AZ Lawyer on WS (paraphrased) states that Juan can use JA's prior testimony from first trial to REBUT her 2 days of super secret testimony.... he's GOT THIS (!) and is likely the reason he did not move to strike.

What really disturbs me all though this trial phase is that it is for mitigation only and so far all I have heard for months now from this defense, ad nauseum is how Travis is the biggest abuser, perv, and monster out there.
HELLO, this woman has already been convicted of first degree pre meditated murder with extreme cruelty, and I have not seen a tear from the defense or one word of regret, sorrow, horror at what JA has done, apology, begging for forgiveness, remorse, etc.!
Now, we may all realize that any such actions from Jodi would be fake anyway, as I think everyone knows she is a soulless psycho, but to see this penalty phase turned into yet another slander-fest of Travis, with the implication being 'he kinda deserved what he got', is horrifying to me. How is this allowed now?
All of this was dealt with in the original trial, and I see NO MITIGATING FACTORS FOR JODI IN THE DEFENSE'S CALLOUSLY AND UNETHICALLY CONTINUING TO INSIST THAT TRAVIS ALEXANDER WAS AN ABUSIVE PERVERT WHO DESERVED TO BE STALKED, STABBED 27 TIMES, THROAT SLIT, AND SHOT.
I am disgusted that JSS has allowed so much of this unsubstantiated BS to continue with more regard for Jodi than for the long suffering Alexander family who have to sit there day after day and hear their beloved brother vilified unmercifully and dishonestly to the entire world.

Now, mitigation consists of actually accepting into court "affidavits" ONLY, from shady "witnesses" too cowardly to show their faces and names as well as subject themselves to the scrutiny of a cross by Juan Martinez. THEY KNOW THEY ARE LIARS. THE DEFENSE KNOWS THEY ARE LIARS. I THINK EVEN JSS KNOWS THEY ARE LIARS. Why in the hell doesn't this judge insist that witnesses come forward, be sworn, and adhere to rules of jurisprudence and the courts just like everyone else?
The jury should not give one ounce of weight to a word put forth by these shady losers!

Sorry for the rant, but I have seen no 'mitigating factors' put forth so far in this very protracted 'mitigation trial'!

Defense to finally rest in Jodi Arias sentencing retrial

After a marathon day of testimony that started at 9:15 Monday morning and ended at 7 o'clock at night, the defense in the Jodi Arias sentencing retrial will rest its case for mitigation late this morning.

Then, prosecutor Juan Martinez will begin his rebuttal case to try to persuade a Maricopa County Superior Court jury to bring back a death penalty for Arias for the 2008 slaying of her lover, Travis Alexander.

Earlier this morning, Martinez and defense attorneys Kirk Nurmi and Jennifer Willmott discussed whether Arias would retake the witness stand. In October, she testified for two days in a courtroom closed to the press and public.

Mitigation witnesses are put on the stand to try to convince jurors they should agree on a verdict of life in prison.

But under Arizona law, defendants in criminal cases do not have to testify. Arias told Judge Sherry Stephens that she did not want to continue, and Stephens did not compel her to do so.

Stephens also said that her two days of testimony would not be stricken from the record, so jurors will be able to consider it even though Martinez did not get a chance to cross-examine her.

I agree. It has been a dog and pony show from the start with the DT.
Admittedly, they had to deal with JA's lies and shady crap. A lot of it.
They presented dirt and scandal and delay in hope of swaying the court.
It did not work.

Juan, on the other hand, is a brilliant statistician.
He plays with honesty and integrity with the cards he is dealt.
He looks into issues, he questions and presents trusting the jury and the court to do that which he has led them to. Find the verdict.

I have raged. Many of us have. Don't feel apologetic!

(I dunno about that. She CAN appeal BUT the COA may not hear her case as she failed to take proper actions in the lower courts. No foundation for appeal. Opportunity was given and she chose to not take it in the lower court. Appeals are done to right a wrong. Usually, an action done by one side or there that denied the def a proper court trial. They look to the record for that information.)
