody prints on it?

Oscar Pistorius trial: State gears up for showdown

The State has filed its final arguments in the case of murder-accused Oscar Pistorius, says the NPA.
“We have filed the closing arguments in the high court today and are ready to argue,” said NPA spokesperson Nathi Mcube today.
Final argument in Pistorius’ murder trial will be heard on August 7.
On July 8, Judge Thokozile Masipa ruled that no heads of argument could be published in print or electronic media until the commencement of the arguments in court.
Prosecutor Gerrie Nel made the application to prevent publication.
