Baby Grace's mother charged with homicide by child abuse

HORRY COUNTY, SC (WMBF)  - Horry County Police are upgrading the charges for Sarah Toney, the mother of 5-month-old 'Baby Grace,' to homicide by child abuse, officials confirmed Monday. The body of ‘Baby Grace’ was found by rescue divers Thursday afternoon in a creek in Socastee, three days after her 33-year-old mother allegedly lost her in rushing creek water. A deputy coroner announced Friday that the manner of death was homicide.



"There's a major difference between a child maybe just crawling around in a yard and slips in a ditch versus a mother apparently walking into the water and the child is released in the water," Horry County Coroner Robert Edge said of the determination

Horry County Police Chief Saundra Rhodes confirmed Baby Grace was found at about 3:45 p.m. Thursday, about 50 yards from the mother's residence in a creek. Divers with the Department of Natural Resources and Horry County Public Works located the body after agencies spent three days searching the area.

The body was found where tracking K-9s had picked up a scent during the search process, Horry County Police Lt. Raul Denis said. Divers were able to locate the body once a large tree was removed from the creek Thursday, Chief Rhodes said.

Toney was charged with unlawful conduct toward a child and was denied bond on this charge on Thursday morning. At the bond hearing, Toney told the court that she went into the creek with Baby Grace, but was unable to hold her and lost her when the water sucked her in.

Toney originally told officers who first responded to the scene that she took Baby Grace to the creek "because she was crying," according to a police report released on Monday. Moments later, she told officers it was because "she was trying to find God." Officers noted in the report that Toney was in emotional distress and exhibited behavior associated with methamphetamine use: "twitching, scratching of skin."

On Monday, police stated the unlawful conduct toward a child charge was dropped and upgraded to homicide by child abuse, which carries a sentence of 20 years to life in prison, according to Lt. Denis. The arrest warrant states that Toney did cause the death of the child, and the death "occurs under circumstances manifesting an extreme indifference to human life."

A Brazilian man who fell from the balcony of a cruise ship did not jump intentionally, the family’s attorney said, but fell in an altercation with crewmembers who hurled anti-gay remarks at him.

Royal Caribbean’s initial statement said that Bernardo Elbaz had jumped from the balcony outside his stateroom on the Oasis of the Sea ship, but Mike Winkleman, the Elbaz family lawyer, told reporters that this was untrue.

“Royal Caribbean is saying this was a domestic dispute and a suicide,” Winkleman said. “It was anything but that.”

Elbaz was traveling on the cruise with his husband of one year, Eric. Crewmembers of the ship directed anti-gay comments at them, according to Winkleman.

Court documents reviewed exclusively by KCTV5 on Tuesday show that police obtained search warrants for the Lee's Summit homes of both boys and their school lockers.

The 43-year-old woman had gone to the car wash early Nov. 1. Surveillance video shows her vacuuming her vehicle at 1:14 a.m. At 1:51 a.m., the two suspects are seen in the area.

At 1:57 a.m., the two boys allegedly got into Chamberlain's vehicle as she was in the front seat.

At 1:59 a.m., the surveillance video went down to reboot because of Daylight Savings Time. When the video resumed, the car was gone.

Less than 20 minutes later, police attempted to pull over the driver of Chamberlain's vehicle because the officer believed the driver was intoxicated...."

FAIRWAY, KS (CBS NEWS) - CBS News will air a live, "48 Hours" primetime special, "Paris Under Attack, tonight at 7 p.m CT on CBS.

"CBS This Morning" co-host Norah O'Donnell will anchor from the CBS Broadcast Center in New York. "CBS Evening News" anchor Scott Pelley will report on the attacks from Paris, along with a team of CBS News correspondents in Paris, Washington, D.C., New York and around the world.

The special will include in-depth reports on the attacks; the politics of terrorism; security vulnerabilities; the latest U.S. intelligence; interviews with witnesses; and a profile of the U.S. band Eagles of Death Metal, which was playing at the Bataclan concert hall when the attacks occurred.

For a few confusing moments, the first pops of gunfire, muffled by loud music and a raucous crowd of young people, were mistaken for firecrackers.

The American rock band Eagles of Death Metal, which had already been onstage for an hour, must have included a pyrotechnic flourish to the end of their show, some concert-goers thought.

Then the music stopped, the shrieking began and terrified crowd hit the floor.

Standing in the the back of the venue were at least two young men holding automatic weapons, possibly AK-47s, witnesses reported. Dressed in black and strapped with tan suicide vests, their faces fully exposed, they emptied their guns into the crowd with an eerie deliberateness, mowing people down, calmly reloading, and then continuing to kill.

"They were not moving," Julien Pearce, a journalist who happened to be in the crowd, told CNN, referring to the gunmen. "They were just standing at the back of the concert room and shooting at us. Like if we were birds."

Over the next 15 minutes, the Bataclan, --  a prized Parisian institution that has hosted luminaries like Edith Piaf, Nick Cave and Lou Reed over the years -- was turned into a slaughterhouse, witnesses said.

Authorities said at least 100 people were killed inside the theater.

The good emerging here is the unity of respecting the sovereignty of the other nations in Europe; a realization that borders and laws must be clearly defined and upheld; and, the offer of support for France from many other nations including Russia and China...

This pulling together of support for France IS what is needed for ALL the world.

Silver alert ends with missing woman's body found in Conn. state park

NIANTIC, Conn. --Police said they found the body of missing 48-year-old Christine McGugan at Connecticut's Rocky Neck State Park Wednesday, reports CBS affiliate WFSB.

The development comes a day after McGugan's SUV was found abandoned about a mile away from the park's perimeter, according to the station.

State police issued a Silver Alert for McGugan -- a mother of three from New London, Connecticut -- on Nov. 13, after she was last seen leaving Lawrence & Memorial Hospital in New London around noon the day before.

They discovered McGugan's body with the help of a K9 team at around 7:45 a.m., police said. The Office of the Chief Medical Examiner will be determining the cause of death, according to the station.

GULFPORT -- A man accused with his girlfriend in the murder of Tena Marie Broadus thought Broadus was going to "snitch" about him to police, a prosecutor said.

Broadus' skeletal remains were found Oct. 7 in the Biloxi River while Gulfport police investigated a missing-person report that led them to three apparent crime scenes. Broadus' mother had reported her missing Sept. 25, about a week after police believe she was killed.

Joshua Anthony Peterman, 28, and Kari Michelle Parker, 34, are accused of cutting Broadus with a knife or a machete Sept. 18 at Peterman's home on O'Neal Road.

Justice Court Judge Melvin Ray was scheduled to preside over preliminary hearings in the case Wednesday in the Harrison County jail courtroom. Peterman and Parker waived their hearings. Their cases will go to a grand jury, Harrison County prosecuting attorney Herman Cox said.

Peterman is held on a $1 million bond and a warrant from the Mississippi Department of Corrections. Parker's bond is $250,000.

3 questioned in murder of Indiana pastor's wife Amanda Blackburn

INDIANAPOLIS, Ind. - Police questioned at least three men Thursday in connection with the fatal shooting of an Indianapolis pastor's wife, reports CBS affiliate WTTV.

The three men were taken into custody Thursday morning after police served several search warrants at different locations across the city. Two of the men were arrested on unrelated parole violations, a police spokesperson confirmed.

The Indianapolis Star reports that in a previous high-profile case, the November 2014 slaying of 15-year-old Dominique Allen, the suspect was initially held in jail on a parole violation for 10 days before being charged in Allen's murder.

Officers conducted DNA swabs on the three men to compare to evidence found at the crime scene.

Police say Blackburn was shot in the head during a home robbery, which detectives later linked to another nearby home break-in. Sources confirmed to the station that Blackburn was sexually assaulted in the attack.

Such a sad loss of a very beautiful friend.. Who was a mother,sister,daughter,best friends to way to many to count.. I will always remember how she helped me when my sister was so sick and in the last few months of her life.. Tena would come by and make her smile She also loved Tena so much..When My sister passed away on March 23rd 2015. Tena was one of the first at my house. Asking what she could do.. She would call me to see how I was doing.. She may have been tiny in height. But she had such a huge & caring heart..Love and Miss you Tena..frown emoticon Always,, Ray....

I understand how they must feel. It breaks my heart for both of them. I'm truly sick over what happened to Tena and what her family are going through. It haunts me daily and will till the truth comes out. I know they fought I saw it firsthand but I just can't fathom he would be involved. I've heard a different story as how he was involved and not from him. I pray I'm right. I hurt for them both.

Her arrest affidavit reveals what she told police:

In an interview on Nov. 23, 2015 in Springdale, Marcotte told Searcy Police that Malik's father (Jeff Clifton) beat the child on Thursday, Nov. 20, 2014 and Malik died shortly after. She said Clifton kept his body hidden until early Sunday morning and then took the body and disposed of it, but did not tell her where or how.

Marcotte and Clifton then staged the events on Sunday, Nov. 23, 2014 to report that Malik was missing.

Marcotte said she and Clifton tried to come up with a way to frame Malik's biological mother in the case

Clifton came up with the plan to tell police that Malik just walked out the door
Marcotte said Clifton told her he would take her down with him if she told anyone what really happened

Marcotte told police Clifton left their home around 3 a.m. on Sunday, Nov. 23, 2014 and came back around sunrise.

Marcotte said Clifton told her to text him about Malik to create the impression that the child was still alive that weekend


In the arrest affidavit for Jeff Clifton released Thursday, the following details about the day Malik died were revealed.

Malik and other children in the household were eating dinner on the coffee table in the living room on Nov. 20, 2014. Malik was not eating and Clifton got mad at him.
Clifton took Malik to the bedroom to discipline him and when they came back out, Malik started eating.

Malik then drank all of another child's drink so Clifton got mad at him again and took him back in the room again.

When Clifton brought Malik back out, Malik "did not act or look okay." Clifton refused when he was urged to take Malik to the hospital. Clifton was reportedly scared to take Malik in because of extensive bruising on Malik's body.

Marcotte told police Clifton beat Malik and his twin sister on several occasions, pointing out a bruise on Malik's lip in one of the pictures on the missing poster she said was inflicted by Clifton.

Clifton then put Malik in the bathtub to see how the water would affect him. Later, the other kids were asleep and Malik was in bed between Clifton and Marcotte. She said his legs were cold and his belly was swelling. Malik started making a choking sound and she tried giving him CPR.

Clifton wrapped Malik in a robe and took him outside. When Clifton came back in he said "it was too late."

Marcotte became hysterical and Clifton sent her to a neighbor's apartment to spend the night and she went next door with the other two children.

Clifton went to work the next day with Malik's body in the back seat of his pickup truck. Clifton asked his brother for his vehicle on Saturday. A week after Malik was reported missing, police say a cadaver dog alerted on the interior of that vehicle.

Clifton put Malik's body in the borrowed vehicle before he left to dispose of it. He left his cell phone at home because "he knew it had GPS on it."

Marcotte made a phone call to Clifton on November 24, 2015 which she recorded. When she asked him about someone finding Malik's body, he told her "We already talked about this. This is not the time to talk about this."

The two then met face-to-face at Clifton's home on Nov. 25, 2015 during which the following conversation was recorded:
Clifton said "they can't come at you with nothin'. The only person that [would] know is me. All you got to remember is to keep saying you don't know. I don't care what they say whatever they is saying, they don't have anything. I don't care what they say, they don't have s*%$. You know this. So I don't care what they tell you they say it is. 'No I didn't. No I didn't. That's why I don't want to say nothin' about it. Got me spooked."

Police released the documents after they arrested Lesley Sue Marcotte, the girlfriend of Malik Drummond's father, Jeffrey Clifton, on a charge of hindering an arrest or prosecution.

Marcotte, 27, said Clifton, 43, beat the 2-year-old Nov. 20, 2014, and kept the body hidden for three days before disposing of it and concocting a story about how the child walked away from the couple's house in Searcy, according to the affidavits.

Clifton was arrested late Tuesday night and charged with capital murder and abusing a corpse. Police on Wednesday said they discovered remains believed to be Malik's in a vacant lot in Jackson County...."

Authorities in Utah said Sunday that a man who has been missing for more than a week is the brother of former MTV reality star Kristin Cavallari and the brother-in-law of NFL quarterback Jay Cutler.

The Grand County Sheriff's Office said it first became involved in the search for Michael Cavallari, 30, on Nov. 27, when it received a report of an abandoned Honda Civic along Interstate 70 in the southeastern part of the state. Authorities said Cavallari was identified as the car's driver after credit card receipts in the vehicle led them to a convenience store in Monticello, Utah, where they saw him in footage on the store's security system.

The Deseret News reported that Cavallari's laptop and cellphone were found inside the car, which appeared to have hit a large rock on the side of the road. The vehicle's engine was running and its airbag was deployed.

COLLEGE STATION, Texas -- The Drug Enforcement Administration has confirmed that a 19-year-old arrested for allegedly selling drugs is the daughter of a DEA agent.

Sarah Furay, the daughter of DEA Special Agent Bill Furay, was arrested in College Station, Texas, on charges related to drug trafficking, according to Barbara Carreno, a DEA public affairs spokeswoman.  According to Carreno, the College Station Police Department is handling all investigative matters related to the charges.

"The Furay family is dealing with this private matter as best they can," Carreno said in a statement.

College Station Police arrested Sarah Furay on November 6th, after obtaining a warrant to search her apartment at the Cottages in College Station. According to a police report, officers found more than 31 grams of packaged cocaine, 126 grams of high grade marijuana, 29 "ecstasy" tablets, methamphetamine and 60 doses of a drug similar to LSD.

New Twist in Arrest of TX Teen Dubbed 'The Adorable Drug Kingpin'

We're learning more about the 19-year-old who was dubbed the "adorable drug kingpin" because of the happy-looking mugshot that followed her drug arrest in Texas.

It turns out that Sarah Furay is the daughter of a longtime DEA agent who once headed up the federal agency's office in Galveston, Texas.

Furay's father, Bill, is now reportedly working for the DEA in Panama.

Sarah Furay was busted last month for selling large amounts of pot, ecstasy, cocaine and methamphetamine out of her College Station apartment.

Furay was arrested after cops found 31.5 grams of packaged cocaine, 126 grams of high grade marijuana, 29 ecstasy tablets, methamphetamine and a 60 doses of an LSD-like drug.

Officers also found digital scales and a written list of drug prices. Furay was released from jail after posting a $39,000 bond.

Police make arrest in case of newborn found buried alive in Los Angeles

LOS ANGELES -- Authorities have arrested the mother of a baby who was buried alive near a Southern California bike path.

Los Angeles County Sheriff's Sgt. Bob Boese said Sunday the woman was arrested late last week. He declined to release the woman's identity, citing the ongoing nature of the investigation.

CBS Los Angeles reports that a news conference is planned for 10 a.m. Monday to provide further details.

Boese said tips from the public and media coverage of the baby's rescue led to the arrest.

Around 4 p.m. on Nov. 27, deputies were sent to an area between 136th Street and Slater Avenue in Compton, Los Angeles, for reports of a baby crying in the riverbed, according to Los Angeles County Sheriff's Department Sgt. Marvin Jaramilla.

SPRINGDALE — A woman accused of helping cover up the killing of 2-year-old Searcy boy Malik Drummond has been released from jail because she is eight months pregnant.

The Searcy Police Department said Lesley Marcotte was released after she was arrested Thursday on a charge of hindering apprehension and prosecution. No attorney information is listed for Marcotte.

Documents released Thursday say Marcotte told police Malik's father, Jeffery Clifton, had beaten Malik on Nov. 20, 2014, which led to fatal injuries. Malik was reported missing three days later.

Authorities have officially ruled the death of a 2-year-old boy, believed to be Kyrian Knox of Rockford, found dismembered in the Garfield Park Lagoon in September a homicide.

The Cook County medical examiner’s office is still awaiting DNA tests to formally identify the toddler, whom detectives have named as Kyrian Knox, but an office spokeswoman announced Friday that his death was ruled a “homicide by unspecified means.”

In late November, investigators said they’d hit a wall in the investigation as the last known people to have seen the boy alive were not cooperating with police.

The body parts were found in the lagoon Sept. 5, about two weeks before Kyrian was reported missing from a residence in Rockford where he’d been staying with Kamel Harris, a male friend of his mother; and Harris’ girlfriend, Danyelle Foggs. Kyrian’s mother, Lanisha Knox, told investigators she left her son there went to Cedar Rapids, Iowa, to start a new job.

Chicago Toddler's Death Still Remains Undetermined

The death of a toddler, whose dismembered remains were found in a Chicago lagoon is now being ruled a homicide, but the cause of death is still undetermined.

Chicago Police matched the remains with 2-year-old Kyrian Knox, who was reported missing in September. The boy's body parts were found in Garfield Park Lagoon.

Police say witnesses ware refusing to cooperate in the investigation. No charges are being filed.

Jared Fogle's former associate claims he's been 'falling asleep in a puddle of tears every night' as he is sentenced to 27 years for child porn

"...The former director of a foundation started by ex-Subway pitchman Jared Fogle was sentenced to 27 years in prison Thursday for producing child pornography that played a role in Fogle's criminal case.

A federal judge sentenced Russell Taylor, 44, who agreed in September to plead guilty to child exploitation and child porn charges and admitted using hidden cameras to produce pornography of 12 children.

The Indianapolis Star reported that Taylor told the courtroom Thursday he has been 'falling asleep in a puddle of tears every night' since his initial arrest.

Before sentencing, Taylor begged US District Court Judge Tanya Walton Pratt for leniency, and choked back tears while asking for a sentence that would allow him to someday reunite with his family and rebuild his relationships with them.

In court papers Taylor said that 'Jared asked me to get roofies to drug kids so he could see them in person'.

He added: 'He wanted me to drug kids to knock them out [so he could] touch them.' ..."

INDIANAPOLIS, Ind. - Police questioned at least three men Thursday in connection with the fatal shooting of an Indianapolis pastor's wife, reports CBS affiliate WTTV.

The three men were taken into custody Thursday morning after police served several search warrants at different locations across the city. Two of the men were arrested on unrelated parole violations, a police spokesperson confirmed.

The Indianapolis Star reports that in a previous high-profile case, the November 2014 slaying of 15-year-old Dominique Allen, the suspect was initially held in jail on a parole violation for 10 days before being charged in Allen's murder.

Police say Blackburn was shot in the head during a home robbery, which detectives later linked to another nearby home break-in. Sources confirmed to the station that Blackburn was sexually assaulted in the attack.

Arrest warrant issued after "affluenza" teen goes missing

DALLAS -- A juvenile-court equivalent of an arrest warrant has been issued for a teenager who killed four people in a 2013 drunken-driving wreck near Fort Worth, then claimed as part of his defense that he suffered from "affluenza."

Ethan Couch's attorneys told CBS DFW that a judge has issued "a directive to apprehend" Couch after a juvenile probation officer was unable to contact 19-year-old Couch or his mother, with whom he was living. Multiple agencies are now searching for the teen, the station reports.

Could California Clerk's Alleged Lies Clear Ex-Con's Name?

A former California county clerk is in hot water for allegedly fabricating death threats against herself — and that could be good news for a man who was convicted of assaulting her nearly two decades ago.

Roger Steiner spent 19 years in federal prison after a jury found him guilty of viciously attacking Karen Mathews Davis as part of a bizarre tax-protest conspiracy.

Steiner, who had always maintained Davis lied about the attack, had just gotten out of prison when he was suddenly under scrutiny again.

Davis, who was then running for Congress, claimed she received two death threats in the mail — and once again tried to cast blame on Steiner, court documents show.

But federal investigators say Davis made up the threats. And now Steiner is hoping that convinces prosecutors to reopen his long-ago case and clear his name.

"If she lied now, that substantiates my story that she lied back then," Steiner, 77, told NBC News.

"I see her as evil, with a criminal mind."

Pair linked to deaths of 2 children in Calif. storage unit

SAN FRANCISCO -- A 39-year-old woman and a teenage boy are suspected in the deaths of two children whose bodies were found inside a storage unit in Northern California, authorities said.

Autopsies for the 3-year-old girl and 6-year-old boy, who bodies were found at a storage facility in Redding, were planned for Wednesday. Authorities have not identified them nor said how they were related to the woman and her teenage companion. They were found while police were checking on a 9-year-old girl who was found starving and injured but alive.

The Redding Police Department said it has identified two children who were in the pair's custody and who are missing. But it added it has yet to determine if they are the same children found dead in Redding, a city of 91,000 located 300 miles north of San Francisco.

The pair traveled to several cities in Northern California between November 27 and December 11 and stayed at a motel in Dunningan, Calif., on November 28, Redding Police said.
