...Though evidence pointed toward Hernandez being involved in the crime in some capacity, the defense argued that the jury used speculation and guessword to fill in the gaps of what they were given in order to reach a verdict.

'Hernandez's murder conviction was unsupported by the evidence and must be vacated,' the memorandum reads.

In post-trial interviews, several jurors said that one of the reasons a guilty verdict was reached was because of Hernandez's 'indifference'.

'We watched the video footage at his home later in the morning or early afternoon after the incident occurred and he was just lounging around by the pool and playing with the baby. He was going about his regular life,' juror Jon Carlson told CNN's Anderson Cooper.

He continued: 'For us to have knowledge that he was there at the time that his close friend was murdered, personally there's no way I could just carry on hours later like nothing happened. That's indifference.'

Hernandez's lawyers, however, argue that this 'cannot be deemed to have demonstrated indifference to or taking pleasure in Lloyd's conscious suffering.'..

FALL RIVER, Mass. (AP) — A perjury charge was dropped Friday against the fiancee of former New England Patriots star and convicted murderer Aaron Hernandez.

Shayanna Jenkins had pleaded not guilty. Prosecutors had said she lied dozens of times to the grand jury that investigated the death of Odin Lloyd, who was dating her younger sister. Hernandez was convicted of first-degree murder in Lloyd's killing last month.

Prosecutors asked a judge to dismiss the charge in a filing Thursday, citing Jenkins' testimony in Hernandez's trial in March.

On Friday, in a hearing that lasted just minutes, Superior Court Judge Susan Garsh agreed and dismissed the charge.

FALL RIVER — “No rational jury” could have convicted Aaron Hernandez of first-degree murder, the former Patriots star tight end’s lawyers say in newly filed court documents seeking an appeal of Hernandez’s conviction.

Hernandez’s attorneys argue that jurors relied on “improper speculation, conjecture and guesswork” to convict Hernandez, 25, for the June 17, 2013, murder of Odin Lloyd in North Attleborough. The defense team said prosecutors never presented any evidence that proved Hernandez acted with malice or intentionally participated in Lloyd’s murder.

The arguments are included in a memorandum Hernandez’s lawyers filed Tuesday in support of a motion asking that Superior Court Judge E. Susan Garsh enter not guilty verdicts on the charges of murder and illegal carrying a firearm. The motion is a routine part of the post-verdict appeals process. Garsh rejected a similar defense motion after prosecutors rested their case last month in Hernandez’s 10-week murder trial at Bristol County Superior Court in Fall River.

Dumb question:  How does someone in prison get a new tattoo?  Is the tattoo parlor near the commissary?  

There are ways to get the tattoos. Sometimes they use the lead in the pencils. They look nothing like the 'outside' tattoos with all the colors and fine detail. There are the 'artists' that will accommodate one. AH seems to be in his element now. All pretense of poor man who got swept up in a terrible event are gone. Shayanna needs to go to counseling so she learns how to make wiser decisions for her and her baby. JMO

I agree with you, Tess.  It is time for Shayanna to let the dream go.  She would probably benefit from some good counseling.  IMO, she needs to sell that great big diamond on her finger and get her and baby Avielle a place of their own to live because AH will more than likely lose that mansion and I doubt that Shayanna will be able to afford the upkeep, utilities, etc. in future years.  I hope that she will reach out to her family, especially Shaneah, and try to make amends as it will be easier for her and Avielle in the future if she has the love and support of family members.  I think Shayanna has a tough road forward right now and the sooner she starts making better decisions the better off she and Avielle will be, IMO.

A broken tine from a piece of plastic dinnerware can be sharpened by friction to form a cutting or puncturing tool for the skin piercing....

Thanks to tesstruhart and Freckles for the info on how tattoos can be gotten in prison.  I obviously know nothing about them.

So, if they are so easily obtainable in prison, and require sharp objects,...I'm just dumbfounded as to how this is allowed to happen.  Those take a while to create, don't they?  Where does such a thing take place?  In someone's cell?  Is he sharing a cell with someone? In the rec yard? Where are the guards during this?  I'm just stunned!

Well, he's just the gift that keeps on giving, isn't he?  He doesn't know when to stop.  I guess the tattoo he has on his arm, the one that's a quote from his dad ("If it is to be it is up to me") shows that he's choosing his own path.  Too bad it's such a wrong path, and he never learns from his mistakes.  Not only does he keep going down the wrong path, but he keeps taking turns for the worse.

Wow.  Just wow.

I feel so sorry for his daughter, but on the other hand, I'm very grateful he won't be raising her.

Pencils have graphite (lead) which can be powdered, mixed with a liquid (water, oil, butter) to create the "ink" solution for injection.... Pens can be stripped of the ink cartridge and treated the same fashion. Many things with a dye can be color stripped out and then treated with the liquid for injection. It does look professional rather than prison house, however. (IF he is in isolation, did he do this himself?)

Easiest way to sharpen someone? The concrete floor! Abrasion is all that is required...

The lack of proper equipment only further shows the dexterity of the artists, and like in the real-world, creative competition behind bars has risen to another level — these tattoos no longer look like the standard prison ink.

The most important part of the process is getting your hands on a tattoo gun. Kinsley sent us some pictures of what the finished homemade device looks like, but in order to get there, you have to collect some contraband materials.

Kingsley says you first need a motor, which can be taken from a CD or tape player. These things can be purchased at the prison store (commissary). Once a motor is attained, the inmates tie it to an empty pen barrell.

For the needle, the artist will pull the spring out of a stapler, or a combination lock by breaking it, and stretch the metal out with heat or fire. Then, they sharpen it with sandpaper. The sandpaper is attached to the motor, which causes it to spin around and sharpen the metal quickly...

I agree with the sheriff that AH behavior is not at all surprising. AH knows that he needs to establish himself early on to best position himself within the prison population. AH clearly loves tattoos as evidenced by the large tattoo collection that he was already sporting. I would imagine that he will collect many, many more in prison. The only thing about his new tattoo that surprises me is the placement. I am a little bit surprised that AH would get a "lifetime" tattoo so high up on his neck where a jury can clearly see it. It can't be helpful to advertise this "accomplishment" to a jury, IMO.

This is almost as bad as accusing the victim.
It may be worse...It isolates a person and throws negative accusations against them.
It attempts to humiliate the person in the society by turning society against them.

Aaron Hernandez Lawyer Seeks Inquiry on Juror Issue

FALL RIVER, Mass. — A lawyer for former NFL player and convicted killer Aaron Hernandez has asked a judge to allow an inquiry into what he says is a juror's "exposure to significant extraneous matter."

Hernandez was convicted in April of first-degree murder. He was sentenced to life in prison without the possibility of parole.

James Sultan, a lawyer for the former New England Patriots tight end, made the request in a court filing last week that was unsealed Wednesday. A judge scheduled a June 12 hearing on the request.

Second Hernandez murder trial date could come Thursday

In the aftermath of the conviction of former Patriots tight end Aaron Hernandez for the murder of Odin Lloyd, it was expected that a date for the next murder trial of Aaron Hernandez would be picked within a matter of days. It wasn’t. It could be today.

According to the Associated Press, a hearing in the case arising from the July 2012 shooting deaths of Daniel de Abreu and Safiro Furtado happens Thursday. The judge could pick a day for the commencement of the trial then.

Aaron Hernandez Double Murder Trial to Begin in December

BOSTON — Jun 4, 2015, 4:46 PM ET

Jury selection for the double murder trial of former New England Patriots player Aaron Hernandez will be tentatively scheduled for Dec. 1, a judge said Thursday.

Superior Court Judge Jeffrey Locke also set a date of Jan. 4 for the trial to begin in earnest. Hernandez was not present in court Thursday.

But, it is interesting that they may combine the Boston murder trial with the witness intimidation charge over the shooting of Alexander Bradley.

Prosecutors say Bradley was later with Hernandez in Florida, and Hernandez told him he saw two men watching him who he thought were undercover police officers.

Bradley told him it was because of what happened in Boston, prosecutors have said.

Bradley has said Hernandez retaliated against him for that comment by shooting him in the face, resulting in the loss of his right eye.

Prosecutors have asked that the double killing and witness intimidation cases be consolidated. The judge agreed to consolidate them for pretrial purposes but did not decide Thursday whether to include the witness intimidation charge when the double murder charges go to trial.

Hernandez fails to reach settlement in Fla. suit

Lawyers for Aaron Hernandez and Alexander Bradley failed to reach a settlement Thursday in a lawsuit that Bradley filed against the former New England Patriots player, which alleges that Hernandez shot Bradley in the face in Florida in 2013, court records show.

In a brief filing in federal court in Florida, mediator Rodney A. Max wrote that attorneys for both sides met Thursday in that state, and “the mediation adjourned without resolution.”

Max said both sides are now prepared to proceed to trial, but he remains “committed to [achieving] a negotiated resolution at such time as may be mutually appropriate.”

AH is in a bit of a bind.... he agrees to a monetary settlement and that can be brought up at the next (Boston) trial. Of course, this last conviction WILL be brought up as well...

After allegedly shooting and killing two men and wounding another in the summer of 2012 in Boston, former Patriots star and convicted murderer Aaron Hernandez told a friend, “I think I got one in the head and one in the chest,” according to court documents released this afternoon.

The victims, 29-year-old Daniel de Abreu, who died of a gunshot wound to the chest, and 28-year-old Safiro Furtado, who suffered fatal gunshot wound the head, were shot in the early-morning hours of July 16, 2012, as they sat at a red light at the intersection of Shawmut Avenue and Herald Street in Boston, the newly released documents allege.

I can only imagine how stressed out and angry AH might have felt when he learned that Alexander Bradley had survived. AB's threat to sue may have added to the paranoia that AH already had. It is a shame that AB did not immediately finger AH as the person that shot him in the face because if AB had done so then I believe that Odin Lloyd would never have been killed because AH would have already been in jail. I am not excusing AH for any of his actions, but, IMO Bradley shares some of the blame by not exposing AH as the one that shot him and not exposing AH in the Boston homicides. Did AB fear retaliation from AH, AH's friends, fans??? Or, just out to make a buck through lawsuits/blackmail??? I am looking forward to the Boston murder trial. I think we will learn a lot about the workings of AH's inner circle.

I am just guessing here... IMO, AB may have felt completely owned, scared to death, with the actions of his "friend..." Where does AB go for street address of his grievances? He can't. He is probably terrified of what AH may/will do to him if he goes to the PD. After all AH is the darling boy.... and AB has nothing to offer.

IMO, AB decided at that time to appear compliant, obedient and keep AH close to him so as to imply complete subservience to AH.

When AB realized he was going to live his life in fear of AH, and then when the trial kicked up a bit, AB may have felt he had a chance at being heard... and that is when he came forward. The darling boy had fallen out of favor and MAYBE there was now room for the truth???
