FALL RIVER, Mass. -- Defense lawyers for former New England Patriots tight end Aaron Hernandez have asked the court to prohibit prosecutors from showing the jury a .45 caliber Glock pistol - the same type of weapon investigators say was used to kill Odin Lloyd in 2013..

The attorneys made their request in a motion filed Friday afternoon, ahead of expected testimony next week from a prosecution witness who works as a sales manager for Glock.

The murder weapon was never recovered, but ballistics experts analyzed spent shell casings and bullets found at the crime scene to determine the model of gun from which the fatal shots were fired.

Defense lawyers wrote in Friday's filing that Bristol County prosecutors have turned over to them documents that suggest they intend to call Kyle Aspinwall, the Glock sales manager, to the witness stand, "to offer an opinion about what he believes to be depicted in the surveillance video."

"The Commonwealth will presumably urge the jury to infer that the object Hernandez is holding in the video is, in fact, the murder weapon," defense lawyers Jamie Sultan, Charles Rankin, and Michael Fee wrote in the motion. Referencing emails between Aspinwall and authorities, the lawyers said that Aspinwall "has never opined that the object in the surveillance video is or even appears to be a Glock Generation 3 Model .45 caliber semi-automatic pistol, nor, in good faith, could he possibly do so."

In the emails, which were included in the filing, Aspinwall said that the object "appears to be a Glock pistol" based on the "curve of the back strap" – but he said he could not distinguish which model it was.

Calls From Aaron Hernandez To Co-Defendant After Slaying Highlighted

FALL RIVER, Mass. -- Less than 24 hours after the Odin Lloyd homicide, former New England Patriots tight end Aaron Hernandez placed several calls to one of his Bristol, Conn. co-defendants from the parking lot of the North Attleborough police station, according to phone records displayed in court Friday.

Using a phone that belonged to one of his lawyers, Hernandez called Wallace three times and texted him at least once after leaving the police station around 11:45 p.m. on June 17, 2013. Lloyd was shot around 3 a.m. that morning.

At the time of the calls, Wallace had already left Massachusetts and was back in Bristol, staying with Hernandez's cousin, Tanya Singleton. In the next week, Wallace would begin making his way south to Florida, where he eventually turned himself in to law enforcement after police issued a wanted poster for his arrest.

We don’t know the last words Odin Lloyd uttered to whoever shot him five times and left him to die amid the shrubs and gravel of an industrial sandpit.

But we do know the last words he texted to his sister, Shaquilla Thibou, in the wee hours of June 17, 2013, shortly before he climbed into a silver Nissan driven by his superstar friend, Aaron Hernandez.

“U saw who I was with?” Lloyd, a landscaper and park league football player, messaged his sister.

When she replied, “Who?”

Lloyd’s answer was, “NFL…just so u know.”

Shaquilla Thibou waited in the wings yesterday afternoon inside the brand new Fall River Superior Courthouse. Her lawyer sat quietly in the back row of Courtroom 7, as other lawyers dissected text messages Hernandez tapped out into the darkness of June 17, 2013, hours before Lloyd was killed..

I was holding my breath and hoping he would not redirect to the clip being part of drug paraphernalia.
I am sure he would rather go down for referring to drug use than murder.

First: A clip is and has always been a ""belt" of ammo/bullets used for rapid firing without reloading or the use of a revolver. It could be a small ammo pack often fed into the gun thru the butt of the gun. Many clips hold 8, 10, 12, or even 20 shells for firing. (The belt style clip was a term coined from war use.)

Second: I have never heard of mixing tobacco with marijuana! Wow. That would be like mixing bourbon with lemonade or something. In the drug world, a "clip" is often called a "roach clip". When the joint is burnt down, it leaves a small butt called a roach. The butt is packed with the THC from all the inhalations. It is more potent than the first few draws/hits from smoking of the joint. Due to the small size, hairpins would be used to clip onto the small joint for easier handling and for passing between persons... When the roach becomes too small to safely pass between persons even with the clip, the "owner" of the marijuana would pinch off the smoldering tip of the roach and eat it. This not only destroyed evidence but the compacted THC may have given an extra buzz...

Instead, they are proceeding on a slightly different theory; something called “Joint Enterprise Murder.” While the distinction may not seem like much, it is important for anyone interested in the Hernandez trial to know, and critical for all 12 jurors to understand, Joint Enterprise Murder is perceptibly different. Unlike the joint venture example in which the law professor talked about “helping another commit the murder,” Joint Enterprise Murder says being present when a murder is committed, while standing by with the same shared intent as the murderer (to bring about the victim’s death), ready, willing and able to help out if needed, is sufficient to sustain a murder conviction. In other words, while merely being present when a murder is committed is never enough to sustain a charge of first or second degree murder, being present with shared intent to kill the victim and standing by ready, able and willing to help bring about his death is sufficient, even if one doesn’t physically commit the crime in question. (One may be found guilty [as an Aider] if “by agreement, he is in a position to render aid to the principal offender even if he does not participate in the actual perpetration of the crime.” Commonwealth v. Soares, 377 Mass. 461, 471-72 (1979) [Italics added].)

Thanks AD. This is really good information and explains how the prosecution plans to deal with three men who will all deny responsibility and hope to point the finger at each other. AH's defense has already started making in-roads toward an attempt at placing blame on Carlos Ortiz just as the author of this article suggests they likely would.

There have been several days during the trial that no one has been at the courtroom to support him. His mother, his brother, and his uncle have been there on some occasions, Shayanna was a permanent fixture in the courtroom but she hasn't been there a lot lately.
